According to The NY Daily News A Pennsylvania woman who walked away from her aging mother, leaving the 88-year-old mired in feces and without food or water, has been sentenced to prison. Janice Harmes, 67, pleaded no contest last week in Lancaster County Court to a charge of third-degree murder stemming from the January death of her invalid mother, Janet Bastendorf. “It’s inexcusable and reprehensible,” Judge James Cullen admonished Harmes, who claimed she was only honoring her mother’s wish to die at home. “Mom and I had an understanding,” Harmes said in court. “I made a mistake and listened to her.” The judge dismissed her excuses. “This may be a lot things,” Cullen said, according to the Intelligencer Journal of Lancaster, Pa., “but a mistake is not one of them.” Cullen sentenced her to a minimum of six years behind bars and a maximum of 12. The judge also chided her for not taking her mother to a hospital or ordering hospice care. Harmes was her mother’s primary care giver. The elderly woman died from sepsis, a virulent infection caused by an untended bed sore. For the 10 days leading up to her death, Bastendorf had languished in a feces-filled diaper with no access to food or water. Harmes took her mother’s cell phone when she walked out. Former Elmo puppeteer Kevin Clash is trying to get all three of the lawsuits alleging sexual misconduct by him dismissed, citing statutes of limitations. He stands accused of inappropriate sexual relations with boys under the age of 18; Clash previously denied all of the allegations against him. Clash attorney Michael Berger wrote in a brief Friday: “There are two applicable types of statutes of limitations , a six-year one based on when the right of action has accrued, and a three-year one based on when the alleged victim turned 18 and was therefore no longer under the disability of being a minor.” According to Clash’s camp, both have lapsed. Cecil Singleton , the first to file suit against the former Sesame Street staple, said in court documents that his interaction with Clash occurred in 2003. He was 15 at the time. He stated that he wasn’t “aware he had suffered adverse psychological and emotional effects from Kevin Clash’s sexual acts and conduct until 2012.” The second plaintiff, who filed as John Doe, said in his suit that he was 16 when he had an inappropriate sexual relationship with Clash in 2000. A third plaintiff, identified only as S.M., charged in a complaint that he was “16 or 17” when he had sexual contact with Clash in the mid-1990s. Yet another man, Sheldon Stephens , accused Clash of similar behavior before settling out of court … then saying he wishes he hadn’t settled. Berger states in today’s filing that the three men suing Clash would have needed to file suit, respectively, in 2009, 2006 and 2001 to be within six years. Or, based on their respective ages, in 2009, 2003 and 2000, respectively as the latest possible dates to be within three years of them turning 18. All three suits were filed in November and December of 2012. Jeff Herman, who represents all three plaintiffs, tells E! News he doesn’t think a motion to “avoid liability on technical grounds” will be successful. “It should be noted his motion does not say the abuse did not happen, just that it is too late to file the complaints,” Herman told the network in response. “The law we are proceeding under recognizes the rights of victims to bring their lawsuits within six years from the time they connect their injuries to the abuse.” “We are hopeful the Court will see it our way, however, by being able to bring their claims forth publicly the victims are already further along in the healing process.”

According to The New York Times , In New Jersey on Tuesday, four gay men who tried the therapy filed a civil suit against a prominent counseling group, charging it with deceptive practices under the state’s Consumer Fraud Act. The former clients said they were emotionally scarred by false promises of inner transformation and humiliating techniques that included stripping naked in front of the counselor and beating effigies of their mothers. They paid thousands of dollars in fees over time, they said, only to be told that the lack of change in their feelings was their own fault. Since the 1970s, when mainstream mental health associations stopped branding homosexuality as a disorder, a small network of renegade therapists, conservative religious leaders, and self-identified “life coaches” have continued to argue that it is not inborn, but an aberration rooted in childhood trauma. Homosexuality is caused, these therapists say, by a stifling of normal masculine development, often by distant fathers and overbearing mothers, or by early physical abuse. But leading scientific and medical groups say that the theories of homosexuality are unfounded and that there is no evidence that core inner-urges can be changed. They also warn that the therapy can, in the words of the American Psychiatric Association, cause “depression, anxiety, and self-destructive behavior” and “reinforce self-hatred already experienced by the patient.” One former patient in the suit, Michael Ferguson, 30, who is now a doctoral candidate in neuroscience at the University of Utah, sought help from Jonah in 2008. He tried to battle his homosexuality, he said, when he was a practicing Mormon who believed that only those in a heterosexual marriage could achieve eternal bliss. “It becomes fraudulent, even cruel,” he said in an interview. “To say that if you really want to change you could — that’s an awful thing to tell somebody.” “I was encouraged to develop anger and rage toward my parents,” he added. “The notion that your parents caused this is a horrible lie. They ask you to blame your mother for being loving and wonderful.” Another former patient in the suit, Chaim Levin, 23, grew up in an Orthodox Jewish community in Brooklyn where, he said, being gay seemed unthinkable. Referred to Jonah by a rabbi when he was 18, Mr. Levin began attending weekend retreats at $650 each. For a year and a half, he had weekly private sessions with Mr. Downing as well as weekly group sessions. He quit, he said, after Mr. Downing had him remove his clothes and touch himself, saying it would help him reconnect with his masculinity. It took a determined FBI agent and a mother in Utah seeking justice for her son to finally catch a pedophile who filmed one of the most widely distributed pieces of child pornography on the Internet before fleeing the country. Antonio Cardenas was sentenced last week to 35 years in prison on child sex abuse-related charges. Getting there, however, required good timing and a trap that was certain to lure Cardenas back to the United States: an invitation to a child’s surprise birthday party Cardenas, 32, first came into contact with the boy in 2004 as his mentor through Big Brother Big Sisters of Utah. The child’s family trusted Cardenas, inviting him on their outings and even allowing him to take the boy to Las Vegas. When Cardenas moved back to Mexico, he still kept in touch through emails and phone calls, The Tribune reported. Unbeknown to the family, the child was being preyed upon. Cardenas had raped him repeatedly and filmed the abuse, prosecutors said, with images and video of it spreading quickly online. The boy tried to tell his school that Cardenas had shown him dirty movies in 2008, but later recanted, The Tribune reported. In June 2009, the child films produced by Cardenas reached Ross’ attention and he began investigating. Identifying the child seemed impossible, although a computer forensics team was able to determine the abuse was taking place in Utah and Las Vegas because of clues in the video’s background. It wasn’t until that October when Ross said he caught a break: FBI agents investigating a child-film ring found a Missouri man who posted Cardenas’ films online, and he knew the name of the victim and who filmed the images, according to The Tribune. Ross tracked down the boy, who at that point was age 12, and learned the back story. He also knew that Cardenas had returned to Mexico. Ross was able to convince the mother of the boy to invite Cardenas to a fake surprise party in honor of her son’s birthday in January 2010. Cardenas even paid someone $2,500 to help smuggle him back into the United States so he could make the festivities, The Tribune reported. The agents nabbed him once he was in Utah and on his way to the family’s home. “We had him in custody thanks in large part to mom’s ability to keep her cool and play this script we had written out,” Ross told The Tribune.
