We Told You So — Obama Tries to Pull a Fast One On Health Care

Sometimes you hate being right. In chapter 4 of our book, “The Blueprint: Obama's Plan to Subvert the Constitution and Build an Imperial Presidency,” we make the point that Team Obama would try to pull a fast one when it comes to Obamacare's individual mandate that everyone reading this blog post needs to buy health insurance, or be subject to a penalty payable to your good friends at the IRS. We first made this argument in a column we co-authored with Senator Orrin Hatch in The Wall Street Journal back in January. Now this issue has suddenly exploded back into the news. For months, Team Obama has been saying that the individual mandate is authorized by Congress' power to regulate interstate commerce, as found in the Commerce Clause. We explain in our book why that argument is a loser in court, and that the White House would have to pull a bait-and-switch and suddenly argue that the mandate is a tax (violating Obama's promise not to raise taxes on anyone making less than $250K per year). Looks like we were right. In their first filing against the multi-state lawsuit challenging Obamacare, Team Obama is now arguing that the individual mandate is… a tax. If you read chapter 4 of our book, though, after we explain how the mandate is not authorized by the Commerce Clause, we then go on to explain how it is also unconstitutional if it's a tax.Evidently worried about this, Team Obama then goes on to argue that if the court doesn't buy the tax argument either (because the argument is bogus, perhaps?), then it's still justified under the General Welfare Clause. Anticipating that, our next section in chapter 4 explains why the mandate is also not authorized by the General Welfare Clause. We close that section by noting that one thing you're taught in law school is that the General Welfare Clause doesn't authorize the federal government to do anything. It is a limitation on federal power, not a source of additional power. When you cite the General Welfare Clause, you're grasping at straws. That's exactly what Team Obama is doing. Their legal argument is desperate, because the Obamacare mandate is unconstitutional. With the vote on Elena Kagan's confirmation to the Supreme Court looming, this issue could not be more timely. We need federal courts that will uphold the Constitution's limits on federal power. The Bruce Beresford-Redman Defense: TV Producer is a Scapegoat

It’s all a set up. That’s the argument lawyers for Bruce Beresford-Redman plan to use if their client is ever extradited to Mexico on first-degree murder charges. The former Survivor producer is the prime suspect in the April death of wife Monica, who was found in a sewer near the Cancun hotel where she and Bruce were vacationing, strangled to death. Since then, Beresford-Redman has proclaimed his innocence , while the victim’s sisters have made no secret over their beliefs that Bruce is responsible for Monica’s death. Now, following an unusual hiccup in the case that proves Mexican authorities confiscated Bruce’s cell phone last month and made thousands of dollars worth of calls on it, a source tells TMZ exactly what the suspect’s defense will be: Beresford-Redman’s attorney will claim police are in need of a scapegoat because there were two deaths aside from Monica’s at the Cancun hotel in question, along with an alleged rape by an employee. With tourism in danger, the lawyer will state, Bruce has been made the fall guy. Meanwhile, a private funeral service is scheduled for Monica tomorrow. Bruce is not invited.

Bam Margera’s Alleged Assailant To Stand Trial

By Gil Kaufman Bam Margera Photo: Frazer Harrison/ Getty Images The 59-year-old woman accused of assaulting “Viva La Bam” star Bam Margera outside a suburban Philadelphia nightclub he owns on June 12 has been held over for trial. According to the Philadelphia Daily News , a district court judge ruled on Thursday that Elizabeth Ray would be held for trial on aggravated assault and related counts. Ray, who has said she’s innocent in the case, lives near the Note, a club Margera, 30, owns in West Chester, Pennsylvania. Margera was allegedly assaulted by Ray with a bat-like object following a noise complaint at the Note earlier this month. Ray was arrested and charged with one count of aggravated assault, two counts of simple assault and two counts of reckless endangerment; she posted $10,000 bail shortly after her arrest. Margera said that he was waiting for a ride home around 2 a.m. when he got into a verbal altercation with Ray and that he was walking away after he thought the argument ended and then collapsed to the ground, suffering a concussion and a large cut to his head after being struck. According to the News, a woman who was with Margera said she saw Ray holding a long, pipe-like object. Pal Tammy Palumbo told the paper that after Margera tumbled to the ground she cradled his head in her lap as Ray began yelling at her. With Margera unconscious and bleeding, Palumbo claimed that Ray threatened, “I’ll hit him again and I’ll make sure I kill him next time.” In a court appearance on Thursday, Margera claimed he exited the club to smoke a cigarette after closing time and Palumbo followed him to a back alley next to Ray’s property. “She yelled, ‘Get off my sidewalk’ to me,” Palumbo testified. “I didn’t even know I was standing in front of someone’s house.” At the time of the incident, Ray professed her innocence to the Daily News, claiming that Margera used racial slurs during their initial argument about the noise. “He called me the n-word,” she said. “I’m innocent, and he’s a jackass, just like his movies.” During testimony, Margera said he got into a shouting match with Ray after she berated Palumbo, the latest in a series of verbal altercations between him and his alleged assailant. “It was kind of a shouting match,” he said. “I was so busy yelling I didn’t hear what she was saying.” Margera denied that he used a racial slur during the argument. Ray’s home shares a wall with Margera’s bar and she often complained about noise from the establishment; to compensate, Margera told the judge that he had his bar manager pay one month’s rent for Ray when the pub opened last year. The complaints continued, however, apparently boiling over into the incident that caused Margera to miss out on a recent shoot for a climactic scene in the upcoming “Jackass 3-D” movie .

ABC’s Tapper: A ‘Good Week’ for White House After ‘Gift’ From Joe Barton

On Friday’s Good Morning America on ABC, White House correspondent Jake Tapper described  White House reaction to Republican Congressman Joe Barton calling BP’s $20 billion escrow fund the result of a government “shakedown”: “…the argument they’re making, that the Republican Party is too close to corporate America…..And they’ve been given this great foil by Joe Barton.” When co-host George Stephanopoulos wondered if the Obama administration was at all concerned about being seen as anti-business, Tapper recited the White House spin: “…they say, at the end of the day, there were inequities throughout the Bush years and they need to correct those inequities. It was the wild west. And they’d rather be on their side, taking on corporate America, than on the Republican side, in their view, defending it.” Later, Tapper concluded: “…they think it was a good week. The President’s trip down to the Gulf, the speech, the $20 billion escrow fund and then this gift from Joe Barton ….they feel like they had a good week. Perhaps their first good week since this crisis began.” At the top of the show, co-host Robin Roberts described the “political firestorm” surrounding BP CEO Tony Hayward’s Thursday testimony on Capitol Hill and Barton’s comments. Later, Stephanopoulos argued that the “beating” Hayward got by members of Congress was “overwhelmed” by Barton. In a report that followed, correspondent Jonathan Karl declared: “Hayward did find one friend on Capitol Hill, Republican Joe Barton.” Turning to Tapper, Stephanopoulos began by noting how Democrats “pounced” on Barton. Tapper quoted a tweet from White House Press Secretary Robert Gibbs: “He said, ‘Who would the GOP put in charge of overseeing the energy industry and big oil if they won control of Congress? Yup. You guessed it, Joe Barton.'” Here is a full transcript of the June 18 Stephanopoulos and Tapper exchange: 7:08AM ET GEORGE STEPHANOPOULOS: Let’s go to Jake Tapper at the White House. And Jake, they just pounced yesterday when they heard that apology. JAKE TAPPER: That’s exactly right. Vice President Biden made comments. And then take a look at this tweet from White House Press Secretary Robert Gibbs. He said, ‘Who would the GOP put in charge of overseeing the energy industry and big oil if they won control of Congress? Yup. You guessed it, Joe Barton.’ And that’s the argument they’re making, that the Republican Party is too close to corporate America, corporations throughout the world, like BP. And they’ve been given this great foil by Joe Barton. STEPHANOPOULOS: Are they concerned at all about the argument that the White House is overstepping its bounds? That the President is just viscerally anti-business, which you’ve heard from many Republicans. TAPPER: Well, a senior White House official I spoke to said that they – they’re careful to walk the line and not be anti-business, they invite businesses to be part of discussions. But they say, at the end of the day, there were inequities throughout the Bush years and they need to correct those inequities. It was the wild west. And they’d rather be on their side, taking on corporate America, than on the Republican side, in their view, defending it. STEPHANOPOULOS: And, Jake, how about the Left? You know, I think the White House was hoping – they kept calling the speech the President gave on Tuesday night an ‘inflection point,’ that it would be a turning point for the President. Yet, they were met by a chorus of criticism, not only by – from conservatives, but also liberals. Concerned by that at all? TAPPER: They are concerned by that. But they think it was a good week. The President’s trip down to the Gulf, the speech, the $20 billion escrow fund and then this gift from Joe Barton, which has really been a lightning rod for the Left, far more than the White House. So I think they feel like they had a good week. Perhaps their first good week since this crisis began. STEPHANOPOULOS: You’re going to have a chance to put a lot of these questions in a big exclusive on Sunday. TAPPER: That’s right, we have an exclusive with White House Chief of Staff Rahm Emanuel.
