Montana Fishburne: Screwed By Prosecutors?

Since the release of the Chippy D sex tape last fall, Montana Fishburne became sort of a household name. At least in gossip and/or adult video circles. Her troubled past has since come to light as well, and the aspiring porn star now says she was jerked around (so to speak) in her assault conviction. Montana Fishburne blieves she was duped by prosecutors who she says went back on the plea bargain she struck, and her lawyer has court over it. COME HITHER : Montana would like some raw justice . Montana’s lawyer, Shawn Chapman Holley, filed legal papers in L.A. Wednesday, claiming last June, prosecutors who filed the assault case agreed to allow Montana to enter a rehab program for 90 days, and in return she’d get no jail time. Montana, relying on the L.A. City Attorney’s offer, entered a rehab facility in September. She is seeking psychiatric help for myriad issues in the facility. According to Holley, prosecutors did an about-face in November and told her they wanted Montana to serve 120 days in jail (Montana is serving 180 in rehab) Now Holley has gone to the judge, asking her to enforce the deal her client relied on. Be it behind bars or in a treatment facility, hopefully she gets the help she needs and gets back to doing what she loves soon. Right, Laurence?

Kredit Kard Katastrophe: Kardashians Sued for $75 Million

The Kardashians have kause for koncern. Five weeks after they took their debit card off the market because it was associated with dangerously high fees, Kim, Kourtney, Khloe and Kris have been sued by The Revenue Resource Group, LLC. For $75 million . The company claims these sisters breached their contract when they pulled out of the aforementioned deal. It’s the biggest pulling out scandal Kim has been involved in since November 2007 . Following an announcement by the Attorney General of Connecticut, who said he’d consider an investigation into the MasterCard-approved debit card, the siblings dropped out of their deal. But Revenue Resource Group says they signed a two-year contract and their public bashing of the product has affected the company’s bottom line. RRG is seeking $75 million in damages. Perhaps this will teach the family a lesson about attaching their name to any product that comes calling. But, somehow, we doubt it will.

Texas Man Declared Innocent After Being Locked Up For 30 Years For A Crime He Didn’t Commit

This is deep: A Texas man declared innocent Tuesday after 30 years in prison could have cut short his prison stint twice and made parole — if only he would admit he was a sex offender. But Cornelius Dupree Jr. refused to do so, doggedly maintaining his innocence in a 1979 rape and robbery, in the process serving more time for a crime he didn’t commit than any other Texas inmate exonerated by DNA evidence. “Whatever your truth is, you have to stick with it,” Dupree, 51, said Tuesday, minutes after a Dallas judge overturned his conviction. Nationally, only two others exonerated by DNA evidence spent more time in prison, according to the Innocence Project, a New York legal center that specializes in wrongful conviction cases and represented Dupree. James Bain was wrongly imprisoned for 35 years in Florida, and Lawrence McKinney spent more than 31 years in a Tennessee prison. Dupree was sentenced to 75 years in prison in 1980 for the rape and robbery of a 26-year-old Dallas woman a year earlier. He was released in July on mandatory supervision, and lived under house arrest until October. About a week after his release, DNA test results came back proving his innocence in the sexual assault. A day after his release, Dupree married his fiancee, Selma. The couple met two decades ago while he was in prison. His exoneration hearing was delayed until Tuesday while authorities retested the DNA and made sure it was a match to the victim. Dallas County District Attorney Craig Watkins supported Dupree’s innocence claim. Looking fit and trim in a dark suit, Dupree stood through most of the short hearing, until state district Judge Don Adams told him, “You’re free to go.” One of Dupree’s lawyers, Innocence Project Co-Director Barry Scheck, called it “a glorious day.” “It’s a joy to be free again,” Dupree said. This latest wait was nothing for Dupree, who was up for parole as recently as 2004. He was set to be released and thought he was going home, until he learned he first would have to attend a sex offender treatment program. Those in the program had to go through what is known as the “four R’s.” They are recognition, remorse, restitution and resolution, said Jim Shoemaker, who served two years with Dupree in the Boyd Unit south of Dallas. “He couldn’t get past the first part,” said Shoemaker, who drove up from Houston to attend Dupree’s hearing. Shoemaker said he spent years talking to Dupree in the prison recreation yard, and always believed his innocence. “I got a lot of flak from the guys on the block,” Shoemaker said. “But I always believed him. He has a quiet, peaceful demeanor.” Under Texas compensation laws for the wrongly imprisoned, Dupree is eligible for $80,000 for each year he was behind bars, plus a lifetime annuity. He could receive $2.4 million in a lump sum that is not subject to federal income tax. The compensation law, the nation’s most generous, was passed in 2009 by the Texas Legislature after dozens of wrongly convicted men were released from prison. Texas has freed 41 wrongly convicted inmates through DNA since 2001 — more than any other state. Dallas County’s record of DNA exonerations — Dupree is No. 21 — is unmatched nationally because the county crime lab maintains biological evidence even decades after a conviction, leaving samples available to test. In addition, Watkins, the DA, has cooperated with innocence groups in reviewing hundreds of requests by inmates for DNA testing. Watkins, the first black district attorney in Texas history, has also pointed to what he calls “a convict-at-all-costs mentality” that he says permeated his office before he arrived in 2007. At least a dozen other exonerated former inmates from the Dallas area who collectively served more than 100 years in prison upheld a local tradition by attending the hearing and welcoming the newest member of their unfortunate fraternity. One of them, James Giles, presented Dupree with a $100 bill as a way to get his life restarted. F*ck a 100 dollar bill!!! Extortion Case Against Oksana Grigorieva Looking Thinner Than Expected

Mel Gibson claims Oksana Grigorieva tried to extort him, and despite what a shady character she is, proving that claim is proving difficult. The investigation of Gibson’s accusations that his former flame and the mother of his daughter tried to extort him is weak, reports indicate. “It’s looking more and more like no crime was committed by Ms. Grigorieva,” a well placed source with knowledge of the situation says. Is Oksana Grigorieva about to be let off the hook? The troubled actor is being investigated for domestic violence against Oksana Grigorieva , a separate investigation also nearing its end. Mel Gibson and his attorney, Blair Berk, met with officials to discuss what they believe was deliberate extortion on the part of Oksana. But it looks like actual evidence is thinner than Lindsay Lohan. “There is simply no smoking gun against Oksana,” the source said . “There are emails which Gibson’s camp say is clearly extortion.” But those emails can also be viewed in the context of an ongoing negotiation between Mel and Oksana regarding custody of Lucia. That makes it tougher to prove extortion, the sources say. Oksana was represented by a very well regarded lawyer, Eric George and walked away from the large settlement she tried to procure, said the well-placed source, noting complications in any potential criminal case against Oksana. Extortion is always hard to prove, especially if the person being accused was already repped by a lawyer and in a custody dispute. Unless you’re the idiot who tried to bilk David Letterman and make it beyond obvious, it’s very tough to make the charge stand up. The Los Angeles Sheriff’s Department hasn’t officially handed over the extortion case to the Los Angeles District Attorney’s Office.

Lindsay Lohan Off the Hook For Rehab Fight

Bribes go a long way. Just kidding … well, mostly. Whatever the reason, Lindsay Lohan received a lovely Christmas present when Dawn Holland dropped her battery allegation. The ex-Betty Ford employee who got into an altercation with the troubled star, who she accused of attacking her, is letting the case against Lohan go. HO, HO, HO : Lindsay’s Christmas season is now more cheerful . “Dawn will not continue to press charges against Lindsay, nor will she be assisting any further in the investigation or prosecution,” her attorney said . “A crime has quite simply not been committed by Ms. Lohan.” The authorities could still file charges against Lohan, but without the testimony of the one witness who lodged the complaint, it would lead nowhere. As such, Lindsay looks to have beaten the rap once again. Last week, the Palm Desert Police confirmed that Lohan was the suspect in a physical incident with Holland, a chemical technician at Betty Ford. Holland claimed that Lohan attacked her when asked to submit to a breathalyzer test andthat she went to the hospital to be treated for injuries. Hours after blabbing her story to celebrity gossip site TMZ, Holland was fired from the famous rehab facility for violating confidentiality rules. A day after that, she pulled a 180 and said she would no longer pursue any case against the 24-year-old, like herself a recovering addict. Holland did not want “in any way shape or form to do anything that would violate Lindsay’s probation or cause an arrest,” her lawyer said. Lohan faced at least six months in jail if she had been found guilty of assault, as it would constitute a probation violation. But it’s all good. She is scheduled to leave rehab January 3. God help us.
