Maybe her inspiring New Year’s Tweet wasn’t just the usual lip service. Even though Lindsay Lohan is legally free to leave rehab today, she’s sticking around Betty Ford, possibly until next week, to get additional treatment. However, reports say Lohan is talking with the Betty Ford Center about remaining in the residential day treatment program until at least Saturday . Good for her. By Jocelyn Vena Lindsay Lohan Photo: Marsaili McGrath/ Getty Images After speaking out about a December 12 incident with Lindsay Lohan at the Betty Ford rehab facility, Dawn Holland has dropped her charges against the embattled starlet. The former rehab worker released a statement to TMZ noting that she wouldn’t pursue a case against Lohan. “Dawn will not continue to press charges against Lindsay, nor will she be assisting any further in the investigation or prosecution,” her lawyer, Kevin Davidson, said. Davidson continued that “a crime has quite simply not been committed by Ms. Lohan.” Holland is reportedly a recovering addict herself and does not want “in any way, shape or form to do anything that would violate Lindsay’s probation or cause an arrest.” E! News reports that while Holland may not be pursuing charges, the Palm Desert Police Department is keeping an investigation into the incident open. “We are continuing our investigation,” the spokeswoman said. “We hope to be done sometime in January.” When asked how Holland would respond if subpoenaed by the police department, her lawyer simply responded “she won’t.” Holland was a technician at the Betty Ford Center and was fired shortly after she gave a video interview in which she discussed the alleged altercation. “She was the only patient out of the three who was being very uncooperative and out of control,” Holland said in the video, explaining that Lohan had been acting defiant at the rehab center. “I did not touch the woman! The fired Betty Ford staff member who accused Lindsay Lohan of battery in a recent altercation now says she will drop her criminal complaint. Not only that, Dawn Holland’s attorney says she will not even cooperate with the authorities in any inquiry into the troubled starlet’s behavior. She says Lindsay should absolutely not be prosecuted. That top has to be a violation of some kind, however . Holland, who was fired after revealing potentially confidential info to TMZ, had said initially that Lindsay’s attack put her on worker’s comp. Holland’s lawyer, Keith Davidson, says she won’t press charges, “nor will she be assisting any further in the investigation or prosecution.” Asked how his client would respond if she’s subpoenaed, Davidson replied, “She won’t.” Basically, no witness equals no case against LiLo . Both recovering addicts, Dawn says she and Lindsay share a bond, and regardless of whether she was clean that night, wants to move on. Davidson says Dawn does not want “in any way shape or form to do anything that would violated Lindsay’s probation or cause an arrest.” “A crime has quite simply not been committed by Ms. Lohan.”

Contrary to the allegations of former Betty Ford staffer Dawn Holland, Lindsay Lohan says she was stone cold sober the night of their fight in rehab . According to Lohan’s camp, she met a friend at the Viceroy Hotel in Palm Springs, Calif., on December 11 to get her hair done . That’s her excuse. While there, sources say Lindsay knocked back Shirley Temples – the famous non-alcoholic mixed drink – along with an order of fries. That’s it. Was Lindsay Lohan bombed that night? [Photo: Pacific Coast News] Sources claim Lindsay eventually headed back to her sober house, completely sober, at around 1 a.m., and that’s when Holland confronted her. Holland claims she smelled alcohol on Lindsay, who was reportedly out past curfew, and that the train wreck refused to take a breathalyzer. Lohan claims she asked for the test in an attempt to prove her sobriety but was denied it by Holland, who she says has “had it out” for her. The details vary depending on who you believe, but it got physical. Holland alleges Lohan hurt her bad enough for her to go on workers’ comp. Lindsay says Holland came at her first, but admits she pushed back. Lohan was quick to play the victim card in the wake of the incident, which resulted in a call to the police and a battery complaint by the staffer. The chemical dependency technician was fired by Betty Ford for talking to TMZ about this, and by doing so, may have even broken the law . Lohan faces a possible police inquiry if officials believe she may have violated her probation in any way during her latest ridiculous incident.
