Antiquated Law Preventing Foreign Naval Aid for Gulf Oil Spill Says CNBC’s Santelli, Heritage Foundation

When a protectionist law is enacted and nearly a century later it is inhibiting a recovery from major ecological catastrophe, it’s probably time to scrap it or at least temporarily waive it. But instead a nearly century old provision known as the Jones Act of 1920 is wielding the wrath of unintended consequences. According to the Heritage Foundation, this protectionist measure was put in place to defend the American maritime industry, but is endangering far more jobs than it is protecting. “The Jones Act, which is supposedly about protecting jobs, is actually killing jobs,” Heritage co-authors James Dean and Claude Berube wrote in a June 8 The Foundry post . “The jobs of fishermen, people working in tourism and others who live along the Gulf Coast and earn a living there are being severely impacted. There are also additional private sector jobs which are NOT being created in the United States since the Jones Act effectively prices U.S. based companies out of the ability to be competitive on the competitive global market. As we strive to develop new technologies for a cleaner environment at sea, the Jones Act continues to hobble our own capabilities, sometimes with devastating results.” And CNBC’s Rick Santelli also noted this impediment to recovery. According to the Belgian newspaper De Standaard , European firms could complete the task in four months, rather than an estimated nine months if done only by the U.S., and just three months if working with U.S. firms. “They are playing this war of words,” Santelli said on CNBC’s June 9 “Closing Bell.” “Just consider this, there’s an old law on the books Ron, called the Jones Act of 1920. I’ve looked at three articles in a Belgian newspaper. They have special ships that could make a big difference in cleaning this up. But they were told by the State Department that they can’t because that act, Jones of 1920 prohibits ships that aren’t made in the U.S. to do such things in U.S. waters.” And Dean and Berube suggest the law should be done away with altogether. “The Jones Act needs to be waived now in light of this catastrophe and permit those whom we have helped and cooperated with in the past to assist us in our need,” they wrote. “After waiving the Jones Act for the Gulf clean up effort, Congress and the administration should repealing it all together.”

Publisher Provides Disclaimer With U.S. Constitution, Will Media Notice?

Copies of the U.S. Constitution put out by Wilder Publishing and being sold on Amazon.com come with an odd disclaimer on the first page of the pamphlet, in part declaring: “This book is a product of its time and does not reflect the same values as it would if it were written today.” On Wednesday’s America Live on FNC, host Megyn Kelly reported the controversy, will the rest of the media follow? In an example of political correctness run amok, the disclaimer goes on to warn parents of the literary material to follow: “Parents might wish to discuss with their children how views on race, gender, sexuality, ethnicity and interpersonal relations have changed since this book was written before allowing them to read this classic work.” The provocative pamphlet also includes the Declaration of Independence and the Articles of Confederation. On FNC, correspondent Trace Gallagher quoted the publishing company’s response to the controversy: “We specialize in classic books and we were receiving complaints about the values depicted in some of the books. We wrote the disclaimer so that we could stop having to point out to our readers that people held different values 100 or 200 years ago. It seems we’re dammed if we do and dammed if we don’t.” Kelly concluded: “You know, it’s one thing when you republish ‘Lady Chatterley’s Lover,’ its another when you slap that thing on the U.S. Constitution and the Declaration of Independence.” Gallagher mocked: “Warning children.” Below is a transcript of the full June 9 FNC report. The publisher apparently feeling that it’s pamphlet, reprinting these documents, needs a warning label about values. Trace Gallagher reports live in our west coast newsroom. Trace. TRACE GALLAGHER: At the end of America Live, we just like to get people riled up, Megyn, we think this will probably do the trick. You know, we started researching this story this morning. We went on to Amazon.com and right next to the title, where it says the U.S. Constitution, somebody typed in ‘shame on you for adding this disclaimer.’ Amazon.com, by the way, has taken that down. But if you buy a copy of the U.S. Constitution on Amazon.com, what you will get is a disclaimer that says, and I’m quoting the following here, ‘This book is a product of its time, and does not reflect the same values as it would if it were written today. We called them, we emailed them, and we finally got a response and we have it right here. And the response is the following: ‘This is a generic warning that we put on all of our books. It was not our intention to tell people how to interpret the U.S. Constitution. We specialize in classic books and we were receiving complaints about the values depicted in some of the books. We wrote the disclaimer so that we could stop having to point out to our readers that people held different values 100 or 200 years ago.’ He ends by saying ‘It seems we’re dammed if we do and dammed if we don’t.’ KELLY: Oh, Warren. Really? The NY Times Passes on Obama’s ‘Buck-Stops-Here Philosophy’

President Obama provided some conservative belly laughs telling an audience of high school graduates in Kalamazoo, Michigan: “Don’t make excuses. Take responsibility not just for your successes.” This from a president who has blamed the last administration (and the Republican Party in general) for various economic and regulatory failures under his watch. This should have been an easy target for New York Times White House reporter Sheryl Gay Stolberg, but she whiffed, even signing on to Obama’s “buck-stops-here philosophy” in Tuesday’s ” Obama Gives Students a Principle to Guide Them .” President Obama has been telling the nation that he takes responsibility for cleaning up the oil spill in the Gulf of Mexico. On Monday, he imparted his buck-stops-here philosophy to an audience of high school graduates , telling them: “Don’t make excuses. Take responsibility not just for your successes.
