Halle believes the kid will be better protected from aggressive paparazzi in France … thanks to the country’s strict anti-pap laws. But Gabriel’s attorney argued Halle and Nahla would be walking right into the lion’s den — because France is the same country where Princess Diana was killed in a wild paparazzi car chase back in 1997. Halle’s lawyer called several French lawyers — who testified that French judges will nail any photog who goes after a celeb. Under French laws, paparazzi can’t photograph celebrities who don’t want their pictures taken — even if they’re out in public. An custody evaluation has been written and submitted to the judge in the Halle Berry/Gabriel Aubry custody war and sources tell TMZ the conclusion is clear, Halle is the better parent, and that clears the way for her move to Paris. The custody evaluator — a psychologist — wrote the report after extensive interviews with Halle, Gabriel, 4-year-old Nahla and others. Sources tell TMZ … the report raises issues about Gabriel’s ability to care for Nahla, in part because of personal issues. We’re told the evaluator did not question Gabriel’s love for his daughter or her love for him, but the report does cast doubt on his ability to assume responsibility for the custody and care for the little girl. Now here’s where it gets interesting … The judge will decide the custody arrangement later this month, and whether Halle gets to move to Paris with Nahla — something Gabriel vigorously opposes. Under California law, the judge cannot question the fact that Halle is moving to Paris. He can’t tell her she’s not allowed to move, nor can he conclude that she’s bluffing. The judge must accept AS FACT that Halle is moving to France. The judge must then decide what is in the “best interest” of Nahla — being with Halle full time or being with Gabriel. Given the conclusions in the custody evaluation report, it’s pretty clear the judge will decide Nahla is best served by being with Halle. So Halle now has a huge advantage in her bid to move to France with the kid. If Halle is allowed to move, it’s almost certain Gabriel would get visitation rights, but that’s easier said than done when Nahla is 5,600 miles away. Add one point for #TeamBerry! According to RadarOnline reports : Halle Berry is “more committed than ever” to moving her four-year-old daughter to France, following a nasty altercation with an over zealous and aggressive paparazzo, RadarOnline.com is exclusively reporting. The pressure that has been building over recent months reached boiling point for the 45-year-old actress this week when she arrived to pick up Nahla from school and ended up in a heated verbal battle with an angry photographer. The Catwoman star was swarmed by photographers and asked them get off the school property or she would call the police, reveals an eyewitness, prompting one snapper to snarl, “f**k off… you make millions and I have a right to make money too.” Halle became inflamed by the confrontation and began arguing with the photographer telling him, “Why don’t you go do an honest job and stop harassing me and my daughter?” A school official and another parent got drawn into the drama, and the police soon arrived to inform all of the paparazzi to leave the grounds and helped the Oscar winner safely escort Nahla to her car. “The school has only ever seen this type of chaos since Halle arrived with Nahla,” revealed a fellow parent, adding that even though there are other celebrity children who attend the school, they’ve only witnessed this type of aggression from the paparazzi towards Halle. One of the mothers revealed that after the photographers were forced to leave by police, Halle broke down in tears and sobbed that this is no way for Nahla to live, saying she does everything in her power to protect the little girl. In the past, friends have stated that Nahla is terrified when she sees the paparazzi anywhere and Halle has asked them to stop taking her picture and leave her alone. “They scream out her name constantly and say awful things about Halle in front of her,” said a pal. When will the baby daddy drama end? Gabriel Aubry wants his 3-year-old daughter Nahla to live in surroundings to which she has become accustomed BUT he wants Halle to pay dearly for it. Via TMZ reports : TMZ has learned what Gabriel wants in the way of $$$ — and it’s a lot. We’ve learned Aubry has filed legal docs asking the family law judge to force Halle to give him $15,000 – $20,000 a month for a proper home. Gabriel has also asked for a laundry list of other things from Halle, including what we’re told is a “very large” amount of money for the little girl’s clothing, as well as money to take the child to Canada to visit his family. We’re told Halle is fighting Gabriel tooth and nail on his request. The hearing on the money issues was scheduled for Monday, but it’s now been put off until April 9, in part because the family law judge wants to see what the dependency judge does to Gabriel. If the dependency judge takes away some of Gabriel’s custody rights, it would have an impact on any child support Halle would have to fork over. Uh-ohhh… According to TMZ reports : TMZ has learned … Halle Berry broke her foot in Spain this morning, and it’s creating problems for the movie she’s shooting. Sources tell TMZ … Halle was on the property where she’s staying and simply took a misstep. She heard a crack and then felt the pain. Halle went to the hospital, where doctors put her foot in a cast. She was taken out of the hospital in a wheelchair. As for the movie she’s currently shooting — “Cloud Atlas” — sources say the immediate plan is to shoot around her. We’re told that will be a combination of things — shooting her from the waist up, using a stunt double, and shooting scenes for the next week or two in which Halle does not appear. Get well Halle. Broken foot and all, you’re still finer than frog hair!
