California Man Freed In Error By Jury Is Stabbed To Death A defendant in a Central California burglary case walked out of a courtroom a free man after a jury mistakenly signed a not-guilty verdict form — only to be killed hours later. Via NY Post reports: The flabbergasted judge said Wednesday that he had no choice but to order defendant Bobby Lee Pearson to be released from jail because the not-guilty verdict had been put on the record, The Fresno Bee reported. After it was too late, jurors told the judge they were hung on the charges against Pearson. Prosecutors might have had an opportunity to retry Pearson in the case of a hung jury. “I can’t believe it,” Superior Court Judge W. Kent Hamlin said after he ordered Pearson to be set free. Hours later, Pearson was stabbed to death after going to a home to get some clothing and belongings, Fresno police Sgt. James Rios said. He apparently got into a fight early Thursday with his sister’s boyfriend, who Rios says then stabbed him. The two apparently had a long history of problems. The boyfriend’s name has not been released. Hamlin said Wednesday that he couldn’t change the verdict form because double jeopardy was already attached. “This has never happened to me in more than 100 jury trials that I have done,” he said. Pearson and two co-defendants were accused of burglarizing an apartment last year and stealing a video system and a gun. The homeowner allegedly caught the intruders and wrestled with one of them. Jurors returned a guilty verdict against Pearson’s co-defendant, Terrel Minniweather, and the mistaken not guilty verdict against Pearson before lunch Wednesday. Hamlin asked the jury whether that was in fact its verdict against Pearson, and all 12 nodded yes, the Bee reported. The jurors were then asked to return after lunch for a potential second phase of the trial. The confusion over the verdict against Pearson came to light during lunch, when one juror told court staff that he had voted to find Pearson guilty, said Linden Lindahl, an attorney for Minniweather. Jurors said they were confused by the forms, one of which was for a guilty verdict and the other for a not guilty verdict. One juror said there was no form they could sign that indicated the jury was deadlocked. Lindahl said he was surprised by the jury’s confusion, since the judge “did everything by the book.” Cold world!

Damn… Killed in front of his own mother. KUTV : A defendant is dead after being shot inside the new federal courthouse in downtown Salt Lake City Monday morning. Officials say the shooting occurred during a trial involving Siale Angilau, 25, a member of the Tongan Crip Gang (TCG). Angilau was the finale defendant in a series of cases being prosecuted by the U.S. Government in federal court against members and associates of TCG. Officials believe Angilau attempted to attack a witness with a pen and was fired at by a U.S. Marshall. Officials at a press conference Monday said the U.S. Marshal shot the defendant multiple times in the chest area. After the shooting, a group of marshals continued to hold Angilau at gunpoint near the jury box while the jury was still present in the courtroom. KUTV

WTF is George Zimmerman smiling about??? Via CNN reports : George Zimmerman is not guilty of the murder of Trayvon Martin, a Florida jury decided late Saturday. The fact that Zimmerman fired the bullet that killed Martin was never in question, but the verdict means the six-person jury had reasonable doubt that the shooting amounted to a criminal act. The verdict caps a case that has inflamed passions for well over a year, much of it focused on race and gun rights. The six-person jury — all women — basically had three choices: to find Zimmerman guilty of second-degree murder; to find him guilty of the lesser charge of manslaughter; or to find him not guilty. The jurors deliberated for 16½ hours total, including 13 on Saturday alone, before delivering its verdict. Zimmerman smiled and then shook his lawyer’s hands when he learned his fate. His parents, Robert and Gladys Zimmerman, were seated nearby, but Martin’s parents were not in the courtroom. Earlier in the day, the jury had asked the court for clarification on its instructions regarding manslaughter. The jury couldn’t have even posed such a query a few days ago: Judge Nelson ruled Thursday, over the defense’s vehement objection, to include manslaughter as an option for jurors, in addition to a second-degree murder charge. The question — the jurors’ first since late Friday afternoon, when they requested an inventory of evidence — was read out in court shortly before 6 p.m. Saturday. After a brief discussion between lawyers and the judge, the court recessed for about 40 minutes. When it reconvened, shortly before the judge announced the jury had ordered dinner, prosecutors and defense lawyers agreed to a response to the jury’s question — basically asking for more detail. “The court cannot engage in general discussions but may be able to address a specific question regarding clarification of the instructions regarding manslaughter,” their response to the jury says. “If you have a specific question, please submit it.” Manslaughter, under Florida law, is “the killing of a human being by the act … of another, without lawful justification … and in cases in which such killing shall not be excusable homicide or murder.” It is a second-degree felony. According to the jury instructions, Zimmerman could be convicted of manslaughter if jurors believe he “intentionally committed an act or acts that caused the death of Trayvon Martin.” “George Zimmerman cannot be guilty of manslaughter by committing a merely negligent act or if the killing was either justifiable or excusable homicide,” the instructions add. “Each of us has a duty to act reasonably toward others. If there is a violation of that duty, without any conscious intention to harm, that violation is negligence.” To convict Zimmerman of second-degree murder, the jury would have to believe that “there was an unlawful killing of Trayvon Martin by an act imminently dangerous to another and demonstrating a depraved mind without regard for human life.” Such a killing would have to be “done from ill will, hatred, spite or an evil intent” and would be “of such a nature that the act itself indicates an indifference to human life.”

Prosecution Finishes Closing Arguments In Zimmerman Trial According to Mail Online George Zimmerman profiled and followed 17-year-old Trayvon Martin, assuming he was up to no good – these assumptions led to his death, a prosecutor argued today in closing arguments of the second-degree murder trial. ‘A teenager is dead. He is dead through no fault of his own,’ assistant state attorney Bernie de la Rionda told the jury. ‘He is dead because another man made assumptions. ‘He is dead not just because that man made those assumptions but because he acted on them, and unfortunately because his assumptions were wrong, Trayvon Benjamin Martin no longer walks on this earth.’ De la Rionda told the jury that Zimmerman wanted to be a police officer and that’s why he followed Martin through his neighborhood, even though the teen wasn’t doing anything wrong. ‘He assumed Trayvon Martin was a criminal. That is why we are here,’ de la Rionda said. ‘Defense will argue self defense. But who do you think was more scared? ‘The kid who was minding his own business being followed by another guy in an SUV. That is the person who was scared. ‘But Trayvon Martin can’t come in here and tell us how he was feeling and that is because of the actions of the defendant.’ Showing jurors the last photograph taken of Trayvon, he described him as an innocent, unarmed teen who was doing an everyday thing by going to the 7/11 to buy Skittles and a drink. In contrast, Zimmerman was painted as an angry, frustrated, wannabe cop who took the law into his own hands by targeting a teen who he believed looked suspicious. ‘What started this?’ he asked the jury. ‘Assumptions, incorrect assumptions on George Zimmerman’s behalf. ‘In George Zimmerman’s mind, Trayvon Martin was a f***ing punk and an a**hole and was NOT going to get away’ ‘This innocent 17-year-old kid was profiled as a criminal. To quote the defendant, he was one of “those a**holes that always get away”, he was one of those “f***ing punks”. ‘But he didn’t scream that out, so the defense will argue there is no ill will or hatred shown. But he muttered it under his breath, which indicates ill will because he verbalized what he was thinking. ‘That’s important, because in his mind he had already assumed certain things. Because in his mind Trayvon Martin was a f***ing punk and an a**hole and was not going to get away.’ De la Rionda referenced many different aspects of the case, different pieces of evidence, and pleaded with the jury to use ‘your God-given common sense’ and find the neighborhood watch volunteer guilty of second-degree murder. The jury has been allowed to consider a manslaughter conviction which in Florida carries a heavy sentence, but you never know what tricks the defense has up their sleeves.
