U.S. Government Sues Lance Armstrong, Seeks $40 Million in Damages

The U.S. government is suing Lance Armstrong for $40 million. The banned cyclist, 41, is accused of violating his contract with his team and is said to have been “unjustly enriched” while cheating to win the Tour de France. That team? The U.S. Postal Service, which “paid about $40 million to sponsor the USPS racing team from 1998 to 2004,” court documents said. Armstrong admitted to doping during all of his seven Tour wins. The lawsuit also names former U.S. Postal Service team director Johan Bruyneel and team management company Tailwind Sports as co-defendants. Lance ended years of denial in a January interview with Oprah Winfrey in which he described doping as part of the process of winning the Tour. The U.S. government announced in February it would join the 2010 lawsuit filed by ex-USPS rider Floyd Landis, who himself admitted using drugs. Tuesday was the deadline for the DOJ to file its complaint. According to the suit, the USPS paid about $40 million to be the title sponsor of Lance Armstrong’s teams for six of his Tour de France victories. It added that Armstrong’s salary during that time, excluding bonuses, was $17.9 million – which the government wants to recoup on top of sponsorship funds. “Defendants were unjustly enriched to the extent of the payments and other benefits they received from the USPS, either directly or indirectly,” the complaint said. The government also asked for a jury trial.

Lance Armstrong Faces Lawsuit According to NBC News Lance Armstrong violated his contract with the U.S. Postal Service and “unjustly enriched” himself by cheating to win Tour de France titles, the Justice Department argued in a lawsuit against the cyclist filed on Tuesday. The government announced in February it would join a federal whistle-blower lawsuit against Armstrong brought by the troubled athlete’s former teammate Floyd Landis. Tuesday marked the deadline to file a formal complaint. “Riders on the USPS-sponsored team, including Armstrong, knowingly caused material violations of the sponsorship agreements by regularly and systematically employing banned substances and methods to enhance their performance,” the complaint says. “Defendants were unjustly enriched to the extent of the payments and other benefits they received from the USPS, either directly or indirectly,” the suit alleges. An Armstrong attorney called the lawsuit “opportunistic and insincere” and said the Postal Service made money off the cyclist, according to the Associated Press. From 1998 to 2004 the Postal Service paid about $40 million to sponsor the team for which Armstrong won six of his seven Tour victories. In that same period the USPS paid Armstrong $17 million, according to the filing. ‘Dodgeball’ Sequel − Good For Humanity & Lance Armstrong, Too?

Let the rehabilitation of Lance Armstrong begin?   The Hollywood Reporter reports that Ben Stiller and his producing partner Stuart Cornfeld have commissioned screenwriter Clay Tarver to write a sequel to Dodgeball: A True Underdog Story , and I think it could be a key public-relations opportunity for the disgraced Tour de France cyclist. If  your memory needs recycling (ba-dump-bump!), Armstrong appears in a key cameo in the movie, where Vince Vaughn’s character, Average Joe’s Gym owner Peter La Fleur is about to quit his underdog team and Armstrong shames him into reconsidering . In the aftermath of Armstrong’s doping scandal, that scene looks ironic and tragic today. But…America loves comeback stories, and if the former champion would be willing to take it on the chin comedically, I bet he could make a little progress in rehabilitating his tarnished image post-Oprah. The sequel is supposed to be about Vaughn’s character and Stiller’s character, White Goodman from Globo Gym , teaming up to battle “an even bigger threat,” as the publication reported.  And Armstrong’s cameo could be as simple as having him seek redemption on La Fleur’s team or play for one of the competitors that Average Joe’s faces.  Either way, he should get beaned real good in a creative elimination scene. Even better: an encounter between La Fleur and Armstrong that would reference the first cameo. Once again, Armstrong would have to agree to take it on the chin. That could be deep and cathartic in a comedic way. It would definitely be more effective than drumming for the reggae band Lance Herbstrong, which Armstrong did on April 20 at the Austin Reggae Festival: Give The Drummer Some…Redemption While we’re on the subject of returning Dodgeball characters, Jason Bateman ‘s loopy ESPN 8 — The Ocho! — color commentator Pepper Brooks is a must . Kristen Stewart Signs on for The Big Shoe

Kristen Stewart has signed on for her next movie role. According to Deadline, the actress will come on board The Big Shoe , costarring with such big names as Elizabeth Banks and Jim Sturgess in a film about a shoe designer (Sturgess) whose family wants to turn his designs into mass-produced knock-offs. The family will hire a psychotherapist named Mary Kay (Banks), while Stewart portrays the woman/muse who lures the main character back to work. No production date or release date has been announced yet. Elsewhere, have you voted for Kristen and Robert Pattinson in the Tournament of THG Finals yet?!?

Lance Armstrong Under Federal Investigation For Obstruction, Witness Tampering, Intimidation

When it rains, it pours for Lance Armstrong, who is under federal investigation for obstruction, witness tampering and intimidation, according to reports. The U.S. Attorney’s office is reportedly in the midst of an active criminal investigation of the disgraced, 41-year-old former Tour de France champion. According to an ABC source, who agreed to speak to the network the condition that his name and position were not used regarding the matter: “Agents are actively investigating Armstrong for obstruction, witness tampering and intimidation” at various points in his (falsely) acclaimed career. The revelation marks a contrast with the U.S. Attorney for Southern California, Andre Birotte, whose own criminal inquiry of Armstrong was/is underway. Birotte’s office spent nearly two years investigating Armstrong for crimes reportedly including drug distribution, fraud and conspiracy, only to drop the case in 2012. Sources at the time said that agents had recommended an indictment against Armstrong. and could not understand why the case was suddenly dropped. Today, a high level source told ABC News, “Birotte does not speak for the federal government as a whole.” Armstrong had no immediate comment. In his much publicized interview with Oprah in January, Armstrong admitted he used PEDs and bullied people throughout his illustrious career. One of those he bullied, Betsy Andreu , said she was furious when she head his admission after all these years … she likely isn’t alone there.

So, who the heck is Donna Savattere? A few facts about the mother of Marino’s seven-year old daughter… She was a 35-year old CBS Sports production assistant in that network’s Manhattan studio when she slept with Marino. She got married to Nahill Younis in Sagaponack, New York in 2009. Aside from Marino’s daughter, Chloe, she has a son with Younis. Marino paid Savattere million to relocate to Texas, but she’s back in NYC now. She has been involved with Southhampton Fresh Air Home, a facility for physically challenged children.

Robert Menendez Reimburses Donor For Trips to Maybe Have Sex With Prostitutes

Sen. Robert Menendez (D-NJ) says he has reimbursed a prominent Florida political donor $58,500 for two controversial trips he took back in 2010. Menendez traveled on the donor’s plane to the Dominican Republic in 2010, and was accused of engaging in sex with prostitutes while in that country. He denied those claims, and there had been no public disclosure of the two trips until now, when he reimbursed Salomon Melgen for the travel costs. “The senator paid for the two trips out of his personal account and no reporting requirements apply,” Menendez spokeswoman Tricia Enright said Wednesday. The FBI searched the West Palm Beach, Fla., office Melgen, an eye doctor, this week; it was unclear if the raid was at all related to Robert Menendez. A third trip by Menendez aboard Melgen’s plane, a campaign fundraising journey to the donor’s residence in the Dominican Republic, took place in May 2010. That trip was reported to the Federal Election Commission. The trip, for fundraising from the community of Americans in the region, took Menendez to Puerto Rico as well as the Dominican Republic, said his office. Menendez categorized the other two trips as personal. The first was August 6-9, 2010, a round trip from South Florida to the Dominican Republic. The second was September 3-6, 2010, from New Jersey to the D.R. and back. Menendez could’ve invoked a “friendship exemption” regarding the personal trips, which would’ve required him to report the travel to the Senate Ethics Committee as a gift. Instead, Menendez chose to reimburse the full cost of the two trips. Senate Majority Leader Harry Reid (D-NV) turned aside questions about Menendez Thursday, saying they should be directed to the New Jersey Democrat instead. On Tuesday, before the disclosures about the FBI raid and the trips, he had expressed skepticism about the allegations, telling reporters to consider the source. White House press secretary Jay Carney declined to answer when asked whether President Barack Obama still has full faith and confidence in Menendez. “I don’t have anything for you on that,” Carney told reporters Thursday. The Daily Caller, a conservative website, reported shortly before the November election that Menendez traveled on Melgen’s plane to have sex with prostitutes. Some New Jersey Republicans filed a complaint with the Senate Ethics Committee last fall in the wake of the shocking allegations by The Daily Caller. In response, Menendez’s staff members searched records for trips by the senator and found the two additional trips that hadn’t been reimbursed. On Tuesday, Menendez became chairman of the Senate Foreign Relations Committee, succeeding Sen. John Kerry (D-MA), who is now Secretary of State.
