Lawsuits: UCLA Forced To Pay $4.5 Milli Settlement To Black Surgeon On Faculty Who Was Depicted As An Oversexed Gorilla

It’s been over a year since we told you about Dr. Christian Head’s discrimination lawsuit against UCLA so we’re happy to report he’s getting pizzzzaid!!! Via LA Times reports : Dr. Christian Head, a surgeon at UCLA’s medical school, will receive $4.5 million to settle a racial discrimination lawsuit against the UC Board of Regents, the university system announced Thursday. The agreement settles the lawsuit, filed in April, that accused the university of failing to prevent discrimination, harassment and retaliation against Head. The head and neck surgeon alleged that he was retaliated against for filing complaints through normal channels and was denied teaching opportunities. Head, 51, also alleged that he was routinely publicly humiliated and once was depicted as a gorilla being s0d0mized in a slide show presentation during a resident graduation event. “The case presented difficult issues of alleged discrimination and retaliation that were strongly contested,” the university said in a statement. “…The matter was settled to the mutual satisfaction of the parties.” The regents approved the settlement in a closed-session meeting in San Francisco on Thursday. During a 2006 event for faculty, staff and graduating medical school residents, a slide show created by the residents — and typically reviewed by staff — included a photo in which Head’s face was superimposed on a gorilla that was being s0d0mized by a department chairman, according to the complaint. Without admitting fault or liability, the university acknowledged that “an inappropriate slide was shown” and regrets the incident, the statement said. Dr. Gerald Berke, chairman of the David Geffen School of Medicine’s Department of Head and Neck Surgery, and Dr. Marilene Wang were named in the lawsuit and were accused of making “inappropriate racial comments and insinuations about blacks” and Head for years, the court document stated. Both are UCLA physicians and professors. The settlement will be paid through a state general liability fund. Head, who resigned from his position, could not be reached for comment. His attorneys deferred to the statement released by the university. Head received his medical degree from Ohio State University in 1993. He joined UCLA’s medical school as part of a fellowship in 1994, then worked as an intern in 1996 and began his residency there in 1997. Congratulations Dr. Head! We are so happy for this man… Perhaps now the folks over at UCLA will get their act together. YouTube Continue reading

Target Sued Over Racially Insensitive Comments, Guide to "Multi-Cultural Tips"

Three former employees are suing Target because of an allegedly racist, offensive “multi-cultural tips” guide provided to managers, according to reports. The memo was meant to note differences among Hispanic employees, such as “not everyone dances to salsa” and “not everyone wears a sombrero.” The workers in question, who were employed at a warehouse distribution center, filed their complaint in Yolo County Court in California in June. Robert Gonzalez, Bulmaro Fabian and Pedro Garcia-Ayala allege that they suffered crude harassment, discrimination and retaliation from Target. They say Target provided distribution warehouse managers with a document titled, “Organization Effectiveness, Employee and Labor Relations Multi-Cultural Tips.” This memo instructs managers to note differences among Hispanic employees, such as: Food: not everyone eats tacos and burritos; Music: not everyone dances to salsa; Dress: not everyone wears a sombrero; Mexicans (lower education level, some may be undocumented); Cubans (Political refugees, legal status, higher education level); and They may say ‘OK, OK’ and pretend to understand, when they do not, just to save face. The suit also alleges that the plaintiffs were expected to work harder than their white counterparts and “were not given the same overtime opportunities.” The plaintiffs also claim that nearly all management positions were held by white people who used racial slurs when addressing Hispanic workers. According to the lawsuit, among the racially insensitive comments made were, “Only a ‘wetback’ can work this hard” and “You got to be Mexican to work like this.” The three workers say they were ultimately fired; Gonzalez was terminated in May 2011 after seven years at the company, according to the lawsuit. The plaintiffs are seeking punitive damages for harassment, failure to prevent harassment, age and race discrimination and retaliation by the company. Target has not commented on the specific allegations of racism made by the trio, but did apologize for the contents of the memo in question. Molly Snyder, a spokeswoman, said in a statement: “We strive at all times to be a place where our team and guests feel welcome, valued and respected.” “It is never Target’s intent to offend our team members or guests and we apologize. The content of the document referenced is not representative of who Target is.” “This document, which was used during conversations at one distribution center, was never part of any formal or company-wide training. We take accountability for its contents and are truly sorry.”

Paula Deen RIPS Lisa Jackson Over Bogus Racism Allegations, Lawsuit

Paula Deen has filed a blistering response to the lawsuit that is torpedoing her career, claiming Lisa Jackson embellished or made up her racism allegations. Yes, Paula admitted using racial slurs in the deposition she gave, but remember that she has NOT admitted anything Jackson has accused her of. Deen said, under oath, that she has used racial epithets in the past, in conversations with friends and family – never in a discriminatory situation. She is fuming that Jackson, who was fired as manager of Uncle Bubba’s Seafood and Oyster House, is actually asking for damages based on racism. Citing discrimination and harassment, Lisa Jackson claims she is “African-American adjacent” – her partner has a biracial niece, she claims in the lawsuit. According to Deen, Jackson’s niece is NOT African-American , but Hispanic. Also, Paula is furious that Jackson alleges she used the n-word in connection with her brother Bubba’s wedding, yet has never offered any proof of this. Thus, Deen feels she was deposed in a lawsuit and forced to admit having used shameful – but quite possibly irrelevant – terms based on bogus claims. As we know, in the wake of the scandal, she’s been fired by Food Network … and Walmart, Caesars, Smithfield Foods, Target, and (sort of) QVC. The celebrity chef wants the case thrown out, and for a judge to throw the book at Jackson, fining her with sanctions for creating a BS harassment case. Stay tuned …

Paula Deen Apology: Posted, Removed, Vague and Really Awkward!

Just hours after she bailed on the Today show , Paula Deen issued a bizarre statement regarding her use of racial slurs, only to promptly yank it off YouTube. It’s the weirdest, least sincere-sounding apology ever. See for yourself: Paula Deen Statement on Racial Slurs With an edit after almost every sentence and frequent stumbles over words, this “apology” achieves the rare feat of leaving Deen’s image worse off than before. Rather than explaining why she used racial slurs in the past, which she admitted under oath in a lawsuit deposition – she just says she’s really sorry. For what? You wouldn’t know based on this video! She doesn’t say. Clearly, some PR team (and not a very good one, mind you) threw together a script and had her read from it, rather than letting her speak from her heart. The result is Deen looking ridiculous … neither sincere, nor apologetic, nor capable of understanding what the heck she even wants forgiveness for. It was taken down shortly after it was posted, but as we know, nothing can truly be axed from the Internet. Her PR people could be axed, however … One assumes this was filmed in response to the controversy that arose over a lawsuit against Deen, who is accused of discrimination in the workplace. A former employee said Deen made racial slurs against her; Deen denied the allegations of the lawsuit, but admits she has used epithets in the past. And to think, there was a time when the nutritional content of Paula Deen recipes was the most controversial topic associated with the Southern chef.
