Bribes go a long way. Just kidding … well, mostly. Whatever the reason, Lindsay Lohan received a lovely Christmas present when Dawn Holland dropped her battery allegation. The ex-Betty Ford employee who got into an altercation with the troubled star, who she accused of attacking her, is letting the case against Lohan go. HO, HO, HO : Lindsay’s Christmas season is now more cheerful . “Dawn will not continue to press charges against Lindsay, nor will she be assisting any further in the investigation or prosecution,” her attorney said . “A crime has quite simply not been committed by Ms. Lohan.” The authorities could still file charges against Lohan, but without the testimony of the one witness who lodged the complaint, it would lead nowhere. As such, Lindsay looks to have beaten the rap once again. Last week, the Palm Desert Police confirmed that Lohan was the suspect in a physical incident with Holland, a chemical technician at Betty Ford. Holland claimed that Lohan attacked her when asked to submit to a breathalyzer test andthat she went to the hospital to be treated for injuries. Hours after blabbing her story to celebrity gossip site TMZ, Holland was fired from the famous rehab facility for violating confidentiality rules. A day after that, she pulled a 180 and said she would no longer pursue any case against the 24-year-old, like herself a recovering addict. Holland did not want “in any way shape or form to do anything that would violate Lindsay’s probation or cause an arrest,” her lawyer said. Lohan faced at least six months in jail if she had been found guilty of assault, as it would constitute a probation violation. But it’s all good. She is scheduled to leave rehab January 3. God help us.

First, it was post-traumatic stress disorder brought on by his service in the Vietnam War. Then came two bouts with throat cancer, which left him without a voice box. Now, 61-year-old Gary Muntz has a new ailment — lymphoma, a slow-moving cancer of the lymph nodes. He speaks only with the aid of a mechanical device pressed tightly to his neck. Long periods outside his home require a wheelchair, and he often cannot sleep. Marijuana helps. It relaxes him, Muntz said. It wards off the nightmares of his childhood, of his time as a paratrooper in Vietnam. It eases pain that sometimes prevents him from getting out of bed. Michigan voters approved the state’s medical marijuana law for people like Muntz, who has a card authorizing him to use the drug for medicinal purposes, said his lawyer, Robert Gaecke. “It was designed for people who really are suffering, that you can see, and this guy was it,” Gaecke said. Muntz, however, was charged with a felony drug crime for violating the law. His case illustrates the muddle surrounding the 2008 voter-enacted legislation and the uncertainty that police and prosecutors face about how to enforce it. “There are still a lot of questions out there, and there is not a lot of definitive legal guidance on how we are supposed to treat these cases,” said John Holda, Jackson deputy police chief. The law must be “far more specific” regarding under what conditions someone can grow marijuana, possess it and acquire it, said Jackson County Circuit Judge John McBain. Hopefully, the courts or state lawmakers can give authorities some clarification, McBain said. Many cases are pending, and governments are looking into it. Last week, Wyoming, a city near Grand Rapids, became the latest municipality to ban medical marijuana. A Miami man whose beating at the hands of police was captured on cell phone video has been charged with resisting arrest without violence, a charge his lawyer says came from nothing more than the man's attempts to cover his head from the blows. Gilberto Matamoros, a 21-year-old youth center worker, says he was doing nothing wrong when police arrested him during a brawl in Miami's Coconut Grove neighborhood on Halloween. According to his lawyer, Ricardo Martinez-Cid, Matamoros was picked out of an unruly crowd and beaten unconscious by two Miami police officers. He had to be taken to a nearby hospital. Cell phone footage of the incident shows a police officer hitting Matamoros five times on or near his head. Miami police launched an investigation into the two officers' actions after the video appeared on local news stations last week. “This is being investigated at this particular time, and until that investigation is completed, we're really not going to have any comments,” Police Chief Miguel Exposito said last week. Martinez-Cid told CBS in Miami that prosecutors had initially told him that all charges against Matamoros would be dropped, but then suddenly changed their minds earlier this week. A charge of disorderly conduct was dropped, but the resisting arrest charge remained in place. “All he tried to do is cover his head, until he passed out. They beat him until he was unconscious, and they had to take him to Jackson [Memorial Hospital],” said Martinez-Cid. He told WPLG channel 10 that if background noise on the cell phone video were reduced, you could hear Matamoros calling for the officers to stop and saying he's not resisting arrest. “Gilbert is a good kid, he actually mentors kids, he's worked for the police athletic league,” Martinez-Cid added. Matamoros has pleaded not guilty. Martinez-Cid told NBC in Miami that he hasn't filed a lawsuit against the police yet, but is keeping that option open.
