Lindsay Lohan Sentenced to 120 Days in Jail For Probation Violation; Theft Charge Reduced

Lindsay Lohan caught a huge break yesterday when the felony grand theft charge against her was reduced to a misdemeanor by Judge Stephanie Sautner. The judge felt that the nature of the alleged crime and the value of the necklace in question simply did not warrant a felony charge. PHEW, right? Of course, LiLo is still on probation for her 2007 DUI arrest, and Sautner was far less lenient in that regard. She sentenced her to 120 days in county jail! Lindsay has been remanded into custody and taken to the courthouse basement to be booked. She is allowed to post bail pending an appeal of the ruling. This being Lohan, she’s been down this road so many times before and was well prepared. She posted $75,000 bail and was back on the street within hours. LiLo was also ordered to complete 480 hours of community service for the offense, 360 of which must be performed at L.A.’s Downtown Women’s Center. There, Lindsay can see how needy women really have to live in this society. The remaining 120 hours of her service will be done at the L.A. County morgue. So she’s free for now, but we expect her to lose that appeal and be back to Century Regional Detention Facility in Lynwood, Calif., soon. Here’s why … At the preliminary hearing on the grand theft charge, the judge felt Lindsay should have called the store and notified the owner about the necklace sooner. She waited several weeks and returned the necklace via some underling only after finding out the cops were about to raid her house. Pretty shady stuff. Sautner seemed influenced by the Lindsay Lohan surveillance video , which she saw for the first time in court, and showed something suspicious was up. Deputy D.A. Danette Meyers argued Lindsay used her friend Patrick as a decoy to distract the clerk while she pilfered the necklace valued at $2,500. Lohan denies all of this and has pleaded not guilty. While a jury of her peers may agree, a judge has the sole authority to rule on probation violations. Lohan rejected a plea deal that would have gotten her three months (cut down to less than one with good behavior) and ended this weeks ago. Rough. So here we are. Most likely, this was a way of making sure Lohan does time no matter what happens in the actual trial – and probably for the best. What do you think of Lohan’s 120-day jail sentence?

It’s HOLLYWOOD.TV’s Celebrity GPS — and Lindsay Lohan goes back to jail! Lindsay was determined to be guilty of violating her parole due to her latest incident, the jewelry heist. At the very least, the troubled actress should be gratefgul her charge was reduced from felony to misdemeanor, requiring her to serve 120 days back in Lynwood Correctional Facility, as well as 480 hours of community service. She is expected to appeal, which would grant her bail opportunity until her next pre-trial date set for May 5. Good luck with that, girlfriend.

By MTV News staff Lindsay Lohan arrives for court in Los Angeles Photo: Getty Images Earlier Friday (April 22), Lindsay Lohan received the good news that her felony grand theft charge had been reduced to a misdemeanor , which brought the threat of jail time from a three-year sentence to a possible one-year stint. However, even with that good news, Lohan was still found to be in violation of her probation , for which Judge Stephanie Sautner has just sentenced Lohan to 120 days in county jail. According to TMZ , Lohan is headed to the Lynwood Correctional Facility, where she will be processed and eligible to post bail. Lohan lawyer Shawn Chapman Holley will appeal the sentence. The actress is due back in court May 11 for a pretrial hearing related to the misdemeanor charge. The troubled actress was also ordered to complete 480 hours of community service; 360 of those hours must be performed at the Downtown Women’s Center, and the remaining 120 hours will be served at the L.A. County morgue. Speaking to Lohan’s alleged theft of a $2,500 necklace back in January, Sautner explained that the actress should have notified the store owners instead of waiting several weeks to return the necklace when she found out the cops were about to raid her house. Late last month, Lohan turned down a plea deal offered by the Los Angeles County District Attorney’s office after being told by Judge Keith Schwartz that had she accepted the DA’s deal — reportedly six months of jail time — she would have been found in violation of her probation and could serve more time. Lohan allegedly lifted a $2,500 necklace from a Venice, California, jewelry store on January 22. The owner reported the theft to the Los Angeles Police Department, which later investigated the accusation and presented evidence to the District Attorney’s office. Lindsay Lohan Locks Role In ‘Gotti’ Flick

Actress is set to play mob wife Kim Gotti in the film. By Jocelyn Vena Lindsay Lohan Photo: Jeff Vespa/ WireImage After some momentary drama on Wednesday, when it seemed that Lindsay Lohan’s role in the mob family biopic “Gotti: Three Generation” was in jeopardy, later that day it was confirmed that the embattled starlet would still be in the film. Originally up for the role of Victoria Gotti, Lohan is now set to play the wife of John Gotti Jr., Kim Gotti. “I’m really excited to be back on set and clear up all the misinterpretations about me and show this is what I love to do,” Lohan said about the casting, according to The Associated Press. “I think it’s such an iconic story. I think it’s a great story to be told. I’m honored to be working with John Travolta and Joe Pesci.” The movie’s producer, Marc Fiore, explained to People.com that it was Lohan herself who managed to make sure she got cast in the flick. “She was definitely out as of earlier today, but she really wanted the part,” he said. “She not only is back in the movie, but she single-handedly put it all together. She called me personally and put her team on it, and we came to an agreement.” Lohan, who was originally rumored to be a part of the movie earlier this month, said that she looks forward to playing the role because “you don’t get to see the heart behind the story and the real side of people. I can relate to that because I think that I’ve been portrayed in a certain light. Lindsay Lohan can’t catch a break these days. Despite rumors that she landed a role that could help resurrect her career, she was just “fired” as Victoria Gotti in Gotti: Three Generations . LiLo wasn’t officially on board, but was rumored to be starring in the biopic about John Gotti and his days running the Gambino crime family. Doesn’t look like this door is still ajar for Lindsay, either . “I promise you Lindsay Lohan is not playing Victoria Gotti,” producer Mark Fiore told E! News today. “Talks have stopped and we are done.” Fiore emphasized again that “We have no discussions with her.” Ouch! Apparently, the troubled star’s management pushed for an offer that the producers COULD refuse. Quite easily, as it turned out … Despite being more of a liability than an asset, Lohan’s camp was pushing for a big payday. More than they were willing to offer, apparently. Her departure comes a week after she turned up at a press conference in New York to plug the project alongside castmember John Travolta. Real-life members of Gotti’s family – including Victoria herself, who said Lindsay had the toughness required for the part – were also there. Lohan’s casting was never official (she acknowledged they had yet to agree to a contract), but it certainly looked like a strong possibility. We should’ve known better after the Inferno debacle. It’s Lindsay Lohan. Between the probation and everything else, it’s just not worth it.

Lindsay Lohan: Robbery Perpetrator … or VICTIM?

Lindsay Lohan will soon be tried for grand theft. But you know who SHOULD be? Kamofle & Co. They marked that necklace up 300 percent! Highway robbery! The necklace piece Linds is accused of bogarting from Kamofie & Co. has been appraised at $850. Legally, this could actually be a significant sum. That price tag does not qualify for felony grand theft, which requires a value of $950 or more. Kamofie was trying to sell the necklace to Lindsay for $2,500. Lindsay’s lawyer, Shawn Holley, will argue the D.A. should only be allowed to charge her client with a misdemeanor, based on the true value of the necklace. But even if Holley loses that argument, Kamofie’s owner already lost. After all, everyone knows jewelers mark stuff up, but 300 percent? That’s going to be a PR problem. Not to mention her selling the surveillance video. It’s hard to make an ungrateful and unprofessional brat like LiLo look like a victim or a sympathetic figure, but they have. Well, almost. One Life to Live and All My Children: Axed by ABC

The future of soap operas is officially bleaker than that of Lindsay Lohan’s movie career, following the decision by ABC yesterday to cancel One Life to Live and All My Children . The daytime dramas were on the air for 43 years and 40 years, respectively, and will be replaced by a pair of horrifically-named talk shows: The Chew , featuring Mario Batali; and The Revolution , starring Tim Gunn. ABC’s Daytime President, Brian Frons, justified the move by saying “we are taking this bold step to expand our business because viewers are looking for different types of programming these days.” The most famous star on either show, Susan Lucci, responded to the news thusly: “It’s been a fantastic journey. I loved playing Erica Kane and working with [show creator] Agnes Nixon and all the incredible people involved with All My Children . I’m looking forward to all kinds of new and exciting opportunities.” One Life to Live will go off the air in January, three months after All My Children ‘s final episode in September.
