Colin Kaepernick’s Collusion Case Against NFL Goes Forward

Source: Patricia Schlein/WENN.com / WENN Colin Kaepernick has been fighting to have his collusion case against the NFL move to a trial and that wish has been fulfilled. The arbitrator in the matter ruled in favor of the free agent quarterback after all 32 teams in the league failed to support why they should receive a summary judgment against Kaepernick and thus taking the case to be heard before a judge. Sports Illustrated reports : The technical reason for Burbank’s ruling is that the NFL and its teams failed to convince Burbank, a law professor at the University of Pennsylvania Law School, that they had met the necessary standard for summary judgment. Under Article 17 of the CBA, Burbank would have granted summary judgment if Kaepernick hadn’t shown enough evidence sufficient to raise a genuine issue of material fact. The “genuine issue” is whether the 30-year-old Kaepernick has been victimized by collusion, which in this context refers to two or more teams, or the league and at least one team, conspiring to deprive Kaepernick of his collectively bargained right to sign with a team. Kaepernick, who earlier in his career led the 49ers to a division championship and a Super Bowl appearance, contends that teams have conspired to keep him out of the NFL. They have allegedly done so on account of the controversy surrounding his kneeling during the playing of the national anthem. A key element of Kaepernick’s argument is that owners are fearful about the capacity and the willingness of President Donald Trump—an ardent critic of Kaepernick and of other players who kneel during the anthem—to damage the league’s business and legal interests. Such a concern was documented in audio recordings of owners during an October 2017 meeting that centered on Kaepernick and the national anthem. This same concern resurfaced in June 2018 when Trump rescinded a White House invitation to the Super Bowl champion Philadelphia Eagles on account of his perception that Eagles players disagreed with him on the anthem (in reality, not one player on the Eagles kneeled during their Super Bowl season). The outlet adds that if Burbank can prove 14 or more teams categorically denied Kaepernick an opportunity to play, the NFL’s player union can band together and call for an end to the current collective bargaining agreement. — Photo: WENN

This back to school season, students in OTRll Tour markets, who are preparing for college, will be chosen by Boys and Girls Club of America. Source: Scott Halleran / Getty According to Jacksonville Police, there was a mass shooting at a Madden video game tournament in Jacksonville, Florida which ended in multiple fatalities. The shooting took place at a downtown shopping center at Jacksonville Landing in the GLHF Game Bar. The Jacksonville Landing area is an open shopping hub with many restaurants, stores and bars. The shooting was streamed one twitch, while on goers were trying to watch the tournament on the internet. Officials say one suspect is dead at the scene. 11 people have been confirmed shot, and 4 dead.   Click here to read more

Rapper Kodak Black Released From Jail

The 21-year-old rapper was released from Broward County Jail early Saturday morning. A camera crew on the scene tried to ask him how he was feeling about his release, but he was too focused on getting the hell out of there. As The Blast first reported, Kodak’s first post-jail stop will be to see his mother and young son. Back in April, the rapper was sentenced to one year in county jail even though he was facing up to 12 years behind bars. Kodak Black pled guilty to two probation violations, including driving on a suspended license and “associating with people committing crimes.” As The Blast previously reported, police witnessed the rapper in the presence of cannabis and ammunition during an Instagram Live stream. His powerhouse attorney,  Bradford Cohen , argued that there was no way to prove that the weed and ammo from the video could be determined to be authentic, and the charges should be dropped. The violation charges were dropped and other charges, including child neglect, that were connected to a police raid on his home, were also dropped.

J ust when you thought it couldn’t get any lower, a Michigan cop tased an unarmed Black man while he was holding his two-month old baby. The video of the incident has gone viral and now the police have released a statement. See Also: President Donald Trump’s Voter Fraud Claims Could Lead To More Voter Suppression Police showed up to a home in Westland, Michigan where people were having a barbecue on Friday night, according ABC 7 in Detroit. “We were just barbecuing, and we saw the cops come up,” said one eyewitness and neighbor who recorded the footage. “They came up and asked us who was fighting. We were like, ‘You got the wrong house.’” Ray Brown, the man who was tased, got agitated with the police coming on his property and demanding answers for something no one knew anything about, according to other witnesses. Audio from the video indicated that an officer told Brown he was going to be arrested and to “get the baby out of here” as police tried to take the baby from him. Brown responded defiantly: “That’s my child. He can be exactly where he’s at. Give me my child. Give me my child.” Brown is then tased. Watch the disturbing video below: Oh my God. I was in the street talking with the cops. I had to come over,” Nichole Skidmore, the mother to two-month-old Christopher, told ABC 7. “The taser is on this side of him, and the baby is over here. As soon as they start tasing him the baby flew out of his hands and I had to grab him, or he would have fell.” Brown was ultimately arrested and was placed in custody. In a statement, police claimed officers went to Brown’s house because of a “report that a male subject had physically assaulted a female and that he had damaged her vehicle.” The statement about the unconfirmed assault continued: “Westland Police Officers made contact with the man involved in the incident. It was determined that the man was going to be arrested for the assault, the damaged property and also for a number of outstanding arrest warrants.” However, police were denying tasing Brown even though it’s on video. “The video shows that during the deployment the child was also in the hands of the mother,” the statement continued. “The child was not injured during the arrest. The child was examined by the Westland EMT and turned over to the mother.” The statement also indicated that the “investigation is only in the beginning phase.” The video clearly showed Brown being tased with his baby; eyewitnesses were screaming in the moment he was tased while holding the baby; the child’s mother said the baby flew out of Brown’s hands while he was being tased; yet the cops still managed to spit out this statement? N ashville police defended the white officer seen shooting a fleeing Black man in the back on a video released Wednesday (Aug. 8), as the Black community demanded justice. See Also: The Disturbing, Growing Trend of Police Fatally Shooting Suspects In The Back Without Consequence James Smallwood , president of the Nashville Fraternal Order of Police, argued Wednesday at a press conference that the video doesn’t “paint a complete image of what occurred that day,” the Tennessean reported. He underscored the police report that said Daniel Hambrick had a gun when Officer Andrew Delke  shot him on July 26, adding that Delke made an “absolutely necessary and reasonable” snap decision. Meanwhile, after viewing the same video, community members  met Wednesday night at the Jefferson Street Missionary Baptist Church and demanded an immediate shakeup of the police department. “I think [Police Chief Steve] Anderson needs to resign or the mayor needs to let him go,” the Rev. Lane (@GicolaLane) August 9, 2018 Delke approached the vehicle Hambrick was in, believing that it was the same car he saw earlier that day driving erratically, according to police investigators. Hambrick, 25, and two others fled from the officer. Surveillance video, released by the prosecutor, shows 25-year-old Delke chasing Hambrick. The officer opens fire on Hambrick, who does not appear to turn toward Delke. After firing multiple times, the officer circles the dying man while continuing to point his weapon at him. While the police alleged that Hambrick had a gun, the video does not appear to show him carrying a weapon. Hambrick’s family wants the officer charged. “The police officer fired four times, three of those bullets ripped Daniel apart. He fell to the ground, where he was cuffed and left, left there like a dog. Worse than a dog,” said Jo Kimbrough , attorney for the Hambrick’s family. “I’m a criminal defense attorney. If there is ever a case of premeditated first degree murder, this is it,” the lawyer continued. A ugust 7 marks Black Women’s Equal Pay Day, bringing awareness to the demeaning statistic that it takes an additional 219 days for African-American women to earn the annual salary of white men. Gender and race pay disparities have led to Black women earning only $.63 cents on the dollar compared to white men, Equal Pay Today reported. Women of color have had to work more than 7 months into 2018 just to match that majority group’s 2017 pay scale — a fact that is equally alarming and urgent to address in our society. Their pay lags behind white woman and Black men as well. The factors contributing to the startling gender and racial wage gap run the gamut: bias, employment discrimination, inadequate minimum wage, and a lack of pay transparency and accountability among many companies across the nation. The absence of affordable child care and quality public school education, as well as the failure to give Black women access to capital, also influence the disparities. Closing the wage gap would greatly benefit Black mothers: 80 percent of them are the primary breadwinners for their households according to Fortune . With equal pay, mothers would be able to afford better child care, pay rent with less stress and put more food on the table. Black Women’s Equal Pay Day stands as an event for women of color to demand more, raise their voices for more and seek solutions for more. The world can’t play with pay as Black women deserve parity. They can ask for a closing of the wage gap as employees, consumers and at the voting booth. A group of 10 Black students has sadly discovered that they are not safe from police while in college. An internal investigation was launched after the students were stopped by cops and wrongfully accused of having an unpaid bill at an IHOP in Clayton, Missouri, police said Monday, July 16. The freshmen, who were unidentified, attended a summer start program at Washington University, which sits at the boundary of St. Louis and Clayton. They walked to IHOP for a late night meal and paid their bill on July 8. However, they were tracked down by officers in multiple squad cars after a restaurant manager issued a complaint about young Black males dining and dashing without settling a $62 bill, The Associated Press  reported. There were six squad cars that followed the students, the university said. Only four cars were named in the incident, according to St. Louis police. Police made the 10 students walk three blocks back to the restaurant, with six squad cars following them. https://t.co/97xP90YorV — St. Louis Post-Dispatch (@stltoday) July 16, 2018 The incident comes at a time when the nation is on high alert about racial profiling incidents that involve cops being called on people of color. The students were cooperative with police and showed their IHOP receipts to officers. They even agreed to walk back to the restaurant and talk with the manager who issued the complaint. After all was said and done, the manager defended the students as innocent and said other customers had left the unpaid bill. However, the damage had been done. “The fact that these 10 students, all of whom are African American, were scared and humiliated is unacceptable to us,” Washington University Vice Chancellor for Public Affairs Jill Friedman said in a statement Monday. “It is extremely disappointing that they have been so seriously let down, even before the official start of their first semester.” Incidents such as this one further show that there are not many safe spaces for students of color at or near colleges and universities. Source: Brian Stablyk / Getty A Texas mother recently proved that she would do anything to protect her kids, even shoot someone if needed. According to FOX 4 News , on Wednesday Michelle Booker-Hicks went to get gas at a Dallas station when she saw a man get into her car with her 2-year-old and 4-year-old sons. She ran back to her car, hopped in and grabbed her gun out of the glove department as the driver sped down the street. Booker-Hicks then shot the carjacker right under his eye. “I proceeded to jump in my backseat and told the gentleman to stop, to get out the car. He would not get out of the car. He turned around and looked at me,” she told FOX 4. “I reached over the armrest to get my glove compartment and that’s when I fired at him once I got the gun from my glove compartment.” After being shot, the carjacker crashed the car into a fence. Thankfully, Booker-Hicks and her children weren’t hurt. The man, later identified as Ricky Wright, was arrested and taken to the hospital. Booker-Hicks stressed that all she cared about in that moment was her children. “I’m not a killer or anything, but I do believe in defending what’s mine,” she said. “I hope that woke him up.” An attorney not involved with her case told FOX 4 he doesn’t think the mother will face any charges for her actions. When children are involved, obviously the authorities are going to be very understanding of that,” Toby Shook said. “The law says that if a reasonable person in her situation would have acted the same way, found it immediately necessary to protect herself or a third party, in this case her children, then that’s legitimate self-defense.” However, Booker-Hicks doesn’t have a  license to carry, but the state of Texas has laws that allow those to carry guns inside their car even without a license.
