Judge strikes down federal health care law

RICHMOND, Va. – A federal judge rejected a key provision of the Obama administration's health care law as unconstitutional Monday, ruling the government cannot require people to buy insurance, in a dispute that both sides agree will ultimately be decided by the U.S. Supreme Court. U.S. District Judge Henry E. Hudson is the first federal judge to strike down the law, which has been upheld by two other federal judges in Virginia and Michigan. Several other lawsuits have been dismissed and others are pending, including one filed by 20 other states in Florida. The government had argued the Commerce Clause of the Constitution gives the government the power to require individuals to buy health insurance or face a penalty, a provision due to take effect in 2014. But Hudson sided with Virginia Attorney General Kenneth Cuccinelli in saying the mandate overstepped the Constitution. “This case, however, turns on atypical and uncharted applications of constitutional law interwoven with subtle political undercurrents,” Hudson wrote. There was no immediate comment from the White House. The Department of Justice, which defended the law in court, stood by its argument that Congress was within its rights to enact the law. Obama’s 2012 Fundraising Goal Pegged At $1 Billion

Chris Cillizza, writing for the Washington Post asks, “Will President Obama be the first billion-dollar man?” Cillizza says “there is already speculation that the cash-collection operation for his 2012 reelection bid will crest the once-unimaginable sum of $1 billion raised. … 'It's not unrealistic at all, given the amount raised and spent in 2008 and the amount Republican interest groups and 527s will spend against him,' said a former Obama administration official.” In 2008, Obama raised “$745 million, while Sen. Obama ignores clemency for political prisoners

President Obama fails to free political prisoners in the US The United States of America holds the world record for the most incarcerated population on the planet. Nearly 2.3 million Americans are locked into the country’s criminal justice system.Among them, hundreds of political prisoners the U.S. government does not recognize. “There are hundreds, perhaps thousands, of people [in the U.S.] whom I would call political prisoners.” So when US President Barack Obama finally decided to execute his pardon privilege, his choices were disappointing to many, like Jim Klimaski, who litigates constitutional and civil rights cases. Klimaski told RT: “President Obama had the opportunity of correcting egregious errors and the people he pardoned are essentially insignificant.” The men and women granted clemency all committed low level offenses such as forgery, drug possession, even mutilating coins. Some of the recipients of the pardons didn't even go to prison. In the stacks of pardon applications were those of prisoners like Native American Activist Leonard Peltier. Peltier, a member of the militant American Indian Movement was sentenced to two life terms in prison for allegedly killing two FBI agents. However, the initial trial was corrupted by faulty affidavits and coerced evidence submitted by the FBI. Some argue Peltier’s only crime was his political activism. Betty Peltier, Leonard’s sister told RT: “They have no evidence at all that he killed anyone.” Mumia Abu Jamal is also considered a political prisoner. He has been on death row for over two decades. Abu Jamal was member of the Black Liberation Movement. He was charged for a crime world dignitaries and members of the European Parliament insist he did not commit. At a demonstration in Washington, DC one Mumia supporter said: “The only reason why he is in jail is because he was framed.” Political hip hop artist Immortal Technique has leant his support and voice to Mumia’s case. He believes these convictions are simply the most known cases of a systematic attempt to silence those seen as a threat to the establishment. “They symbolize a system basically charging someone who is innocent with a crime. Someone specific who is attached to a movement.” Hundreds of other cases fit the description of political prisoners. Such as the Cuban Five, in prison for investigating terrorists attacks against Cuba from Miami and the Puerto Rican Liberation fighters jailed for fighting for Puerto Rico’s independence from the U.S. Those groups, along with countless members of the Black Panther Party, became targets for political reasons some lawyers insist. Zachary Wolfe of the National Lawyers Guild has dealt with many flawed cases. He believes Obama acted with poor judgment. “Pardon Power is absolute, he can do whatever he wants and he has chosen not to,” Wolfe said. He recalls previous pardons that were controversial. “It's hard to see any justice in the process. There are people who have done harm to democracy who have been pardoned such as Oliver North” Oliver North was convicted of selling weapons to the Iranian government during the Iran/Iraq war to fund America’s covert war against the socialist Sandinista government in Nicaragua.The incident became infamous as the Iran Contra scandal. Other controversial pardons in recent history include President Gerald Ford granting clemency to President Richard Nixon for Watergate and installing a vigilante program against political dissidents. President Bill Clinton pardoned billionaire fugitive Marc Rich while George W Bush commuted Scooter Libby's sentence, the man convicted of the CIA leak scandal. There is an international precedent for recognizing and releasing political prisoners. France did it with its anarchists, Germany with the Red Army, Great Britain with the IRA. Not the US government. Barack Obama pulled off a huge coup with his tax-cut deal, but House Democrats are too dim to realize it. Obama slyly negotiated “the biggest stimulus in American history,” complains Charles Krauthammer in the Washington Post. Republicans boast that this is their kind of stimulus—meaning mostly tax cuts. “That’s consolation? WaPo Thumps 2012 Hopeful Rick Santorum as ‘Notorious for His Moral Pronouncements’

Washington Post political reporter Karen Tumulty explored the dark-horse presidential explorations of former Sen. Rick Santorum on the front page of Friday's paper. It was a fairly respectful story until it came time to discuss the former senator's “notorious” moral statements, and how he still “breathes fire” on occasion: Santorum was notorious for his moral pronouncements . He contended, for instance, that Boston's liberal culture was partly to blame for the sex-abuse scandal in the Catholic Church there, and suggested that lifting antiquated state sodomy laws would sanction bestiality — or as he put it, “man on dog.” Santorum still breathes fire . In his evolving stump speech, he frames the prospect of Obama's reelection in near-apocalyptic terms: “Democracy and freedom will disappear.” His agenda consists of stopping pretty much everything that has been set in motion in the past two years, starting with the overhaul of the nation's health-care system. read more

Bill Clinton implores Democrats to back tax deal

WASHINGTON – Bill Clinton implored Democrats to back the tax-cut deal that President Barack Obama negotiated with Republicans as the former president made a surprise appearance at Obama's side in the White House briefing room Friday. “I don't believe there is a better deal out there,” Clinton told reporters who'd been summoned at a moment's notice to see the former chief executive back the current one. Clinton and Obama had just finished a private meeting in the Oval Office. Obama said it was a “terrific meeting” and then turned the podium over to Clinton. The voluble former president took it away, and Obama left part-way through his remarks, saying he had holiday parties to attend. “Both sides are going to have to eat some things they don't like,” Clinton told reporters. “We don't want to slip back into a recession. We've got to keep this thing going and accelerate its pace. I think this is the best available option.” The pact would extend cuts in income tax rates for all earners that would otherwise expire next month, renew long-term jobless benefits and trim Social Security taxes for one year. A number of liberal Democrats say it gives away too much to Republicans, and a provision that's particularly irksome to Democrats cuts estate taxes for the wealthiest Americans. Nonetheless the measure appears headed for Senate approval after negotiators added a few relatively modest sweeteners to promote ethanol and other forms of alternative energy. It's unclear whether House Democrats, who are most opposed, will be able to demand changes that go much further.
