Lindsay Lohan Refuses Plea Deal Involving Jail

Lindsay Lohan’s lawyer is doing all she can to negotiate the best possible plea deal for a client who, in legal parlance, is up s— creek without a paddle. The troubled star has other ideas about how to proceed, however. Lindsay doesn’t care what Shawn Chapman Holley is trying to work out with the D.A., and is still steadfastly refusing to plea bargain if it involves jail time. DENIAL : The writing is on the wall, but LiLo won’t read it . Facing felony grand theft charges for allegedly pilfering a $2,500 from a jewelry store, and already on probation for her 2007 DUI case, she’s up against it. Nevertheless, Lohan insists on going to trial in the hopes she will win and clear her name. Apparently the train wreck is unaware of how probation works. Holley, D.A. Danette Myers and Judge Keith Schwartz will meet week to get a feel for how much time Lindsay Lohan will be sentenced to with a guilty plea.

Lindsay Lohan slept with Samantha Ronson the other night. She hasn’t commented on the nature of that sleepover, but she is firing back at reports that she fell off the wagon when she met Sam out on Thursday night. “The reports i was at teddys are inaccurate. I was just at roosevelt to meet Samantha and say happy birthday to a friend,” she said of the late rendezvous. Her hard-partying days are over, Lindsay swears . And furthermore, Lohan Tweeted , “i take my sobriety seriously. please dont believe this accusations. i know the rules and i wouldnt risk probation. xoxo L” Totally. People are just out to get her, remember. She would NEVER be stupid enough to risk violating probation, and knows enough to stay out of trouble. Well, except for the ankle monitor violation that got her probation revoked last time, that fight in rehab, or the whole felony grand theft issue. Details. Oh wait, we forgot, she would never steal . Sorry for ever doubting you, LL, and we hope they allow conjugal visits in at Lynwood Correctional Facility.

After the “Hold It Against Me” singer tweeted about the team-up Tuesday, the Black Eyed Peas’ leading man opened up about his studio session with the pop princess. “I just came from the studio right now,” Will told The Associated Press . While hesitant to give away details, he did gush about the tune, emphasizing the song’s place in today’s music scene. “It’s a monster,” he said. “It’s mean, pretty, edgy, next level. But the beat just … It’s that beat. She’s singing fresh over it. It’s something that today needs.” While many fans were pleased to hear about the pop partnership, some weren’t so keen on a tweet will.i.am posted shortly after Spears’ collabo announcement. It read, “I just found out some people don’t tweet themselves they have teams of tweeters for them … Wow.” After Team Britney went after the producer, he clarified his sentiments : “Britney tweets for herself I saw it with my own eyes when we recorded in the studio today,” he wrote. “She’s such a sweet heart she’s a perfectionist. You guys read into things way to hard … shame on who ever thought I was talkin about britney … so sad people want to start things.” In the end, Will reverted the focus back to his tune with the pop star, tweeting, “The song I did with britney is ganna be crazy fresh. from the super bowl to the studio workin on a mega smasher. can’t wait till its done.” As Britney continues her daily tease-a-thon for the “Hold It Against Me” video , which will premiere February 17 on MTV, her collaboration with will.i.am might be one of her final studio sessions in completing her new album, Femme Fatale . Scheduled to drop March 29, the LP is expected to include production credits from Dr. Luke, Max Martin, Rodney Jerkins, Stargate, Fraser T. Smith and Bloodshy & Avant. One producer who might not be making the final cut, however, is William Orbit (Madonna’s “Ray of Light”), according to one of his latest tweets. “did a song w Klas Ahlund, who wrote ‘Piece of Me’. Lindsay Lohan Charged With Felony Grand Theft

By Mawuse Ziegbe, with additional reporting by Gil Kaufman Lindsay Lohan at her arraignment in Los Angeles on Wednesday Photo: Mario Anzuoni-Pool/ Getty Images Lindsay Lohan was arraigned Wednesday (February 9) on a felony charge related to her recent jewelry theft case, and the presiding judge made it clear that he wants the troubled starlet to stay straight. Lohan arrived in court in a clingy white minidress, big black shades and hair in a blond ponytail with a necklace tucked into her collar. In the courtroom, the actress sat quietly next to her lawyer, Shawn Chapman Holley, who said Lohan’s probation officer maintained she has been “a good probationer.” Ultimately, the judge decided to revoke her probation in her previous misdemeanor case and set bail at $20,000. At the close of the minutes-long arraignment, Judge Keith Schwartz addressed Lohan directly and advised her that her current circumstance is more serious than her previous legal scrapes. “You’re in a different situation now that a felony has been filed against you,” Schwartz said, later adding that, “If you violate the law, I will remand you and set no bail.” The judge explained that Lohan wouldn’t be able to dodge jail time and post bail as she did last year after she admittedly failed a court-mandated drug test , saying, “A felony is a different situation and you’re not entitled to bail.” The judge also firmly told the starlet, “You need to follow the laws just like everybody else,” and added, “Please, don’t push your luck. I’m telling you, things will be different.” Lohan allegedly lifted a $2,500 necklace from a Venice, California, jewelry store on January 22. The owner reported the theft to the Los Angeles Police Department, which later investigated the accusation and presented evidence to the District Attorney’s office last week. The actress has been officially charged with one count of felony grand theft and faces up to three years in prison. The case is unusual for a number of reasons, according to criminal defense lawyer Jacob Glucksman, who used to be a deputy district attorney in the Los Angeles County Prosecutors office. “It does seem odd to me,” Glucksman told MTV News on Wednesday afternoon a short time before Lohan’s arraignment. “Most theft cases are: You go into a store and hide something in your bag and leave or take it from a person. Something like this is fairly rare and begs the questions: Why didn’t the store just go to Lindsay’s people and not the cops?” Glucksman said the case will come down to the issue of intent, which could be hard for the prosecutor’s office to prove. One of the keys to the case will be prior acts, including similar incidents in the past in which Lohan has been accused (but never criminally charged) with keeping or taking something that didn’t belong to her. “There’s an evidence code in California [section 1101 (b)] that relates to character evidence,” he said. “It says that character evidence cannot be used to prove a person’s propensity to commit a crime. That means they can’t say that ‘Lindsay Lohan is the type of person who would commit this crime because she’s done XYZ in the past.’ ” However, Glucksman, who is not involved in the Lohan case, added, you can use prior acts to show “motive, intent, opportunity, knowledge or modus operandi,” in which case prosecutors could use the character evidence to show that she had intent to steal this time. “You would say, ‘In the past, someone has given her a coat, a watch, trinkets … and they haven’t asked for it back,’ and because she had the knowledge and intent to keep it, that’s what she did this time too.” Lohan does not have to have been charged with crimes in the prior acts in order for them to be brought up in court, but a judge could seek to limit such evidence if he or she thought it would confuse or mislead jurors and possibly lead them to convict Lohan for a past crime rather than the one that led to her charging. The necklace-nicking incident is the latest case in Lohan’s extensive litany of legal run-ins. The starlet was recently released from rehab after failing a court-ordered drug test and spending 2010 in and out of courtrooms and in prison for continually failing to comply with the conditions of her probation stemming from a 2007 DUI bust. Dina Lohan confirms Lindsay’s release to E! According to E! News , Lohan’s mom, Dina, confirmed her daughter’s release from the Betty Ford Center, adding: “It’s a great day.” MTV News reached out to Lohan’s rep for an official statement but did not receive a response by press time. Lohan’s sixth stint in rehab came after she voluntarily entered the Ford Center in late September following an admission that she’d failed a court-mandated drug test. It was preceded by a 14-hour trip to jail — the same one she’d exited in August for violating her probation. That was followed by 23 days in court-ordered rehab. Despite being dropped from her one upcoming film project, “Inferno,” the problem-plagued star has plans to expand her 6126 fashion line. Lohan also recently posted a hopeful message on Twitter on New Year’s Day, writing, “Today is the first day of the rest of my life,” and then quoted spiritual icon Mahatma Ghandi’s message that, “The future depends on what we do in the present.” Her sometimes-estranged father, Michael, told CBS News that his daughter is doing “unbelievably” well. “She’s turned this whole situation around to use this to her advantage and she has taken the right steps and put the right people back in her life that she had at the best part of her life to really use it as a springboard,” Lohan said. Nicole Richie married Joel Madden this month. In slightly less blissful news, Nicole Richie’s probation stemming from a 2006 DUI was terminated early this week. December is all about milestones! The clothing designer and Priceless author was arrested in December 2006 after she was pulled over for driving on the wrong side of the highway. IT’S OVER : Probation, that is. Way to go, Nic . Nicole admitted to using marijuana and Vicodin before getting behind the wheel. She spent 82 minutes in jail, was released and put on probation. Richie’s lawyer showed that she completed all the terms of her probation and the judge agreed to terminate her probation early. Amazing, right? Hear that Lindsay Lohan ? It can be done!!

Richie’s lawyer, Shawn Chapman Holley, went to court Wednesday morning (December 29) to present the judge with proof that her client had completed the terms of her probation. The verification included a report from the alcohol-education program that the reality-TV star had been attending for the last 18 months. Richie was supposed to end her probation in February 2011, but the judge agreed to terminate it early after ruling that all the terms were been met sufficiently. Earlier this month, Richie and her longtime beau, Good Charlotte rocker Joel Madden , finally tied the knot after dating for four years and having two kids together. The wedding took place in California at the home of Nicole’s dad, Lionel Richie. An array of stars helped the celebrate the nuptials, including No Doubt frontwoman Gwen Stefani, celebrity DJ Samantha Ronson and Madden’s twin and Good Charlotte bandmate, Benji. Reverend Run presided over the ceremony. The couple have a 1-year-old son, Sparrow, and an almost-3-year-old daughter, Harlow. The pair made headlines last February when they announced their engagement. Richie broke the news during an appearance on “The Late Show With David Letterman,” while Madden took to Twitter to let the world know. In October 2009, Richie opened up about being a parent. “I couldn’t be happier,” Richie explained to People . “The only thing you want is for your kids to be healthy and happy, and they are.
