Lindsay Lohan Charged With Felony Grand Theft

‘Don’t push your luck,’ judge tells actress during arraignment for allegedly stealing a necklace. Lohan arrived in court in a clingy white minidress, big black shades and hair in a blond ponytail with a necklace tucked into her collar. In the courtroom, the actress sat quietly next to her lawyer, Shawn Chapman Holley, who said Lohan’s probation officer maintained she has been “a good probationer.” Ultimately, the judge decided to revoke her probation in her previous misdemeanor case and set bail at $20,000. At the close of the minutes-long arraignment, Judge Keith Schwartz addressed Lohan directly and advised her that her current circumstance is more serious than her previous legal scrapes. “You’re in a different situation now that a felony has been filed against you,” Schwartz said, later adding that, “If you violate the law, I will remand you and set no bail.” The judge explained that Lohan wouldn’t be able to dodge jail time and post bail as she did last year after she admittedly failed a court-mandated drug test , saying, “A felony is a different situation and you’re not entitled to bail.” The judge also firmly told the starlet, “You need to follow the laws just like everybody else,” and added, “Please, don’t push your luck. I’m telling you, things will be different.” Lohan allegedly lifted a $2,500 necklace from a Venice, California, jewelry store on January 22. The owner reported the theft to the Los Angeles Police Department, which later investigated the accusation and presented evidence to the District Attorney’s office last week. The actress has been officially charged with one count of felony grand theft and faces up to three years in prison. The case is unusual for a number of reasons, according to criminal defense lawyer Jacob Glucksman, who used to be a deputy district attorney in the Los Angeles County Prosecutors office. “It does seem odd to me,” Glucksman told MTV News on Wednesday afternoon a short time before Lohan’s arraignment. “Most theft cases are: You go into a store and hide something in your bag and leave or take it from a person. Something like this is fairly rare and begs the questions: Why didn’t the store just go to Lindsay’s people and not the cops?” Glucksman said the case will come down to the issue of intent, which could be hard for the prosecutor’s office to prove. One of the keys to the case will be prior acts, including similar incidents in the past in which Lohan has been accused (but never criminally charged) with keeping or taking something that didn’t belong to her. “There’s an evidence code in California [section 1101 (b)] that relates to character evidence,” he said. “It says that character evidence cannot be used to prove a person’s propensity to commit a crime. That means they can’t say that ‘Lindsay Lohan is the type of person who would commit this crime because she’s done XYZ in the past.’ ” However, Glucksman, who is not involved in the Lohan case, added, you can use prior acts to show “motive, intent, opportunity, knowledge or modus operandi,” in which case prosecutors could use the character evidence to show that she had intent to steal this time. “You would say, ‘In the past, someone has given her a coat, a watch, trinkets … and they haven’t asked for it back,’ and because she had the knowledge and intent to keep it, that’s what she did this time too.” Lohan does not have to have been charged with crimes in the prior acts in order for them to be brought up in court, but a judge could seek to limit such evidence if he or she thought it would confuse or mislead jurors and possibly lead them to convict Lohan for a past crime rather than the one that led to her charging. The necklace-nicking incident is the latest case in Lohan’s extensive litany of legal run-ins. The starlet was recently released from rehab after failing a court-ordered drug test and spending 2010 in and out of courtrooms and in prison for continually failing to comply with the conditions of her probation stemming from a 2007 DUI bust. Report: Montana Fishburne Punked P.I. With Fake Suicide Attempt

Montana Fishburne put on a show for the private investigator her dad hired to follow her around, faking a suicide attempt just to f*%k with the guy. Seriously. Last August, Montana’s dad, Laurence Fishburne, was so concerned about her that he had a P.I. follow her. Apparently Montana got wind of it, too. Sex tape star Montana Fishburne knows about putting on a show. The investigator shot video of Montana drinking what appeared to be bleach, but it turns out she faked that whole charade just “to put on a show.” This came up in the ongoing criminal assault case against Montana, whose lawyer claims it illustrates her troubled mental state. Not a big stretch. Shawn Chapman Holley wants to get a plea deal that involved rehab, not jail time, for Montana after she beat the crap out of her boyfriend’s ex. The prosecutor agreed to the deal, but has since disavowed it and wants her to do time, claiming that the video was a stunt of a different kind. The prosecutor argues that the fake suicide attempt was “a ploy by the defendant to manipulate the People to offer a more lenient sentence.” Shortly after sending the video to the prosecutor, Holley learned it was fake and told the prosecutor everyone had been duped, including her. Holley is asking the judge to enforce the original deal, which is rehab and no jail. The prosecutor is steadfast about NOT honoring that deal.

Two months after Russell Brand was arrested at Los Angeles International Airport for getting into a scuffle with a paparazzo who he claimed was trying to take upskirt pics of “The Tempest” actor’s then-wife-to-be, singer Katy Perry, Brand learned on Wednesday that he likely will not face sanctions in the incident. According to the Associated Press , Brand and his lawyers met with prosecutor s on Wednesday in Los Angeles and city attorney spokesperson Frank Mateljan said the legal officials decided not to pursue charges. Brand had been facing a potential misdemeanor simple battery charge in the September 17 incident, which was caught on video. The couple, on the way to Las Vegas for Perry’s bachelorette party, were besieged by paparazzi in the Delta Airlines terminal and Brand was caught on tape as he swatted at a photographer and hit his camera. Brand was arrested and later released on $20,000 bail. According to Mateljan, a prosecutor is slated to meet with the photographer involved in the altercation — who placed Brand under citizen’s arrest after the scuffle — on Friday (November 19). While the prosecutor’s office could still file a case against Brand after the meeting, Mateljan said “it doesn’t seem likely.” Married life appears to have mellowed the once infamously out-of-control British actor. He recently told Us Weekly that his marriage to Perry is “just normal” and not what you might expect from two young stars constantly in the spotlight. “The other day, I put a shirt on, and she went … ‘You’re wearing that shirt, are you?’ I thought, ‘That’s actually happening?’ That’s a thing off a sitcom,” he said. “That happened in my actual life. T.I. And Tiny Allegedly Caught With Ecstasy, Say Police

By MTV Staff T.I. and Tameka “Tiny” Cottle in L.A. county police custody Photo: Los Angeles County Sheriff’s Department Los Angeles police confirmed on Friday (September 3) that tests on the illicit substance allegedly found during a traffic stop involving rapper T.I. and his wife, Tameka “Tiny” Cottle , have tested positive as a type of the drug Ecstasy . Los Angeles County Sheriff’s Department spokesperson Nicole Nishida confirmed that lab tests on the pills found on both T.I., 29, and Cottle, 36, tested positive for Ecstasy, a Schedule 1 narcotic noted for a euphoric high that mixes the effects of hallucinogens and amphetamines. Nishida said only that “several” pills were found by detectives, but that no other drugs were confiscated during the search. Tip (born Clifford Harris Jr.) and Tiny were arrested after police stopped their Maybach for making an illegal U-turn on Los Angeles’ busy Sunset Boulevard on Wednesday night. After stopping the car, police allegedly smelled marijuana and then searched the vehicle, which resulted in the substance being found. Nishida said no mention was made by arresting officers of any marijuana confiscated during the search and, despite pictures on TMZ of the Maybach having white Styrofoam cups of the type typically used for sipping “sizzurp” (a narcotic drink popular in the South that contains coediene-laced cough syrup) inside, there was also no mention of that substance in the police report either. Both were arrested and charged with felony possession of a controlled substance and then released from jail a short time later on $10,000 bail. Neither is expected back in court for an arraignment before next month. T.I. is on probation following a seven-month prison stint for a felony gun charge, which is itself a violation of his probation from a previous felony arrest. T.I.’s new probation conditions included supervised release for three years, DNA testing and drug counseling, as well as a ban on owning firearms and an agreement to submit to reasonable searches. The rapper’s lawyers said on Thursday that Tip would be headed back to Atlanta within 24 hours , cautioning that it was too early to speculate on when, or if, he would have to appear before a judge. A spokesperson for the federal prosecutor’s office in Atlanta — where T.I. was prosecuted on the gun charge — said they are awaiting word from the probation department to find out what their investigation turned up about the Los Angeles incident. The probation officer handling T.I.’s case must first gather the facts on the arrest after consulting with Los Angeles County and then make a recommendation to the prosecutor’s office and the court as to whether the rapper deserves to be sanctioned for a violation of his probationary terms. Police Stole $100,000 Which "Smelled" of Marijuana

Although a search of a vehicle that yielded a backpack full of cash that smelled like marijuana was ruled invalid, the money was never returned to the vehicle’s occupants. In June the appellate division of the state Superior Court ruled the search was invalid but many readers — including John Paff, who is chairman of the New Jersey Libertarian Party’s Open Government Advocacy Project — were curious as to what happened to the smelly money. It was divided between the agencies involved in the case. The Hunterdon County Prosecutor’s Office got $25,197.60, the Readington Police Department $37,796.40 and the state kept the remaining $41,906. Ricardo Webb and Brian Bennett of Georgia were arrested on May 5, 2005. According to police, at 2:26 a.m. a motorist called to tell them that a white Chevy Yukon with New York plates had been driving erratically on Route 202 before turning onto Old York Road near the Branchburg/Readington township line. Patrolman Joe Greco spotted the SUV turning onto Pleasant Run Road and pulled it over after having to go 60 mph in a 25 mph zone. Lindsay Lohan Due in Court For Probation Hearing

The troubled actress could be headed to jail if judge rules against her on Tuesday. By Gil Kaufman Lindsay Lohan Photo: Scott Wintrow/ Getty Images Lindsay Lohan is due in court on Tuesday (July 6) for a probation revocation hearing that could land the once promising actress in jail again. According to The Associated Press, Lohan will appear before Judge Marsha Revel in a Beverly Hills, California, courtroom following the revocation of her probation in May, after she missed a scheduled hearing. The actress, who was traveling overseas at the time for the Cannes Film Festival, blamed her absence on a lost (or stolen) passport. While Lohan’s skipped court appearances and failure to comply with all of the terms of the sentence stemming from her 2007 DUI case have reportedly irritated the judge in the case, it’s possible the prosecutor could seek remedies other than additional jail time for the troubled 24-year-old starlet . The AP reported that Lohan could either be allowed to remain free, in which case she will likely begin work on her much-discussed biopic of porn star Linda Lovelace . Alternately, she could be ordered to jail, in which case she would be taken into custody immediately. It was not clear at press time what her potential sentence might be. Lohan was sentenced to three years probation in 2007 after pleading guilty to two misdemeanor counts of being under the influence of cocaine and no contest to two counts of driving with a blood-alcohol level above 0.08 percent and one count of reckless driving. The plea followed two widely reported arrests earlier that year. She spent a total of 84 minutes in jail in that case. Her probation was extended by a year in October after she failed to fully complete court-mandated alcohol-education classes. Lohan is currently sporting an alcohol-monitoring anklet Judge Revel ordered her to wear in May after she missed a court date due to the passport snafu; Revel also scheduled Tuesday’s hearing at that time to determine whether Lohan had violated her probation. TMZ reported that Lohan, in anticipation of Tuesday’s hearing, spent part of her Fourth of July weekend in alcohol-education classes in an effort to meet her class requirements. Lohan’s SCRAM bracelet was set off after the “Mean Girls” actress attended an MTV Movie Awards afterparty, which in turn prompted Revel issue a warrant for Lohan’s arrest and double her bail to $200,000 .
