Gov.-elect John Kasich wants to overhaul collective bargaining law

COLUMBUS, Ohio — Public employees who go on strike over labor disputes should automatically lose their jobs, says Gov.-elect John Kasich. “If they want to strike they should be fired,” Kasich said last week. “I really don't favor the right to strike by any public employee. They've got good jobs, they've got high pay, they get good benefits, a great retirement. What are they striking for?” 12Share 47 Comments Kasich has made it clear that dismantling Ohio's collective bargaining law will be a top priority of his administration. In particular, Kasich is going after binding arbitration rules often used to settle police and fire department salary and benefits disputes that he says are costly and bankrupting cities. That in turn drives up the state's share of funding for local government budgets. “You are forcing increased taxes on taxpayers with them having no say,” Kasich said. The Middletown City Council recently passed a resolution asking the Ohio General Assembly to revise the state's collective bargaining law. City Councilman Josh Laubach, who authored the resolution, said the city had to dip into reserves to pay police and fire costs this year and is expecting a $2.5 million increase in safety personnel in 2011 despite adding no new positions, according to the Middletown Journal. But state labor groups have said the incoming governor is wrong, and they are ready to fight him on any attempts to repeal or alter the nearly three-decade-old collective bargaining law. Terry Gallagher, executive director of the Ohio Patrolmen's Benevolent Association, a group representing about 7,500 policemen, including patrolmen in Parma, Berea, Fairview Park and Westlake, called Kasich's comments “foolish.” “Arbitration is a fair way of doing things — you have a neutral person come in and listen to both sides and make a decision,” Gallagher said. “Kasich doesn't want us to strike and he doesn't want us to collectively bargain, so what is law enforcement left with? Collective begging is what it would amount to.” The 1983 collective bargaining law, which gives public employees a right to unionize, was implemented by a Democratic-controlled legislature and signed by Democratic Gov. Richard F. Celeste. The law, and a 1989 Ohio Supreme Court ruling that addresses it, requires cities to automatically enter into binding arbitration when in a dispute with its safety forces and abide by whatever decision that mediator hands down. added by: figgdimension

Republicans Demand Two-Month, Taxpayer-Funded Recess After Election

House Republicans are going forward with plans to introduce a resolution on Tuesday to prohibit the House of Representatives from assembling during the two-month period following the November elections. A GOP leadership aide confirmed to the Huffington Post that the resolution, authored by Rep. Tom Price (R-Ga.) for the purposes of preventing Democrats from passing legislative items during the lame-duck session, would be introduced before the House passes additional Medicaid and teacher funding. The aide argued that comments on Sunday by Carol Browner, the White House's top energy and environmental adviser, suggesting that energy legislation could be considered during the so-called lame duck period, proved that the resolution was pertinent. And yet, Price's resolution appears likely to produce nothing more than Kabuki theater — which that Democrats aren't necessarily averse to enjoying. For starters, the procedural process by which the issue will play out appears pre-ordained. Because he is introducing a privileged resolution, Democrats can't table Price's gambit from the get-go. Rather, the chair is going to rule that it is “out of order.” Price will appeal the ruling, after which members will vote on the chair's ruling (not the resolution itself). The issue, at that point, will be resolved. The majority will side with the chair. The political drama around the lame-duck session will, undoubtedly, remain. But even then it's not entirely clear what Price's resolution accomplishes. Certainly, it's a procedural maneuver that will please the conservative base. Freedom Works, the moneyed organization behind the Tea Party movement, has been pushing Price's resolution on its website. And former House Speaker Newt Gingrich has been touting the need to shut Congress down after the elections. But the notion that the House should take a two-month, taxpayer-paid break invites obvious political ridicule. One aide deemed it the “Republican Winter Vacation Act.” “Washington Republicans wrecked the economy and haven't lifted a finger to help us fix it,” said Doug Thornell a top aide to Democratic Congressional Campaign Committee Chairman Chris Van Hollen (D-Md.). “Now, the GOP wants to vote for a two-month long taxpayer-funded vacation because they believe the challenges middle class families face today should be ignored. This is the type of work ethic and arrogance that got us into this mess in the first place.” While Browner hinted that a vote on energy legislation may take place between the election and the seating of the new Congress, even that “option” is complicated by a host of factors that don'tjustify the GOP's fear of a lame-duck Congress. For starters, Democrats couldn't get 60 votes in the Senate for a comprehensive bill even when they had that many members caucusing. Tomorrow the National Association for the Advancement of Colored People (NAACP) is expected to pass a resolution condemning racist elements of the Tea Party movement. They knew that all they had to do was string a bunch of sciency-like words together, that all ended in “logical”, and people would not notice that the resolution they just passed did not make any damn sense. Especially if those “people” had the misfortune of getting their education from the South Dakota school district. Let me guess. The people of South Dakota just LOVE Sarah Palin, don’t they?
