Former NYT Editorialist Cohen Insists First Amendment Free Speech Protection Is ‘Vague’

In his June 9 “case study” feature for Time.com, Adam Cohen, formerly of the New York Times editorial board and Time magazine, tackled the question “Are Liberal Judges Really ‘Judicial Activists’?” Cohen’s short answer: yes, but so are conservative judges, and it’s the conservatives on the Supreme Court that have been on an activist kick lately. To bolster his argument, Cohen complained that judges must of necessity make judgment calls about vague elements of U.S. law and the Constitution. You know, vague stuff like, wait for it, the First Amendment (emphases mine): Roberts and the rest of the court’s five-member conservative majority have overturned congressional laws and second-guessed local elected officials as aggressively as any liberal judges. And they have been just as quick to rely on vague constitutional clauses. Earlier this year, in the Citizens United campaign-finance case, the court’s conservatives struck down a federal law that prohibited corporations from spending on federal elections. Once again, they relied on a vaguely worded constitutional guarantee. That “vaguely worded constitutional guarantee” reads as follows: Congress shall make no law… abridging the freedom of speech, or of the press. What part of that is vague? Congress has no business abridging the freedom of speech, or of the press. The amendment says nothing about whose freedom of speech, and congressional attempts to fence in that freedom of speech to individuals alone, and not corporate entities, is a pretty clear violation of the text of the amendment’s prohibition against speech abridgement. Indeed, as the majority in Citizen’s United made clear: Speech restrictions based on the identity of the speaker are all too often simply a means to control content….The First Amendment protects speech and speaker, and the ideas that flow from each. Cohen also considers “vague” the 14th Amendment’s equal protection clause: In a 2007 case, the conservative majority overturned voluntary racial integration programs in Seattle and Louisville, Ky. Good idea or bad, the programs were adopted by local officials who had to answer to voters. But the conservative Justices had no problem invoking the vague words of the Equal Protection Clause to strike them down. In that controversy, the two school systems involved were purposefully engineering the racial demography of schools within their districts to correct what was perceived as racial imbalance. In other words, some schools were too white, others too black, in the eyes of policymakers. Whereas Brown v. Board ruled that de jure segregation was a violation of the 14th Amendment protections because segregation by law was inherently unequal, liberal proponents of the Seattle and Louisville plans defended the respective school districts’ obsession with the skin color of its school populations.  Here’s how Washington Post reporter Robert Barnes recorded the logic of Chief Justice Roberts in the Court’s opinion in Parents Involved in Community Schools v. Seattle School District No. 1 et al. : “Before Brown, schoolchildren were told where they could and could not go to school based on the color of their skin,” Chief Justice John G. Roberts Jr. wrote for a plurality that included Justices Antonin Scalia, Clarence Thomas and Samuel A. Alito Jr. “The school districts in these cases have not carried the heavy burden of demonstrating that we should allow this once again — even for very different reasons.” He added: “The way to stop discrimination on the basis of race is to stop discriminating on the basis of race.”  Those crazy conservative justices and their radical activism, upholding the implications of Brown v. Board of Education!

Charlize Theron Says Pauly D Is Her Favorite ‘Jersey Shore’ Castmember

Oscar winner improves her record with MTV reality-show trivia. By Todd Gilchrist, with reporting by Josh Horowitz Josh Horowitz and Charlize Theron Photo: MTV News Charlize Theron is a cultured, cosmopolitan actress who transformed herself to play Aileen Wuornos (to Oscar-winning effect) in 2003’s “Monster” and threw herself into roles in socially conscious films like “Battle in Seattle” and “North Country.” But the real sign of her worldly wisdom is her familiarity with none other than MTV’s blockbuster reality show, “Jersey Shore.” “I know Snooki,” Theron told MTV News Saturday night at Spike TV’s Guys Choice Awards when asked how well she knew the show. “I know ‘The Situation’. [I know] Paulie.” Theron’s familiarity with even a few of the folks on “Jersey Shore” is a significant improvement on her storied history with “The Hills,” which she discussed several times with MTV News. She even has a favorite of the Seaside Heights crew. “I would say that out of all of them, Pauly is the cutest.” In between accidental F-bombs, another Theron trademark, she paid tribute to Snooki and JWoww, the show’s female contingent. “I love you all,” she said to the cast, who will all join MTV News on the red carpet for the MTV Movie Awards pre-show. “What are they called, guidettes? Rock on, guidettes!” Don’t miss the live red-carpet coverage, exclusive movie clips and fist-pumping action on MTV News’ “Jersey Shore Blow-Out at the MTV Movie Awards,” airing live from Los Angeles this Sunday, June 6, at 8 p.m. ET/PT. Attack on West Seattle teen a hate crime?

SEATTLE – Seattle Police are investigating to determine if an attack on a 15-year-old West Seattle boy was racially motivated. Shane McClellan's father says his son was walking home from a friend's house Tuesday around 2 a.m. when he was approached by three black males and an Asian or Pacific lslander male. Asking him first for a light, they then attacked him, kicking and hitting him and threatening him with a gun, said McClellan. “They started punching, knocked him down, kicking him, robbed him of everything, stole his coat, shoved him to the ground, stuck a gun in the back of his head,” described McClellan. “I can't tell you what it's like to see and not even be able to recognize your son.” McClellan says they also burned the back of Shane's neck with cigarette butts before taking out a belt and making the racially-charged comments. “When they were beating with the belt [they said] that they hated white people, and that's what the whipping was for,” said McClellan. Shane said they told him they singled him out because that was what his ancestors did to theirs. The teen was unconscious until about 7 a.m., said McClellan, and he then stumbled into the street and was helped to a hospital by a passerby. Seattle Police have referred the case to their Bias Crimes Unit for review as a possible hate crime. By king5. com http://www.liveleak.com/view?i=c79_1275253093 added by: CarlosBobthe3rd

‘Glee’ Recap: Neil Patrick Harris Makes Strange Dreams Come True

NPH sang with Mr. Schue, and did a different kind of duet with Sue Sylvester. By Jean Bentley Neil Patrick Harris in “Glee” Photo: FOX Remember the weeks before “Glee” came back from hiatus and all we had to tide us over were glimpses of upcoming scenes in promos? And there was one promo that showed Mr. Schuster making out with Idina Menzel’s character, and for a hot second you were like “OMG he’s making out with Rachel!”? Well, you weren’t crazy. Anyone with eyes can see that the Broadway legend and Lea Michele are pretty much identical. But it wasn’t until tonight’s episode that we learned for sure what everyone had suspected all along: Shelby Corcoran, you are the mother. Rachel’s birth mother is, in fact, the Vocal Adrenaline coach, and Rachel’s foxy new boyfriend, former VA star-turned-New Directions transfer Jesse St. James, has been but a pawn in Shelby’s evil plan. Except the plan isn’t all that evil. Shelby explained to her young minion that the only thing she regretted in life was not being able to meet her daughter. Unfortunately, the surrogate contract wouldn’t let her contact Rachel until Rachel turned 18. To meet any sooner, it had to be Rachel’s idea. Shelby had Jesse get close to Rachel (seducing her was his idea) and encourage her to try to find her birth mother. He planted a tape from Shelby in the box of baby stuff Rachel dug out from her basement, helping her realize that no, her birth mother wasn’t Patti LuPone or Bernadette Peters. It took some pressing, but he finally got Rachel to listen to the tape of Shelby singing “I Dreamed a Dream,” which turned into a lovely mother/daughter duet. Speaking of dreams, Neil Patrick Harris dropped by William McKinley High to crush a few. NPH is always great when he’s playing a jerk (which seems incongruous since he appears to be such a nice guy in real life), and last night’s douche du jour was Bryan Ryan, Mr. Schue’s former glee club nemesis and the current school board member in charge of extracurricular funding. He was at the school deciding which arts program to cut and had his eye on the glee club, since it had brought him nothing but pain when his dream of becoming a famous performer didn’t pan out. He advised the gleeks that their dreams, too, would one day come crashing down around them and lead to a crack addiction. Schuester pleaded his case to keep the club and let the kids have their dreams, but Bryan wouldn’t relent. That is, until his love of performing (and zeal for competition) was reignited. Will and Bryan both went out for the part of Jean Valjean in the local Lima production of “Les Mis#233;rables,” and a tight audition schedule meant they had to try out together by dueting on “Dream On.” Schue got the part, but wound up trading it to Bryan Ryan to save the glee club. Also, somehow Bryan Ryan and Sue Sylvester totally DID IT. Yeah. Try to get that mental picture out of your brain before we continue. Since the drama with his rival prevented Mr. Schuester from giving the kids an assignment this week, Tina created her own assignment to help Artie achieve his dream of being able to dance. But instead of helping Artie deal with his reality and come up with his own way of dancing, Tina told him that he would definitely be able to walk (and dance) one day. In a particularly heartbreaking scene, Artie tried to use crutches to walk around the choir room, but fell on his face instead. Artie daydreamed leading an intricate mall-set dance number to “The Safety Dance,” which gave former boy-bander Kevin McHale a chance to get out of the wheelchair and show off his sweet dance moves. It was also a cute homage to the “Glee” flash mobs that dedicated fans have organized in cities like Seattle and Rome. But Artie eventually realized that this dream would never happen. Tina choreographed a tap dance number to “Dream a Little Dream of Me” with Mike Chang instead, while Artie sang. What did you think of Neil Patrick Harris’ guest appearance on “Glee”? Pornland, Oregon: Child Prostitution in Portland

Video at the link… Child prostitution has become a national problem in this country. Yes, I know that you have trouble believing that. You don't want to believe it, so you tend not to. “Widespread sex trafficking in children?”, you may be saying to yourself. “Sure, it happens overseas in places like Thailand and Moldova, and while there may be some of it here there's not that much of it in our country.” Based on a months long investigation and some reportorial digging, I'm here to tell you that you are wrong. We all are. We're in denial. In covering news for more than 60 years, I'd like to think that few stories shock me anymore. But this is one of them. We ran across it late last year and the more we dug, the more disturbing it became. Eighty-year-old men paying a premium to violate teenage girls, sometimes supplied by former drug gangs now into child sex trafficking big time? You've got to be kidding. Nope. That's happening and a lot more along the same lines. The business is booming. One of the worst areas for it runs along lines running roughly from Seattle to Portland, to San Francisco and Los Angeles, to Las Vegas. But no place in the country is immune. To pick just one example among many, Portland, Oregon is without doubt one of the nation's treasures. It has been voted one of the best places to live and work. But according to police, the city and its outlying communities has become a hub for the sexual exploitation of children. In a recent nationwide sting by Federal, state and local law enforcement agencies, Portland ranked second in the country for the number of rescued child prostitutes. And according to Doug Justus, the workhorse sergeant in charge of Portland's tiny Vice Detail, many of the children caught up in this are middle class kids from the area. ‘Eclipse’ Clip Shows Volturi Scheming In Seattle

Dakota Fanning and company watch the newborn vampires’ chaos in brand-new clip. By Eric Ditzian Photo: Summit Entertainment Robert Pattinson , Kristen Stewart and Taylor Lautner don’t need to get all the attention, do they? With the “Twilight” trio set to appear together Thursday (May 13) on an episode of “The Oprah Winfrey Show,” Summit Entertainment released a brand-new clip from “Eclipse” in which none of them appears. Instead the footage, which debuted as an iTunes exclusive , focuses on Dakota Fanning’s Jane and her crew of Volturi vampire badasses, giving us our closest look yet at their roles in “Eclipse.” And the 40-second clip is doubly interesting because this scene does not appear in the book on which the film is based. The scene opens as the Volturi, the Italy-based royalty of the vampire world, look down upon a collection of newborn vampires sowing chaos on the city streets. These just-turned bloodsuckers were created by Victoria (Bryce Dallas Howard) with the express purpose of destroying Edward Cullen (Robert Pattinson) and his family, as well as Bella Swan (Kristen Stewart). The Volturi watch the Seattle newborns feed on humans, overturn cars and generally create an atmosphere of violent chaos. “They’ve already drawn too much attention,” Demetri (Charlie Bewley) says. “So has our inaction,” Felix (Daniel Cudmore) responds. “Others may begin to question the Volturi’s effectiveness.” But the diminutive Jane is not buying this call for a show of strength. “Let them,” she says, her blood-red eyes unblinking. Felix remains unsatisfied. “Maybe we should consult with Aro,” he suggests. It’s then that we see Jane’s abilities on full display. She can inflict incapacitating pain with only her thoughts — a special ability she developed after being burned at the stake as a child. As she holds Felix using only her mind, Jane’s brother Alec (Cameron Bright) looks on. “Aro’s decisions are being watched,” she says cryptically. “Either we let them do what they were created for, or we end them. Decisions, decisions.” What do you think of this scene and its departure from Stephenie Meyer’s “Eclipse”? Share your thoughts in the comments.
