Race Matters: Ex-Gang Member Exonerated After Serving 19-Years In Prison!

Justice served? Thanks to a corrupt system and false testimonies , 37-year-old John Edward Smith has been in jail…serving 19 years of his TWO life term sentences for murder. What’s got us so angry about this case is the LAPD’s internal affairs department ignored polygraph tests and repeated reports made by the witness; admitting before and after the sentencing that he’d falsely accused Smith. According to the LA Times… “I had days when I was really frustrated, but I knew I couldn’t stop,” John Edward Smith said of his bid for release in a phone interview minutes after he walked out a free man. He said he was most dazed by the lights of downtown Los Angeles and Staples Center, and was looking forward to going home and hugging his grandmother. Smith said he was putting the details of his case out of his mind and focusing on the small steps to rebuild a life on the outside, like getting a driver’s license. During 19 years behind bars, Smith, a 37-year-old former gang member, adamantly maintained his innocence in the drive-by shooting, insisting that he was miles away at his grandmother’s house at the time of the crime. His claims went unheard until three years ago, when a fledgling wrongful convictions group, Innocence Matters, took his case and identified problems with the testimony of the lone witness to identify him as the killer. The man subsequently recanted and at a brief and raucous hearing Monday afternoon, a Los Angeles County Superior Court judge vacated his conviction. Smith’s relatives and friends erupted in cheers as Judge Patricia Schnegg, the supervising criminal judge, said she was setting aside the 1995 verdict because Smith’s conviction rested almost entirely on perjured testimony….The judge’s ruling came after the district attorney’s office completed its own yearlong investigation and determined that the witness, a high school student injured in the shooting, had lied on the stand. That teenager, Landu Mvuemba, told Smith’s lawyers that LAPD detectives had pressured him into the identification and that he had tried on a number of occasions over the years to alert authorities about his false statements. Smith offered the jury an alibi: He was with a girlfriend and two others at his grandmother’s house nearly three miles away. But the jury believed Mvuemba, convicting Smith of murder and attempted murder after three hours of deliberations. He was given two life sentences. Smith’s family, including his grandmother Laura Neal, firmly believed in his innocence. At one point, his grandparents mortgaged their house to pay an appellate law firm $65,000. Mvuemba said he soon regretted it and reported his concerns to LAPD internal affairs twice. He even told the courtroom bailiff as he prepared to take the witness stand, he said. No one did anything, he said. He and Smith later took polygraph tests. Both passed. Outside the courthouse, Smith’s grandmother, a frail women who uses a walker, said she had willed herself to stay alive until he was free. “There was a part of me that was in there too,” she said of his prison stay. “I am free now.” It’s sad that one false testimony can have such a heavy impact on your life. We’d like to think the LAPD might feel some repercussion after ignoring Mvuemba and other members of Smith’s family for so many years…but we know what kind of world we live in. Images via KTLA

The Dark Knight Rises Other Star: The Tumbler – Take a Look!

The Batmobile has had quite the evolution since actual volition appeared in the ’60s television version to its altogether super-suped up version heading your way in The Dark Knight Rises . Its latest incarnation includes some nifty gadgetry including a rocket launcher, the vehicle’s creator Andy Smith told Beyond The Trailer host Grace Randolph at Comic-Con where the vehicle, aka The Tumbler, is on display along with previous versions of The Batmobile. Smith has a history in race car work and worked on a car for a James Bond film and for an earlier Batmobile back in ’89. The current Tumbler is a hybrid of a Humvee and Lamborghini and it’s the only one that has ever been named something other than a ‘Batmobile.’ Smith gives a rundown of interesting factoids in the video below, including Christopher Nolan and production designer Nathan Crowley’s hand in creating The Tumbler after toying with various model kits. Of note, The Tumbler is 9 feet, 2 inches wide and 15 feet, 2 inches in length. Those stats keep it from being street-worthy at least legally speaking. It also has a top speed of 110mph, but “film makes it look much faster,” Smith notes. The video also shows previous Batmobiles including an interview with one owner and an interview with an early Batmobile designer who also designed many other famous on-screen vehicles including four-wheel stars appearing in Knight Rider , The Dukes of Hazzard and even The Monkees .

In our “MTV First: Snow White and the Huntsman,” they made each other laugh with their comments and played off each other’s answers — like when Stewart described Theron in three words, saying, “I want you,” and Theron replied, “You got it,” and spread her legs apart. When MTV News’ Josh Horowitz caught up with the “Young Adult” actress, she chalked up their friendship to the age-old “opposites attract” phenomenon, saying that what specifically attracts her to Stewart is her genuine personality. “The first thing I noticed about her was when she says ‘I don’t give a f—,’ she means that,” Theron said. “She’s not just trying to be cool. She’s not trying to be edgy. The film hits theaters June 1, and Theron got to know Stewart as they worked on the project together. “I think that there’s an incredible girl there,” Theron said. “And I like that she’s so different because I think that it’s authentic — and there’s nothing I despise more than people trying to be something that they’re not. And all these, kind of, quirks that she has, they’re authentic to who she is and she’s not putting it on, she’s not trying to do it. She’s just really who she is.” While the “Twilight” actress has received bad press in the past when people mistook her timid nature for rudeness or conceit, her co-star had nothing but praise for her character. “You know, a lot of people at that age can still be [finding themselves]. By Kara Warner Will Smith in “Men in Black 3” Photo: Columbia Pictures No matter what you love most about the “Men in Black” franchise, the most compelling aspect of the sci-fi/action films — despite all their otherworldly and impressive visual effects — is the charm of their star and all-around likable actor Will Smith as Agent J. The former “Fresh Prince” is known for being a ball of excitable, positive energy on set, but according to “Men in Black 3” director Barry Sonnenfeld, sometimes that energy can get a little dangerous. “Usually, while I’d be turned here directing Josh Brolin, Will Smith would be punching me in my kidneys,” he told MTV News recently. “In fact, at the end of this movie, I went into the hospital because Will had torn my rotator cuff. On ‘Wild Wild West’ he broke my hand in five places, so Will’s gotta have his energy harnessed a little bit, at least when he’s working with me. I don’t think he ever went around punching Michael Mann [who directed Smith in 2001’s ‘Ali’], let me just say that.” We then asked Sonnenfeld if there were any repercussions for Smith with all this on-set abuse. “I told him that if he didn’t stop hitting me that I would direct ‘Men in Black 4’ and hire his son to play young Agent J,” Sonnenfeld joked. “So maybe that will make him calm down a little bit.” It should also be known that Smith’s acting skills were a little rusty when he arrived on set to begin work on “MIB 3,” which required some lighthearted finessing from Sonnenfeld and extra practice from Smith. “On the first day of photography, we filmed Will on a blue-screen stage having to jump down [from the top of the Chrysler building], and what was great about it was that he hadn’t acted in three years and was really bad,” Sonnenfeld recalled of one of his favorite moments during filming. “Luckily, we cut out the bad stuff, but that first take we did after he hadn’t acted in three years, I was sweating because he was no good. After I yelled, ‘Cut!’ Will said, ‘Baz, I can do better! I’m really terrible. I haven’t acted in three years, I’m really rusty!’ And within a day or two, it all worked out fine. But man, it was interesting. You know how they say ‘Once you learn how to ride a bicycle, you never forget?’ Well, Will forgot how to act for the first day or two.
