Wall Street Quietly Creates a New Way to Profit From Homeowner Distress

Auctions allow private investors to acquire rights to collect overdue property taxes, levy escalating fees on homeowners, and foreclose on those who do not pay. Credit: Emma Schwartz When Florida retiree Gladys Walker fell behind in paying taxes on her modest Pompano Beach home, she had no idea one of America’s biggest banks and a major Wall Street hedge fund engaged in frenzied bidding for the right to collect her debt—all $768.25 of it. “I just couldn’t come up with the money,” said Walker, 67, a former hotel worker who makes do on a monthly Social Security check. Barely more than a year after a taxpayer bailout of major financial institutions, Bank of America and the hedge fund, Fortress Investment Group, spotted a fresh money-making opportunity – collecting the tax debts of tens of thousands of people like Walker. The bank and hedge fund can add interest charges and fees, and they bundled the debts as securities for investors. In late May and early June, proxies for the two institutions quietly bought hundreds of millions of dollars in homeowners’ property tax debts in Florida by bidding at a series of online auctions held by county tax collectors. They didn’t use their names but donned multiple other identities, dominating the auctions and repeatedly bidding on the same parcels – in the case of Walker’s small home, more than 8,000 times. Then, in September, Bank of America’s securities division packaged $301 million worth of the tax liens it and Fortress had acquired into bonds pitched privately to major investors. The anticipated return – estimated at between 7 to 10 percent – is possible because buyers of tax debts can assess a panoply of interest charges and other fees. When the debt goes unpaid long enough, the liens buyer can seize properties through foreclosure. Because the bonds were sold privately, there’s no public record indicating who purchased them, the prices paid, or the anticipated return. Moody Investment Services spokesman Tom Lemmon said the type of offering, known as a tax lien securitization trust, is fairly uncommon. Bank of America, he added, may make additional offerings in future years. A Bank of America spokesman, while otherwise declining comment, said that the bank and Fortress had not acted together in bidding in the auctions. Bank of America spokesman William Halldin said by email: “Our bids were made independent of any other organization. Any suggestion that they weren’t independent is simply incorrect.” Fortress, which is headed by former Fannie Mae chief Daniel Mudd, had no comment. The Florida securities deal illustrates how financial institutions, including some beneficiaries of federal bailout dollars, are actively creating new ways to profit from the financial distress of homeowners. Acting as surrogate tax collectors, they can help local governments quickly and efficiently bolster their budgets by tens of millions of dollars and in some cases find new owners for dilapidated property. The 2010 Hollywood Style Awards: No Prizes For The Social Network Here

While critics and awards groups spent the weekend fawning over The Social Network , one star-studded awards show went down with little acknowledgment of the critical juggernaut. Last night, our parent company MMC helped honor film and television fashion at the 2010 Hollywood Style Awards with The Palazzo Las Vegas, Klipsch and FRS ® Healthy Energy® (Or, let’s say “The Hollywood Style Awards” for short). While they chose not to honor Mark Zuckerburg’s admirable tenacity to shorts and sandals, the event did yield a possible hint about Finn and Rachel’s relationship on Glee , news from Kate Bosworth that T-shirts are still in style and more. The Los Angeles Film Critics Awards & The American Film Institute Like The Social Network

Director David Fincher’s take on the creation of Facebook had a banner day today, as The Social Network was named the Best Film of the year by the L.A Film Critics Association and one of the top ten movies of the year by the AFI. Watch a Young Chelsea Handler Do Stand-Up Completely Unrelated to Angelina Jolie

Earlier this week when Chelsea Handler came under fire for calling Angelina Jolie a homewrecker during her stand-up routine, the E! hostess claimed that her digs weren’t anything new. “I’ve been making fun of Angelina Jolie since she made out with her brother! Jesse Eisenberg on Zombieland 2, Good Sequels and Missing John Ritter

Last week I met actor Jesse Eisenberg for a lengthy discussion of subjects ranging from his coming-of-age in the New York theater to his beloved Zombieland and his awards-season prospects for The Social Network. We covered a lot of ground, which I’ll be retracing this week in a five-part series here at Movieline. And so we arrive, sadly, at the end of our five-part journey with Jesse Eisenberg. By the time the actor and I reached this point, the done-to-death The Social Network had given way to… well, quite a few subjects. Justin Timberlake Injury Delays Filming On Sci-Fi Thriller ‘Now’

The movie will be on hiatus until singer/actor’s muscle injury heals. By Jocelyn Vena Justin Timberlake (file) Photo: Christian Petersen/ Getty Images Last week, Justin Timberlake was spotted on crutches after sustaining an injury on the set of his sci-fi thriller “Now.” And now, more details are emerging about what happened to the singer/actor when he attempted to do his own stunts on the set of the Amanda Seyfried and Olivia Wilde co-starring flick. Sources say they “heard a pop” in Timberlake’s leg, and E! News confirmed that Timberlake’s injury has temporarily shut down production on the film. A rep for the studio said in a statement, “Justin Timberlake sustained a muscle injury to his calf on the set of Andrew Niccol’s thriller ‘Now.’ Production has taken a brief hiatus and will resume shortly.” A set source told the website that the shutdown should last about two weeks. “He hasn’t heard anything about the MRI results,” the source added. “But they’re freezing production until he’s off crutches and able to act again.” Timberlake was spotted at the Arclight theater in Hollywood for a “Social Network” Q&A session last Thursday, and he seemed to be having trouble walking. The session took place shortly after he was injured. Timberlake has been making waves as an actor as of late thanks to his roles in “The Social Network” and “Friends With Benefits,” which also features Mila Kunis and Emma Stone. “I gotta tell you, breaking up with Justin Timberlake is really fun,” Stone recently told MTV News . “It’s a feel-good time. Nobody forced him to have his Department of Justice ignore the Bush administration's criminality. Nobody forced him to continue secret renditions or a policy of denying suspected terrorists the human right of due process. Nobody forced him to order his DOJ to appeal court rulings that would have ended Don't Ask Don't Tell. Nobody forced him to open a discussion about the deficit which even puts Social Security and Medicare on the table when the economy desperately needed and needs more Keynesian stimulus. Nobody forced him to keep on Bush's Defense Secretary. Nobody forced him to hire a neoliberal economic team and ignore the traditional liberal economists who had been almost alone in predicting the economic collapse. Justin Timberlake, who stars in the current hit The Social Network, suffered an injury to his calf muscle while filming his upcoming sci-fi thriller, Now this week. Looks like Justin Timberlake#39;s burgeoning career as a movie star is dangerous. A Fox rep tells us that production for the film, which also stars Amanda Seyfried, has taken a brief hiatus for the actor to recover but will resume shortly.
