Chris Brown Legal Drama Explained: Assault Cases, Probation Violations, Con Air & More

Chris Brown’s legal predicaments have gotten so confusing that they require a lengthy explanation to fully understand at this point. So here we go: Chris Brown Jailed Until at Least June After Trial Delay Brown has been on probation since accepting a plea deal in the 2009 attack on his ex-girlfriend Rihanna. That probation is set to end later this year. He was arrested last fall for assault in D.C. Because his probation requires him to obey all laws, a judge revoked his probation in the Rihanna case. However, after Chris pleaded not guilty to the D.C. attack on Parker Adams, a judge allowed him to seek treatment rather than sit in jail awaiting trial. He was kicked out of rehab and jailed in March, though, after violating the rules of the anger management rehab center he was assigned to by the court. In addition to its own legal ramifications, the D.C. case could lead to major penalties – potentially YEARS in prison – in the probation violation case. Ensnared in this tangled legal web, Brown has been shuttled from L.A. to D.C. via Con Air and now is heading back again in the custody of federal officers. The D.C. trial has been delayed because of the singer’s bodyguard, Christopher Hollosy , a key witness who was just convicted in the same incident. Hollosy says unless he is granted immunity, he will not testify in Brown’s case until he has exhausted the appeals process, which could take six months to a year. Hollosy had been widely expected to take the fall for his boss, accepting responsibility for attacking Adams, but this new delay might suggest otherwise. 23 Pics of Chris Brown Thuggin’ It! Franklin Burgess Jr. set a status hearing for the Chris Brown assault case for June 25, the same day as Hollosy’s sentencing. Until then, he will remain behind bars. L.A. Judge Victor Greenberg denied the request of Brown lawyer Mark Geragos to release him with the trial pending. Come June, he’ll be transported back to D.C. on Con Air again. Such is life for detainees who face criminal charges in two different U.S. jurisdictions. “I’m quite sure that Chris Brown would actually love not to be transferred via U.S. Marshal Service,” says Darren Kavinoky, an L.A.-based criminal defense lawyer. “I’m sure he’d much rather fly under his own power, via private jet, or even on a commercial flight in coach for that matter,” he adds … but that’s a no-go. Transporting prisoners via the Justice Prisoner and Alien Transportation System (better known by the nickname “Con Air”) is actually quite commonplace. JPATS transfers more than 350,000 prisoners and illegal aliens a year. The jets are owned or leased by the government and funded by the taxpayers. Kavinoky continues , “Since he’s in custody, this is standard operating procedure. It’s a common occurrence also with witnesses [for] cases other than their own.” In other words, Brown is not getting any special treatment here. Kavinoky adds, “This is not any sort of special celebrity treatment situation. Actually, I’d say that what’s happening here is the anti-celebrity treatment.” “Chris [is] getting a worse deal because the judge knows that the eyes of the world are upon him. When will people learn to watch what they say on Facebook? Former School Secretary Fired For Racist Obama Facebook Post If he had just kept his personal feelings to himself, he would still have a job. According to Raw Story: A former school secretary in Harlingen, TX sued the school district for firing him over a racist post on the social medium Facebook. Courthouse News Service reported that Abel Gonzalez believes that his right of free speech was infringed upon by the Harlingen Consolidated Independent School District. Gonzales’ suit, which was filed in the Federal Court in Brownsville on Monday, said, “On Saturday, August 25, 2012 at 9:08 a.m., plaintiff was at home on his own personal computer, when plaintiff received an e-mail from the Huffington Post’s Facebook page.” “The Facebook page had a picture of a little girl chasing President Obama in the Oval Office and beneath the picture were the words, ‘Caption this,’” the complaint continued. “Plaintiff wrote ‘Run N****r Run.’” A commenter on Huffington Post’s page named C. Orlando Pettiford saw Rodriguez’ racist post and copied and pasted it to the Dr. Rodriguez Elementary School Facebook page, the school where Gonzales worked as a secretary. On the same day, school principal Tracy Gonzalez [no relation to the plaintiff] received notice about the racist post. On September 7, 2012, School Superintendent Steve Flores placed Gonzales on administrative leave. Two weeks later, Gonzales was fired. He is suing the school district for $2 million in damages for “conspiracy, civil rights violations and violations of the First Amendment and due process violations, with an emphasis on the First Amendment claims,” said CNS. Luminita Perijoc, a 31-year old Romanian who prides herself on resembling Angelina Jolie, has been sentenced to four years in prison after stabbing a deliveryman six times. The incident occurred after she made this same man perform oral sex on her at knifepoint. According to court documents, the victim (Nicolae Stan) was delivering wine to Perijoc’s apartment when she threatened him with a four-inch blade and prompted him to undress. She demanded vaginal and oral sex from Stan and, when he was unable to get an erection for  a third go-around, she thrust her knife into him six times. The victim was somehow able to escape to Perijoc’s and call the police from his cell phone. A judge initially sentenced Perijoc’s to five years behind bars, but the sentence was reduced after she claimed to be on medication at the time of the attack. “I think she wasn’t used to anyone saying no because she flew into a rage when I declined,” Stan said . “When I refused she attacked me with a knife, and forced me to have sex with her but she still stabbed me.” Stan is a married father of three and says he understand folks may mock him for turning down someone who (sort of) looks like Angelina Jolie, but… They don’t understand why I refused her, but they do not know what it is like to have a mad woman yelling at you at knifepoint,” he said. “They look at her, then look at me and laugh. Colin Kaepernick Denies Involvement In Sexual Assault Case

San Francisco 49ers quarterback Colin Kaepernick is denying that he has any involvement in a criminal case following an incident in a Miami hotel room. TMZ reported yesterday that Kaepernick is being investigated in connection with an alleged sexual assault. “The charges made against me in the TMZ story and other stories I’ve seen are completely wrong,” Kaepernick tweeted yesterday. “They make things up about me that never happened.” Kaepernick didn’t specify what details of the story were inaccurate, though TMZ reports that their source in the Miami police department has changed his story , downgrading the incident from a “sexual assault” to a “suspicious incident.” Kaepernick followed up his earlier tweet by saying, “I want to thank all the people who have shared their encouraging sentiments. I assure you that your faith is not misplaced.” The NFL star seems unconcerned with the allegations against him and has been spotted partying at various nightclubs several times since the investigation began. Specifics about the incident remain scarce but according to TMZ, a woman claims she was naked in a bed with Kaepernick smoking marijuana and she later awoke in a hospital. The nature of her injuries are unknown.

It appears The Real Housewives of Atlanta star Kenya Moore may be having second thoughts about having a baby following the death of her beloved puppy. Or alleged death, depending on who you believe. Some crazy rumors on the Internets say Kenya Moore faked her dog’s death for ratings and sympathy. Anyway, opening up about her hectic lifestyle, Moore, 42, says on her Bravo blog that taking care of Velvet opened her eyes to what a huge job it is. “Speaking as someone who travels weekly, works constantly, and come and goes as I please, a puppy was a huge wakeup call,” Porsha Williams ‘ nemesis writes. “When I adopted Velvet, whom I affectionately call my puppy baby, it was the first time I ever had to take care of any living being in my life.” “Clearly, a dog is not a child and can never be mistaken as one,” she added, with the observation that “having a child is drastically different and life changing.” The former Miss USA reflected on her dysfunctional childhood and why she decided to educate herself about motherhood with a programmed baby doll. “Had there been the resources available to us today when I was born to 16 year-old parents in the ’70s things may be drastically different now,” she added. Kenya Moore: Did She Fake Dog’s Death? “It’s amazing that we have the resources that we do today.” “I wanted to be knowledgeable about the process and the [programmed doll] would be a formidable challenge. I took the process seriously as all mothers to be should.” “Perhaps if we had more sobering steps such as the programmable baby doll tool, there would be less unwanted pregnancies and abused children in the world.” Words to live by. Not ones that will lead to any reduced tensions when you watch The Real Housewives of Atlanta by any means, but wise ones just the same.

Lady Gaga may have sung about the paparazzi early in her career, but from now on she’ll only be serenading paps who follow her strict instructions. According to the New York Post , Gaga has started issuing demands to photo agencies , giving them exclusives in exchange for their promise to Photoshop her pics according to her specifications.  Photographers at a Gaga event last week were reportedly told to “smooth out her jaw line and thin her arms” as well as “smooth out and thin her legs.” So much for “born this way!”  Some photographers and event planners are getting fed up, with one coordinator anonymously describing Gaga as a “control freak.”  Others don’t seem to mind the demands and are likely grateful for the exclusives.  Kevin Mazur – a photographer who gained sole rights to photograph Gaga’s final show at the Roseland Ballroom – says similar demands aren’t all that uncommon. “It’s like any other artist I work with and it’s very minimal because we want to get the photos out there right away,” said Mazur. “She caters to the paparazzi like no other artist I’ve seen.” Sounds like someone wants to keep getting those exclusives! But not every celebrity shares Gaga’s view on photo enhancement.
