George Zimmerman’s Defense Team Requests A New Trial Judge Former self-appointed neighborhood watchman George Zimmerman is now requesting a new judge be appointed to handle his murder trial. George Zimmerman, accused of murdering 17-year-old Trayvon Martin, filed a motion on Friday to disqualify the judge that will preside over his case, citing his fear that he will not be given a fair trial. Zimmerman, via his attorney, Mark O’Mara, filed the 17-page document with the Seminole County Circuit Court. The motion is a response to Judge Kenneth Lester’s July 5 order that set $1 million bail for Zimmerman and claimed that Zimmerman had “flaunted the system” and practiced “deception upon the court.” It was the second time Lester granted Zimmerman bail. Lester revoked a previous $150,000 bail in April after prosecutors presented evidence that Zimmerman and his wife misled the court about how much money they had available by speaking in code on phone calls. Prosecutors added that Zimmerman initially lied about the existence of a second passport. O’Mara recently tried to appeal to the judge that Zimmerman was confused and fearful back in March when the alleged deception occurred. In a second bond hearing in June, O’Mara reiterated that Zimmerman had voluntarily turned himself in to the court and now was completely open regarding his financial ability. Lester, however, in that July 5 bail order, remained skeptical of Zimmerman’s motives and expressed irritation at being lied to. He accused Zimmerman of manipulating the court and even suggested that if Zimmerman had the opportunity he would have fled prosecution. In Friday’s motion, O’Mara wrote that Lester’s order was indicative of a bias against Zimmerman, saying that the judge’s statements were “disingenuous, self-serving manipulations.” First you want out of jail, now you want a new judge. George Zimmerman To Turn Himself In George Zimmerman has returned to Florida and will turn himself in to authorities by Sunday’s deadline after a judge revoked his bond in the Trayvon Martin case, an attorney said. Attorney Mark O’Mara announced Zimmerman’s return on his website Sunday, saying Zimmerman arrived late Saturday evening. Zimmerman, who is charged with second-degree murder in the fatal shooting of the 17-year-old Martin, was ordered by a judge Friday to return to jail. The press release on the website said the deadline for his surrender is 2:30 p.m. Sunday. The judge revoked Zimmerman’s bond, suggesting he and his wife had not been honest about their finances. During a bond hearing in April, the couple had indicated they had limited funds. But prosecutors say Zimmerman had raised thousands through a website he had set up for his legal defense. Zimmerman’s legal team said Sunday that they will ask for a new bond hearing to address those concerns, and that they hope Zimmerman’s voluntary surrender will show he is not a flight risk. Furthermore, the money Zimmerman has raised is in an independent trust and cannot be directly accessed by Zimmerman or his attorneys, according to the press release. Zimmerman has pleaded not guilty to the second-degree murder charge. He maintains he shot Martin in self-defense under Florida’s so-called “stand your ground” law because the teen, who was unarmed, was beating him up after confronting Zimmerman about following him in a gated community outside Orlando. Zimmerman’s credibility could become an issue at trial, legal experts said, noting the case hinges on jurors believing Zimmerman’s account of what happened the night in February that Martin was killed. Zimmerman was arrested 44 days after the killing, and during a bond hearing in April, his wife, Shellie, testified that the couple had limited funds available. Zimmerman took the stand at the hearing and apologized to Martin’s parents. Prosecutors pointed out in their motion that Zimmerman had $135,000 available then. It had been raised from donations through a website he had set up. They suggested more has been collected since and deposited in a bank account. Shellie Zimmerman was asked about the website at the hearing, but she said she didn’t know how much money had been raised. Circuit Judge Kenneth Lester set bail at $150,000. The 28-year-old was freed a few days later after posting $15,000 in cash — which is typical. Prosecutor Bernie De la Rionda complained Friday, “This court was led to believe they didn’t have a single penny. It was misleading and I don’t know what words to use other than it was a blatant lie.” The judge agreed and ordered Zimmerman returned to jail by Sunday afternoon. The defense countered that Zimmerman and his wife never used the money for anything, which indicated “there was no deceit.” The judge said he would schedule a hearing after Zimmerman is back in custody so he could explain himself. Benjamin Crump, an attorney for Trayvon Martin’s parents, Tracy Martin and Sybrina Fulton, said his clients have always said Zimmerman should remain in jail until trial. Wait, what?!?! Alan Dershowitz Says George Zimmerman Had A Right To Kill Trayvon Martin A medical report by George Zimmerman’s doctor has disclosed that Zimmerman had a fractured nose, two black eyes, two lacerations on the back of his head and a back injury on the day after the fatal shooting. If this evidence turns out to be valid, the prosecutor will have no choice but to drop the second-degree murder charge against Zimmerman — if she wants to act ethically, lawfully and professionally. There is, of course, no assurance that the special prosecutor handling the case, State Attorney Angela Corey, will do the right thing. Because until now, her actions have been anything but ethical, lawful and professional. She was aware when she submitted an affidavit that it did not contain the truth, the whole truth and nothing but the truth. She deliberately withheld evidence that supported Zimmerman’s claim of self-defense. The New York Times has reported that the police had “a full face picture” of Zimmerman, before paramedics treated him, that showed “a bloodied nose.” The prosecutor also had photographic evidence of bruises to the back of his head. But none of this was included in any affidavit. Now there is much more extensive medical evidence that would tend to support Zimmerman’s version of events. This version, if true, would establish self-defense even if Zimmerman had improperly followed, harassed and provoked Martin. A defendant, under Florida law, loses his “stand your ground” defense if he provoked the encounter — but he retains traditional self-defense if he reasonably believed his life was in danger and his only recourse was to employ deadly force. Thus, if Zimmerman verbally provoked Martin, but Martin then got on top of Zimmerman and banged his head into the ground, broke his nose, bloodied his eyes and persisted in attacking Zimmerman — and if Zimmerman couldn’t protect himself from further attack except by shooting Martin — he would have the right to do that. (The prosecution has already admitted that it has no evidence that Zimmerman started the actual fight.) Wish we could say we are surprised, but we already know that there are a bunch of people that think that it’s cool for some scary-a$$ 28 year-old man to shoot a 17 year-old. Martin’s death sparked public outrage after police released Martin’s shooter, George Zimmerman, without any criminal charges for the killing. Zimmerman, 28, is a multi-racial Hispanic man who shot the black high school junior at close range on Feb. 26, and claimed self-defense, though Martin was unarmed. Zimmerman was later charged with second-degree murder, and the killing provoked widespread debate about racial profiling The autopsy report shows traces of the drug THC, which is found in “kush”, in Martin’s blood and urine. The autopsy also shows that Zimmerman shot Martin from a distance of between 1 inch and 18 inches away, bolstering Zimmerman’s claim that he shot Martin during a struggle that landed Zimmerman on his back, Martin straddling him and banging Zimmerman’s head on the ground. Martin’s autopsy report also revealed that there was a quarter-inch by half-inch abrasion on the left fourth finger of Martin, another indication of a possible struggle. The teen, who lived in Miami, was in Sanford while serving a suspension for a bag of maryjane being discovered in his possession. Slowly but surely the facts are starting to come out about this tragic night. Not only did the official autopsy find that drugs were found in Trayvon’s system, it’s also come to light that Zimmerman’s fatal bullet was fired from within a very close distance, which suggests that his claims of the night may be withstanding.
