NSA Executive Leaked After Official Reporting Process Failed Him | Threat Level | Wired.com

A former NSA executive who is fighting government charges of leaking classified information was part of a group that pursued several sanctioned paths to report concerns about an agency spy program, but was repeatedly frustrated by the government’s inaction, according to a report Wednesday. Thomas Drake, now reduced to working at a Washington, D.C.-area Apple store while awaiting his trial, first notified his superiors at the National Security Agency, then looked to Congress to address his concerns, and finally worked with a group that went to the Defense Department’s inspector general, according to The Washington Post. When all of these avenues failed to net results, he took his information to a reporter at The Baltimore Sun. Drake now faces a maximum sentence of 35 years in prison if convicted of mishandling classified information and obstructing justice. Drake’s information involved a data-mining program called ThinThread that, after the Sept. 11 attacks, was going to be replaced by a more expensive, less efficient and less privacy-friendly program called Trailblazer. When he expressed concerns that the new program would ignore constitutional safeguards around wiretapping, he was reportedly rebuffed by his superiors. “He tried to have his concerns heard and nobody really wanted to listen,” attorney Nina Ginsberg, who is representing a former Capitol Hill staffer but is not representing Drake, told the Post. Drake began working for the NSA in 1989 as a contractor. His job was to evaluate software programs for the agency. In 2001, on the morning of Sept. 11 to be exact, he began a new job as a senior executive at the NSA overseeing the office of change leadership and communications, the Post says. ThinThread was developed for the NSA in the ’90s to mine massive amounts of digital data collected by the agency and find patterns. One of the existing program’s key features was a privacy component that anonymized collected data through encryption. The identifying information would only be decrypted if authorities gained sufficient evidence to obtain a warrant. Although the mere collection of domestic data was still illegal without a warrant, Drake apparently approved of the product as long as the anonymization feature was in place. But after Sept. 11, NSA director Michael Hayden opted instead for the $1.2 billion Trailblazer program, which was believed to have more robust capability to handle larger volumes of data, but which had none of the privacy safeguards present in ThinThread. Three of Drake’s superiors now say that he never mentioned his concerns about constitutional safeguards to them, but career NSA employees back Drake’s story, according to the paper. They took their concerns to congressional leaders and staffers, including Diane Roark, a Republican staff member of the House Intelligence Committee. Roark contacted Chief Justice William H. Rehnquist, who was responsible for appointing judges to the Foreign Intelligence Surveillance Court — the court that oversees requests for national security surveillance warrants. But Rehnquist apparently was a dead end. Roark also had no luck with her boss, House Intelligence Chairman Porter Goss (R-Florida). Instead of performing his congressional oversight duty, Goss simply sent her along to NSA chief Hayden, who told her: “We’re proud of what we’re doing and how we’re doing it.” That’s when Roark and former NSA employees who sided with Drake took their concerns to the Defense Department’s inspector general. They reported that the NSA had shelved ThinThread in favor of a program that cost 10 times as much and was less effective. An administrative investigation was spawned by their complaint, as well as two criminal fraud investigations. The inspector general’s report was completed in December 2004 but was classified and led to no action. It was Roark who suggested Drake contact a reporter at that point. A month later, in December 2005, The New York Times reported its groundbreaking story disclosing that the NSA had been spying on Americans, based on information from anonymous sources. Drake decided he should come forward with his information as well. He contacted Siobhan Gorman at The Baltimore Sun, using Hushmail, an encrypted e-mail service. They communicated for a year without Drake identifying himself, before they finally met in person. Drake allegedly provided Gorman with scans of classified documents, from which she wrote an article questioning the NSA’s replacement of ThinThread with Trailblazer and its abandonment of privacy safeguards. Drake later told New Yorker investigative reporter Seymour Hersh that the story was actually much more significant than what The Baltimore Sun reported. Drake’s attorney, a public defender, says the government’s allegations against his client are factually wrong and miss important principles suggested by the case. “Throughout, Tom Drake has tried as best he could to do the right thing in service of his country,” Jim Wyda told the Post. “His motives in this important matter are completely pure.” added by: toyotabedzrock

The timing of today’s announcement from the Swiss that fugitive director Roman Polanski will not face extradition  to the United States coming just a couple days after we all witnessed Hollywood’s reaction to the audio tape of Mel Gibson’s raging, racist rant is fitting. What an interesting opportunity for a side-by-side look at Leftist Hollywood’s values. It’s unlikely that anyone who’s considered a serious part of the Hollywood community will openly work with Mel Gibson again for a long, long time — if ever. WME, his agency, announced they had dropped him  as a client within minutes of the release of the recording, and courtesy of the L.A. Times, the warning has already gone out making clear that anyone foolish enough to work with Gibson again will pay a heavy price: There’s little chance he’ll land at another agency anytime soon — signing would bring down a horrible avalanche of bad PR to any agency that got within smelling distance and, more to the craven point, any agent that signs him has little hope of booking him any roles anyway since there isn’t a studio in town that will hire Gibson. So toxic is the “Braveheart” director that the L.A. Times also “ suggested ” that now would be a “good time” for Tinseltowners to loudly and proudly condemn the former superstar, and a special point was made to single out his longtime friend Jodie Foster (who just finished directing a film that stars Gibson): Actually, strike that, because even now the silence is deafening. This would seem like a good time to make a public statement, Jodie Foster, longtime friendship or not. While I find the L.A. Times’ stand-up-and-be-counted witch huntery a little nauseating, it pales in comparison to Gibson’s sub-human attempt to emotionally break the mother of his child in two with a stream of racist-fueled hate unlike anything I’ve heard before. This is a fool-me-once situation if there ever was one. Like many, I bought Gibson’s contrition tour after his sexist, anti-Semitic tirade in 2006. But how anyone could work with him now is beyond me, and no one in Hollywood is likely to. And yet, who will Hollywood work with? As I write this, Charlie Sheen is about to once again enjoy the superstar treatment on the set of his hit sitcom “Two and a Half Men” even though reports suggest he’s about to plead no contest to charges of domestic violence after allegedly pinning his wife to a bed with a knife to her throat. And today, throughout much of Tinseltown , you can hear the exhales of relief and imagine the quiet celebrating now that their favorite child rapist is once again free to move about the world amongst all the beautiful people eager to worship him. Leftist Hollywood should consider themselves lucky The Fates gave them an entire weekend to feel all sanctimonious and superior about themselves over the Mel Gibson situation before reminding them of what they really are with today’s Polanski news. ‘Perfect Citizen’ Program Places ‘Sensors’ Throughout Web

The federal government is launching an expansive program dubbed “Perfect Citizen” to detect cyber assaults on private companies and government agencies running such critical infrastructure as the electricity grid and nuclear-power plants, according to people familiar with the program. The surveillance by the National Security Agency, the government’s chief eavesdropping agency, would rely on a set of sensors deployed in computer networks for critical infrastructure that would be triggered by unusual activity suggesting an impending cyber attack, though it wouldn’t persistently monitor the whole system, these people said. Defense contractor Raytheon Corp. recently won a classified contract for the initial phase of the surveillance effort valued at up to $100 million, said a person familiar with the project. An NSA spokeswoman said the agency had no information to provide on the program. A Raytheon spokesman declined to comment. ‘Doomsday Ark’ to be Housed on the Moon

If the human species should be destroyed on Earth, our future may reside on the Moon if plans.being drawn up for a “Doomsday ark” on the moon by the European Space Agency are carried through. The Ark will contain the essentials of life and human civilization, to be activated in the event of earth being devastated by a giant asteroid or nuclear war. The construction of a lunar information bank, discussed at a conference in Strasbourg last month, would provide survivors on Earth with a remote-access toolkit to rebuild the human race. A basic version of the ark would contain hard discs holding information such as DNA sequences and instructions for metal smelting or planting crops. It would be buried in a vault just under the lunar surface and transmitters would send the data to heavily protected receivers on earth. if no receivers survived, the ark would continue transmitting the information until new ones could be built. The vault could later be extended to include natural material including microbes, animal embryos and plant seeds and even cultural relics such as surplus items from museum stores. As a first step to discovering whether living organisms could survive, European Space Agency scientists are hoping to experiment with growing tulips on the moon within the next decade. The first flowers – tulips or arabidopsis, a plant widely used in research – could be grown in 2012 or 2015 according to Bernard Foing, chief scientist at the agency’s research department. Tulips are ideal because they can be frozen, transported long distances and grown with little nourishment. Combined with algae, an enclosed artificial atmosphere and chemically enhanced lunar soil, they could form the basis of an ecosystem. The first experiments would be carried out in transparent biospheres containing a mix of gases to mimic the earth’s atmosphere. Carbon dioxide given off by the decomposing plants would be mopped up by the algae, which would generate oxygen through photosynthesis. The databank would initially be run by robots and linked to earth by radio transmissions. Scientists hope to put a manned station on the moon before the end of the century. The databank would need to be buried under rock to protect it from the extreme temperatures, radiation and vacuum on the moon. It would be run partly on solar power. The scientists envisage placing the first experimental databank on the moon no later than 2020 and it could have a lifespan of 30 years. The full archive would be launched by 2035.
