Federal Judge To Dismiss Second BLM Suit

BATON ROUGE, La. (AP) — A federal judge says he intends to dismiss a lawsuit that accuses Black Lives Matter and several movement leaders of inciting violence that led to a gunman’s deadly ambush of law enforcement officers in Baton Rouge last year. U.S. District Judge Brian Jackson issued that warning in an order Wednesday, less than a week after ruling Black Lives Matter is a social movement and therefore can’t be sued. Last Thursday, Jackson threw out a police officer’s lawsuit blaming Black Lives Matter and movement leader DeRay Mckesson for injuries he sustained during a protest over a deadly police shooting in Baton Rouge last year. The officer’s lawyer also attempted to add “#BlackLivesMatter” as a defendant, but Jackson ruled a hashtag can’t be sued either. Now the judge is vowing to dismiss a separate suit filed on behalf of a sheriff’s deputy wounded in the July 2016 attack that killed three other officers in Baton Rouge. The same Baton Rouge-based attorney, Donna Grodner, filed both suits. The judge is giving her until Oct. 13 to respond to his order and present arguments why the deputy’s case shouldn’t be dismissed. Grodner declined to comment Thursday on the judge’s order or say whether she plans to appeal last week’s ruling. Mckesson, a Baltimore, Maryland, resident and four other Black Lives Matter leaders were named as defendants in the suit that Grodner filed on behalf of one of the officers wounded in the July 17, 2016, attack by Gavin Long, a black military veteran from Kansas City, Missouri. The suit doesn’t name the plaintiff, but its description of the wounded officer matches East Baton Rouge Parish Sheriff’s Deputy Nicholas Tullier, who was has been at a Houston rehabilitation hospital since November. Long, a 29-year-old former Marine, was armed with a semi-automatic rifle when he killed three officers and wounded three others outside a convenience store and car wash near Baton Rouge police headquarters before he was shot dead. Long had posted rambling internet videos calling for violence in response to police treatment of African-Americans, which he said constituted “oppression.” He apparently posted a YouTube video from Dallas on July 10, three days after a sniper killed five officers and wounded nine others there. The attack came less than two weeks after a white Baton Rouge police officer shot and killed Alton Sterling, a 37-year-old black man. Mckesson was one of nearly 200 people arrested in Louisiana’s capital at nightly protests after Sterling’s death. The wounded deputy’s lawsuit claimed Mckesson was “in charge of” a July 9 protest that “turned into a riot” and described Long as an “activist whose actions followed and mimicked those of” the sniper who killed officers in Dallas, But the judge said that latter claim is “not altogether relevant.” Otherwise, the judge wrote, the lawsuit is “devoid of any facts that tend to demonstrate that any of the named Defendants, in particular, are liable for the alleged injuries suffered by Plaintiff, even assuming that those Defendants have the capacity to be sued.” Later Thursday, Mckesson tweeted a link to The Associated Press story on the judge’s order, saying “I’m happy to get both of these lawsuits behind me as I did nothing wrong in either case.”   Like BlackAmericaWeb.com on  Facebook . Scooter Braun on Justin Bieber: He Was Effed Up, People!

Think Justin Bieber hit rock bottom back in 2014? Think the singer was a complete mess after he was arrested for drunk driving and after he constantly berated the paparazzi and didn’t even seem to care one bit about his fans? You actually have no idea, Scooter Braun now says. Braun, who has served as Bieber’s manager throughout the course of his career and who has been tight with the artist for years, opened up this week to The Wall Street Journal Magazine. The topic? Bieber. Specifically, the depths to which Bieber plummeted during his fairly recent struggles. “It was worse than people realized,” Braun told the publication. “I failed him day after day. We were living in hell because he was in such a dark place.” In January of 2014, Bieber was arrested for drunk driving . The incident seemed to be the culmination of a downward spiral in which Bieber partied too much and drove too fast. However, Braun says here that things continued to get worse for the superstar over the next several months. “I have inconveniences, and other people have problems. Mine feel important, but they’re not. They’re not life or death,” Braun told The Wall Street Journal crypically, prior to adding: “Justin’s stuff got to a point where it was a problem.” Based on that phrasing,it sounds like it was a life or death problem. Yikes . “Some of the biggest people in the industry, people invested in Justin’s career, told me, ‘It’s over. Focus on something else. That kid is done,'” Braun explained. But the manager has been with Bieber since Justin was a young teenager. He wasn’t about to abandon his friend when he was needed the most. “I made a promise to him when he was 13 that I would never give up on him. I plan on keeping that promise.” Added Braun: “He’s family. I think the relationship is more like a big brother, especially because he’s become a man. “I think he’s seen the worst of himself, and to watch him rise out of it was amazing.” Has Bieber risen out of it? We guess so. He hasn’t been arrested in years and his fans still love him. But he’s taken a strange break from making music and folks still have no idea why he let down so many people when he canceled his tour this year .   A ctivists are getting paid from protests surrounding the death of Kenneka Jenkins in a suburban Chicago hotel earlier this month, according to the teenager’s mother. “I’m ending y’all’s agendas that’s not righteous toward my child,” Tereasa Martin accused the activists in a video posted to Facebook on Sunday night. READ MORE: Kenneka Jenkins’ Mother Announces Funeral Date Martin’s claim seemingly targeted one person in particular who has been organizing daily protests outside of the Crowne Plaza hotel in Rosemont, Illinois, where Jenkins’ body was found frozen in a walk-in storage freezer on September 9. “Who else could she have been talking about?” Jedidiah Brown asked the Chicago Sun Times during a recent interview. Brown told the Sun Times that he had raised more than $6,000 to supplement any relevant legal fees. Meanwhile, details of the Rosemont Police Department’s investigation into Jenkins’ death have been scarce while authorities await autopsy results. The cause of death has not yet been revealed and there is no surveillance footage of her entering the freezer. The absence of both have prompted a whirlwind of conspiracy theories , which authorities have said only slowed their investigation. Martin has pleaded for the FBI to intervene and launch its own independent probe, but Rosemont police declined the participation of the federal agency. See Martin’s full Facebook video below. In Cobb County, Georgia neighbors are upset about body hanging from a noose in another neighbors front yard as part of Halloween decorations. The front yard is decorated with tombstones witches, skeletons and a hooded body with its hands and feet tied hanging from a noose. “I just feel like Halloween is not an excuse to use that kind of symbolism,” says a neighbor who asked to remain unknown. According to WSB-TV Atlanta , the woman noticed it while out for a walk on Monday, September 25, 2017. Shocked by the decoration, she took a picture and shared it, She was hoping to start a conversation about it as it’s a terrible reminder of lynching in America. Carl Willis a reporter for WSB-TV went up to the house to see if he could get an answer for the decorations. A man answered saying that it was his roommates. He gave information to contact his roommate but nobody answered any calls. The anonymous neighbor was afraid to go up and ask saying, “What’s even scarier is people are going to ask, ‘well, did you go up and ask them?’” She continued, “I felt scared to go to their front door because I don’t know what kind of people live in that household.” Other neighbors commented saying they didn’t see the problem with the decoration. “This is 2017. We need to change it, and if that is your typical Halloween decoration, then it’s absolutely not okay,” she said. “It was not okay when we did it back in the day, and it’s not okay now.” When Willis returned to the house for a response the decoration was taken down. He expressed his support in a random Instagram post on Friday. “I am a white Canadian and I will never know what it feels like to be an african American,” he started. “But what I do know is I am willing to stand up and use my voice to shine light on racism, because it’s a real thing and it’s more prevalent now than I have ever seen in my lifetime.. we are all Gods children and we are ALL EQUAL.” Bieber has a questionable history when it comes to race issues. From being caught on video saying the N-word , to being heavily influenced by Black culture , the singer has rarely gotten political when it comes to issues that actually impact Black peoples lives. But now it seems like the tides might be turning. Can we expect the Biebs to become more vocal in the future? After word spread about Trump’s remarks on Friday, several NFL players and activists took to Twitter to let him know that his comments were uncalled for and that he could have a football stadium full of seats.
