Chris Brown has countersued a man who has accused the R&B star and his entourage of attacking him at a recording studio earlier this year. The singer filed an assault and battery lawsuit against Sha’keir Duarte, who claimed in an earlier suit that he was injured when a fight involving Brown. The melee erupted between Chris Brown and Frank Ocean ‘s entourages back in January outside a West Hollywood studio. No charges were filed. Duarte’s lawsuit filed in August accused Brown of being the aggressor in the fight, during which a gay slur was allegedly hurled at the bisexual Ocean. Brown’s countersuit, however, claims Duarte instigated the brouhaha by pushing, kicking and punching the R&B singer and threatening to kill him. Brown’s lawsuit seeks unspecified damages, while Duarte’s attorney Joseph Porter III did not immediately return a phone message seeking comment. Chris is currently in rehab for anger management , following his most recent arrest at a D.C. hotel, where he was charged with misdemeanor assault. Chris Brown has checked into a rehab facility to seek treatment for anger management issues in the wake of his arrest last weekend, according to reports. Brown’s attorney, Mark Geragos, dropped him off at an L.A. treatment center, presumably to deal with his rage issues – and stave off a prison sentence. Perhaps Breezy heeded Mike Tyson’s advice ? “Chris Brown has elected to enter a rehab facility,” said a statement Tuesday night from his rep. There is no indication of substance abuse issues. Only rage. “His goal is to gain focus and insight into his past and recent behavior, enabling him to continue the pursuit of his life and career from a healthier vantage point.” The L.A. County Probation Department is proceeding with an investigation to determine if Brown violated his probation in the 2009 Rihanna case. By getting arrested for assault for allegedly punching some guy in the nose, Chris could have his probation, and freedom, revoked. Conviction or not. Due to the victim’s injuries being less than severe and conflicting witness accounts, the felony charge against him has already been reduced to a misdemeanor. It’s the probation that’s the real problem for Chris, though, not this case. The embattled 24-year-old star flew to L.A. after getting released from the D.C. jail and met with L.A. County Probation Department officials today. Following his conviction for assault for his attack on Rihanna , he was given five years’ probation, which requires him to do community labor and obey all laws. Not done and not done. At best, the R&B singer is on thin ice at this point. It’s likely the Probation Department will conclude Brown violated his probation , and a judge could sentence him to as much as four years in prison. However, a judge could also withhold a decision until after the D.C. case plays out. In which case, the rehab move could show good faith and contrition. Chris Brown Fight: Who Threw the First Punch?

Chris Brown did not throw the first punch in the fight that got him arrested and thrown in jail, according to the initial draft of the police report that was filed. The report was then corrected to indicate that he did, but it seems there’s a good deal of confusion surrounding the melee that broke out early Sunday. Initially, the report described Chris’ bodyguard as the person who threw the punch that broke the alleged victim’s nose, while Chris jumped in afterward. However, a revised copy of the report says it was the singer who landed the bone-crushing blow; Chris Brown was arrested for felony assault in D.C. To make things even more confusing, police recorded Chris, his bodyguard, the alleged victim, and other witnesses describing who hit whom in the fracas. Law enforcement sources believe that some of the people involved may be stretching the truth or outright lying, so the confusion is clearly a problem. Chris Brown Accused of Assault Look for Chris’ attorney to make the police report correction and any discrepancies in the investigation a key point of his defense, if it comes to that. We still haven’t heard his side of the story in any official capacity. The accuser says Chris freaked after he was photobombed. Brown sources say he was just trying to keep couple of guys from trespassing on his tour bus. Chris faces up to four years in prison for violating his probation, which he’s still on for beating Rihanna, regardless of what happens in this assault case. Judging by the reaction on Twitter , he’s already losing in the court of public opinion … and maybe even with the girl who stood by him for so long, Karrueche Tran .

Chris Brown Assault Charge Reduced; Star Faces Misdemeanor, Free Without Bail

The assault charge against Chris Brown, filed after his arrest early Sunday morning, has just been reduced from a felony offense to a misdemeanor. Chris has been released from jail, where he had been for about 36 hours, with no bail. He is required to stay 100 yards away from the alleged victim. Brown will not be required to take a drug test, as often stipulated in such cases. His bodyguard’s charge was also reduced to a misdemeanor. The controversial 24-year-old was arrested for felony assault in Washington D.C. after allegedly attacking a man outside a hotel and breaking his nose. Brown had been in custody since, though it’s unclear who threw the first punch , and the reduced charge certainly indicates some of that uncertainty. Law enforcement sources have indicated that the fight started when the man and his friend photobombed Chris, who was posing for a picture with two girls. The victim says the same in his official statement, claiming he was trying to get a picture with Chris when Brown allegedly said, “I ain’t down wit that gay s–t.” The victim says he responded by saying to Chris, “Why you hoing?” Chris then said, “I feel like boxing” and hit him in the face. Then, he says, he went to square off with Chris when the bodyguard also hit him in the face. According to the victim, who suffered a broken nose, after the bodyguard punched him, the R&B star got behind the bodyguard , screaming, “Yeah, walk away.” Sources close to Chris insist it wasn’t over a photo, though, and that the guy tried to get on Chris’ tour bus, and Chris was just trying to stop a trespass. In his witness statement, Chris DENIES punching the victim and says he was on the bus when the victim tried getting on and his bodyguard “handled it.” Brown, who recently broke up with Karrueche Tran , faces certain jail time if found to be in violation of his probation for beating Rihanna back in 2009. He could theoretically have his probation revoked without a conviction, but the more likely scenario is that probation officials will see how this plays out.

Brown was arrested for felony assault early Sunday, having allegedly punched a guy in the face and broken his nose. He is due in court this morning. Chris Brown’s latest saga gets a bit deeper… According to TMZ reports : Chris Brown was arrested in Washington D.C. this morning for FELONY assault after allegedly attacking a man outside a hotel … TMZ has learned. Law enforcement sources tell TMZ … at around 4:30 AM Brown got into an argument with a man outside the W Hotel on K Street and allegedly punched him once in the face. We’re told the alleged victim never threw a punch. The alleged victim tells TMZ … he and a friend were hanging out at the W when they saw 2 women about to take a picture with Brown. The victim — who says he’s not a Chris Brown fan — says he and his buddy photo bombed the 2 women and Chris went nuts, punching him in the face and BREAKING HIS NOSE. He went to the hospital and says he may need surgery as early as tomorrow. Law enforcement sources and the alleged victim tell TMZ … before striking the man, Chris said, “I’m not into this gay s**t, I’m into boxing.” After Chris punched the man, the fight was taken to the ground. SMH…Chris just HAD to add that to quip to upgrade his fade to another charge. Sources connected with Chris tell TMZ … the alleged victim is full of BS. He was NOT trying to take a pic with Chris … he was trying to get on Chris’ tour bus, and Brown was simply trying to stop a trespass. The sources say before the incident the 2 girls tried to get on the bus but they were stopped, and that’s when the victim and his friend made their move. Law enforcement sources say Chris did not appear to be under the influence of anything. Chris and his bodyguard — who was also arrested — will stay in jail today. Under DC law Brown can’t get bail so he’ll appear before a magistrate Monday, and until then he’ll stay behind bars. The alleged victim tells TMZ he doesn’t understand why Brown was “so homophobic” to hurl such a slur. And get this … the victim says he would have accepted an apology at the scene, but now he will absolutely press charges — and he’s already hired a lawyer. Chris Brown has been arrested for felony assault. Insiders tell TMZ that an incident took place around 4:30 a.m. in Washington D.C., as Brown allegedly got into a fight with a man outside the W Hotel and started punching him repeatedly. It is not believed that the singer was under the influence of drugs or alcohol at the time. As of this writing, the 24-year-old R&B star is in police custody, while the victim is being treated for injuries at a local hospital. The artist, of course, remains under probation for his felony beating of Rihanna in 2009 and this arrest may be grounds for a violation of those terms. If so, he could be sentenced for at least four years in prison. Prior to the altercation, Breezy – who claims he’s a beast at sex – had been hosting a party at a nightclub nearby. Return to THG throughout the day for more details … UPDATE : According to reports, a woman approached Chris Brown in front of the W Hotel and asked to take a picture with him. The singer obliged. However, just as the picture was about to be taken, two men rushed over to get in the photo. It’s unclear why, but the situation quickly turned violent. The star allegedly, said, “I’m not into this gay s–t, I’m into boxing,” and hit the alleged victim in the face. Reports say the man Chris hit never threw a punch.
