Sly Stone of Sly and the Family Stone was arrested for cocaine possession recently. He is 68 years old. Sly was due in court today to face the charge. Stone, a.k.a. Sylvester Stewart, got popped after LAPD officers say they found freebase cocaine on the old school rocker during a vehicle search. Sly’s attorney, James Silverstein, says Stone was riding in a buddy’s camper vehicle with some friends when a routine traffic violation occurred. That’s George Clinton behind sly. Both look Stoned . During the stop, Silverstein says, cops searched the vehicle and found the coke. Stone was arrested and hauled to a nearby police station. “The evidence is clear that the vehicle was not his,” Silverstein said. “I believe that this case his highly defensible, and Stewart should never had charges filed against him. We firmly believe the DA will lose this case.” We’ll have to wait until next week to find out it looks like. Stone is battling heart problems and could not make it to court today. A federal appeals court on Wednesday refused to allow gay marriages to take place in California while it considers the constitutionality of the state’s voter-approved ban. California Attorney General Kamala Harris had joined gay marriage proponents in urging the 9th U.S. Circuit Court of Appeals to lift a stay that had been placed on a lower court’s ruling to strike down Proposition 8. They argued that the U.S. District Court ruling overturning the ban should be honored while the appeal, which they believe is unlikely to succeed, slowly make its way through the courts. “We felt then, as we do now, that it is decidedly unjust and unreasonable to expect California’s gay and lesbian couples to put their lives on hold and suffer daily discrimination … while their U.S. District Court victory comes to its final conclusion,” said Chad Griffin, board president of the American Foundation for Equal Rights, in a statement. In a letter to the court earlier this month, Harris said sponsors of Proposition 8 were unlikely to prevail in their appeal. Keeping it in effect, therefore, was a fruitless violation of gay Californians’ civil rights, Harris said. “The public interest weighs heavily against the government sanctioning such discrimination by permitting it to continue,” she wrote. The nutcases who like to picket soldiers funerals are threatening to protest at Elizabeth Taylor’s service because of her work with HIV/AIDS and gay rights groups. The anti-gay fundamentalist Westboro Baptist Church said on Wednesday that it plans on picketing Elizabeth Taylor’s funeral. Margie Phelps, daughter of church leader Fred Phelps, tweeted the picket plan and referred to Taylor as a “serial-adulterous fag hag.” The apparently very Internet-savvy Phelps also tweeted, “No RIP Elizabeth Taylor who spent her life in adultery and enabling proud f-gs. They cuss her in hell today. #Westboro will picket funeral!” Westboro has made funeral picketing threats before — in the case of both Heath Ledger and Natasha Richardson — but thankfully failed to show in either case. That was enough to keep veteran punks Rise Against down at #2 with the debut of their latest, Endgame, which sold 85,000 copies to edge out last week’s #1, Lupe Fiasco ‘s Lasers, which sits at #3 on sales of 47,000 as sales dropped by 77 percent. The only other debut in the top 10 comes from Blink-182 drummer Travis Barker , whose all-solo bow, Give the Drummer Some, lands at #9 (28,000). That’s according to TMZ , who reported Tuesday that Lohan — charged in early February with felony grand theft after allegedly taking a $2,500 necklace from a Venice, California, jewelry store — had met with her lawyer, Shawn Holley, and opted not to take a plea being offered by the Los Angeles County District Attorney’s office. She will now proceed to trial before Judge Stephanie Sautner; a preliminary hearing in the case is set for April 22. Late last month, Lohan was told by Judge Keith Schwartz that had she accepted the DA’s deal — reportedly six months of jail time — she would have been found in violation of her probation and would serve time. “I don’t care that you’re Lindsay Lohan,” the judge added, bluntly. “One of the things about me is that I treat everybody the same,” Schwartz said at the time. “What I look to in sentencing is, ‘What is the prior record?’ In this particular case, there has been so much speculation in the press [that] I’m just going to tell you a couple of things: If you plead in front of me, you are going to jail. There might be an issue about the amount of time, but if the case settles here, you will be going to jail.” By going to trial, Lohan now faces both jail and prison time — jail if Judge Sautner decides she’s violated her probation, prison if she is convicted of grand theft — but the actress has long proclaimed her innocence on the theft charge, tweeting that she “was not raised to lie, cheat or steal” and saying in TV interviews that she “feels great.” In March, security-camera footage showing Lohan trying on jewelry and texting appeared on “Entertainment Tonight,” who had apparently purchased 45 minutes of tape from the jewelry store in question.
