Man Awarded $15 Million After Being Left In Solitary Confinement For 2 Years A New Mexico prisoner who was left in solitary confinement for 2 consecutive years while serving time for a DUI was recently awarded a $15 million settlement. via Fox News A southern New Mexico county announced Tuesday that it reached a $15.5 million settlement to end the legal battle over the case of a man who was held in solitary confinement for two years without a trial and was so neglected that he took out his own tooth. The settlement stems from mediation ordered by the 10th U.S. Circuit Court of Appeals. Dona Ana County was appealing a lower court decision that upheld a $22 million judgment that was awarded last year to former county inmate Stephen R. Slevin. That verdict was one of the largest federal civil rights settlements in history. Slevin spent 22 months in the county jail after being arrested for drunken driving but was never convicted, according to his lawsuit. Attorney Matthew Coyte said his client ended up in solitary confinement after someone noted he was suicidal. He was so neglected, Coyte said, he was left in his cell for months at a time, had untreated dental problems and toenails that grew so long they curled under his feet. A 25-year-old woman has been arrested for allegedly threatening her boyfriend with a box cutter and assaulting him during an intimate moment in a parked vehicle this past weekend. Jennifer Joseph, of 394 Main St., was arraigned Monday on charges of attempted first-degree assault, criminal threatening, simple assault and resisting arrest for the Sunday morning incident. According to court documents, Joseph and her boyfriend, Dayne Titus, 21, were parked near the railroad tracks at the end of Lock Street early Sunday morning when their romantic moment turned violent. Titus told police that he accidentally pinched Joseph’s hand between his hip and the car seat and she became enraged, according to a police affidavit filed in 9th Circuit Court, Nashua District Division. “The defendant began yelling at him and removed a box cutter from the glove box of the vehicle. (Joseph) held the box cutter to him and said, ‘I could slit your throat at any time,’” court records indicated. After a brief argument, Joseph allegedly grabbed Titus’ neck with both hands before he was able to escape the vehicle, according to the affidavit, and she then followed him down Lock Street with the box cutter. Joseph is accused of swinging the box cutter in the area of his chest and then attempting to stab his neck with the weapon, but Titus eventually retrieved it, according to court documents. Titus was able to track down a nearby police officer and report the incident. Police allege that Joseph resisted arrested when an officer attempted to detain her. Titus suffered minor injuries to his face and neck during the assault, police said. Joseph told a different version of the events to authorities, claiming the couple began to “play-wrestle” inside the car, which may have caused Titus’ neck injury. She claims an argument ensued when the two began disputing whether to have an exclusive relationship. Although she admits to keeping a box cutter, duct tape and gloves inside her vehicle’s glove box for her work at an area candle shop, Joseph told police she does not know how it was removed from her car. She denied ever threatening the man with the box cutter and claimed the blood on her own clothes was likely from her boyfriend’s facial acne, court records indicated. Joseph was held on $10,000 cash or surety bail and has been ordered to have no contact with Titus and refrain from possessing any firearms or weapons. Movie theaters have long been the target of consumer ire when it came to rising ticket prices, but a man in Michigan feels the steep price for theater snacks is worthy of a lawsuit. Joshua Thompson, of Livonia, filed a class action lawsuit in Wayne County Circuit Court against his local AMC theater, with the aim of forcing film houses around the state to reduce their snack prices, the Detroit Free Press reported. “He got tired of being taken advantage of,” Thompson’s lawyer, Kerry Morgan, of Wyandotte, told the newspaper. “It’s hard to justify prices that are three and four times higher than anywhere else.” According to the publication, Thompson claimed in the suit that he used to bring his own snacks to the theater until AMC posted a sign on the doors banning any outside food and drinks. The suit accuses AMC Theatres of violating the Michigan Consumer Protection Act by charging grossly excessive prices for snacks, and seeks refunds for all customers who were overcharged, and a civil penalty against the company. In 2009, AMC Entertainment joined Regal Entertainment Group in banning outside food and drinks from entering its 300 theater locations. In a statement released at that time, Sun Dee Larson, vice president of corporate communications for Kansas City-based AMC Entertainment, said “AMC recently reviewed its company policy regarding outside food and drink and will no longer be permitting guests to bring in these items, as is the case with many entertainment venues. Maybe it has to do with the name… NEW ORLEANS — A Louisiana appeals court has upheld the murder conviction and life sentence for rapper C-Murder. C-Murder, whose real name is Corey Miller, was convicted of shooting a teenager to death in 2002. A three-judge panel from the state’s 5th Circuit Court of Appeal on Wednesday rejected Miller’s argument that he didn’t get a fair trial. In 2009, a jury convicted Miller of second-degree murder for shooting 16-year-old Steve Thomas during a confrontation at a nightclub. Miller claims the judge who presided over his trial allowed jurors to hear prejudicial and unsubstantiated testimony that he threatened witnesses to the shooting. He also accused prosecutors of systematically eliminating black people from the jury. But the 5th Circuit rejected those arguments. So it looks like we won’t be seeing a free C-Murder any time soon. According to PEOPLE reports: Rush Hour star Chris Tucker’s $6 million Florida mansion is in foreclosure, with more than $4.4 million owed to the bank, reports the Orlando Sentinel, citing papers filed in Circuit Court in Lake County. Tucker, 39, bought the 10,000-sq.-ft. waterfront home on Lake Apopka, near Orlando, in 2007. The newspaper says the residence contains five bedrooms, three fireplaces, a personal spa, an outdoor kitchen overlooking a pool, and a basement outfitted to resemble a pirate ship, including the sail. Court documents reportedly show an $11.5 million IRS lien on the home in 2011 in order to collect federal income taxes from Tucker, whose monthly mortgage payment, the documents also show, was $25,812.50. There has been no comment from Tucker, but the Times Union of Albany, N.Y., reports that his comedy show scheduled in the city for this Sunday – and was a rescheduling of a postponed Sept. 3 performance – has been canceled because of “unforeseen circumstances.” Damn shame… This just goes to show, it’s hard out here for everybody. That’s because, according to a panel of three judges, you have no reasonable expectation of privacy in your driveway, and no reasonable expectation that the government is not tracking you. Huh? The 9th Circuit Court of Appeals just decided that it was legal for the police to put a GPS tracking device on your car, sitting in your driveway, on your property. Here's how to protect yourself. To quickly summarize, the supreme court says that police can look through things that anyone in the public could come across, meaning, your driveway is freely accessible to the public, hence, the cops can shove a GPS locator onto your car. Then they can use it track you. Without a warrant. How do you stop this without combing over the underside—or perhaps even inside—of your car and finding the GPS tracker? With technology. Your first bet is probably to find out if someone is tracking you or not. You can turn here for cellphone and bug device detectors. But these aren't 100%, so if you're really paranoid and want to hide your location, you'll want to just go ahead and stop the trackers anyway. The first type is a GPS jammer, which is technically illegal to buy and use in the US, so keep that in mind. These types of GPS jammers plug into the cigarette lighter in your car, and will “prohibit GPS signal” up to 10 meters. Ten meters isn't too far, but it isn't super close either, so cars next to you might get some GPS interference as you drive down the road. This model is $33. There are handheld and higher-powered versions available for slightly more. Our friends at Brando have one too, for $50. If you're worried that someone is tracking your cellphone, there's a signal blocking bag for about $10 that you can shove your device into when not in use. You also have the cellphone-type trackers, which need to be stopped with a different device: a cellphone jammer. There are various portable versions, as well as ones that go into your car. These types of jammers are as illegal as the GPS ones, so again, know what you're getting into. Is it worth it to go to the potential legal troubles of owning and operating a GPS or cellphone jammer if you're not doing anything wrong? That's up to you to decide. But if you are doing something that you want to make sure the government doesn't know about and they're already surveilling you, it might already be too late to get one of these.
