Kim and Khloe Kardashian might need to pay up for selling out . The sisters could soon be the subjects of a class action lawsuit due to their endorsement of QuickTrim, the non-FDA-approved weight loss supplement Kim and Khloe have been hawking since 2009. QuickTrim Commercial Law firm Bursor & Fisher tells The New York Post it is preparing to file on behalf of a client because QuickTrim reportedly contains a high level of caffeine, an ingredient which is not an effective means for shedding unwanted pounds. “My firm has been retained by an individual that purchased QuickTrim, and we are investigating the matter,” a partner with the company tells the newspaper . “We have provided written notice of our client’s claims to the company and others involved in marketing QuickTrim.” The firm has sent an email to QuickTrim users asking if they want to join the suit and saying: “The active ingredient in QuickTrim weight loss products is a large dose of caffeine… The FDA has determined that caffeine is not safe or effective for weight loss.” As much as we’d love to see Kim suffer for attaching her name to any product that comes calling, let’s be honest: If you actually purchased a cleanse based on Kim Kardashian saying she uses it, you deserve to stay up all night, wondering where you went wrong in life.

Did George Huguely Murder Yeardley Love?

Former University of Virginia lacrosse player George Huguely is on trial for murdering his ex-girlfriend, Yeardley Love, in a case that has garnered national attention. His first-degree murder trial included dramatic testimony Wednesday in Charlottesville, Virginia, from Love’s two roommates, serving as witnesses for the prosecution. The saga is People’s cover story this week. What makes it so noteworthy? The element of mystery surrounding the case, for one, and the fact that the accused is a Division I lacrosse star – who professes his innocence. Caity Whiteley, who lived with Love and was on the lacrosse team with her, described returning to Love’s apartment to ask her to go out with them. With Yeardley Love, 22, face down in bed, just as Whiteley had last seen her, nothing appeared to be out of the ordinary, at least at first. “Her hair was all messed up and pulled aside,” Whiteley said, according to Charlottesville’s Daily Progress . “I moved her hair, and then that’s when I noticed.” “There were cuts on her face, and it was just messed up.” Whiteley also testified that Love’s body was warm but that her feet were cold at the time. On Thursday, when graphic photos of Love’s lifeless body were shown in court, her family sobbed, while George Huguely, 23, kept his head down. Whiteley said that in the months before Love’s death her already on-again-off-again relationship with Huguely, had become even “more rocky than usual.” Huguely reportedly was observed choking Love during a party. Love and Whiteley’s other roommate, Kaitlin Duff, said oLove had become “very upset” in late April after she learned Huguely was with another woman. Another witness was Anna Lehman, who lived in the apartment below Love. Describing a loud noise she heard from the floor above shortly before midnight, Lehman testified, “I thought that maybe like a stereo set had fallen, or a bookshelf.” Right after that she saw a dark-haired man in a royal blue T-shirt leaving Love’s apartment. She described him as looking “like a male student.” The defense reportedly does not dispute that Huguely was in the apartment that night. In opening statements Wednesday, Huguely’s lawyer said his client was very drunk the night Love died and was incapable of plotting to kill her. Huguely has pleaded not guilty to first-degree murder, robbery, burglary, breaking and entering, grand larceny and murder in the commission of a felony. According to an affidavit, Huguely admitted that he kicked in Love’s door and shook her, repeatedly hitting her head against a wall, back in May 2010. Huguely’s attorney Francis Lawrence told reporters, “We are confident that Ms. Love’s death was not intended but an accident with a tragic outcome.” Reports say that prosecutors said in court Wednesday that two days before Love’s death, Huguely accused her of having another relationship. Prosecutor Dave Chapman told jurors Huguely assaulted Love and wrote to her saying he was upset because she had slept with someone else. According to prosecutors, Huguely sent angry e-mails to Love, including one that said, “I should kill you.” When it came time for Huguely’s attorney Lawrence to address jurors, he reportedly relayed the rest of the e-mail’s message: “I should have killed you. You should’ve killed me. You’re so [expletive] up. Prosecutors also outlined Huguely’s pattern of violence against Love and said he intended to kill her and steal her laptop to destroy evidence.

Andre Davis, 29, was sentenced in Hamilton County Common Pleas on 14 counts of felonious assault. Davis, who wrestled using stage names including Gangsta of Love and Sweet S**y Sensation, was convicted in November. Prosecutors said Davis violated state law by not telling a dozen sex partners about his HIV status or lying to them. Davis told the judge Monday that he was a “sex addict” and that his addiction grew worse when he lost his dream of becoming a professional wrestler after getting the HIV test results. This piece of isht goes on to say: “I am not a monster,” he said. Assistant prosecutor Amy Tranter had argued during trial that Davis should go to prison for a long time, saying the case was about his responsibility to tell the women his test results. Davis’ attorney, Greg Cohen, argued that the state law regarding HIV and felonious assault is poorly written because it doesn’t require proof that there has been harm or an attempt to commit harm. Cohen said Monday that his client was sorry for what he had done and that the women Davis slept with also had some responsibility for choosing to have unprotected sex. Davis was informed in 2009 by the WWE that they could not hire him because he failed his physical and was HIV positive. FedEx Fail: Camera Catches Worst Delivery Ever

This FedEx delivery guy is probably pretty embarrassed right now. Or out of a job. The shipping company is in damage control mode after one of its drivers inflicted actual damage to a (now broken) computer during a delivery. Watch his oh-so-careful methods below. Merry Christmas! FedEx Delivery FAIL “I want you to know that I was upset, embarrassed, and very sorry for our customer’s poor experience,” said Matthew Thornton, a FedEx Senior V.P. “The situation has now been resolved to the customer’s satisfaction, and we are handling the employee according to our disciplinary policies.” “We know that this behavior is an aberration and is not reflective of the outstanding FedEx customer service that makes us proud around the world.” The hilarious part is that the customer was home at the time , with the front door wide open. Ringing the bell on the gate would’ve done the job. No word on what disciplinary action will be taken against the driver.

Monta Ellis, Warriors Shooting Guard, Sued for Texting Penis Photos to Team Employee

Monta Ellis has allegedly pulled a Brett Favre . No, he hasn’t sullied his legacy by announcing multiple false retirements and then taking subtle shots at his superstar replacement. Instead, the Golden State Warriors shooting guard and one of the most dynamic players in the NBA has been sued by a former team employee, Erika Ross Smith, for supposedly sending her numerous unwanted text messages, culminating in a photo of his genitals. Talk about being a baller! (Sorry.) Smith worked last year as in the team’s community relations department, and claims in her lawsuit that Ellis texted her from November through January with lines such as “I want to be with you” and “Hey Sexy.” He would also ask what she was wearing. “On a micro level, my client has endured unwanted harassment, has suffered and continues to suffer emotional distress and trauma,” Burt Boltuch, Smith’s lawyer, said at a news conference this week. “On a macro level, this type of conduct, especially in the sports world, must stop… she was embarrassed. She was intimidated. She felt scared and helpless.” The Warriors have responded to the allegation and said Ellis – who is married – and Smith engaged in a “consensual relationship.” After Smith reportedly rejected the guard’s advances, she says he complained about her job performance and sent her a picture of his penis on December 17, 2010. Boltuch told reporters of the photo in question, which he possesses: “We know it came from him,” saying his client’s interactions with Ellis with “absolutely, unequivocally 100 percent not consensual.” Smith eventually lost her job, in her opinion, due to Ellis’ wife finding out about the text messages and complaining to team executives. The lawsuit alleges retaliation, wrongful termination and intentional infliction of emotional distress. It seeks unspecified damages.
