The judge declared a mistrial today in Roger Clemens’ perjury case after prosecutors showed jurors evidence that was previously ruled inadmissible. U.S. District Judge Reggie Walton said the prosecutors had made a grave error and that the baseball legend could no longer be assured a fair trial. Walton scheduled a September 2 hearing to determine whether to hold a new trial, but the jurors were dismissed and the case is off – for now. Roger Clemens was indicted for perjury for allegedly lying to Congress during a 2008 investigation into performance-enhancing drug use in the sport. He is not being charged with using drugs, per se, but for knowingly false testimony he allegedly gave involving his use of the substances years ago. This morning, in the second day of testimony, the judge interrupted prosecutors’ playing of a video from his 2008 testimony before Congress. The jury was removed from the room. When they returned, they were dismissed, and the judge issued the following explanation of why: “There are rules that we play by and those rules are designed to make sure both sides receive a fair trial. If this man got convicted, he would go to jail.” Because prosecutors broke his rules, “the ability with Mr. Clemens with this jury to get a fair trial with this jury would be very difficult if not impossible.” Prosecutors suggested the problem could have been fixed with an instruction to the jury to disregard the evidence, but Walton seemed skeptical. He said he could never know what impact the evidence would have during the jury’s deliberations “when we’ve got a man’s liberty at interest.” “I don’t see how we un-ring the bell,” he said. Defense attorney Rusty Hardin patted an unsmiling Clemens on the back as the judge announced his decision. Clemens did not speak to reporters. Here’s the latest: Ginger Lee, a porn star who says the Congressman coached her through the scandal as it broke, has hired attention-loving attorney Gloria Allred to represent her against a series of mysterious threats. Protecting her client from whatever may be released in the future, Allred told TMZ this morning: “Ms. Lee has asked me to issue this statement, because an individual has threatened her with a release of another statement which purports to be from her, but which she has not authorized. “Ginger would like it to be known that she has not authorized any person, except me, her attorney, to issue statements on her behalf. Unlike the roughly 800,000 federal workers who would be affected, lawmakers get wide latitude deciding who is essential and who’s not in the fiefdoms of their own offices and committees. They also get to choose whether to give up their own pay during a shutdown — an option not afforded the furloughed. “How does that make any sense?” said Sen. Joe Manchin, D-W.Va., who added that he will forgo a paycheck for the length of a budget impasse. More than two dozen senators of both parties took the same pledge as the clocked Friday toward the midnight shutdown deadline. House Speaker John Boehner on Friday told other lawmakers that he planned to return the pay he would be entitled to during a shutdown, In a message to House members, he noted that the Constitution forbids lawmakers from changing their compensation or the president’s in mid-term, but there is no prohibition on lawmakers refusing their pay when a shutdown occurs. Rank-and-file House members and senators make $174,000 a year, with the leaders of each party making more. Boehner receives $223,500. President Barack Obama’s annual salary is $400,000.
