Bam Margera’s Alleged Assailant To Stand Trial

Elizabeth Ray, 59, is accused of beating Margera with a pipe outside his Pennsylvania nightclub. By Gil Kaufman Bam Margera Photo: Frazer Harrison/ Getty Images The 59-year-old woman accused of assaulting “Viva La Bam” star Bam Margera outside a suburban Philadelphia nightclub he owns on June 12 has been held over for trial. According to the Philadelphia Daily News , a district court judge ruled on Thursday that Elizabeth Ray would be held for trial on aggravated assault and related counts. Ray, who has said she’s innocent in the case, lives near the Note, a club Margera, 30, owns in West Chester, Pennsylvania. Margera was allegedly assaulted by Ray with a bat-like object following a noise complaint at the Note earlier this month. Ray was arrested and charged with one count of aggravated assault, two counts of simple assault and two counts of reckless endangerment; she posted $10,000 bail shortly after her arrest. Margera said that he was waiting for a ride home around 2 a.m. when he got into a verbal altercation with Ray and that he was walking away after he thought the argument ended and then collapsed to the ground, suffering a concussion and a large cut to his head after being struck. According to the News, a woman who was with Margera said she saw Ray holding a long, pipe-like object. Pal Tammy Palumbo told the paper that after Margera tumbled to the ground she cradled his head in her lap as Ray began yelling at her. With Margera unconscious and bleeding, Palumbo claimed that Ray threatened, “I’ll hit him again and I’ll make sure I kill him next time.” In a court appearance on Thursday, Margera claimed he exited the club to smoke a cigarette after closing time and Palumbo followed him to a back alley next to Ray’s property. “She yelled, ‘Get off my sidewalk’ to me,” Palumbo testified. “I didn’t even know I was standing in front of someone’s house.” At the time of the incident, Ray professed her innocence to the Daily News, claiming that Margera used racial slurs during their initial argument about the noise. “He called me the n-word,” she said. “I’m innocent, and he’s a jackass, just like his movies.” During testimony, Margera said he got into a shouting match with Ray after she berated Palumbo, the latest in a series of verbal altercations between him and his alleged assailant. “It was kind of a shouting match,” he said. “I was so busy yelling I didn’t hear what she was saying.” Margera denied that he used a racial slur during the argument. Ray’s home shares a wall with Margera’s bar and she often complained about noise from the establishment; to compensate, Margera told the judge that he had his bar manager pay one month’s rent for Ray when the pub opened last year. The complaints continued, however, apparently boiling over into the incident that caused Margera to miss out on a recent shoot for a climactic scene in the upcoming “Jackass 3-D” movie .

2010 US Open, First Round Scoreboard: K.J. Choi Headlines Quartet Tied For Lead At 2-Under, Mickelson 3-Over

With the morning groups halfway through their opening rounds at Pebble Beach, a quartet of golfers have moved into the early lead at the 2010 U.S. Open. K.J. Choi, Edoardo Molinari, Soren Kjeldsen and David Toms all sit at 2-under, through 13, 13, 13 and 8 holes respectively. Choi started off his round disastrously, bogeying and double-bogeying the first two holes, before bouncing back with five birdies to jump into a share of the lead. Toms and Kjeldsen have both recorded three birdies and a bogey thus far in their rounds, while Molinari has rung up four birdies, to go with two bogeys. Mike Weir and Ian Poulter lead a pack of golfers a shot back at 1-under, with Jim Furyk, who’s been something of a darkhorse pick to win the Open, behind them at even through 12 holes. Meanwhile, Phil Mickelson has struggled on his first day, sitting at 3-under through 11 holes after finding the drink on the 18th hole. Also of possible interest, noted golf enthusiast Tiger Woods will tee off at 4:36 PM EDT, in a powerhouse group that includes Ernie Els and Lee Westwood as well. BP Tries to Block Photos of Dead Wildlife

For animal lovers, one of the most heartbreaking aspects of the Gulf spill is the oil-drenched wildlife washing up on shore. If you're too horrified to look at any photos, you're in luck — BP doesn't want you to see them. As of Friday morning, the U.S. Fish and Wildlife Service’s tally of dead animals collected in the Gulf area was 527 birds, 235 sea turtles (six to nine times the average rate), and 30 mammals, including dolphins. Yesterday morning, the spill washed over Queen Bess Island (called “Bird Island” by locals), which is a habitat for Louisiana brown pelicans, the state bird that was once an endangered species. Forty-one of the birds were coated with oil, and that number is expected to rise. Have you seen the terrible pictures of all this carnage? Neither have I. And neither has anyone else. Wonder why? The New York Daily News reported on Wednesday that BP has ordered its contractors not to share pictures or otherwise publicize the scores of dead and injured wildlife. An unnamed BP contractor gave a reporter a very different tour from the one presented to President Obama during his recent visit. Among the “highlights,” if that's what they can be called, was a decomposing dolphin that the worker said had been found filled with oil. The shoreline grass of Queen Bess Island was covered with stricken marine life, some dead and some struggling to breathe. The normally white heads of pelicans were dark with oil. The worker said BP was insistent it didn't want any photos of the dead animals. “There is a lot of coverup for BP,” the worker told the reporter. “They know the ocean will wipe away most of the evidence.” As extra assurance that most of us will never see photographic or any other evidence of the true extent of the carnage, Louisiana residents said BP quickly whisks off dead and injured wildlife to inaccessible buildings and offshore ships. Out of sight, out of mind … but forever in locals' memories. New York Daily News reporters trying to get a closer look at the disaster were escorted from a beach by police who said they were taking orders from BP. Even Louisiana residents have been required to sign non-disclosures. Really, BP? Did you not get the memo this isn’t a police state? You may be able to control politicians by lining their pockets, but your bucks stop there. This disaster is going to affect all of us, and we have every right to see the extent of the damage. In an encouraging development, this week Charlie Riedel of the Associated Press was somehow able to bypass BP's myriad roadblocks and snap some appalling photos. They may make us want to shield our eyes, but it's important we don't bury our heads just as BP would love for us to do. added by: captainplanet71
