President Obama Orders The Justice Department To Stop Using The Defense Of Marriage Act To Halt Gay Unions

Barack Obama once again steps out and demands that the government stay out of the personal lives of its citizens. Washington (CNN) — President Barack Obama has ordered the Justice Department to stop defending the constitutionality of the Defense of Marriage Act, which defines marriage for federal purposes as only between a man and woman, according to a statement Wednesday from Attorney General Eric Holder. “The president has concluded that given a number of factors, including a documented history of discrimination, classifications based on sexual orientation should be subject to a more heightened standard of scrutiny,” Holder said. The key provision in the law “fails to meet that standard and is therefore unconstitutional.” “Given that conclusion, the president has instructed the (Justice Department) not to defend the statute” in two pending cases in New York, Holder said. “I fully concur with the president’s determination.” Obama has previously expressed his personal opposition to the Defense of Marriage Act but had never stated an opinion relating to its constitutionality. The administration had a March 11 deadline to respond to two lawsuits against the measure in New York. The 2nd U.S. Circuit Court of Appeals — which includes New York — is the only federal circuit to have never decided the basic legal question of whether a law discriminates against gay men and lesbians. Republicans immediately ripped the White House’s decision, calling it a distraction at a time when they said the focus needs to be on the economy. But leave it to the Republicans to find a way to hate. Speaker of The House John Boehner’s rep says: “While Americans want Washington to focus on creating jobs and cutting spending,the president will have to explain why he thinks now is the appropriate time to stir up a controversial issue that sharply divides the nation,” Rep. Lamar Smith said that Obama’s plea is a: “…transparent attempt to shirk the (Justice) Department’s duty to defend the laws passed by Congress. Michael Jackson Lawyer on Dr. Conrad Murray Defense Theory: Come On!

Thomas Mesereau, Michael Jackson’s former attorney, has come out swinging at Dr. Conrad Murray’s defense team and the theory they will reportedly use. Of reports that Murray will claim Michael Jackson killed himself , Mesereau scoffs and blames MJ’s death squarely on Murray, as the star was “not suicidal.” “The defense lawyers have to do something. What they’re gonna try and do is deflect attention from their guilty client onto Michael Jackson,” he said. Thomas Mesereau Slams Conrad Murray Mesereau successfully defended Michael in his 2005 molestation trial. “The reality is Michael Jackson was not suicidal or self-destructive in the way they’re trying to say,” he added. “Hopefully their defense will not succeed.” While he’s spot on as far as the defense trying some misdirection and putting MJ on trial instead of Murray, the “suicidal” comment is a bit off base. The defense will say that a frustrated Michael MAY have killed himself by accident after trying to self-administer Propofol with Murray out of the room. They may also argue he was too weak to perform , after years of being treated poorly by other doctors and by himself, to absolve Murray of blame.

SMH: Shady Doctor’s Lawyers Say Michael Jackson “Killed Himself” With Propofol

They just need to let poor MJ rest in peace: Michael Jackson killed himself with a lethal dose of the hospital anaesthesia Propofol, it has been claimed. Los Angeles County Deputy District Attorney David Walgren claimed lawyers for Dr Conrad Murray, who is accused of involuntary manslaughter in relation to Jackson’s death, plan to use the theory as the main part of his defense. Walgren’s statement came at a hearing yesterday where a lawyer for Dr Murray clashed with the prosecutor over who should test residue from two syringes found in Jackson’s bedroom. He said: ‘I do think it’s clear the defense is operating under the theory that the victim, Michael Jackson, killed himself. ‘They don’t want to say it but that’s the direction in which they are going.’ Defense attorney J. Michael Flanagan said a huge amount of the anaesthetic Propofol was found in Jackson’s body, but his client has said he gave him only 25 milligrams of the drug. Mr. Walgren suggested the defense will claim Jackson killed himself by injecting more of the drug into himself. It is understood that Dr Murray’s lawyers will claim that the star woke up while his physician was out of the room for two minutes in the toilet and administered a lethal dose of the drug himself. A preliminary hearing in the case begins next Tuesday when Judge Michael Pastor will decide whether the prosecution has a strong enough case to support the unusual charge that Dr Murray was criminally responsible for the king of pop’s death in June 2009. As many as 30 witnesses are expected to be called during the two week hearing. Although the defense won’t be putting its case, it is thought highly likely that the judge will find that the American cardiologist will have to go to trial. Dr. Murray, 52, faces up to four years in prison if he is convicted. Reports in the US have suggested that the doctor’s lawyers will argue that the singer injected Propofol himself using an intravenous drip, causing a massive heart attack. He then supposedly dropped the bottle on the floor. When the doctor came back into the room he tried CPR in a desperate attempt to revive Jackson. An autopsy later showed the heart attack was caused by a fatal dose of Propofol, a drug Jackson used to help with his chronic insomnia. Mr Flanagan said a broken syringe was found on the bedroom floor in addition to a syringe in an intravenous medication bag. He also revealed that a fingerprint found on the broken syringe hasn’t been identified. Source

Shelley Malil Sentenced to Life in Prison

Shelley Malil has been sentenced to life in prison. The actor, who was found guilty in September of trying to murder his ex-girlfriend, will be eligible for parole in 12 years. At yesterday’s hearing, he told the judge: “I want to do whatever I need to do to make sure I make right from the wrong that I did.” Malil’s victim, Kendra Beebe, was stabbed over 20 times. Her injuries included a punctured lung, along with cuts to her back, chest, arms and neck. In his defense, the 40 Year-Old Virgin star claimed he became disoriented after arriving at Beebe’s home and finding her with another man. He said he wielded his knife against an attacker he believed was trying to harm him. The jury did not buy this story.

Corporate corruption of the defense industry is at the heart of the motivation that leads insiders to leak information to Wikileaks. Honest everyday people that work for the government and its myriad of private contractors in the capitalist world are morally repulsed by the information that they are being charged with keeping secret represent to their sense of honoring their other sense for justice and truth. They cannot help themselves but reveal the corruption because it is morally repugnant to them. +++ The leak may have come from the State Department itself The controversy and the caliber of the information have led some political analysts to the conclusion that it could only have leaked from the State Department itself, which puts its efficiency under question. Vitaly Leibin, the chief editor of Russian Reporter, a magazine which claims to officially collaborate with WikiLeaks, also believes that the leaks are the result of people inside the US government wanting the information exposed. “These leaks would never have happened if not for the number of insiders who are ready to leak this information. It looks like it’s linked to the wars in Iraq and Afghanistan when officers understood that they are working for a not exactly fair business, and this moral decay inside the Pentagon caused these leaks,” he said. “The main thing this leak has done is break the illusion that the State department has everything under control. There have been exposed mechanisms – not secret, but quite simple and cynical. Partners of the US will be more careful now. It’s another sign that the US is no longer dominating the world,” he added. What the WikiLeaks incident shows is how the whole intelligence community has become over-reliant on technology, said former intelligence officer Glenmore Trenear-Harvey. He pointed out the inherent problems with the Secret Internet Protocol, a system of networks used by the US Defense and State Departments to transmit classified information that is one of the alleged sources of the leak. “The idea was for an exchange of information after 9/11, when the intelligent services weren’t sharing their information together,” he said. “Now what has happened is that whereas maybe 40,000 people within the intelligence community would have access, suddenly, bizarrely, diplomats, military people and, indeed, intelligence people – there’s over 2 million people that had access to it.” +++ Now that these revelations are making governments reconsider their security I would venture to say that this is going to lead to an extended cyberwar along with resistance from states to support some of the security measures that will likely be proposed by US lawmakers. added by: jubal
