Federal Judge To Dismiss Second BLM Suit

Read the rest here:

BATON ROUGE, La. (AP) — A federal judge says he intends to dismiss a lawsuit that accuses Black Lives Matter and several movement leaders of inciting violence that led to a gunman’s deadly ambush of law enforcement officers in Baton Rouge last year. U.S. District Judge Brian Jackson issued that warning in an order Wednesday, less than a week after ruling Black Lives Matter is a social movement and therefore can’t be sued. Last Thursday, Jackson threw out a police officer’s lawsuit blaming Black Lives Matter and movement leader DeRay Mckesson for injuries he sustained during a protest over a deadly police shooting in Baton Rouge last year. The officer’s lawyer also attempted to add “#BlackLivesMatter” as a defendant, but Jackson ruled a hashtag can’t be sued either. Now the judge is vowing to dismiss a separate suit filed on behalf of a sheriff’s deputy wounded in the July 2016 attack that killed three other officers in Baton Rouge. The same Baton Rouge-based attorney, Donna Grodner, filed both suits. The judge is giving her until Oct. 13 to respond to his order and present arguments why the deputy’s case shouldn’t be dismissed. Grodner declined to comment Thursday on the judge’s order or say whether she plans to appeal last week’s ruling. Mckesson, a Baltimore, Maryland, resident and four other Black Lives Matter leaders were named as defendants in the suit that Grodner filed on behalf of one of the officers wounded in the July 17, 2016, attack by Gavin Long, a black military veteran from Kansas City, Missouri. The suit doesn’t name the plaintiff, but its description of the wounded officer matches East Baton Rouge Parish Sheriff’s Deputy Nicholas Tullier, who was has been at a Houston rehabilitation hospital since November. Long, a 29-year-old former Marine, was armed with a semi-automatic rifle when he killed three officers and wounded three others outside a convenience store and car wash near Baton Rouge police headquarters before he was shot dead. Long had posted rambling internet videos calling for violence in response to police treatment of African-Americans, which he said constituted “oppression.” He apparently posted a YouTube video from Dallas on July 10, three days after a sniper killed five officers and wounded nine others there. The attack came less than two weeks after a white Baton Rouge police officer shot and killed Alton Sterling, a 37-year-old black man. Mckesson was one of nearly 200 people arrested in Louisiana’s capital at nightly protests after Sterling’s death. The wounded deputy’s lawsuit claimed Mckesson was “in charge of” a July 9 protest that “turned into a riot” and described Long as an “activist whose actions followed and mimicked those of” the sniper who killed officers in Dallas, But the judge said that latter claim is “not altogether relevant.” Otherwise, the judge wrote, the lawsuit is “devoid of any facts that tend to demonstrate that any of the named Defendants, in particular, are liable for the alleged injuries suffered by Plaintiff, even assuming that those Defendants have the capacity to be sued.” Later Thursday, Mckesson tweeted a link to The Associated Press story on the judge’s order, saying “I’m happy to get both of these lawsuits behind me as I did nothing wrong in either case.”   Like BlackAmericaWeb.com on  Facebook . Cirque Du Trump: Pumpkin Bisque POTUS Fires FBI Director James Comey

Trump Fires James Comey As FBI Director In Wake Of Clinton E-Mail Mistake The the low-budget soap opera that has become the United States of America continues to present plot twist after plot twist. After effusively praising FBI director James Comey for bringing down the hammer on Hillary Clinton during the election, orange Fanta POTUS has decided that he no longer needs him. Like so many Apprentice contestants, and several folks on the executive staff, Trump fired James Comey today with this statement read by Sean Spicer: Today, President Donald J. Trump informed FBI Director James Comey that he has been terminated and removed from office. President Trump acted based on the clear recommendations of both Deputy Attorney General Rod Rosenstein and Attorney General Jeff Sessions. The FBI is one of our Nation’s most cherished and respected institutions and today will mark a new beginning for our crown jewel of law enforcement,” said President Trump. A search for a new permanent FBI Director will begin immediately. Comey came under fire yesterday when the FBI released a statement rebutting the idea that Hillary Clinton’s aide, Huma Abedin, had forwarded “hundreds of thousands of emails” to her then-freak-a-leek husband, Anthony Weiner. According to ThinkProgress , the Bureau’s statement clarified that only “a small number” of emails were accidentally forwarded to Weiner. Then comes the fact that despite Trump’s best effort to purport innocence, Comey confirmed that the FBI was indeed investigating Trump for his alleged collusion with Vladimir Putin and the Russians to interfere with our election. Sounds like anyone who thinks Trump might be a shady, dirtbag, scumbucket, is going to get the Ned Stark treatment (spoiler alert) OFF WITH HIS (or HER) HEAD! Who’s President mans is this?!? Study Finds The Average Black Family Needs 228 Years To Catch Up To The Wealth Of The Average White Family Today

Study Predicts That It Would Take Black Families 228 Years To Catch Up With White Wealth Today A new study predicts that in the future , the wage gap between White Americans and Minorities continues to grow larger as opposed to getting better– and it would take 228 years for black families to acquire the wealth of white families today. Via The Nation If current economic trends continue, the average black household will need 228 years to accumulate as much wealth as their white counterparts hold today. For the average Latino family, it will take 84 years. Absent significant policy interventions, or a seismic change in the American economy, people of color will never close the gap. Those are the key findings of a new study of the racial wealth-gap released this week by the Institute for Policy Studies (IPS) and the Corporation For Economic Development (CFED). They looked at trends in household wealth from 1983 to 2013—a 30-year period that captured the rise of Reaganomics, expanded international trade and two major financial crashes fueled by bubbles in the tech sector and housing prices. The authors found that the average wealth of white households increased by 84 percent during those three decades, three times the gains African-American families saw and 1.2 times the rate of growth for Latino families. To put that in perspective, the wealthiest Americans—members of the Forbes 400 list—saw their net worths increase by 736 percent during that period, on average. If those trends persist for another 30 years, the average white family’s net worth will grow by $18,000 per year, but black and Hispanic households would only see theirs grow by $750 and $2,250 per year, respectively. Check out this visualization of what this study means courtesy of IPS . Thoughts?

The Joys Of Being Black: Police Fatally Shoot Innocent & Learning Disabled Donnell Thompson In Compton “Not Sure We Got The Right Guy” [Video]

WOW!!! And just like the Paul O’Neal pigs said on camera …the officer is now on “desk duty.” ABC7 : The man fatally shot by a deputy in Compton last month was not connected to a carjacking suspect who had opened fire on deputies, sheriff’s officials said. During the July 28 incident, a carjacking suspect crashed a stolen car, fired at deputies and fled into a neighborhood. A search ensued, and that suspect was taken into custody. Around the same time, a resident in the neighborhood noticed 27-year-old Donnell Thompson lying in his yard and called 911. Sheriff’s officials said deputies were concerned that Thompson may be armed and possibly connected to the carjacking suspect. Deputies said Thompson did not respond to their attempts to communicate with him and was lying in a position that covered one of his hands from view. At one point, investigators said Thompson stood up and “charged at the deputies.” That’s when a deputy fatally shot Thompson, believing he was armed. According to the sheriff’s department, the deputy who shot Thompson fire from the turret of an armored vehicle. After the shooting, authorities launched an investigation, which included gun residue testing, DNA testing, interviews with witnesses, deputies and family members and fingerprinting. The sheriff’s department released a statement Tuesday on its findings. “We have determined that there is no evidence that Mr. Thompson was in the carjacked vehicle, nor that he was involved in the assault on the deputies,” the statement said. Dawn Modkins, a spokeswoman for Black Lives Matter Long Beach, organized a press conference with Thompson’s family and friends in front of the Los Angeles County Board of Supervisors building after the information was released. Thompson’s family, who called him “Little Bo Peep,” said they plan to file a wrongful-death lawsuit against the sheriff’s department. His brother said Thompson was a “kind, sweet person” who did not have a criminal history. His family and friends said they wanted justice for his death and that the sheriff’s department needed to publicly apologize. “We want the sheriff’s department to be held accountable for their actions. We want an apology to us as his family (and) a public apology to the community for their reckless actions on July 28,” Thompson’s sister-in-law said. Matrice Stanley, 44, one of Thompson’s sisters, said she and the rest of her family did not learn about his death until several hours later that day. “Justice is not going to bring my brother back,” she said. Stanley said her brother had a diminished mental capacity, was reserved, extremely quiet and non-confrontational. She said she believed her brother’s race was a major factor in why he was shot. “My brother was dehumanized, disvalued,” Stanley said. “I wouldn’t treat an animal this bad. How is this justifiable?” Stanley also expressed anger about the deputy firing from an armored vehicle. “He can’t go through armored cars,” she exclaimed. The deputy involved in the shooting has been reassigned to non-field duties, authorities said. The shooting was under investigation. It will ultimately be turned over to the county district attorney’s office for review. Only black folks can be mistaken for something they are not and that fact alone be the justification for their demise. “We do not know why he was acting that way?” While lying on the ground with no gun? WTF??? We have another video on the next page.

No Quiero Policia: Taco Bell Employee Fired After Refusing To Serve Police

Taco Bell Employee Fired For Refusing To Serve Police A Phenix City, Alabama Taco Bell employee has been fired after refusing to serve police officers according to WTVM. One of the officers’ wives, Tammy Bush Mayo (what an ironic last name) took to Facebook to post a lengthy rant about how her uniformed husband: My husband is a Deputy Sheriff in Lee County, Alabama and tonight a Deputy on his shift went into Taco Bell in Phenix City, AL and was told that they don’t serve cops. A lady waiting for her food spoke up to say that she was about to ask for a refund because she didn’t want to eat somewhere with a cop. This really disturbs me that people have started treating law enforcement professionals in this manner when these same law enforcement professionals put their lives on the line everyday to protect all people, including this woman with a very bad attitude at Taco Bell. We’re going to research this further but if this is what Taco Bell allows to happen, they have lost my business and I hope others of you will do the same. Sheriff Jay Jones said that the cashier told two of his officers that she would not serve them. When asked if she was kidding she replied: “No, I’m not serving you.” So sayeth the sheriff: I’m very disappointed that simply because they were uniformed law enforcement officers that our deputies were treated in such negative fashion. We pride ourselves in giving people basic respect and only ask the same in return. I am inclined to believe that this was the attitude of one employee and not the policy of the management. The fair thing is to give them an opportunity to respond. We won’t base our opinion of Taco Bell on one employee’s negative action any more than the general public should base their opinion of law enforcement on the negative action of one officer. Is that what black folks have to do to avoid being unfairly profiled? Work at Taco Bell?? Image via Shutterstock

Fair Or Foul? Kentucky Clerk Kim Davis Thrown In Jail For Refusing To Issue Gay Marriage Licenses

Kim Davis Thrown In Jail For Refusing To Issue Gay Marriage Licenses A county clerk in Kentucky who has repeatedly defied court orders by refusing to issue gay marriage licenses will appear before a federal judge who could hold her in contempt of court. Vis LEX 18: Rowan County clerk Kim Davis has been summoned to the hearing at 11 a.m. Thursday before U.S. District Judge David Bunning. He’s also ordered all of Davis’ deputy clerks to appear. Bunning could hold Davis in contempt, which can carry hefty fines or jail time. Davis stopped issuing licenses to all couples in June after the U.S. Supreme Court legalized gay marriage. Despite rulings against her, she’s turned away couples again and again, citing her Christian beliefs and “God’s authority.” The couples who originally sued in the case have asked Bunning to punish Davis with fines but not jail time. A federal judge has ordered a defiant Kentucky clerk to jail after she refused to issue marriage licenses to gay couples. U.S. District Judge David Bunning told Rowan County Clerk Kim Davis she would be jailed until she complied with his order to issue the licenses. Davis said “thank you” before she was led out of the courtroom by a U.S. marshal. She was not in handcuffs. Davis has refused to issue marriages licenses for two months since the Supreme Court legalized same sex marriage. The Kentucky clerk claims that her Christian faith should exempt her from signing the licenses. A federal judge is warning deputy clerks in Kentucky that they must issue marriage licenses to gay couples or face fines or jail. U.S. District Judge David Bunning already jailed Rowan County Clerk Kim Davis for refusing to comply with his order. She was led out of the courtroom by U.S. marshals on Thursday. The judge gave the deputy clerks time to go meet with public defenders and said the hearing will resume at 1:45 p.m. Do you think Kim Davis should be jailed for her beliefs??

Jesus Take The Wheel: Texas Deputy Gunned Down While Pumping Gas Into Police Cruiser

Texas Sheriff’s Deputy Darren Goforth Gunned Down While Pumping Gas America…the land of shootings and senseless murders. Via CNN A man “believed to be the alleged gunman” in the killing of a uniformed Houston-area sheriff’s deputy was in custody and being questioned Saturday morning, Sgt. William Kennard of the Texas Department of Public Safety told CNN. No charges have been filed against the man, Kennard said. The man’s name wasn’t given. It was the man’s mother who called the Harris County Sheriff’s Department about her son, Kennard said. “All the information she had heard led to him.” A red pickup truck was parked at the spot where deputies took the person in custody, according to video shot by CNN affiliate KTRK. Authorities had said the suspect drove away from the shooting in a red Ford Ranger. The suspect shot Deputy Darren H. Goforth, 47, while the deputy was filling up his patrol car at a Chevron station just after 8:30 p.m. (9:30 p.m. ET), Harris County Sheriff Ron Hickman said. “Deputy Goforth was refueling his vehicle and returning to his car from inside the convenience store when, unprovoked, a man walked up behind him and literally shot him to death.” Goforth was shot multiple times from behind and then fell to the ground, where the suspect shot the deputy multiple times again, said Deputy Thomas Gilliland, a spokesman for the sheriff’s office. Goforth, a 10-year veteran of the Harris County Sheriff’s Office, died at the scene. R.I.P. Deputy Darren Goforth. Image via AP
