Ill. Inmate Died in Agony While Pleading for Help

For days before he died in a federal prison, Adam Montoya pleaded with guards to be taken to a doctor, pressing a panic button in his cell over and over to summon help that never came. An autopsy concluded that the 36-year-old inmate suffered from no fewer than three serious illnesses — cancer, hepatitis and HIV. The cancer ultimately killed him, causing his spleen to burst. Montoya bled to death internally. But the coroner and a pathologist were more stunned by another finding: The only medication in his system was a trace of over-the-counter pain reliever. That means Montoya, imprisoned for a passing counterfeit checks, had been given nothing to ease the excruciating pain that no doubt wracked his body for days or weeks before death. “He shouldn't have died in agony like that,” Coroner Dennis Conover said. “He had been out there long enough that he should have at least died in the hospital.” The FBI recently completed an investigation into Montoya's death and gave its findings to the Justice Department, which is reviewing the case. If federal prosecutors conclude that Montoya's civil rights were violated, they could take action against the prison, its guards, or both. A Justice Department spokesman declined to comment, saying that the matter was still being investigated. The coroner said guards should have been aware that something was seriously wrong with the inmate. And outside experts agree that the symptoms of cancer and hepatitis would have been hard to miss: dramatic weight loss, a swollen abdomen, yellow eyes. Three inmates corroborated that account in interviews with The Associated Press. The younger Montoya was taken to the prison clinic one day for “maybe five, 10 minutes,” his father said. “And they gave him Tylenol, and that was it. He suffered a lot.” The federal prison in Pekin will not discuss Montoya's death. Prison spokesman Jay Henderson referred questions to the Bureau of Prisons, which denied an AP request for information on Montoya's medical condition, citing privacy laws. It isn't clear whether the prison system, relatives or even Montoya himself knew the full extent of his illness. Montoya's father had no idea his son had cancer or hepatitis. Pakistan: Anti-terror court convicts 5 Americans

Five American men were convicted Thursday on terror charges by a Pakistani court and sentenced to 10 years in prison in a case that has heightened concerns about Westerners traveling to Pakistan to contact al-Qaida and other Islamist extremist groups. The trial of the young Muslim men from the Washington, D.C., area was sensitive for the U.S., which has a duty to ensure justice for its citizens abroad but also has pushed Pakistan to crack down on militancy. Prosecutors said e-mail records and witness statements proved the men used the Internet to plot terror attacks in Pakistan and nations allied with it. The father of one of the men said they were in Pakistan to attend his son's wedding, but had intended to cross into Afghanistan for humanitarian work. The verdict comes the same week Pakistani-American Faisal Shahzad pleaded guilty to trying to bomb New York's Times Square in May after getting training by the Taliban in Pakistan's tribal areas. The judge on Thursday handed down two prison terms for each man, one for 10 years on a criminal conspiracy charge, and the other for five years on the charge of funding banned organizations for terrorism. A copy of the decision seen by The Associated Press said the terms were to be served concurrently. The men, all in their 20s, had faced up to life in prison. They were acquitted of three charges, including planning to wage war against the U.S. and Afghanistan – allies of Pakistan. The men said nothing when the verdict was read out, Deputy Prosecutor Rana Bakhtiar said. Previously, the men claimed they were tortured by Pakistani police and FBI agents, charges denied by authorities here and the U.S. Their lawyers said they would appeal the case. The trial moved with unusual speed in a country where cases often drag out for years and where terror convictions are rare and often overturned on appeal. The trial was closed to journalists and observers and was heard by a single judge in a special anti-terrorism court. The men have been identified as Ramy Zamzam of Egyptian descent, Waqar Khan and Umar Farooq of Pakistani descent, and Aman Hassan Yemer and Ahmed Minni of Ethiopian descent. On Sunday, New York Times reporter Randal Archibold offered up more of his slanted reporting on Arizona’s pending new immigration enforcement law, suggesting that supporters of tough immigration enforcement are fostering fear by exaggerating the problem of violent crime on the border with Mexico: ” On Border Violence, Truth Pales Compared to Ideas .” But does his evidence stand up? Two conservative writers say no, pointing to FBI statistics that show crime in towns outside major metropolitan areas and rural counties crime has increased substantially. When Representative Gabrielle Giffords, Democrat of Arizona, announced that the Obama administration would send as many as 1,200 additional National Guard troops to bolster security at the Mexican border, she held up a photograph of Robert Krentz, a mild-mannered rancher who was shot to death this year on his vast property. The authorities suspected that the culprit was linked to smuggling. “Robert Krentz really is the face behind the violence at the U.S.-Mexico border,” Ms. Giffords said. It is a connection that those who support stronger enforcement of immigration laws and tighter borders often make: rising crime at the border necessitates tougher enforcement. But the rate of violent crime at the border, and indeed across Arizona, has been declining, according to the Federal Bureau of Investigation, as has illegal immigration, according to the Border Patrol . While thousands have been killed in Mexico’s drug wars, raising anxiety that the violence will spread to the United States, F.B.I. statistics show that Arizona is relatively safe. That Mr. Krentz’s death nevertheless churned the emotionally charged immigration debate points to a fundamental truth: perception often trumps reality, sometimes affecting laws and society in the process . Archibold again pompously implied fear-mongering on the part of supporters of immigration enforcement: Moreover, crime statistics, however rosy, are abstract. It takes only one well-publicized crime, like Mr. Krentz’s shooting, to drive up fear. …. Crime figures, in fact, present a more mixed picture, with the likes of Russell Pearce, the Republican state senator behind the immigration enforcement law, playing up the darkest side while immigrant advocacy groups like Coalición de Derechos Humanos (Human Rights Coalition), based in Tucson, circulate news reports and studies showing that crime is not as bad as it may seem. For instance, statistics show that even as Arizona’s population swelled, buoyed in part by illegal immigrants funneling across the border, violent crime rates declined, to 447 incidents per 100,000 residents in 2008, the most recent year for which comprehensive data is available from the F.B.I. In 2000, the rate was 532 incidents per 100,000. Nationally, the crime rate declined to 455 incidents per 100,000 people, from 507 in 2000. Reporter Jennifer Steinhauer seconded Archibold’s assertion about crime dropping on the Arizona border in her Tuesday front-page profile of Sen. John McCain on the campaign trail in Arizona: While border crime has decreased in this state in recent years , the killing of a prominent rancher in the south by what the police suspect was an illegal immigrant set off rage across the state, and helped fuel a tough new state law directed at immigrants. But Tom Maguire researched the actual FBI statistics and came away with the opposite result, though his results are not definitive: …the stats reprinted below tell a different story — measured by violent crimes per 100,000, the non-MSA portion of Arizona has seen a dramatic increase in crime….these numbers do not support the case that the rural and border areas of Arizona are getting safer. Quite the contrary, actually. Maybe the Times can turn a reporter loose on that. Taking off from Maguire’s spadework, Mark Hemingway at the Washington Examiner explained: …essentially, the FBI crime stats are broken down by region and while crime has fallen 20 percent in cities from 2000 to 2008, in towns outside major metropolitan areas and rural counties crime is up 39 and 45 percent, respectively. In other words, it sure looks like crime is way up in the border regions of Arizona.

Leonardo DiCaprio To Star In J. Edgar Hoover Biopic

The movie, penned by ‘Milk’ screenwriter Dustin Lance Black, will be directed by Clint Eastwood. In “Catch Me If You Can” he was constantly one step ahead of the FBI as legendary scam artist Frank Abagnale Jr. He also earned the domestic intelligence agency’s attention as industrialist Howard Hughes in “The Aviator.” Now DiCaprio is set to lead the FBI, playing its very first director, J. Edgar Hoover. Deadline Hollywood reports that the “Shutter Island” star will take on the challenging task of bringing the controversial Hoover’s life to the big screen in a biopic to be directed by Clint Eastwood, who is also producing with Brian Grazer’s Imagine Entertainment. The script comes from Dustin Lance Black, the Oscar-winning screenwriter of “Milk.” Deadline further reports that the film is untitled, though IMDb identifies it simply as “Hoover.” A great deal of controversy surrounds the life of the FBI’s first director. Hoover served in a leadership role over the FBI and its precursor organizations for a total of 48 years. Although he is credited as being responsible for instituting many of the bureau’s grand-scale crime-fighting techniques, he has also been accused of misusing his power for political purposes and employing illegal methods in evidence-gathering. Following Hoover’s reign, the FBI instituted a 10-year maximum term for all directors. As for Hoover’s personal life, it is fraught with rumors that he was a closeted homosexual and cross-dresser. Many of these allegations come from untrustworthy sources and have been refuted, but it remains to be seen how Black chose to handle that aspect of the FBI director’s life in his script. DiCaprio teamed with filmmaker Martin Scorsese earlier in the year — their fourth collaboration — for an adaptation of the Dennis Lehane novel “Shutter Island.” The actor also has a major summer blockbuster coming next month, sci-fi action/thriller “Inception,” from “The Dark Knight” director Christopher Nolan. Eastwood has shifted in his later years from grizzled cowboy actor to respected filmmaker. He picked up Oscar nominations for “Mystic River” and “Letters From Iwo Jima,” and he took home Best Director and Best Picture awards in 2005 for “Million Dollar Baby,” a film for which he also received a Best Actor nom. Eastwood is set to release his latest directing effort, “Hereafter,” later this year. Drunk Speeding Cop Back @ Work After DWI Homicide, No Charges Filed

His own police department says this detective was drunk and speeding when he killed a man, so why is he still working and still a detective? A victim's family wants to know if a Newark, New Jersey detective received special treatment. For more than a week, we have been trying to set up an interview with Newark's Police Director concerning our investigation. We've been ignored. We caught up with Newark detective Mark Hulse as he headed into work at this precinct on a recent morning. Back to work after six-month suspension. Back to work even though his own police department found him guilty of being drunk and speeding when, off-duty, he struck and killed a man named John Marques on this Newark street in July of 2008. The impact was so violent, some of Marques' limbs were severed. An internal police department memo that we obtained put Hulse's speed at 73 miles an hour in a 25 mile an hour zone and his blood alcohol content at .12. The legal limit is .08 So you're probably wondering, how did someone who is supposed to uphold the law and is found to have broken it by his own department, still on the job? And why wasn't Hulse criminally charged? WALLACE: “Do you think they didn't charge him because he was a cop?” LUCIA PIRES: “Yeah. Yeah. I think that. What other conclusion could I come to?” Pires, the victim's ex-wife, claims she and the couple's two teenage children were largely kept in the dark about the criminal investigation into the accident by the Essex County Prosecutor. “There was no communication with the family,” she said. The family says it was stunned to learn that months after the accident, a grand jury had failed to indict Officer Hulse. “There's no doubt in my mind that had it been anyone else they would currently be in jail for manslaughter. There is no doubt in my mind,” Pires said. “Anyone else would have been charged given those circumstances, but because he was a cop I basically think he got away with it.” Our investigation raises questions about how this case was handled from the very beginning. Police records show Officer Hulse, on his way back from a club at 3:00 a.m., ran from the accident scene to the nearby 3rd precinct allegedly to get help for the victim, but was it also to get protection for himself. He was never given a breathalyzer. “Somebody died, and it was 3 0'clock in the morning, and you're coming from the nightclub and no breathalyzer? If it were me or you, you know we'd have a breathalyzer done immediately,” Pires said. Hulse remained at the precinct for two and a half hours without giving any statement. Later, complaining of dizziness and other minor ailments, he went to the hospital. Blood wasn't drawn until more than four hours after the accident. His blood alcohol level then registered .058, but an alcohol expert consulted by the Prosecutor's office put the intoxication level at the time of the accident at .12, adding that it resulted in significant impairments. “Had it been me, or any normal citizen, I believe there would have been charges and they would have been put in jail,” Marques' son, Matthew, said. “I think it's wrong, I don't believe he should be back at work. I personally believe he should be in jail, serving time.” And why is he back at work? Officer Hulse wouldn't answer that question while we were at the precinct. A police spokesman showed up. He wouldn't answer that question either. We were told to put in a formal request to interview the Police Director. We did. No response. “He was speeding. He was drunk. He killed someone and he still has a job and pension in the state of New Jersey. Don't get it,” said Pires. The Essex County Prosecutor's Office told Eyewitness News it believes the criminal case was handled properly and it respects the grand jury's decision. The office did take a second look at this case after we contacted them. Sources tell us the FBI may be pursuing a civil rights investigation and we've learned there may be witnesses who have not yet come forward who were at the precinct the night of the accident. The magazine reported the new arrival, daughter Harper Renn Smith, weighed in at 8 lbs., 3 oz., and was “doing great,” along with her first-time parents. Thiessen, 36 and her artist/actor husband, Brady Smith, were eager to meet their little girl. The actress tweeted just a little more than a week ago, urging her baby to “hurry up.” “Okay, this child of mine needs to hurry up,” she wrote. “Don’t they know outside is so much more fun then inside?” The new parents have been married since 2005. Thiessen followed her “Bell” success with a surprising and memorable turn on another teen classic, “Beverly Hills 90210,” on which she played villainous Valerie Malone. She appeared in several TV series in the late ’90s and early ’00s (“Just Shoot Me,” “Fastlane,” “What About Brian”) and currently appears on USA’s “White Collar,” a show reminiscent of the movies “To Catch a Thief” and “Catch Me If You Can.” Thiessen plays Elizabeth Burke, the dutiful and doting wife of a by-the-book FBI agent.
