Muslim Woman Sues Planet Fitness For Refusing To Let Her Work Out In Headdress A Muslim woman is pursuing her lawsuit against Planet Fitness after she says the refused to allow her to workout in a religious head covering. via News One Tarainia McDaniel (pictured), recently filed a lawsuit against a Planet Fitness in New Mexico over an incident that occurred in October 2011, claiming that the gym wouldn’t allow her to wear her religious head covering when she tried to work out, reports Albuquerque Journal. According to the 37-year-old Albuquerque resident, she signed a two-year contract with the New Hampshire-based business at one location where she was never given a problem about wearing her Muslim head covering. When McDaniel transferred her membership to another Planet Fitness location, though, she was allegedly told that her religious head covering was not allowed because it was against the gym’s dress code, according to the lawsuit. However, the gym in question did display a sign that read, “No jeans, work boots, bandannas, skull caps, or revealing apparel.” McDaniel alleges in her complaint that she asked the gym’s representatives if she could wear her head covering to accommodate her faith and even asked if she could instead wear a hijab, a more formal piece that covers the head and chest. McDaniel claims that her requests were flatly denied and told that the head coverings were direct violations of the strict gym dress codes. Planet Fitness’ attorney, Erika Anderson ,defends her client’s position regarding the case, telling Albuquerque Journal, “My client’s position is that they didn’t know the head covering was for religious purposes. It violated their dress code policy. But the New Mexico Human Rights Act and the Unfair Practices Act states that Planet Fitness had no legal right to deny McDaniel entry on to its facility while wearing her religious head covering. He can’t seem to catch a break. According to TMZ: Chris Brown is the victim of EXTORTION … and his lawyer is about to blow the whistle on the alleged evildoer … so claims Brown’s famous lawyer. Malcolm Ausbon filed a lawsuit against Chris, claiming the rapper and 3 of his goons beat the crap out of him during a pick-up basketball game at 24-Hour Fitness. TMZ has obtained a letter Ausbon’s lawyer sent to Chris’ legal eagle, Mark Geragos, demanding $250,000 from Chris … OR ELSE. As for the “or else” … the lawyer says if Brown doesn’t pay, “Mr. Ausbon is placed in a position by the LAPD where he needs to decide whether he will press charges.” The lawyer continues, “He would rather be compensated.” THAT, Mark Geragos tells TMZ, is EXTORTION … cleverly worded extortion, but extortion nonetheless. Geragos says he’s going after Ausbon by filing a police report. And, by the way, a lawyer in Geragos’ office says he met with Ausbon’s attorney back in August and the guy admitted Brown never touched his client. Geragos’ lawyer says the other attorney said the guy who struck his client had dreadlocks and it was all captured on video. Unfortunately, Chris’ prior bad behavior has made him a target for people looking for a come up. Poor Thang.
Malcolm Ausbon, a California man, says short-fused singer Chris Brown and three members of his posse jumped him at a 24 Hour Fitness last year. All, he says, because of a disputed foul during a pickup basketball game. Ausbon is suing Brown, his goons and 24 Hour Fitness for unspecified damages claiming assault, battery, intentional infliction of emotional distress and negligence. The lawsuit states that when Brown, 24, refused to acknowledge the foul called on him by Ausbon around 11 p.m., Ausbon “expressed his dissatisfaction.” Chris allegedly replied that he was a member of the Bloods street gang. As Ausbon began to back away, members of the singer’s entourage stepped in and said, “If you f–k with Chris, you f–k with us,” the lawsuit states. According to Ausbon, Brown and three members of his posse jumped him at the gym and began to “strike, punch, kick, pull and stomp” his head and body. Ausbon ended up in the ER with a fractured rib and other injuries including cuts and bruises over his face and body, his lawyer Stephen Wegman said: “He was jumped, beaten and dazed, and at some point my client made a police report about the incident and is waiting for police follow-up. Police never followed up.” “Imagine going to play a game of basketball, and you get jumped by four guys because you call a foul,” he said. “This isn’t for fame or fortune. He’s got medical bills and issues.” Ausbon has suffered from post-traumatic stress disorder, distorted vision, dizziness, nervousness, embarrassment, fear and anxiety, the lawyer specified. “All a result of some famous guy thinking he’s above the law.” Wegman said he filed the civil lawsuit after a failed attempt to negotiate a private settlement with Brown’s legal team, who “didn’t want to communicate anymore.” “If Chris Brown isn’t willing to compensate (Ausbon) for what he did to him, I’m not going to back down. It will be for a jury to decide.” Brown is also fighting an unrelated criminal charge that he punched a man in Washington, D.C., last October, and is in anger management rehab as a result. He is still on probation after he pleaded guilty to beating pop singer Rihanna in 2009, agreeing to a no-jail, felony probation plea deal that’s now in jeopardy. He is due back in court February 28. For Chris Brown , or more accurately the people who cross Chris Brown, it appears the hits just keep on coming.
