USA Today’s Request Ted Kennedy-Related FBI Documents Ends with Surprising Lack of Chappaquiddick Papers

USA Today released the results of its Freedom of Information Act requests for FBI documents related to Ted Kennedy. John Fritze’s story leans heavily on the sympathetic “barrage of threats” angle to begin his story, and downplayed the lack of documents on the death at Chappaquiddick. Fritze began:  Sen. Edward Kennedy, who buried two brothers killed by assassins, endured a barrage of threats on his life that continued for much of his political career, thousands of FBI documents released Monday show. More than 2,200 pages of previously secret documents reveal Kennedy, the brother of President John F. Kennedy, received a constant stream of anonymous threats and warnings from members of the Ku Klux Klan and the militant anti-communist “Minutemen.” Fritze arrived at Chappaquiddick late in the article, and hinted without outrage that the Kennedy family may have removed a pile of documents that might have tainted the Ted Kennedy image:  “There might be a lead here or there,” said David Kaiser, a professor at the U.S. Naval War College who has written on the Kennedys. But Kaiser said he is “surprised by what wasn’t there,” including correspondence between the White House and the FBI over Chappaquiddick. The Kennedy family was given a chance to review the documents before they were released. Rep. Patrick Kennedy, D-R.I., and family representatives did not respond to requests for comment. So much for “Freedom of Information.” Remember this one the next time leftists start complaining about George W. Bush being tight with presidential records. Fritze reported that documents show Nixon aide John Dean was asking the FBI to determine if Mary Jo Kopechne, who died in the car Ted Kennedy drove off of Dyke Bridge in 1969, had visited Greece in 1968. Bryan Bender of the Boston Globe suggests the Nixon team was trying to see if Kopechne accompanied the Senator on a Greek vacation.  The Washington Post story by Jerry Markon reported that former Kennedy adviser Bob Shrum said Ted Kennedy delayed running for president until 1980 because of the threats, and somehow not because the threat of Chappaquiddick would also be hanging over his campaign:  Kennedy waited 12 years after Robert was assassinated before running for president, largely because of his family’s concerns about such threats, according to a longtime aide, Robert Shrum. “You took precautions,” said Shrum, Kennedy’s speechwriter during his 1980 presidential campaign. “We had a doctor with us everywhere we went. We had ambulances in most places. The memory was there. But you just lived with it.” Markon’s story ended by relaying only 77 of the 2,200 pages of Ted Kennedy documents were on Chappaquiddick: The files include 77 pages on the drowning of Mary Jo Kopechne when Kennedy drove his car off a bridge on Chappaquiddick Island off Martha’s Vineyard in 1969. The pages are nearly all newspaper articles, but one internal FBI document informed Hoover of the accident and says the police chief in Edgartown, Mass., “confidentially” advised that Kennedy was the driver. “Stated fact Senator Kennedy was driver is not being revealed to anyone,” the document said.

News Laws Are Death to Cats in Australia – Suburban Cats to Be Legally Trapped & Euthanized Under New Local Cat Laws

Cat ownership in WA is under siege by local cat laws newly introduced by the Shire of Swan and soon to be implemented by the City of Joondalup. Cat owners will be penalized by fines if their cat unwittingly trespasses onto a neighbors property without their permission. The ultimate penalty is the trapping of your beloved moggy by a neighbor in a trap supplied by the shire and the impoundment and possible euthanization of your cat if you can’t locate it within 7 days. Location map of City of Joondalup, Western Aus… The legal trapping of cats opened up by these new local cat laws will only encourage vigilantes who hate cats to have an ‘open season’ on cats in their neighborhood. The Cat Haven, a well known Perth based cat rescue group have already reported incidences of cats caught in traps being drowned in lakes. A horrible death for any animal with no chance of escape and astonishingly still a set of laws introduced in such poor format by local councils that policing these laws is almost impossible. Very little forethought went into the ultimate outcomes that these laws would fester, if councils honestly thought that residents of their shire would act responsibly under these new laws they have already been witness to the folly of their naivety. With cats being drowned in traps and my own experience of having my cat Simon being trapped by a neighbor in my own street and taken to the pound with no consultation with the shire. I managed to rescue my cat Simon on Day 6, it was clearly a lucky day for him will your cat be so lucky? Parts of these laws have validation with responsible cat ownership including limiting the number of cats per household, sterilizing cats, micro-chipping or identifying your cat with a collar & identification tag and keeping your cat indoors from the hours of 9pm to 6 am is also very doable. What these laws fail to take into consideration is the intrinsic nature of cats and the impossibility of cat owners to always control some of their inherit behaviors which have allowed cats to survive well prior to their domestication. Cats are highly independent creatures who value their freedom, they have instinctual drives to patrol their territory and to chase off any intruders entering their territory. Cats have very strong maternal instincts and are predatory in nature and mark their territory with their scent to keep any other animals out of their area. Cats rely on these instincts to get through life and expecting them to change these behaviors is literally asking them to stop being a cat. Cats cannot be trained like the dog species and forcing cat owners to achieve the impossible by preventing their cats from occasionally wandering into a neighbors yard is simply ludicrous! The harsh penalty of trapping cats, impounding them and having your cat euthanized as a result is a sickening and heart breaking reality now for cat owners and their families. That this type of action is being implemented by your local shire and your neighbors is just disgusting. I was questioning the legitimacy of the war in Iraq when a serviceman posted a response where he felt insulted that I would be doing something like this on this weekend. And this was my response. “Jason it is because I honor your service as well as the service of the members of my family and all that Americans that are serving endless deployments in Iraq & Afghanistan as well as those who have died in other wars that I think we should honestly examine why we find ourselves nation building on the other side of the world. Maybe those people you encounter wouldn't be so glad to see you if we hadn't helped a brutal dictator like Sadam get and maintain power. After the Iranian revolution we encouraged and aided him in his brutal invasion of Iran. Power that included weapons of mass destruction that we know he used. That we knew were destroyed before we invaded. Maybe they wouldn’t be so glad to see us if we hadn’t tricked him into invading Kuwait and then left him in power while punishing the population. They’ve been so screwed over for the past fifty years they’d be happy to see anyone. Maybe if the western powers hadn't spent the first 60 years of the 20th century drawing up the map of the Middle East we wouldn’t be over there. These aren't conspiracy theories it's history. If we'd just let these people determine what their own countries and government should be (the right of self determination) you might not have to over there serving. For over one hundred years we have been exporting not our highest ideals to other countries but death and destruction in the name of unfettered capitalism. You can dress it up with whatever kind of holier than thou platitudes that you want but it all boils down to money. If you can offer me any proof that what I’m saying isn’t true than you should thank me and all the other loyal Americans for using our freedom of speech this to speak up on your behalf. Especially this weekend. We speak up for you and get crapped on for it and a whole media industry full of chicken hawks makes a fortune out of attacking out patriotism. And I’m also speaking up for my soon to be 18 year old son who I’m sure the war machine will soon be needing once we get into Iran & N. Korea. And it will be the perfect trick when the Dems bring back the draft. Don’t take my word listen to people like General Butler, Dwight Eisenhower, and Ron Paul. It’s all a cynical adaptation by the corporations to use the religious/political philosophy called manifest destiny. It provided for the violent expansion of white people across a broad swath of North America in the first hundred years following indolence. And once we hit California we just kept going. This is just history it’s all there if you look around. If I’m wrong about any of this by all means enlighten me. I’d love to hear an intelligent response. So peace my brother and thanks for yours and all the others who serve(ed). If you’re in combat keep your head down and your powder dry. Stay safe and come home. We need you here.” So far after the response from the right has been a thundering silence. And I’ve found that usually to be the case. Once you get past the platitudes and childish insults that is the usual response the right wingers don’t have anything else to base their position on. I’m not taking part in a conspiracy theory by saying most of the wars that have been fought over the last one hundred years haven’t been necessary and have been fought to improve the wealth and power of the major corporations. May 17th, 2010 BP’s Atlantis: Another Catastrophic Accident Waiting to Happen? The Gulf of Mexico is currently reeling from the human and environmental tragedy unfolding after the explosion of the Deepwater Horizon, an offshore oil platform. The Horizon, operated by BP, exploded on April 20, 2010, killing 11 workers, injuring many others and spilling millions of gallons of oil into the ocean. While the cause of the Horizon explosion is being investigated, it is important to note that BP has a devastating history of accidents and evading government oversight. Worse yet, an even bigger tragedy in the Gulf could be looming. An internal BP email admits that a “catastrophic” accident is possible at another one of its platforms, the BP Atlantis. An accident at this platform could result in a spill that is many times larger than the one currently unfolding from the Deepwater Horizon. BP Atlantis poses a serious, immediate and potentially irreparable threat to the Gulf of Mexico’s marine environment, oil workers and communities. BP’s Atlantis platform became active during the Bush administration in October of 2007. Located in “Hurricane Alley,” more than 150 miles from New Orleans at a water depth of more than 7,000 feet, it is one of the deepest moored semisubmersible oil and gas platforms in the world. In August of 2008, a BP contractor made a startling discovery about Atlantis: The company was operating the massive Atlantis platform without proper up-to-date and engineer-approved documentation. Some of the problems included: * More than 6,000 critical documents — including those for pipelines, flowlines, wellheads and other important systems — did not have the required engineering documentation. * Over 85 percent of the project’s subsea piping and instrument diagrams, critical documents for operating the platform, were not approved by engineers. * Many of its safety shutdown system logic diagrams were not up to date. * Over 95 percent of its subsea welding documents had no final engineering approval, calling into question the safety of the welds. An internal BP email characterized the situation as having the potential for “catastrophic operator errors.” Worse yet, Atlantis is operating in deeper water than the Deepwater Horizon. A worst-case scenario oil spill from Atlantis would exceed the Exxon Valdez spill in only two days, and be many times larger than the spill from the Horizon explosion. BP’s Big Oil Profits The BP group is the largest oil and gas producer and one of the largest gasoline retailers in the United States, and in 2008 was the fourth-biggest company in the world. In 2009, BP was the largest producer in the Gulf of Mexico and had pre-tax profits of $25.1 billion. BP Evades Compliance and the Federal Government Fails to Take Action Despite questions from Food & Water Watch and Members of Congress, BP has chosen to deny the problems at Atlantis. The company went so far as to send a letter to Congress saying that it only learned of the allegations recently and claimed they were unsubstantiated. However, BP’s own documents show that BP has known about these problems for years. Meanwhile, the U.S. Department of Interior’s Minerals Management Service (MMS), the primary federal agency responsible for ensuring that all aspects of oil, gas, leasing, exploration, development and production activities are conducted safely, hasn’t been doing its job. The agency did almost nothing when the whistleblower and Food & Water Watch first reported the problems at BP Atlantis and alerted members of Congress. It was only after 19 members of Congress requested an investigation that MMS said it would conduct an investigation starting in March 2010. By May 2010, however, according to an agency response to a Food & Water Watch Freedom of Information Act request, the agency admitted that it had not and would not take any steps to investigate. Given the seriousness of the situation, production at the Atlantis platform must be immediately suspended until it can be proven safe. In addition, President Obama needs to order a review of all deepwater platforms in operation and overhaul offshore drilling regulations to reflect public interests, not private profits. Supreme Court: Sex offenders can be held indefinitely

(CNN) — The U.S. Supreme Court ruled Monday the federal government has the power to keep some sex offenders behind bars indefinitely after they have served their sentences if officials determine those inmates may prove “sexually dangerous” in the future. “The federal government, as custodian of its prisoners, has the constitutional power to act in order to protect nearby (and other) communities from the danger such prisoners may pose,” Justice Stephen Breyer wrote for the 7-2 majority. At issue was the constitutionality of federal “civil commitment” for sex offenders who are nearing the end of their confinement or who are considered too mentally incompetent to stand trial. The main plaintiff in the case, Graydon Comstock, was certified as dangerous six days before his 37-month federal prison term for processing child pornography was to end. Comstock and the others filing suit remain confined at Butner Federal Correctional Complex near Raleigh, North Carolina. Three other inmates who filed suit served prison terms of three to eight years for offenses ranging from child pornography to sexual abuse of a minor. Another was charged with child sex abuse but was declared mentally incompetent to face trial. All were set to be released nearly three years ago, but government appeals have blocked their freedom. The government says about 83 people are being held under the civil commitment program. Corrections officials and prosecutors determined the men remained a risk for further sexually deviant behavior if freed. The inmates' attorneys maintain the continued imprisonment violates their constitutional right of due process and argue Congress overstepped its power by allowing inmates to be held for certain crimes that normally would fall under the jurisdiction of state courts. The law in question is the 2006 Adam Walsh Child Protection and Safety Act, which includes a provision allowing indefinite confinement of sex offenders. A federal appeals court in Richmond, Virginia, ruled lawmakers had overstepped their authority by passing it, prompting the current high court appeal. “The statute is a 'necessary and proper' means of exercising the federal authority that permits Congress to create federal criminal laws, to punish their violation, to imprison violators, to provide appropriately for those imprisoned and to maintain the security of those who are not imprisoned but who may be affected by the federal imprisonment of others,” Breyer wrote. Breyer equated the federal civil commitment law to Congress' long-standing authority to provide mental health care to prisoners in its custody, if they might prove dangerous, “whether sexually or otherwise.” In dissent, Justice Clarence Thomas said the federal government overstepped its bounds. “Congress' power, however, is fixed by the Constitution,” Thomas wrote. “It does not expand merely to suit the states' policy preferences, or to allow state officials to avoid difficult choices regarding the allocation of state funds.” He was joined by Justice Antonin Scalia. added by: TimALoftis

She grew up encouraging and battling her sister, former Danity Kane singer D. Woods, in songwriting. “It was me, my sister, and we have an older brother,” Shanell said on a recent trip to NYC. “We used to watch him. He did music before either one of us. He did television, movies, and we used to run around the house singing his songs, until we started writing our own. It was friendly competition between me and my sister, because we would always help each other and challenge each other. “I been real nice with the pen game,” she added with a smile. “I was good when I started, and I got better and better and better.” While on the road with her sister during Danity Kane’s tour in support of their debut LP, Shanell, who used to be a backup dancer, crossed paths with Ne-Yo. She was writing to a track, and he asked if he could use it for his album. The song turned out to be “Say It” from Ne-Yo’s Because of You. Ne-Yo eventually invited the singer — who went to a performing-arts high school — to be down with his camp as a songwriter. “It was really a great learning experience,” she said. “[Ne-Yo] listens to all different types of music. I know he sat me down one time and was like, ‘That’s great, but try to say all that in three lines.’ I was like ‘a challenge.’ So my writing has been influenced a lot by him.” Shanell said she decided to join Young Money because, whereas Ne-Yo’s attention was on her writing skills, Wayne saw her as a performer. “Wayne was kinda like, ‘You do this. Keep your music for yourself. You have the talent, I see what you do. You can come over here with Young Money and do what you do over here,’ ” Shanell said. “Which was the best situation I can be in. My music is a little bit different. It’s not R&B, it’s not pop, it’s not rock, it’s not alternative. It’s a fusion of everything. A lot of labels don’t let you do that, but at Young Money, they let you do that.” Wayne also gave her the freedom to take several minutes from the America Most Wanted tour to showcase her skills. She had a mini-set within Wayne’s set last summer. “It was great,” she said. “I brought dancers in. I did a lot of staging and choreographing. I loved that he believed in me enough to do that.” Shanell said her debut LP won’t be out until sometime next year, but she did just drop the mixtape Shut Up and Listen. If you have a physical copy of the disc and look inside, you’ll see a baby carriage filled with headphones and other musical items. That is a playful middle finger to the rumors that she was having Lil Wayne’s baby . “I’m trying to take a negative thing and make a positive,” ‘Nell said, who added that she was never romantically involved with Wayne. “That’s another reason I put this mixtape out, because a lot of people haven’t heard what I do. It’s all these rumors flying, that’s all they hear. So it’s here, this [mixtape] is my baby, this is what I’ve been sitting in the studio every night working on. This is my baby. This is what I’ve been pregnant with for the past nine months. So we’re just trying to take a bad rumor and turn it into something positive.” What did Weezy think of the rumors that he had knocked up his artist? “We never talked about it,” the singer insisted. “Nobody ever talks about the negative stuff. We’re too busy making records. We get on the stage and perform, we get in the studio, we’re on the radio every day.” Joints to Check For
