Treasury Draft Docs Vindicate IBD’s 2009 ‘Individual Private Medical Insurance Is Illegal’ Claim

In mid-July of last year, the good folks on the editorial board at Investors Business Daily made the following observations about the version of ObamaCare then under consideration by the House: … Right there on Page 16 is a provision making individual private medical insurance illegal. … the “Limitation On New Enrollment” section of the bill clearly states: “Except as provided in this paragraph, the individual health insurance issuer offering such coverage does not enroll any individual in such coverage if the first effective date of coverage is on or after the first day” of the year the legislation becomes law. So … Those who currently have private individual coverage won’t be able to change it. Nor will those who leave a company to work for themselves be free to buy individual plans from private carriers. The leaked Treasury draft documents ( 83-page PDF ) referred to in an earlier post this morning about employer coverage (at NewsBusters ; at BizzyBlog ) go beyond vindicating IBD by applying the same prohibitions to group coverage, as the following graphic from Page 14 of the document shows: Therefore, effective March 23: Individuals seeking new or alternative coverage can only buy policies that “comply with Affordable Care Act provisions from which grandfathered health plans are exempted.” Groups seeking new or alternative coverage (obviously including new groups) are in the same boat. As shown earlier this morning, any changes beyond trivial to existing group or individual policies will cause those policies to lose their grandfathered status, forcing those plans to “comply with Affordable Care Act provisions.” Thus, those looking to purchase new policies or who make even minor changes to existing policies that lead to de-grandfathering will have three choices: ObamaCare’s specified minimum coverage levels, which are far higher and far more expensive than typical private plans. Coverage that is more generous and therefore even more expensive than ObamaCare’s specified minimum — but not too generous. As commenter Gary Hall at the previous NewsBusters post noted, if one has coverage that is considered overly generous, it will run the risk of being considered a “Cadillac” plan subject to a 60% excise tax. By 2018, when that tax takes effect, the distance between ObamaCare’s high-threshold minimum coverage and where the “Cadillac tax” kicks in may not be very great. A majority of large-employer plans and plans at many small professional enterprises may end up being subject to the tax. Paying the individual penalty for either not buying insurance (for individuals) or not covering employees (for employers). In other words, individuals can’t freely engage in commercial transactions with insurance providers to buy new policies with provisions tailored to their or their employees’ particular needs and circumstances. Entering into a contract that would do so is now illegal, as IBD observed last July. In an editorial five days after its original, IBD stuck to its guns in the face of withering attacks from the establishment media outlets, “backed up” by the likes of FactCheck.org. Their common complaint was, “Well, they will still be able to buy individual insurance through the state-run ‘exchanges.'” But it was clear then and true now that they will only be able to buy coverage there that is at or above ObamaCare’s specified minimums, and in one so-called “marketplace.” In reality, the “exchanges” are the roach motels of health insurance; once you’re forced in, you can never get out. It turns out that IBD was absolutely correct last year. For affected individuals and even groups, there is no real “market” for health insurance. Arab-American from Michigan crowned 2010 Miss USA

LAS VEGAS – A 24-year-old Arab American from Michigan beat out 50 other women to take the 2010 Miss USA title Sunday night, despite nearly stumbling in her evening gown. Rima Fakih of Dearborn, Mich., won the pageant at the Planet Hollywood Resort & Casino on the Las Vegas Strip after strutting confidently in an orange and gold bikini, wearing a strapless white gown that resembled a wedding dress and saying health insurance should cover birth control pills. When asked how she felt about winning the crown, she said, “Ask me after I've had a pizza.” Fakih, a Lebanese immigrant, told pageant organizers her family celebrates both Muslim and Christian faiths. She moved to the United States as a baby and was raised in New York, where she attended a Catholic school. Her family moved to Michigan in 2003. Pageant officials said historical pageant records were not detailed enough to show whether Fakih was the first Arab American, Muslim or immigrant to win the Miss USA title. Crowned 2010 Miss USA Is Arab-American Rima Fakih, a 24-year-old Arab-American, won the 2010 title in Las Vegas on Sunday after confidently walking on stage in an orange and gold bikini, wearing a strapless white gown that resembled a wedding dress and saying health insurance should cover birth control pills. Miss USA 2010 Rima Fakih, representing Dearborn, Michigan, nearly stumbled in her evening gown, but she said she believed she had the title after glancing at pageant owner Donald Trump as she awaited the results with the first runner-up, Miss Oklahoma USA Morgan Elizabeth Woolard. According to her “That’s the same look that he gives them when he says, ‘you’re hired’,” seh is referring to Trump’s catchphrase from his reality show The Apprentice. US Health Care Bill Summary HR 3590

It’s another significant event in the US as the The US Health Care Bill this March 21, 2010 voting has finally ended. The HR 1203, HR 3590, HR 4872 or Obama Health Care Reform Vote Results are just important to almost every adult American. Health care has been always a hot topic among Americans and has been much of a debate to many. The 219-212 vote cleared the Senate version of health care legislation, “Patient Protection and Affordable Care Act,” which now heads to the White House for Obama’s signature. A vote is pending on a second bill, “The Reconciliation Act of 2010,” a package of fixes and modifications to tax items. This will require a separate Senate vote before it can become law. The Senate bill has 10 major sections and is some 2,400 pages long. The following is a summary of the major provisions of the Patient Protection And Affordable Care Act (HR 3590) -Seeks to provide “Quality Health Insurance Coverage for All Americans” by amending the Public Health Service Act to prohibit preexisting health condition exclusions from insurance coverage. -Prohibits a health plan from rescinding coverage of an enrollee except in the case of fraud. -Health insurance exchanges: requires states to establish an American Health Benefit Exchange for purchase of qualified health insurance plans. Creates a related entity to assist with small business health coverage. -Directs states to establish one or more reinsurance entities for reinsurance programs to assist in health care coverage. -Individual coverage, penalties: requires individuals to maintain minimal health care coverage beginning in 2014. Imposes a penalty for failure to maintain such coverage with exceptions for low-income individuals, members of Indian tribes, people who object on religious grounds. -Penalties for medium-sized Businesses: requires employers of 50 workers who don’t offer coverage to pay a fee up to $750 per worker. -Creates a Small Business Tax Credit: beginning in 2010, small employers can elect a tax credit for 50% of their employee health care coverage expenses. Small employers are generally defined as businesses with no more than 25 employees. -On abortion, permits states to prohibit abortion coverage in qualified health plans offered through an exchange in the state. It prohibits federal funds from being used for abortion services and requires separate accounts for payments for such services. -On Medicaid, the bill seeks to extend Medicaid coverage, beginning in calendar 2014, to certain low-income individuals under age 65. States can expand Medicaid eligibility to these people as early as April 1, 2010. -Sets new standards for Medicare payment to hospitals and doctors by linking “payment to quality outcomes under the Medicare Program.” -Maintains Children’s Health Insurance Program funding for two years through fiscal year 2015. -Medicaid Prescription Drug Coverage: seeks to close a gap in seniors’ prescription drug coverage known as the donut hole. -Expands funding for Community Health Centers. -Expands doctors and health care services, particularly in rural and underserved areas: increases loans made by schools to nursing students. Expands various health care professional training programs. -To curb fraud and potential conflicts of interest, bill would require drug, device, biological and medical supply manufacturers to report “transfers of value” made to a medical professionals. Requires disclosure of physician ownership or investment interest in a manufacturer and new disclosure requirements for nursing homes. -Implements the “Biologics Price Competition and Innovation Act of 2009″ that gives drug makers 12 years of protection, or exclusivity, to sell biologic medicines before facing the threat of cheaper, off-brand alternatives. Senate Democrats reach tentative deal on public option

Senate Democrats reached a tentative deal on the public option Tuesday night. In exchange for dropping the contentious provision, medicare will be expanded for those of age 55+ (may start in 2011), a national insurance plan would be administered by the same federal agency that oversees the respected Federal Employees Health Benefits Program(the insurance options within that plan would be offered by private, nonprofit entities) and finally, a national public option would kick in if insurance companies did not meet certain coverage standards (aka a trigger)
