Source: Patricia Schlein/WENN.com / WENN Colin Kaepernick has been fighting to have his collusion case against the NFL move to a trial and that wish has been fulfilled. The arbitrator in the matter ruled in favor of the free agent quarterback after all 32 teams in the league failed to support why they should receive a summary judgment against Kaepernick and thus taking the case to be heard before a judge. Sports Illustrated reports : The technical reason for Burbank’s ruling is that the NFL and its teams failed to convince Burbank, a law professor at the University of Pennsylvania Law School, that they had met the necessary standard for summary judgment. Under Article 17 of the CBA, Burbank would have granted summary judgment if Kaepernick hadn’t shown enough evidence sufficient to raise a genuine issue of material fact. The “genuine issue” is whether the 30-year-old Kaepernick has been victimized by collusion, which in this context refers to two or more teams, or the league and at least one team, conspiring to deprive Kaepernick of his collectively bargained right to sign with a team. Kaepernick, who earlier in his career led the 49ers to a division championship and a Super Bowl appearance, contends that teams have conspired to keep him out of the NFL. They have allegedly done so on account of the controversy surrounding his kneeling during the playing of the national anthem. A key element of Kaepernick’s argument is that owners are fearful about the capacity and the willingness of President Donald Trump—an ardent critic of Kaepernick and of other players who kneel during the anthem—to damage the league’s business and legal interests. Such a concern was documented in audio recordings of owners during an October 2017 meeting that centered on Kaepernick and the national anthem. This same concern resurfaced in June 2018 when Trump rescinded a White House invitation to the Super Bowl champion Philadelphia Eagles on account of his perception that Eagles players disagreed with him on the anthem (in reality, not one player on the Eagles kneeled during their Super Bowl season). The outlet adds that if Burbank can prove 14 or more teams categorically denied Kaepernick an opportunity to play, the NFL’s player union can band together and call for an end to the current collective bargaining agreement. — Photo: WENN
Kanye West headed home to Chicago to sit down with 107.5’s WGCI Morning Show today and while there he addressed a plethora of topics, including Trump , Drake and Pusha T ‘s beef, and even that unbelievable slavery was “a choice” comment. Earlier this month, ‘Ye seemed to have no idea how to respond when Jimmy Kimmel asked him what makes him think Donald Trump cares about black people—or, any people, for that matter. Now we finally got an answer. He said on the show, “I feel that [Trump] cares about the way black people feel about him, and he would like for black people to like him like they did when he was cool in the rap songs and all this. He will do the things that are necessary to make that happen because he’s got an ego like all the rest of us, and he wants to be the greatest president, and he knows that he can’t be the greatest president without the acceptance of the black community. So it’s something he’s gonna work towards, but we’re gonna have to speak to him.” As for his current relationship with Drake, Kanye said “It hits me in a really sensitive place…because you, like, hang around people and they come to your house and be around your family and this and that, and then they get mad about a beat and then send you purple demon emojis.” But it seems Kanye still has love for the rapper, who dissed him in the process of responding to Pusha T . “It ain’t no beef, ” he said, but he also adds, “I feel that it was insensitive for [Drake] to, in any way, stress me out in any way after TMZ, while I’m in Wyoming healing, pulling all the pieces together, working on my music. And you know, we’ll reconcile that one day because we got to, because we got work to do, and these voices is just too powerful.” He also swore he was not the person who told Pusha about Drake’s secret child . “Don’t pull me into that type of conversation,” Kanye said. “That’s what y’all don’t even understand. I’m ‘Ye, I got major things to do other than be telling him some information about Drake. I don’t sit around and do that. I honestly don’t care that much, in all honesty.” On another note, he finally apologized for his comment about slavery . “I have never really approached or addressed the slavery comment fully, and it’s not something for me to over-intellectualize,” he said to WGCI. “This is something about the fact that it hurt people’s feelings and the way that I presented that piece of information. I could present in a way more calm way, but I was ramped up. And I apologize. That happens sometimes when people are…I’m not blaming mental health, but I’m explaining mental health.” He added, “I don’t know if I properly apologized for how the slavery comment made people feel. I’m sorry for the one-two of the MAGA hat into the slavery comment. Just a couple of weeks ago, Dennis Shields was found dead in his Trump Tower apartment. The ex-boyfriend of Bethenny Frankel was 51 years old. His loved ones, including Bethenny, are still coping with the tragic news. Loss is never easy. Now, the Skinnygirl mogul has taken to Twitter to thank her fans and followers for their support — and to admit just how difficult of a time this is. On Sunday, in a carefully condensed tweet, the The Real Housewives of New York City star shared exactly how she is feeling. “It’s hard to breathe,” Bethenny’s tweet begins. Processing a sudden and agonizing loss is never easy. Shields was part of her life for a couple of decades. “And,” her tweet continues. “I appreciate you giving me the space & support to try to do so.” That means that her fans have been, for the most part, respectful and supportive on social media during this very difficult time. Good. But Bethenny is not mincing words when it comes to sharing how she feels. “It’s excruciating,” she admits. Of course it is. Death is always hard, but this situation is especially difficult, as she explains. “Sudden death is no closure,” Bethenny writes. “And,” she continues, she is haunted by “constant questions and memories.” (Bethenny shared this thank you message on social media, giving a succinct shout-out to followers for supporting her emotionally during these trying times) Her tweet continues, making clear that she and Dennis Shields were still very much in each other’s orbits. “Our relationship is current,” Bethenny reveals. It sounds like she means that neither of them were in the other’s past. Sometimes, on-again, off-again relationships are like that. “So,” she explains. “It’s painfully raw.” Of course. Despite everything, she is pushing forward and dealing with her grief. Bethenny writes that she is “trying to stay healthy and move through it.” That is a very healthy attitude. She explains that she is coping “with tears and close friends. Xo” That is absolutely the way to do it. Don’t try to bury your grief or go through this sad journey alone. Mourn together. And surround yourself with people who can help you to process a senseless loss even if they aren’t reeling from it personally. Your friends and loved ones want to support you. Unfortunately, even as Bethenny processes this loss emotionally, it is coming up during her court battle with her vicious ex, Jason Hoppy. In fact, just days after Shields’ passing, Hoppy’s attorney argued that Dennis Shields’ death, which was initially reported as sounding like an overdose, proves that Bethenny is a bad mom . That is, of course, absurd. And not just because Shields’ final words indicate that his death may have been more complicated than people first assumed — featuring a lethal mix of medications in an effort to combat his back pain. This unfortunately adds insult to injury and almost seems like an argument designed to fail in court but upset Bethenny. Even the judge compared the claim about Bethenny’s parenting to a “grenade.” Bethenny is strong and we know that she can get through this. We just hope that it’s as painless as possible.
Thomas Ravenel does not want your pity. But, if you’re a woman, he very much does want you to give him a call. The veteran Southern Charm star took to Twitter over the weekend in order to make one accusation and one offer. First, the accusation: Ravenel – who quit the aforementioned Bravo series this month amidst allegations of rape by two women – wrote on his personal account that he’s totally fine with Ashley Jacobs ending their relationship a couple weeks ago. For what reason? Because Ravenel hints strongly that Jacobs cheated on him. Today, my personal life just took a huge upward turn,” Thomas Tweeted on Saturday, explaining why as follows: “I finally have more than enough information to move forward without any doubt or hesitation and I’ll never look back.” How ominous sounding, right? The assumption around the Internet is that Ravenel is confirming that he has gathered the necessary intel to prve that Jacobs was sleeping with other men behind his back. That’s why he can finally “move forward” confidently and that’s why he replied to a follower asking if he were single by writing: “And ready to mingle!” Ravenel also sent a second Tweet that cited the Chicago song “If She Would Have Been Faithful,” suggesting that Jacobs had been untrue, writing: “After 30 years I finally understand the lyrics from that wonderful Chicago tune: “If she would have been faithful, if she could have been true, then I would have been cheated, I would have never known real love.” Jacobs – who dated Ravenel for two years and whose feud with his two-time baby mama, Kathryn Dennis, drove much of Season 5 – broke the break-up news to her own social media followers back in mid-August. Fighting off tears in a video, Jacobs said ” I love Thomas and I’ll always love Thomas . I’ll always care about him.” That’s sweet and all, but as we noted above: RAVENEL HAS BEEN ACCUSED OF RAPE ! A former housekeeper and a woman with whom Ravenel went on a date in 2015 have both said he assaulted them sexually. This does not mean he’s guilty, we know. But it’s worth emphasizing. The very rich Charleston resident has denied these accusation, while resigning from Souther Charm and blaming his portrayal on that series for his sullied reputation. “I’m not doing the show anymore,” Ravenel said upon announcing his departure, adding: “In the contract they have the right to fictionalize your story. They took advantage of me. I decided I’ve got too much to lose and informed them I’m not coming back.” As for Jacobs? “I hope the best for her … I do feel a bit sad now,” he Tweeted over the weekend. “But now I know that just around the corner, down the street, around the block, something magical is going to happen … perhaps real love.” Perhaps. Or maybe jail time for those aforementioned rape allegations. Ravenel said he is now seeking “a woman with whom the trust, faith, respect and love is immovable,” adding that he felt he never got that from Jacobs. Will Ashley return to Southern Charm for Season 6? It remains unclear. But she attempted to make amends with Dennis via a lengthy Instagram apology last week . Might she next write one to Thomas? On Friday August 24, Deadline reported that the Chicago native, who has acted in movies including American Gangster and Barbershop 3 , recently signed an overall TV deal with Lionsgate. This deal is one that will see him use his Freedom Road Productions company to “produce and develop” new television series. It seems like Common is really excited for this endeavor, which he spoke on recently. “I’m proud to expand my relationship with the innovative content creator Lionsgate,” Common raved of his new arrangement. “The studio offers a collaborative, creative freedom that is unique in the entertainment industry, which makes them a perfect partner for Freedom Road Productions. I’m looking forward to teaming up with Kevin, Chris and the Lionsgate collective on exciting and fresh television programming.” The rapper, producer, and actor has previously worked with Lionsgate when he appeared in the production company’s films Now You See Me and the third installment of the John Wick franchise. Now, it looks like he’s about to take his partnership with the company to the next level with his very own project to produce. When it comes to acting, Common is known primarily for his roles in movies–but he’s also starred in AMC’s Western drama, Hell on Wheels. He’s certainly a jack of all trades, so it’ll be interesting ot see if this new partnership with Lionsgate will have him stepping in front of the camera for any of his new TV endeavors.
