In a shocking move, Oksana Grigorieva dropped her domestic violence claim against Mel Gibson at a court hearing today in the couple’s custody case. Last month, Mel pleaded no contest to battery, ending that chapter of the pair’s legal circus. But the battle for custody of Lucia, 1, remains unresolved. In fact, it’s been so contentious that today’s move came out of left field, as Oksana actually extended an olive branch in an attempt to settle the case . Oksana’s lawyer, Dan Horowitz, told Judge Scott Gordon that they would no longer claim Mel’s alleged violence as grounds to strip him of custody. Mel’s lawyer, Stephen Kolodny and the judge were visibly shocked. The domestic violence protective order Oksana obtained – prohibiting Mel from contacting or harassing her – has also been terminated as of today. Sources close to Oksana Grigorieva say she would like to be able to communicate directly with Mel, rather than going through intermediaries. No word on whether Mel feels the same way, but it’s a good first step in putting this ugly mess behind them for the good of their little girl. The only potential bad news? Kristian Otto Herzog’s book won’t sell nearly as well if these two are actually getting along now. Poor guy.

In the wake of his former wife’s recent troubles, Charlie Sheen is moving to gain full custody of his two children with Brooke Mueller , Bob and Max. He’s not stopping there, either. Charlie is declaring legal war on Brooke and will not only ask a judge for full custody, but to cut off child support. Sheen has been paying her $55,000 per MONTH to support the twin sons, who were born after the couple’s 2008 wedding (they split this winter). Charlie’s lawyer, Mark Gross, just gave Brooke Mueller’s attorneys notice that he’s going to court tomorrow to try to change the custody arrangement . Gross says he’ll ask the judge to strip Brooke of both legal and physical custody, on grounds that Brooke has relapsed and checked back into rehab . If the judge does give Charlie full custody, Gross wants the judge to terminate his obligation to pay Brooke $55,000 a month in child support. After all, she would no longer be incurring those expenses. Sheen (and presumably the goddesses) would be handling the parenting. Shudder . Brooke’s lawyers are planning their own offensive, though, also asking the judge for full custody. They also Charlie to be psychologically evaluated. That sound you hear is of it being ON. And potentially high and unstable. Imagine if Charlie Sheen is deemed the safer of two parenting options …

This is definitely a sad story, but it kinda makes you angry at the same time. LAWRENCE, Mass. — A woman who withheld potentially life-saving medications from her autistic, cancer-stricken son was sentenced Friday to eight to 10 years in prison by a judge who said her actions “really do chill one’s soul.” Kristen LaBrie was convicted of attempted murder Tuesday for withholding at least five months of at-home chemotherapy treatments for her son, Jeremy Fraser. The boy died at age 9 in 2009. LaBrie, 38, wept and apologized before Judge Richard Welch handed down her punishment in Lawrence Superior Court. “I am remorseful for my actions and I wish I could have done things differently,” LaBrie told the judge in a courtroom packed with sobbing family members and friends of both LaBrie and the boy’s father, Eric Fraser. “If I could do it differently, I would, because I certainly miss my son, and I think about him every day and I wish he could be with me and my family,” she said. Jeremy Fraser was severely autistic, nonverbal and developmentally delayed. He was diagnosed with non-Hodgkins lymphoma shortly after he turned 7 in 2006. His oncologist testified that she told LaBrie that her son’s cancer had a cure rate of about 85 percent to 90 percent under an intensive, two-year treatment plan that included doses of chemotherapy to be given during hospital stays and clinic visits as well as at-home medications LaBrie was supposed to administer at home. LaBrie testified that she largely followed doctor’s orders during the first four phases of his treatment. But she acknowledged that she stopped giving him the at-home medications during the final phase of treatment because she could not bear to see how much pain and suffering the side effects of the medication caused him. Many of LaBrie’s family attempted to plead with the judge to be lenient on her: LaBrie’s older son, Matthew, 18, wrote a letter to the judge asking for leniency. “My mother was nothing but unbelievably kind, caring and completely devoted to Jeremy in every aspect of her life,” he wrote. He described his mother sitting by Jeremy’s bedside while he was treated for cancer at Massachusetts General Hospital. “Something like that takes a toll on a person and after all that, could anybody so easily sit by and watch while a cure is making a child feel worse?” Jeremy’s uncle, Andrew Fraser, spoke to the judge before sentencing, saying he wanted to represent Jeremy and Jeremy’s father, Eric, who was killed in a motorcycle accident seven months after Jeremy died. Andrew Fraser said his brother would have asked for a “fair and just” punishment for LaBrie, despite the contentious relationship they had. Today, the actress posed for photographs at a New York City press conference for Gotti: Three Generations , an upcoming movie about the mob family. John Travolta and Joe Pesci will star in the film, with Nick Cassavetes directing. Lindsay has been rumored to be on board as a younger Victoria Gotti. The key word there is rumored. It’s not official, and even though she was on hand today, she refused to answer questions about her potential role. Will Lindsay Lohan bring Victoria Gotti to life on the big screen? A role in a big, prestigious movie like Gotti: Three Generations would give her career – DOA since her 2007 DUI – a boost. But producers may be hedging. When asked what appealed to her about the film, Fiore Films publicist Steve Honig dodged the question for Lohan, calling it premature to discuss her role. Lohan was recently fired from Inferno , the Linda Lovelace biopic, and there’s no way her ongoing legal problems and train wreck status weren’t to blame. Halle Berry and Gabriel Aubry were back in court today, but unlike previous before a judge, they left having nearly finalized a custody settlement. In a sign that their custody battle may end, Judge Mark Juhas told Gabriel and his camp, “We’re making huge progress. We need to stick with it.” Halle and her lawyers, Neal Hersh and Judy Bogen, went into chambers to talk with the judge. Before that, Gabriel and his lawyers did the same. A settlement conference over Nahla’s custody and visitation is what brought them to court. The major stumbling block has been Halle’s schedule. This takes her out of town from time to time, obviously. From what happened this AM, it looks like Halle and Gabriel are on the verge of a truce. That’s a far cry from a few short months ago, when the two clashed publicly and harshly over not just custody, but their daughter’s race . It only took the Fulton County jury about two hours to convict Redding. Under a life sentence, Redding is not eligible for parole for 30 years. Redding has refused to cooperate with police. Don Henderson praised authorities for attacking the gang problem in Atlanta. He said his family would do its part by lobbying state authorities to ensure Redding never gets paroled.
