Decision on stay expected in California same-sex marriages case By the CNN Wire Staff August 12, 2010 1:57 a.m. EDT Los Angeles, California (CNN) — A federal court in California will rule Thursday on whether to keep a temporary stay in place in the case that overturned the state's ban on same-sex marriages. The United States District Court for the Northern District of California will announce its decision between 9 a.m. and noon (12 p.m. and 3 p.m. ET). If the stay is lifted, same-sex marriages will be legal in California. Last week, Chief U.S. District Judge Vaughn Walker in San Francisco struck down the state's ban on same-sex marriage, ruling that voter-approved Proposition 8 violates the U.S. Constitution. The 136-page opinion is an initial step in what will likely be a lengthy fight over California's Proposition 8, which defines marriage as a union between a man and a woman. At question in the trial was whether California's ban on same-sex marriage violates gay couples' rights to equal protection and due process, as protected by the U.S. Constitution. The high-profile case is being watched closely by both supporters and opponents of same-sex marriage, as many say it is destined to make its way to the U.S. Supreme Court. If it does, the case could result in a landmark decision on whether people in the United States are allowed to marry people of the same sex. Same-sex marriage is currently legal in five U.S. states — Massachusetts, Connecticut, Vermont, Iowa and New Hampshire — and in the District of Columbia, while civil unions are permitted in New Jersey. “Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license. Indeed, the evidence shows Proposition 8 does nothing more than enshrine in the California Constitution the notion that opposite-sex couples are superior to same-sex couples,” Walker, who was appointed to the federal bench by former President Ronald Reagan, wrote in his opinion. “Race restrictions on marital partners were once common in most states but are now seen as archaic, shameful or even bizarre,” he added. “Gender no longer forms an essential part of marriage; marriage under law is a union of equals.” After the ruling, elated supporters gathered to celebrate the judge's opinion in San Francisco's Castro district. People waved rainbow flags and U.S. flags, and carried signs that read, “We all deserve the freedom to marry,” and “Separate is Unequal.” Similar rallies unfolded in Los Angeles and San Diego. “For our entire lives, our government and the law have treated us as unequal. This decision to ensure that our constitutional rights are as protected as everyone else's makes us incredibly proud of our country,” said Kristin Perry, a plaintiff. Perry and Sandy Stier, along with Jeffrey Zarrillo and Paul Katami, are the two couples at the heart of the case, which, if appealed, would go next to the 9th U.S. Circuit Court of Appeals before possibly heading to the U.S. Supreme Court. Opponents of same-sex marriage have said their best bet lies with higher courts and have vowed to appeal the federal judge's ruling. In a national survey conducted by Gallup in May, 53 percent of respondents said same-sex marriages should not be recognized by law, while 44 percent said they should. Proposition 8 is part of a long line of seesaw rulings, court cases, debates and protests over the controversial issue of same-sex marriage. It passed in California with some 52 percent of the vote in November 2008. “Big surprise! By Jayson Rodriguez Lindsay Lohan appears in court (file) Photo: Pool/ Getty Images The Beverly Hills, California, judge who presided over Lindsay Lohan’s recent probation-violation case has removed herself from further proceedings involving the actress after allegations of improper practices. According to TMZ , Judge Marsha Revel contacted various medical experts and participants in Lohan’s case without notifying the former Disney star’s lawyer or the district attorney’s office. A source in the D.A.’s office reportedly told TMZ that Revel stepped down from the case in lieu of the prosecution’s impending request to have her removed. The move is notable because the judge made headlines when she went against the recommendation of experts in Lohan’s case and ordered the troubled star to a different rehab facility after she completed her prison term . Lohan was slated to check into the Morningside Recovery treatment center, however, Revel changed the location, ultimately selecting the UCLA Medical Center instead. Reports suggested Revel was concerned drugs could be attained by Lohan at the recommended treatment center. Sources told TMZ that Lohan’s legal team and prosecutors met Friday to discuss their issues with Revel. Among the complaints aired during the conversation was that the judge contacted representatives at Morningside Recovery on two occasions without properly disclosing her actions. Revel also allegedly met with Robert Shapiro, the attorney Lohan briefly hired after her lawyer in the case quit. The judge, TMZ reported, failed to notify the prosecution of the Shapiro meeting in her chambers. Revel was particularly harsh with Lohan during the troubled actress’ sentencing , scolding her after she pleaded for leniency. “It’s like someone who cheats but doesn’t think it’s cheating if they don’t get caught,” the judge said. CBS ‘Early Show’ Ignores Accusations of Bias Against Judge Behind Prop 8 Ruling

While Thursday reports on both ABC’s Good Morning America and NBC’s Today featured Proposition 8 supporters questioning the impartiality of California Federal Judge Vaughn Walker’s decision to strike down the state’s referendum defending traditional marriage, CBS’s Early Show failed to provide any such arguments. On Good Morning America, correspondent Terry Moran explained: “Opponents of same-sex marriage vowed to fight on and blasted the judge for, they said, letting personal interests trump his legal duty.” A clip was played of one Proposition 8 supporter: “The judge has imposed his own agenda upon the voters and the children and the parents of California.” On Today, legal correspondent Pete Williams noted: “But opponents of gay marriage, who supported Proposition 8, denounced the ruling and began preparing to fight back.” Supporter Randy Thomasson explained: “The judge has shut the Constitution, imposed his own agenda. He’s made a lot of people happy in the gay community in San Francisco, but he is the most dangerous type of judge in America.”   The Early Show report by correspondent Priya David-Clemens only featured a couple brief sound bites of gay marriage opponents in “outright disbelief” of the ruling, but no specific criticisms of the judge being biased. In contrast, three sound bites in favor of the ruling were featured. Of the three network morning shows, only Good Morning America noted that Judge Walker was himself openly gay. Introducing the segment, co-host George Stephanopoulos mentioned: “The judge, Vaughn R. Walker, a Republican first nominated for the bench by Ronald Reagan, he is also openly gay.” Both the Early Show and Today skipped over that detail.      Following David-Clemens’s Early Show report, co-host Harry Smith discussed Judge Walker’s decision with legal correspondent Jan Crawford, who proclaimed: …this is a devastating opinion for opponents of same-sex marriage. 136 pages, he has 80 findings of fact that basically amount not only to a defense of same-sex marriage but to a defense of gay people. He says same-sex couples are identical to straight couples and that religious beliefs that homosexually is a sin harms gays and lesbians. On point after point after point he knocks down all of the arguments that were put forth by opponents of same-sex marriage and says gays and lesbians have a fundamental right to marriage under the constitution, just like straight people do. Smith then wondered if Walker’s ruling amounted to settled law: “…there are plenty of people still opposed who want to mount lawsuits against it. What kind of a chance do they have with – is this enough to set a precedent?” Crawford responded: “If this ruling stands and is affirmed by higher courts, it could affect the laws in 45 states, forcing them to redefine how they look at marriage…this is really the first federal court test and it could definitely, as it goes forward, set a precedent that will affect every person across the country.” Raising the possibility of the case going to the U.S. Supreme Court, Smith asked: “[if] the Supreme Court stays on the same side, based on the legal issues that you just outlined, will same-sex marriage become the law of the land?” Only then did Crawford acknowledge the temporary nature of the ruling: “Now, if the court agrees with that, absolutely. But that is a huge gamble that – the people who brought this case are making a huge gamble the Supreme Court is ready to do that. You know, it’s pretty closely divided, Harry, as you well know, up there.”
