Shady White Plains Cops Will Not Be Charged For Shooting 68-Year-Old Former Marine To Death

Damn shame how they did this man . No Indictment In White Plains Police Killing Of Kenneth Chamberlain No criminal charges will be filed in the fatal police shooting of a 68-year-old ex-Marine killed in his White Plains apartment. A grand jury found no reasonable cause to vote for an indictment in the Nov. 16 killing of Kenneth Chamberlain, Westchester County District Attorney Janet DiFiore said. “We did everything we could and should do to put before that grand jury every piece of relevant and admissible evidence,” DiFiore told reporters on Thursday. The incident started when Chamberlain’s medical alert pendant accidentally went off and police went to his apartment. Family members say Chamberlain told officers he was OK, but they insisted on seeing him. Police took the door off and, they said, Chamberlain came at them with a hatchet and knife. But Randolph McLaughlin, the lawyer for Chamberlain’s family, said White Plains Officer Steven Hart allegedly shouted the “N-word” before he was shot twice by Officer Anthony Carelli and died. DiFiore said the police department assured her it will order a “top to bottom” review over the use of the epithet, as well as its policies on the use of force regarding emotionally disturbed individuals. She said uttering the epithet was not deemed criminal. “The use of a racial epithet in any context is offensive to the dignity of all of us,” she said, adding that when it is used by a police officer “it’s intolerable.” Both officers have civil cases pending against them. Dear Bossip: When My Boyfriend Drinks He Chokes & Beats Me, But He’s Not Like That Sober

Dear Bossip , Preface: I’ve been with my boyfriend for almost two years now.  He’s my first love. Now, he’s one of my best friends, if not my very best friend.  We spent this past Christmas together, which was the first time either of us had ever spent it away from our families.  He invited me to go on his family’s reunion cruise.  He got a job as a counselor at the same sleep away summer camp as me for this July and August.  We go to college in different states now, and he used some of the inheritance money he received from his recently deceased grandmother to come down here and visit me.  He’s been nothing but a wonderful, loving boyfriend, and I can’t imagine not marrying this kid one day and having all his babies.  He frequently talks about when we’re going to get married.  We even almost went to city hall one day last summer on a whim.  He has this whole little plan about how he’s going to get the money to buy me a ring and a house for us and how we will effectively live happily ever after.  He gets me in a way I’ve yet to experience with anyone else, and I honestly feel like we truly love each other. Problem:  We’re both 22.  We both drink.  Sometimes we drink a lot.  Sometimes when we both drink a lot, we argue.  But sometimes, when he drinks too much, the night ends in him choking me.  It’s not every time he gets too drunk, but it’s happened more than once.  Maybe 7 times in the entirety of our relationship.  The last time he blacked out, he punched me repeatedly in the head, and my hearing is still recovering.  He woke up in the morning completely unaware.  He’s admitted to having a drinking problem for years now.  I proposed a break after the last time he hurt me for him to decide if he’s really ready to make the changes necessary to ensure that blacking out and choking me never happens again. Question:  How big of a mistake am I making?  I’m not stupid.  I’m a college senior at one of the most prestigious universities in the country.  I am well aware of the statistics in this country about domestic violence in this country, specifically in the Black community, and I know that logically, I should have left after the very first time.  Even if we were both drunk.  It doesn’t matter.  And, I know that the popular opinion is that if I stay with him, he could potentially kill me one day.  But am I so wrong in thinking that an abusive alcoholic can become a recovering abusive alcoholic?  Or am I too first love drunk to objectively view the situation? I think it’s the fact that it has only happened when he or both of us have been obliterated that I’ve given him the benefit of the doubt.  Plus, we have literally never fight sober.  We don’t argue sober.  We either agree or compromise through communication.  The drunken nights, though severe, are my only qualm about the relationship.  And he’s seen me through some dark times in my life.  I don’t want to give up on him.  I know in my heart that he’s not this guy.  So, I guess, what do you think? I’ve never told anyone that before.  I can’t tell anyone, honestly.  I guess I’m just hoping for some sort of outside opinion. – Punch Drunk Love Dear Ms. Punch Drunk Love , This is Breaking News! This just came in! You say that you are not stupid, well, according to my bull-ish calculator, YES YOU ARE! The hell you trying to justify or reason this damn boy beating on you??!!! No, this is not cool. No, this is not okay. And, hell to the MF’ing naw you shouldn’t stay a minute longer. Get your –ish, and get the hell out!!!! He is not going to change, won’t change, and isn’t interested in changing. And, if you’re so damn smart and intelligent, and you attend one of the most prestigious universities in the country, then how come you can’t use your intelligence and deduce that a boy who beats a woman repeatedly, a boy who admits to being an alcoholic, and a boy who refuses to get treatment for said disease will only continue to beat you, remain an alcoholic, and remain in denial about his illness? Don’t they teach something like that during your core classes at prestigious universities? Don’t you intelligent high-siddity know-it-all women use your brains for common sense, or y’all are too smart for your own damn good, and you figure you’re too intelligent to allow yourself to be beaten by a man because you attend a prestigious university? And, I’m curious as to what prestigious university you attend, or has his punching you in the head rattled your brain and caused delusions of grandeur and you have misconstrued your community college as a prestigious university? Chile, puhlease! Miss me already. And, he didn’t choke your ass “Maybe” 7 times. He did choke your ass 7 TIMES! Then, this fool punched you repeatedly in the head, and you’re recovering from the hearing loss, and you’re asking me what you should do? Really! REEEEEAAAAAALLY????? Here’s what you do: The next time he drinks himself to the point of blackening out, then I want you to boil you some grits, and when they are piping hot I want you to stand over him and pour them over his genitals. And, while he’s recovering in the hospital you tell him that you don’t remember anything at all because you were so drunk that you are unaware of what happened because you blacked out. It’s interesting that you referred to your boyfriend as a “kid” early on in your letter. So, I am only left to surmise that you are correct in your assertion, and that he is not a man, because a real man does not put his hands on a woman. A real man does not drink himself into a stupor and beats his woman, and then awakens the next day with no recollection of what happened. Oh, yeah, those gifts he gives you, and those promises of making you his wife and loving you are only a ploy and his lame sorry ass excuses to you so that you won’t leave him. Because quite frankly no woman with any amount of common sense, or half a brain, and definitely someone who is college educated from a prestigious university would not allow herself to be used as a punching bag for ANY MAN! And, sweetie, if you can’t tell anyone. And, you’ve never told anyone. Then what does that make you….hmmm…I think the correct word is ENABLER! If he knows he has a drinking problem, but he won’t get help for it, then guess what, Ms. Oh-So-Smarty-Pants, he isn’t interested in getting help. They say the first sign of someone who is an addict is the fact that they know they have a problem. If he knows this and he doesn’t do anything about it, then he isn’t interested in healing, and getting treatment. He will forever, and will always be an alcoholic. And, you are enabling him by drinking with him. You are enabling him by allowing him to use you as a punching bag, and then act as if nothing happened. There are no repercussions for his behavior. HE NEEDS TO BE IN AN ALCOHOL TREATMENT PROGRAM. He needs to find out what is they source of his drinking and why he is doing it, and especially getting to the point of blacking out, and beating you in the process. Hold up, hold up, let me take that back….HIS ASS NEEDS TO BE LOCKED THE HELL UP!!!! I’m sorry, but it wouldn’t be me sitting there letting some man punch me and choke me out, and he’s still walking on two legs. No ma’am! As he is blacked out from his drunken stupor, I would be all the black off his ass and then call the police and tell them where to come pick his narrow ass up! And, I want you to know this, and listen to me good, you hear me damn it!!!! You can’t fix him. You can’t change him. You can’t make him be who he isn’t. He is an alcoholic. He is an abuser. He is a monster and like most people when they see a monster, YOU RUN! And, love is not beating on someone. It’s not abusing the person you’re with in any fashion. It’s not hurting them physically, mentally, or emotionally. That is not love, and he doesn’t love you! You’re 22-years old and he is already using you as his target of frustration and anger, and beating you to a pulp, but somehow and some where in your small ass brain you are trying to outweigh the bad with what good again? There is nothing you can say to me, or anyone who is a battered person and has survived an abusive relationship that will make us agree with you and tell you that you should stay. I don’t and will not ever condone or support any man who puts his hands on a woman for any damn reason. Hell, I don’t support any persons putting their hands on their mates, or the person they claim they love. And, here your silly young dumbass is sitting up here trying to justify a man CHOKING YOU and PUNCHING YOU IN THE HEAD! Whew, girl, you gon’ get my blood pressure up! If you feel you can’t talk to anyone, or you are too embarrassed to say something, then have your parents write me. Better yet, I want to sit down with them. I will tell them what’s going on, and let’s see how your father handles the situation. As a matter of fact, let’s have a family meeting, and I pray to GOD that you have a Bubba, Ray Ray, and June Bug in your family. I want them to hear the sordid details of how this boy beats you until he blacks out, and how he doesn’t remember anything the next day. I bet his ass will remember the ass whooping they put on him when I finish telling them what he does to you! So, in the meantime, refer him to an alcohol treatment program. That is all you can do for him. You can’t save him, fix him, or make him be in treatment. That is not your job. If he refuses or doesn’t want to get help, then that should be your ticket and answer to GET THE HELL OUT OF THE RELATIONSHIP! And, then I want you to get into some counseling and speak with someone about your emotional and mental state, as well as being a victim of domestic assault. Please, please, please do not try to justify his niceness, and goodness when he’s sober for when he’s drunk and pummeling you. That doesn’t make sense. There is no justification or reasoning for his behavior. It’ wrong. Pure and simple. And, if you don’t get out just know that this is a prelude to what your life will be like with him forever, if you make it to forever, because one night after he’s drunk and going upside your head he may actually strangle you and kill you. Arrest Made In Phylicia Barnes Murder Case And Sister’s Ex-Boyfriend In Custody As Suspect Someone’s locked up now for the murder of Phylicia Barnes: For nearly a decade, Michael Maurice Johnson dated the half-sister of Phylicia Barnes. He went along on family trips, and played basketball with their brother. He was like family, and considered Phylicia a “little sister,” relatives say. He was also the last person to see the girl alive in late December 2010. Now Baltimore prosecutors have charged him in the murder of the promising North Carolina teenager, whose nude body was found floating in the Susquehanna River one year ago this month. In announcing the charge Thursday, authorities said very little about the case against Johnson, 28. He faces one count of first-degree murder, and officials declined to say how or where Phylicia was killed. Johnson was arrested late Wednesday outside his apartment after police said he tried to run from officers. “This was an enormous collaborative effort by all agencies involved,” Baltimore State’s Attorney Gregg Bernstein said at a news conference, where he was flanked by city police and state troopers. “We hope it provides some measure of closure for the family.” Johnson, who does not appear to have a criminal record, had been repeatedly questioned since Phylicia’s disappearance, but defense attorney Russell Neverdon said Johnson continues to deny any involvement. Neverdon briefly met with his client Thursday at the Baltimore City Detention Center. “He told me, ‘I’m innocent. I didn’t do anything wrong. I will fight this to the very end,’” Neverdon said. After 16 months of investigating, prosecutors obtained the grand jury indictment two days after the former lead detective in Baltimore, Daniel Nicholson IV, was suspended amid allegations that he conducted a rogue investigation to search for his own daughter. The teen went missing from Baltimore County last Friday and was later found unharmed. Neverdon, during a news conference in his lower Charles Village office, said he believes that police expedited their case because of the troubles Nicholson faces, and that the single-count indictment shows their case remains circumstantial. “Police had Mr. Johnson in their sights from the first day,” Neverdon said, noting that his client met four times with homicide detectives and submitted a DNA sample for testing. Johnson’s relatives were questioned and his car was searched, the lawyer said. “The police made good on their promise,” Neverdon said. “They told him during one meeting that it was only a matter of time before they got him.” Bernstein said Thursday that the allegations against Nicholson — whose squad attended the news conference without him — are a “completely separate matter” and will “absolutely not” impact the case against Johnson. “If I thought for a moment that the alleged activity impacted the case, we wouldn’t have brought it,” Bernstein said. Phylicia, an honor student who was set to graduate early from high school, vanished on Dec. 28, 2010, from the Reisterstown Road apartment of her half-sister Deena, while visiting from Monroe, N.C. Deena has said she met Phylicia about 10 years ago at a family reunion in Baltimore, and they reconnected about three years ago on Facebook. Phylicia visited Baltimore several times, and hoped to attend Towson University. Police have described the apartment as a “college house” that wasn’t always secured and said that up to a dozen people were in and out of it over the holidays. George Zimmerman Raises $200K For Legal Defense

George Zimmerman, the former neighborhood watch volunteer accused of murdering Trayvon Martin, has raised at least $200,000 online to fund his defense. Donors contributed “just over $200,000” on a website to help pay for the defense of Zimmerman, who was released on bail earlier this week, his lawyer said. Mark O’Mara added that the site, therealgeorgezimmerman (dot) com, has since been shut down for unknown reasons and Zimmerman remains in hiding. Zimmerman is living in an undisclosed location as he awaits trial on charges of second-degree murder in the February shooting death of Trayvon Martin. The killing, which took place as Martin walked unarmed through a gated community in the central Florida town of Sanford, has gained national attention. Zimmerman has pleaded not guilty and says he killed Martin in self defense. In a stunning move, he apologized to Martin’s family at his bail hearing. The sensational case has prompted civil rights protests and a national debate over guns, self-defense laws, racial profiling and media bias in America. O’Mara told CNN that he would inform the judge in the case of the funds he has raised on Friday. No date has been set for his official arraignment.

George Zimmerman Photo Shows Bloody Head, May Bolster Self-Defense Claim

A new photograph showing the bloodied back of George Zimmerman’s head has surfaced, shedding new light on the controversial Trayvon Martin case. Taken three minutes after he shot and killed Martin, the image gives possible credence to his claim that he fought for his life and acted in self-defense. The revelation comes as his lawyer and prosecutors prepare for Zimmerman’s first bail hearing today, which could result in his being released from jail. George Zimmerman, Bloody Head Zimmerman, 28, is being held on charges of second-degree murder for the February 26 shooting of Martin, 17 which could carry a life sentence if convicted. The graphic image, first obtained by ABC news, shows blood trickling down the back of George Zimmerman’s head from two cuts after the altercation. It also shows a possible contusion forming on the crown of his head. Though the police video , taken hours after the shooting, did not show any obvious injuries, the original police report that night notes that the back of Zimmerman’s head was wet, and that he was bleeding from the nose and head. Zimmerman told police that night that he shot and killed Trayvon Martin in self-defense after Martin punched him, pounced on him and threatened him . Zimmerman says Martin was the aggressor and that he bashed his head into the concrete sidewalk inside the Retreat at Twin Lakes in Sanford, Fla. Zimmerman was treated at the scene by paramedics, then cuffed and driven to the Sanford police station. He was questioned for hours and released. He was not admitted to a hospital or given stitches the night of the incident. The photographer did not see the scuffle that night, but did hear it. The source saw Martin’s body on the wet grass and claims the gunpowder burns on Martin’s gray hoodie were clearly visible, indicating he was shot at very close range. The photographer says Zimmerman asked to call his wife. When the photographer asked what to say, Zimmerman blurted out “man, just tell her I shot someone.” ABC News reports that investigators have seen the photo. “How bad could it have been if they didn’t take him to the hospital [and] didn’t stitch him up,” Martin family attorney Benjamin Crump said in a statement. He goes on to note that, “The special prosecutor has seen all the evidence and still believes George Zimmerman murdered Trayvon Martin.” Zimmerman’s attorney Mark O’Mara says his client will be vindicated: “He needs to get out. He should not be in jail. I want him out because I need him out. He wants to get out. His family wants it out. It should happen.” In a bail hearing in Florida, the burden of proof to deny bail, even in a second degree murder trial, is higher than necessary to seek a conviction in a trial. If Zimmerman is released, his attorney tells ABC News that he has a number of potential safe houses prepared to shelter him. Stay tuned.

Screenwriter Joe Eszterhas, who was collaborating with Mel Gibson on his ill-fated film The Maccabees before claiming in a letter Mel Gibson hates Jews , says he’s got proof that he witnessed the latest rage-filled rants from the troubled star. His teenage son secretly recorded much of it, Eszterhas says. “A lot of the stuff is on tape,” he tells TMZ. What stuff? He says the recordings were made in Costa Rica by his son Nick, though he would not say if the following alleged comments by Mel were captured: “I want to f**k her in the ass and stab her while I’m doing it.” – on his ex-girlfriend and former hate-filled rant target Oksana Grigorieva “He’s a c**t Jewboy.” – on William Morris/Endeavor Chairman Ari Emanuel “I’m glad he’s dead. As for The Maccabees script that Warner Bros. rejected, Joe said: “I’m heartbroken. I put my heart and soul into a script for someone who hates Jews. He needs help. Badly.”

George Zimmerman Appears in Court; Affidavit Outlines Probable Cause For Murder Charge

George Zimmerman made his first court appearance since being officially charged with second-degree murder in the shooting death of Trayvon Martin. Zimmerman wore a gray prison jumpsuit and spoke only to answer “Yes, sir,” after being asked questions about the charge against him and his lawyer. His hair was shaved down to stubble and he sported a thin goatee, which appeared consistent with his booking photo from the day before (below). He resurfaced Wednesday to turn himself in after weeks in hiding. Meanwhile, a new document provided additional details on the prosecution’s case. Judge Mark E. Herr said he found probable cause to move forward with the case and an arraignment would be held on May 29 before another judge. The affidavit of probable cause prepared by prosecutors shed some light on why they chose to charge Zimmerman in the February 26 shooting. The Orlando Sentinel says that on that night, Trayvon Martin’s mother identified screams heard in the background of a 911 call as her son’s. There were doubts as to whether Martin or Zimmerman called for help. Prosecutors interviewed a friend of Martin’s who was talking to him just before the shooting. Martin told the witness he was being followed and was scared. Martin tried to run home, the affidavit says, but was followed by Zimmerman. The affidavit says, “Zimmerman got out of his vehicle and followed Martin.” The affidavit says that “Zimmerman disregarded the police dispatcher” during his initial 911 call , who told him to stop, and “continued to follow Martin.” The 17-year-old “was trying to return to his home.” George Zimmerman: First Court Appearance At a press conference following the court appearance, Zimmerman’s attorney Mark O’Mara said he will seek a bond hearing “in the next few weeks.” Zimmerman is widely expected to enter a not guilty plea. O’Mara said he is working on finding a place he could safely stay if he is released before trial. Speaking to reporters after the hearing, O’Mara said he was concerned that the case up until now has been handled largely in the public eye. “It’s really supposed to happen in the courtroom,” O’Mara said, deflecting questions about evidence in the case and his client’s mental state. “He’s tired,” O’Mara said when asked about Zimmerman, who has said he acted in self-defense and that Martin was the aggressor that night. “He’s gone through some tribulations of his own, being the focus of the intensity of this event. He’s facing second degree murder charges now.” “He’s frightened. That would frighten any one of us.”

For Your Information: Why Florida’s “Stand Your Ground” Law Is Working AGAINST Justice For Trayvon Martin’s Shooting Death

Sometimes the laws made to “protect us” end up doing more harm than good. Sanford police let George Zimmerman go home after he shot and killed Trayvon Martin last month, but Central Florida police agencies routinely make arrests for murder in “stand your ground” cases — and then let courts decide if a killing is justified. Passage of Florida’s landmark self-defense law in October 2005 caused initial confusion, but court records show police and prosecutors now file charges more often than not. Central Florida’s “stand your ground” claimants already in prison or awaiting trial range from an off-duty security guard to a retired Orlando police officer, bar patrons and a man who chopped off his cousin’s hand with a machete. So if police make these type of arrests regularly, why the hell isn’t George Zimmerman punk azz walking the streets??? Those and many other cases headed for trial share a common factor: witnesses willing to testify. In January 2011, 15 to 20 people were nearby when Chad Bekari Smith claimed two men shot at him outside an Orlando gas station. A security guard and father of three, Smith drew his licensed pistol, wounded both men, called 911 on his cellphone and waited for police to arrive, according to his arrest report. “I was going to lose my life, so I reacted and defended my life,” Smith, then 23, told his lawyer, according to court records. But police did not believe him. Nor did a jury that convicted Smith last fall of two counts of aggravated battery with a deadly weapon. His conviction and 20-year prison sentence are under appeal. Unlike that case, there were no known eyewitnesses when Trayvon died Feb. 26 in a confrontation with Zimmerman inside the gated Retreat at Twin Lakes neighborhood. The teen was walking back from a 7-Eleven when he was followed by Zimmerman, 28, a Neighborhood Watch volunteer who fired a single shot and later told police Trayvon attacked him, records show. That’s hardest type of case for prosecutors. When the alleged aggressor is dead and there are no witnesses, “it is harder to disprove or to prove beyond a reasonable doubt” that the shooter claiming self-defense faced a credible threat, according to Randy Means, chief investigator and spokesman for the Orange-Osceola State Attorney’s Office. “Since very little case law exists, all we have to go on is our interpretation of the statute. It’s too new for us to use case law effectively,” Means said. “It is frustrating for the charging prosecutors.” Ultimately, the decision to charge Zimmerman with murder lies in the hands of State Attorney Norm Wolfinger who was one of several prosecutors who lobbied AGAINST “stand your ground” in 2006. At SXSW, Matthew McConaughey Says It’s OK To Laugh At ‘Killer Joe’

By Kara Warner Despite the fact Matthew McConaughey is a homegrown Texan, this is the first year he’s attending Austin’s annual South by Southwest film festival in support of a film of his that was selected. And McConaughey isn’t just in town for one premiere — he’s here for two: “Killer Joe” and “Bernie.” In “Joe,” the “Lincoln Lawyer” star plays a contract killer hired by a young man (Emile Hirsch) who’s trying to get rid of his mom for stealing his drugs. Sound outrageous? It is. So much so that the castmembers revealed that while watching some of the scenes, they didn’t know if they should laugh or be offended. “It’s a comedy, but everyone played it straight,” McConaughey told MTV News at the SXSW premiere Saturday night. “It wasn’t a comedy where you played the joke. The situations are absurd. It’s a bit of a hyperreality like in some good Tarantino films — very violent, at the same time, it’s very funny.” Co-star Gina Gershon added, “The wonderful thing about it is that you could be watching a scene and … one person watching is totally horrified and the other is laughing their head off. Sometimes, it’s like, ‘This is kind of sexy.’ ‘No, it’s horrible!’ ‘No, it’s funny.’ It really screws with your emotions a lot.” Hirsch admitted that the fact that his character hires a hitman to kill his mom is extreme, but she asked for it when she stole his drugs. “It’s kind of crazy. I think the MTV crowd — whoever those Music Television-loving people are out there — could like it,” he said. “I don’t know. I’m not going to tell them they will.” The “Into the Wild” star said he liked the insanity of the story — and that he got to act with a limp. “It was good. [Director William] Friedkin kept coming up to me and was like, ‘Don’t forget the pain. Sources say that he’s is demanding Kim to pay up $7 Million or risk a public and humiliating divorce trial. Here’s what TMZ.com is reporting: “Kris Humphries is secretly demanding $7 MILLION from Kim Kardashian to walk away from their marriage … TMZ has learned. Sources directly connected to Kris tell TMZ … the bballer — through his Minnesota lawyer — has given Kim an ultimatum … either pay up, or endure an ugly, public trial. Our sources say Kris and his lawyer have been told to pound sand, and with good reason. For starters, even if there wasn’t a prenup, the marriage lasted a grand total of 72 days, so the community property wouldn’t be in the universe of $7 mil. Second, there was an iron-clad prenup, which provided that Kim owes Kris zilch. Third, Kris actually MADE MONEY from the marriage. Sources tell us … Kris raked in around $1 mil from the wedding and the TV special that showcased the nuptials. And Kris made off like a bandit because Kim ended up using a portion of what she got to pay for the ring. In addition, we’re told Kris made somewhere between $250,000 and $300,000 from the Kardashian reality show.”
