The late NFL star and convicted killer Aaron Hernandez was granted an abatement on his conviction for the 2013 murder of Odin Lloyd. What does that mean? It means the former New England Patriots star, who took his own life last month in prison, is now considered not guilty in the eyes of the law. Bristol County (Mass.) Judge Susan Garsh, who presided over the original trial, ruled in favor of the star’s estate, citing a bizarre law. Massachusetts law states that if a defendant dies while a conviction is still in the process of appeal, then the previous verdict is vacated. Hernandez committed suicide late last month while serving a sentence of life without parole for the murder of Lloyd. He was just 27. “Abatement is the law in this Commonwealth and this court is required to follow that precedent,” Garsh said. “The Court has no other choice.” The state is expected to appeal the controversial decision, which will most likely wind up in the Massachusetts Supreme Judicial Court. In other words, the legal battle is just beginning. Hernandez’s attorney, John Thompson, argued that neither his client’s cause of death nor any assumed motives should apply to the law. He also noted there was no precedent in any other ruling on the issue that called for abatement not to be granted in a similar situation. “[The original Lloyd ruling] is not a final conviction,” Thompson said, even though a jury convicted Hernandez of murder. “And that’s what matters.” Prosecutor Patrick Bomberg argued otherwise. Bomberg argued that Hernandez chose to die, thus making a conscious decision to forfeit his appeal as a means of being cleared. This is supported by the suicide note to Shayanna Jenkins that basically says as much, and was never, he says, the intent of the law. According to a state police report, Hernandez even mentioned to an unnamed fellow inmate that he was aware of the abatement law. In one of his suicide notes, he allegedly wrote “YOURE RICH” to Jenkins (above), his fiancee and the father of his four-year-old daughter. “The defendant should not be able to accomplish in death what he could not accomplish in life,” Bomberg said of Hernandez’s efforts. At stake is not just Hernandez’s criminal record, which is a moot point now, but his potential monetary payouts from the NFL franchise. The Patriots may no longer be able to withhold money owed on his contract due to a conviction for murder, as they have been doing. “We are arguing there is a motive to [commit suicide],” Bomberg said, noting the financial benefits; Garsh summarily dismissed that point. “This court cannot know why Hernandez took his life,” Garsh said, citing other possible motives, including the athlete’s increased spirituality. She also noted that other inmates heard via a Boston radio show that Hernandez might be gay or bisexual and trying to hide that. Also complicating matters is that if the Hernandez estate does get paid, the family of Odin Lloyd still has a wrongful death civil suit pending. They, in turn, may be able to access any or all money the Hernandez estate gets, if it comes to that (the Patriots are expected to fight this). The families of Daniel de Abreu and Safiro Furtado, whom Hernandez was acquitted of murdering in 2012, may also be suing his estate. A civil suit requires a lower standard of proof than a conviction in criminal court (see O.J. Simpson’s $33 million judgment, for example). Hernandez estate is currently valued at $0.00. Lloyd’s mother and sister led a large group at the hearing of supporters for Lloyd, a former semi-pro football player and Boston landscaper. That group included Shaneah Jenkins, Lloyd’s former girlfriend and the sister of Shayanna Jenkins-Hernandez, who was not present. The Lloyd supporters wept at the ruling. After a lengthy trial, a Bristol County jury ruled in 2015 that Hernandez shot Lloyd six times in an industrial park less than a mile from his home. Steven Holcomb, a former Olympian Gold Medalist in the bobsled, was found dead in his room at the U.S. Olympic Training Center in Lake Placid, New York on Saturday. He was 37 years old. As of this writing, the cause of Holcomb’s is unknown. No foul play is suspected and it is believed he died in his sleep, although we’ll know more about an autopsy is performed. “The entire Olympic family is shocked and saddened by the incredibly tragic loss today of Steven Holcomb,” Scott Blackmun, United States Olympic Committee CEO, said in a statement. He added: “Steve was a tremendous athlete and even better person, and his perseverance and achievements were an inspiration to us all. “Our thoughts and prayers are with Steve’s family and the entire bobsledding community.” Holcomb, a native of Park City, Utah, won a total of three medals while representing the United States at the Olympics. He took home a Gold in 2010 after piloting the four-men sled that broke the United States’ 62-year first-place drought in the event. And Holcomb also won two two bronze medals in 2014; the five-time world champion was training for the 2018 Games at the time of his death. “The only reason why the USA is in any conversation in the sport of bobsled is because of Steve Holcomb,” U.S. bobsled pilot Nick Cunningham, who roomed next to Holcomb in Lake Placid, told the Associated Press. “He was the face of our team. He was the face of our sport. We all emulated him. “Every driver in the world watched him, because he was that good at what he did. It’s a huge loss, huge loss, not just for our team but for the entire bobsled community.” Holcomb battled depression in the past and even attempted suicide inside of a hotel room in 2007. He wrote honestly and emotionally about this period in his life as part of his 2012 autobiography, “But Now I See: My Journey From Blindness to Olympic Gold.” The memoir chronicled how Holcomb was diagnosed with the eye disease keratoconus, which slowly degenerated his vision until a surgery saved his sight and, as a result, his bobsledding career. “After going through all that and still being here, I realized what my purpose was,” Holcomb said in a 2014 interview with the AP. Said USA Bobsled & Skeleton CEO Darrin Steele said in a statement on Saturday: “It would be easy to focus on the loss in terms of his Olympic medals and enormous athletic contributions to the organization, but USA Bobsled & Skeleton is a family and right now we are trying to come to grips with the loss of our teammate, our brother and our friend.” We send our condolences to the family members, friends and loved ones of Steven Holcomb. Last month, the world was shocked to learn that former New England Patriots tight end and convicted murderer Aaron Hernandez was found dead . The 27-year-old former NFL star took his own life, hanging himself in his prison cell at Souza-Baranowski Correctional Center in Massachusetts. Though Hernandez was serving a life sentence without the possibility of parole for the murder of Odin Lloyd , his suicide raised questions. Hernandez’s motive for killing himself has not been established, and some even raise the possibility of foul play due to unusual timing. Conspiracy theorists were quick to note that Hernandez had recently been acquitted of double murder charges in a second, related trial. Only one week before his death, this development offered the athlete and his family hope for his pending appeal of the Lloyd conviction. But now it seems Hernandez may have waited out his second trial in order to ensure that he was acquitted for a surprising, alternate reason: By seeing the second case through (assuming he was found not guilty), he could provide for his family by exploiting an arcane legal loophole. Moments ago, TMZ and several other outlets published the contents of a suicide note Hernandez addressed to his fiancee , Shaynna Jenkins: The message reads: ” Shay, You have always been my soul-mate and I want you to love life and know I’m always with you. I told you what was coming indirectly!” “I love you so much and know you are an angel – literally! We split into two to come change the world! Your characteristics is that of a true angel and the definition of God’s love!” “Tell my story fully but never think anything besides how much I love you.” The suicide note concluded: “This was the Supreme’s, the Almighty’s plan, not mine! I love you! Let (redacted) know how much I love her! Look after (redacted) and (redacted) for me.” “They are my boys (you’re rich). I knew I loved you = Savage Garden ” The note – particularly the part about Jenkins getting “rich” – seems to shed new light on Hernandez’s possible motives in taking his own life. According to investigators, in the weeks before Hernandez was found dead, he was heard telling a friend that “if an inmate has an open appeal on his case and dies in prison, he is acquitted of his charge and will be deemed not guilty.” It seems Hernandez was under the impression that as long as he had a pending appeal in the courts, he would be ruled not guilty upon his death. That may seem like a meaningless technicality, but for Hernandez’s loved ones, the distinction could be worth millions. The New England Patriots terminated Hernandez’s contract as a result of his conviction, a move which allowed them to withhold the $6 million he was owed at the time of his arrest. Now that Hernandez has died an “innocent” man, there’s a possibility that the team will be forced to pay that amount over to the beneficiaries of his will. But as with all matters involving the legal system and large sums of cash, the matter is complex on every conceivable level. In other words, the Patriots organization will likely fight any decision that forces them to issue a payment to Hernandez’s estate. Investigators say they found a total of three notes in Hernandez’s cell. One was addressed to his 4-year-old daughter, and there are conflicting reports about the recipients of the third letter. (Some say the missive was addressed to Hernandez’s gay prison lover , while his lawyers claim the note was written to them.)
