Man charged for covering head during police beating

A Miami man whose beating at the hands of police was captured on cell phone video has been charged with resisting arrest without violence, a charge his lawyer says came from nothing more than the man's attempts to cover his head from the blows. Gilberto Matamoros, a 21-year-old youth center worker, says he was doing nothing wrong when police arrested him during a brawl in Miami's Coconut Grove neighborhood on Halloween. According to his lawyer, Ricardo Martinez-Cid, Matamoros was picked out of an unruly crowd and beaten unconscious by two Miami police officers. He had to be taken to a nearby hospital. Cell phone footage of the incident shows a police officer hitting Matamoros five times on or near his head. Miami police launched an investigation into the two officers' actions after the video appeared on local news stations last week. “This is being investigated at this particular time, and until that investigation is completed, we're really not going to have any comments,” Police Chief Miguel Exposito said last week. Martinez-Cid told CBS in Miami that prosecutors had initially told him that all charges against Matamoros would be dropped, but then suddenly changed their minds earlier this week. A charge of disorderly conduct was dropped, but the resisting arrest charge remained in place. “All he tried to do is cover his head, until he passed out. They beat him until he was unconscious, and they had to take him to Jackson [Memorial Hospital],” said Martinez-Cid. He told WPLG channel 10 that if background noise on the cell phone video were reduced, you could hear Matamoros calling for the officers to stop and saying he's not resisting arrest. “Gilbert is a good kid, he actually mentors kids, he's worked for the police athletic league,” Martinez-Cid added. Matamoros has pleaded not guilty. Martinez-Cid told NBC in Miami that he hasn't filed a lawsuit against the police yet, but is keeping that option open. Man with Half a Head Arrested in Miami.

This mugshot of inmate #100087196 looks like a fake but a guard at a Florida criminal booking facility swears it's for real. “Yeah, I saw him,” a woman who answered the telephone at the Miami-Dade County Pre-Trial Detention Center said. “I just looked at him. I see a lot of stuff. It didn't really bother me.” The woman, who didn't identify herself, said the man who appears to be missing the top of his head “seemed fine” when she saw him about a week ago. The man's picture was no longer on the Miami-Dade County website because he has been released, she said, adding that she didn't know his name. But the mugshot could still be found at http://miami.whosarrested.com , a database of Florida arrests. The website identifies the man as Carlos Rodriguez, 25, and says he was picked up on a charge of allegedly soliciting prostitution on Nov. 9. Other websites were identifying him as Carlos Sosa. The police report, posted on the Miami New Times website, shows that cops wrote “half a head” in the form's “unique physical features” box. His name isn't legible on the form. added by: UtopianSky

Fla. Gay Adoption Ban Unconstitutional

A Miami appeals court on Wednesday upheld a lower court ruling that found the Florida ban on adoption by gay people to be unconstitutional. According to The Miami Herald, “The unanimous 3-0 decision deals a critical blow to Florida's 33-year-old law banning adoption by gay men and lesbians, and most likely sends the case to Florida's highest court for resolution.” The opinion stated, “Given a total ban on adoption by homosexual persons, one might expect that this reflected a legislative judgment that homosexual persons are, as a group, unfit to be parents. No one in this case has made, or even hinted at, any such argument. “To the contrary, the parties agree 'that gay people and heterosexuals make equally good parents.'” The decision from the third district court of appeal in Miami will allow Frank Martin Gill, the gay father at the center of the case, to keep the two sons he and his partner adopted in 2009 after fostering the boys for several years. Legal analysts expect the case to move to the Florida supreme court, where it will ultimately be decided. added by: TimALoftis
