Tracy Morgan, still recuperating from injuries suffered in a horrific car accident last month, has filed a lawsuit against Wal-Mart. The crash took place on June 7 and also took the life of Morgan’s good friend, Jimmy McNair, who was riding with the comedian and others in a limo on the way home from a show in Delaware. They state that “Wal-Mart was careless and negligent in the ownership and operation of its motor vehicle, which caused Mr. Morgan to suffer severe personal injuries.” The complaint continues: “As a direct and proximate result of said collision, Mr. Morgan was caused to sustain severe painful bodily injuries, including but not limited to multiple fractures which required multiple surgeries, extensive medical treatment and will require significant physical rehabilitation.” Tracy Morgan: On the Mend The suit alleges that “Wal-Mart knew, or should have known” that Roper – who was later charged for his role in the incident – was “awake for more than 24 consecutive hours” prior to the collision. Nearly two weeks after the car crash that put Tracy Morgan in critical condition , the actor/comedian was released from Robert Wood Johnson University Hospital today. Morgan will now be admitted to an undisclosed rehab facility where he will work to repair damage caused by his injuries which include a broken femur. At one point, it was rumored that the injuries were so severe that Morgan’s leg would be amputated . While that thankfully turned out not to be true, the June 7 wreck on the New Jersey Turnpike did result in the death of Morgan’s close friend James McNair, as well as in vehicular manslaughter charges for truck driver Kevin Roper , who police now believer was speeding through a construction zone at the time of the accident. There is no word on how long Morgan will need to be in rehab, but his rep stated that the comic still has “a long way to go.” Morgan was scheduled to begin filming a series for the FX network prior to the crash. Producers have assured Tracy and his team that his job will be waiting for him whenever he is fully recovered. Good news Via HuffingtonPost Actor and comedian Tracy Morgan has been upgraded to fair condition following the New Jersey highway crash that badly injured him and killed one of his friends, his spokesman said Monday. “His personality is certainly starting to come back as well,” spokesman Lewis Kay said. The 45-year-old former “Saturday Night Live” and “30 Rock” star suffered broken ribs and a broken leg in the June 7 crash on the New Jersey Turnpike. The crash killed fellow comedian James McNair and seriously injured two other people. Prosecutors say Wal-Mart driver Kevin Roper’s truck hit Morgan’s limo. The Jonesboro, Georgia, resident has pleaded not guilty to death by auto and assault by auto charges. A criminal complaint alleges Roper hadn’t slept for more than 24 hours before the accident when he swerved to avoid slowed traffic on the turnpike and plowed into Morgan’s limo.
