Supreme Court: Sex offenders can be held indefinitely

(CNN) — The U.S. Supreme Court ruled Monday the federal government has the power to keep some sex offenders behind bars indefinitely after they have served their sentences if officials determine those inmates may prove “sexually dangerous” in the future. “The federal government, as custodian of its prisoners, has the constitutional power to act in order to protect nearby (and other) communities from the danger such prisoners may pose,” Justice Stephen Breyer wrote for the 7-2 majority. At issue was the constitutionality of federal “civil commitment” for sex offenders who are nearing the end of their confinement or who are considered too mentally incompetent to stand trial. The main plaintiff in the case, Graydon Comstock, was certified as dangerous six days before his 37-month federal prison term for processing child pornography was to end. Comstock and the others filing suit remain confined at Butner Federal Correctional Complex near Raleigh, North Carolina. Three other inmates who filed suit served prison terms of three to eight years for offenses ranging from child pornography to sexual abuse of a minor. Another was charged with child sex abuse but was declared mentally incompetent to face trial. All were set to be released nearly three years ago, but government appeals have blocked their freedom. The government says about 83 people are being held under the civil commitment program. Corrections officials and prosecutors determined the men remained a risk for further sexually deviant behavior if freed. The inmates' attorneys maintain the continued imprisonment violates their constitutional right of due process and argue Congress overstepped its power by allowing inmates to be held for certain crimes that normally would fall under the jurisdiction of state courts. The law in question is the 2006 Adam Walsh Child Protection and Safety Act, which includes a provision allowing indefinite confinement of sex offenders. A federal appeals court in Richmond, Virginia, ruled lawmakers had overstepped their authority by passing it, prompting the current high court appeal. “The statute is a 'necessary and proper' means of exercising the federal authority that permits Congress to create federal criminal laws, to punish their violation, to imprison violators, to provide appropriately for those imprisoned and to maintain the security of those who are not imprisoned but who may be affected by the federal imprisonment of others,” Breyer wrote. Breyer equated the federal civil commitment law to Congress' long-standing authority to provide mental health care to prisoners in its custody, if they might prove dangerous, “whether sexually or otherwise.” In dissent, Justice Clarence Thomas said the federal government overstepped its bounds. “Congress' power, however, is fixed by the Constitution,” Thomas wrote. “It does not expand merely to suit the states' policy preferences, or to allow state officials to avoid difficult choices regarding the allocation of state funds.” He was joined by Justice Antonin Scalia. added by: TimALoftis

The singer — who fronted Rainbow, Black Sabbath, Heaven and Hell and his own band, Dio, over the years — was remembered by many musicians in the hours after his death was announced on Sunday, including members of Slipknot, Slayer, Anthrax and others . Yet Metallica’s Lars Ulrich wrote an extremely heartfelt, personal and lengthy letter to Dio posted on Metallica’s official website , drummer recalling seeing Dio’s band Elf opening for Deep Purple in Denmark in 1975. “Dear Ronnie, I just got off stage in Zagreb. I was met with the news that you’ve passed on,” he wrote. “I’m kind of in shock, but I wanted you to know that you were one of the main reasons I made it onto that stage to begin with. When I first saw you in Elf, opening for Deep Purple in 1975, I was completely blown away by the power in your voice, your presence on stage, your confidence, and the ease with which you seemed to connect to 6000 Danish people and one starry-eyed 11 year old, most of whom were not familiar with Elf’s music. The following year, I was so psyched when I heard the results of you joining forces with my favorite guitar player [Ritchie Blackmore left Deep Purple to form Rainbow with Dio in 1975]. You guys sounded so right for each other and I instantly became Rainbow’s #1 fan in Denmark. “In the fall of 1976, when you played your first show in Copenhagen, I was literally in the front row and the couple of times we made eye contact you made me feel like the most important person in the world. The news that you guys were staying in town on your day off somehow embedded itself in my brain and I made the pilgrimage to the Plaza Hotel to see if I could somehow grab a picture, an autograph, a moment, anything. A few hours later you came out and were so kind and caring … pictures, autographs and a couple minutes of casual banter. I was on top of the world, inspired and ready for anything. “When we finally got a chance to play together in Austria in 2007,” the post continues, “even though I may not have let on, I was literally transformed back to that little snot-nosed kid who you met and inspired 31 years earlier and it was such a f—ing honor and a dream come true to share a stage with you and the rest of the legends in Heaven and Hell. A couple of weeks ago when I heard that you were not going to be able to make it to the Sonisphere shows that we would be sharing this June, I wanted to call you and let you know that I was thinking of you and wish you well, but I kind of pussied out, thinking the last thing you needed in your recovery was feeling obligated to take a phone call from a Danish drummer/fan boy. I wish I’d made that call. “We will miss you immensely on the dates, and we will be thinking of you with great admiration and affection during that run. It seemed so right to have you out on tour with the so-called ‘Big Four’ since you obviously were one of the main reasons that the four bands even exist. ‘American Idol’ Experts: Michael Lynche Done In By Song Selection

They both bet on the demise of cougar-bait cowboy Casey James , who toyed with self-parody with his ode to mother lovers, “Mrs. Robinson.” But it was brawny Michael Lynche who got the boot . On the one hand, MJ Santilli, webmaster of the “Idol” fan site MJsBigBlog.com , was not surprised Lynche was eliminated, only that he was still around. “Actually, it’s pretty amazing how long he stuck around, considering he was originally slated to go out in ninth place,” she said, noting that the judges were not impressed with his cover of Michael Jackson’s “Will You Be There,” and, apparently, neither were viewers. “Casey James’ fanbase came through for him this week, and he may have caught the attention of some casual fans who appreciated his solid performance of ‘Mrs. Robinson,’ ” she said, noting that it was better than Lee Dewyze’s tepid “Kiss From a Rose.” “Casey’s performance was better than the judges acknowledged — or barely acknowledged, as they were too busy teasing Kara and making jokes about the song’s theme — a younger man seducing an older woman,” Santilli said. “Who knows? The figures shown below comprises the 89.90% of the total election returns. Earlier this morning, the Comission on Election announced that this will be the last announcement of the partial and unofficial results of the elections. This island was made in conjunction with the publishers of Choose Your Own Adventure books. The Nabooti tribe is looking for five missing jewels from the mysterious Nabooti totem. The player flies to various locales across Africa to find the jewels and return them. The island was opened on December 10, 2008. Reality TV Island is the eleventh island released on Poptropica and is based on the hit reality TV show Survivor. Ne-Yo Credits ‘Chemistry’ With Rick Ross For ‘Super High’ Collaboration

Kelly (“Speedin’ “), but his latest, “Super High,” with Ne-Yo , has the potential to be his biggest success yet. The track is the pair’s second collaboration following Deeper Than Rap ‘s “Bossy Lady.” According to Ne-Yo, it was their working relationship that convinced the Boss to recruit his labelmate for “Super High,” the lead single from his forthcoming Teflon Don album. “It was a chemistry thing, so when he put this one together, he said I was one of the first people he called about it,” Ne-Yo told MTV News from the “Super High” video set . “Ross is just a cool dude. I respect his lyrical ability. There’s only a few in the game that really say something when they say something, and Ross is one of those few. So it’s just an honor to be on the joint.” The song has been added radio-station playlists across the country, including New York’s Hot 97 and Power 105. Ne-Yo is currently working on the follow-up to his last album, Year of the Gentleman, which he hopes to release this September. The project is still untitled, but the songwriter explained that the collection will consist of songs inspired by a screenplay he’s written. ‘Glee’ Madonna Soundtrack Debuts At #1 On Billboard Chart

The seven-track The Power of Madonna from “Glee,” featuring such hits as “Vogue,” “Like a Virgin,” “Like a Prayer” and “Express Yourself,” will top the charts with a modest 100,000 in sales, according to figures provided by Nielsen SoundScan. The second-highest debut of the week will belong to the all-AC/DC soundtrack to “Iron Man 2,” which will hit #4 (76,000), followed by the latest from flip-flop-loving beach bum Jimmy Buffett, the Wal-Mart exclusive Encores (#7, 31,000). The rest of the top 10 was relatively unchanged, with country trio Lady Antebellum continuing the strong run of Need You Now (#2, 83,000), riot-causing teen Justin Bieber falling two slots to #3 with My World 2.0 (81,000), Usher falling one with Raymond v Raymond (#5, 52,000), NOW 33 holding steady at #6 (37,000), Bieber’s debut, My World, creeping up two spots to #8 (31,000), the Zac Brown Band’s Foundation hopping six spots to #9 (29,000) and Lady Gaga dropping three to #10 with The Fame (28,000). A handful of wins at the Academy of Country Music Awards in Las Vegas helped boost Miranda Lambert’s Revolution by 23 spots, moving it to #13 (26,000, up 105 percent), even as trippy rockers MGMT took a serious 16-spot tumble in week two with their knotty second album, Congratulations (#18, 20,000, down 70 percent). Carrie Underwood also drafted on some ACM goodwill, moving up 17 slots to #21 with Play On after becoming the first woman in the awards’ history to win Entertainer of the Year two years in a row.
