PBS Reporter Waters Down Liberal Bias of Ninth Circuit Court

Reporting a U.S. District Court judge overturning California’s Proposition 8, PBS correspondent Spencer Michaels noted that if the case is appealed to a higher court, the U.S. Ninth Circuit Court of Appeals would handle it. Michaels watered down the court’s infamous history of liberal rulings, saying that though it may be liberal, it is not more so than any other U.S. Circuit Court. The Ninth Circuit has “kind of a liberal bias – at least that’s the charge,” Michaels quickly corrected himself. “In actual fact, they probably aren’t any more liberal than any other court,” he insisted of the circuit with the dubious distinction of being the most-overturned of any by the Supreme Court. The Ninth Circuit has a long history of being stacked with liberal judges since the days of President Carter, and infamously struck down “under God” from the Pledge of Allegiance in 2002. The Court has arguably inched to the right with the addition of moderate and conservative judges, but is still widely regarded as the most liberal of the circuit courts. James Taranto, member of the editorial board of the Wall Street Journal, described the court as “notoriously liberal,” in his piece about the reversal of Proposition 8. Ashby Jones, writing for the WSJ’s law blog, said that the court has a reputation for being “packed with liberal judges.” The sentiment isn’t confined to conservative-friendly publications. The Los Angeles Times reported last year that 15 of the court’s 16 cases reviewed by the U.S. Supreme Court were reversed. “Judicial analysts attribute the high reversal rate at least partly to the 9th Circuit’s reputation as a liberal-dominated bench, even though more recent conservative appointments have diluted that influence,” the paper reported. Indeed, the New York Times reported this past spring that “outside experts who have examined the circuit for quantitative evidence of its leanings say that over all, it is indeed the most liberal circuit – but not by all that much.” A transcript of the segment, which aired on August 4 at 7:10 p.m., is as follows: JUDY WOODRUFF, PBS anchor: And as you suggest, the proponents of Proposition 8 had already served notice that they plan to appeal. What is their recourse here? SPENCER MICHAELS, PBS correspondent: Well, they’re going to go to the Ninth Circuit, which is California and the rest of the West’s appellate court in the federal system. That court has a kind of a liberal bias, at least that’s the charge. In actual fact, they probably aren’t any more liberal than any other court. They’re going to take up this case, and from there, what one of the lawyers I talked to today said, is that what happens in the Ninth Circuit is going to be very, very important, that they will set precedent. And if they set a precedent that makes the Ninth Circuit different than the rest of the country, then the Supreme Court will want to step in and settle this issue. You can’t have gay marriage approved in the Ninth Circuit and not in the rest of the country. So the Supreme Court will want to get involved in that. So that’s probably what will happen. It probably will go to the Supreme Court eventually. The people who are in favor of gay marriage aren’t really happy to go to the Supreme Court at this point. They know the make-up of that court, and they probably figure that they don’t have a big chance of winning. WOODRUFF: And Spencer, you were saying in your report a few minutes ago that it’s not clear the effect this is going to have on the other 49 states right now. What is your understanding of that? MICHAELS: Well as I said, right now this court is just a district court, a trial court – it doesn’t present a precedent. If it goes to the Ninth Circuit, then there is a precedent involved, and the Ninth Circuit rules in most of the states west of the Rockies. But the rest of the country is not bound by the Ninth Circuit. So the U.S. Supreme Court would have to make a decision for the rest of the country.

Steven Tyler’s Rumored ‘American Idol’ Gig Surprises Joe Perry

Aerosmith guitarist says Tyler’s judging job is a ‘done deal,’ but the rocker didn’t give the band a heads-up. By Mawuse Ziegbe Joe Perry and Steven Tyler Photo: Kevin Kane/WireImage Aerosmith’s Joe Perry said he has been in the dark about bandmate Steven Tyler’s alleged “American Idol” plans and that he only heard the news when rumors of the singer’s new gig hit the Web. “I found out on the Internet, like the rest of the world,” Perry told The Boston Herald. “There was an Aerosmith afterparty at Studio 54 after the [Las] Vegas show — which none of us in the band knew anything about — and he said some stuff there,” Perry said. “I mean, this is no small thing.” Perry also revealed that he’s under the impression that Tyler has already inked a contract with “Idol.” The guitarist said he would have appreciated a heads-up, since the decision has repercussions for the rest of Aerosmith. “I mean, after working with me for 40 years, he couldn’t tell me about this,” Perry said. “Why so secretive? We’re told it’s a done deal. If Steven is committed to a TV show, that kind of affects the rest of us. We’d like to plan our lives, ya know?” Perry’s concerns suggest that Tyler will indeed take a seat at the judges’ table when the 10th season of “Idol” kicks off. Rumors have been swirling about the rocker’s move to the talent competition since Ellen DeGeneres announced her departure from the show after one season. Singer/dancer/actress Jennifer Lopez is another celebrity name that has been thrown around as a possible addition to the show. The fate of the remaining judges — Kara DioGuardi and Randy Jackson, the only remaining judge who has been dishing out feedback since the show debuted in 2002 — still hangs in the balance. “Idol” reps offered a “no comment” when contacted by MTV News regarding reports that DioGuardi had been ousted from the show. Even before DeGeneres’ recent exit, Fox had not confirmed a replacement for straight-talking judge Simon Cowell , who announced in January that he was abdicating his post after the ninth season. However, with the return of executive producer Nigel Lythgoe , the “Idol” judge lineup may firm up soon. Lythgoe has been vocal about his dream critic team and said he would push to get stars such as Elton John and Usher to give pointers on “Idol.” Lythgoe has also said he would welcome back onetime judge Paula Abdul. Abdul, however, has a deal with CBS for her own dance show. Lythgoe said he’s open to bringing Tyler’s wild style to the show. “He has come through that whole rock-and-roll circus,” Lythgoe recently told Variety. “Why wouldn’t you want a legend there? Someone forgot to tell Avenged Sevenfold . The SoCal hard rockers have managed to end Slim Shady’s five-week run at #1 with the best debut of their career. Their fifth album, Nightmare , debuts at the top on next week’s chart on sales of 163,000, according to figures provided by Nielsen SoundScan. That was just enough to edge out Em, who drops to #2 (159,000 units shifted),as Recovery edged toward the 2 million mark and he celebrated his nine VMA nominations . There are no other debuts this week, and the rest of the top 10 just features a shuffling of the cards. Last week’s #2, Rick Ross ‘ Teflon Don, only falls one slot to #3, but with a 64 percent sales drop-off, the Bawse sold considerably less product (63,000) in his second week on the charts. Justin Bieber ‘s My World 2.0 moves up a few to #4 (38,000), Drake ‘s Thank Me Later drops one (#5, 34,000), Kidz Bop 18 is down one to #6 (29,000), Lady Antebellum ‘s still-strong Need You Now is up two (#7, 27,000), Sheryl Crow ‘s 100 Miles From Memphis drops 5 to #8 (24,000), VMA queen Lady Gaga ‘s The Fame is up to #9 (24,000) and NOW 34 is down two spots to #10 (22,000). Veteran rapper Tech N9ne ‘s collabos album The Gates Mixed Plate — featuring Big Scoob , Glasses Malone , Devin the Dude and Brotha Lynch Hung — debuts at #13 (17,000). Fat Joe ‘s The Darkside Vol. 1 has a soft landing at #27 (12,000). Further down the line, R&B vocal group Dru Hill celebrate Indrupendence Day with a #30 bow on sales of 11,000, and new indie buzz act Best Coast sail into the #36 spot with Crazy for You (10,000). The iTunes charts tell a similar story, as Eminem holds on to the #1 slot on the singles tally with the smash Rihanna collabo, “Love the Way You Lie,” while A7X takes over the top spot on the album list. Nightmare is followed by Em’s Recovery , Ross’ Teflon Don , Drake’s Thank Me Later , Gaga’s Fame , an iTunes session from former 10,000 Maniacs singer Natalie Merchant at #6, the Black Keys ‘ Brothers , Mumford & Sons ‘ Sigh No More , the Hans Zimmer score to “Inception” and B.o.B ‘s B.o.B Presents: The Adventures of Bobby Ray . While iTunes does not provide detailed sales data, it’s clear Em’s hold on the top of the singles heap is safe, as the rest of the top 10 is essentially the same as it was last week with just one new title, Usher ‘s “DJ Got Us Fallin’ in Love” at #6. Otherwise, it is: Taio Cruz ‘s “Dynamite” (#2), Enrique Iglesias ‘ “I Like It” (#3), Katy Perry ‘s “Teenage Dream” (#4), Perry’s “California Gurls” (#5), B.o.B’s “Airplanes” (#7), Mike Posner ‘s “Cooler Than Me” (#8), Jason Derulo ‘s “Ridin’ Solo” (#9) and Eminem’s “Not Afraid.” It’s not likely that Eminem will retake the top spot next week, as the Arcade Fire ‘s buzzed-about The Suburbs is due to debut, along with new albums from Bun B , Buckcherry and a Lady Gaga remix album.

Kristin Cavallari Relives Her ‘Hills’ Debut On Finale Red Carpet

‘All the producers were like, ‘You need to own this,’ ‘ she tells MTV News. By Jean Bentley, with reporting by Tim Kash Kristin Cavallari might have looked calm in her blue dress as she confidently marched into the church where Heidi and Spencer were exchanging vows during season five of “The Hills.” But in reality, the former “Laguna Beach” star told MTV News at the “Hills” finale red carpet that she wasn’t quite as secure as she seemed when she made her big debut. “I was so nervous,” Cavallari admitted. In fact, it was the “Hills” crew that gave her the confidence she needed to make her grand entrance at the wedding so memorable. “All the producers were like, ‘You need to own this. Walk out there like, “Move over!” ‘ ” When Cavallari joined the cast after Lauren Conrad’s departure, she certainly had some big stilettos to fill (figuratively speaking). Her biggest concern was how the rest of the ladies would react to the news. “[I thought] ‘Oh my God, no one knows I’m here,’ ” she recalled. “I didn’t know how everyone was going to react. Everyone could’ve been like, ‘Why are you here?’ which I think it seemed like on the show.” But in reality, after the bombshell dropped, Kristin said the rest of the ladies were very kind to her. “Everyone was actually very sweet and did welcome me with open arms.” In fact, the tables were turned when one star said she was actually intimidated by Kristin. “Stephanie’s first comment was, ‘Wait, wait, wait — you’re going to be on the show now?’ She was like, ‘Oh, I’m scared!’ ” What were your thoughts when Kristin first appeared on “The Hills”? Rand Paul To America’s Poor: You Don’t Have It So Bad

Don't fret, American poor people! Turns out you're living better than “the rest of the world,” according to Kentucky Republican Senate nominee Rand Paul. Responding to an attack from Democratic nominee Jack Conway at a candidate forum yesterday, Paul tried to defend his past statement that the president criticizing BP is “un-American.” Paul launched into a spirited defense of “the engine of capitalism,” and worried that assaults on it — like the criticisms of BP from Conway and his Democratic friends — could lead to a “day of reckoning” in the U.S., and perhaps a Depression. This somehow led to a lesson Paul said Kentuckians should hold dear: Sure there are “problems” with the way America deals with the poor, but when they think about it, poor folks should thank goodness they're not stuck in one of those other horrible countries. “The poor in our country are enormously better off than the rest of the world,” Paul said. “Doesn't mean we can't do better, but we have to acknowledge and be proud of our system of capitalism, be proud of our American way.” How'd he get there? Paul told a little story about the Cold War to set up his argument that the poor have it pretty good in America when you really stop to think about it: One of the important lessons that came out of the Cold War — and this is an important description that I don't think comes up enough — the Cold War was won by America because the engine of capitalism defeated the engine of socialism. The Soviets used to show a propaganda film — they wanted to show how horrible America was and how our poor were doing so poorly. They filmed a building in the poor section of New York with some broken windows and they said, 'Oh this is how the poor in America lives.' But it backfired on them because the Soviet citizens looked at that video closely and they saw flickering color television sets in all those windows. Wallace now faces twelve felony counts, including four counts of attempted first degree murder, for what he described as an act of defending his property and his life. If convicted, he could spend the rest of his life in prison. One of the thieves, Damacio Torres later admitted to the theft. He and his partner in crime, Alvara Cardano both have prior arrest records and are believed to be in the country illegally. But they are not facing any charges. Recht said, in his experience, prosecutors overcharge cases to force a person to plea bargain. He argued that it's just not right to put a person through that kind of mental and financial stress. Jefferson County DA, Scott Storey, indicated he'll take a closer look at his office's decision to throw the book at the homeowner and hinted the charges could be reduced. Photo: Chris Weeks/ WireImage When MTV News spoke to Diplo way back in March, he told us that M.I.A. ‘s new album was going to be “heavy” and “weird.” Turns out, he also thinks it’s also “a turd.” That’s according to Dip himself, who was asked by a fan via Twitter on Wednesday about why, at the end of the track “Tell Me Why” “does it sound like a toilet just flushed …?” “Cuz the rest of [the] album is a turd,” he tweeted back. Of course, his response quickly made the rounds on the Internet, ending up on seemingly disparate sites like Oh No They Didn’t and Pitchfork . Diplo then spent the rest of the day tweeting that the sites in question were “trippin’.” “I think when there are no Wavves vs. Crystal Castles 12″s or open [letters] from Conor Oberst and Gucci Mane, @pitchforkmedia has 2 reach a lil 4 news.” But whether or not he was just kidding around when he called M.I.A.’s ///Y/&#92 a “turd,” Diplo has had a rather interesting relationship with the album. Last month, he tweeted that his own “3 trax are slammin'” but that the rest of the record — which was produced mainly by Rusko, Blaqstarr and Switch — “sounds like Skinny Puppy and gives me nightmares.” He also added a pair of sad-face emoticons to further illustrate his point. And back in May, in the now-infamous New York Times Magazine feature on M.I.A. , he told reporter Lynn Hirschberg that “for me, making this record wasn’t easy. In the past, we were a team. But Maya wanted to show us how much she didn’t need us. In the end, Maya is postmodern; she can’t really make music or art that well, but she’s better than anyone at putting crazy ideas into motion.
