The arbitrator in the matter ruled in favor of the free agent quarterback after all 32 teams in the league failed to support why they should receive a summary judgment against Kaepernick and thus taking the case to be heard before a judge. Sports Illustrated reports : The technical reason for Burbank’s ruling is that the NFL and its teams failed to convince Burbank, a law professor at the University of Pennsylvania Law School, that they had met the necessary standard for summary judgment. Under Article 17 of the CBA, Burbank would have granted summary judgment if Kaepernick hadn’t shown enough evidence sufficient to raise a genuine issue of material fact. The “genuine issue” is whether the 30-year-old Kaepernick has been victimized by collusion, which in this context refers to two or more teams, or the league and at least one team, conspiring to deprive Kaepernick of his collectively bargained right to sign with a team. Kaepernick, who earlier in his career led the 49ers to a division championship and a Super Bowl appearance, contends that teams have conspired to keep him out of the NFL. They have allegedly done so on account of the controversy surrounding his kneeling during the playing of the national anthem. A key element of Kaepernick’s argument is that owners are fearful about the capacity and the willingness of President Donald Trump—an ardent critic of Kaepernick and of other players who kneel during the anthem—to damage the league’s business and legal interests. Such a concern was documented in audio recordings of owners during an October 2017 meeting that centered on Kaepernick and the national anthem. This same concern resurfaced in June 2018 when Trump rescinded a White House invitation to the Super Bowl champion Philadelphia Eagles on account of his perception that Eagles players disagreed with him on the anthem (in reality, not one player on the Eagles kneeled during their Super Bowl season). The outlet adds that if Burbank can prove 14 or more teams categorically denied Kaepernick an opportunity to play, the NFL’s player union can band together and call for an end to the current collective bargaining agreement. — Photo: WENN

J ust another day in America. Audio recordings of Buford City Schools superintendent Geye Hamby talking about killing “n***ers” and more violent behavior has leaked. He is now on leave. See Also: President Donald Trump’s Voter Fraud Claims Could Lead To More Voter Suppression In June, a federal lawsuit was filed against Hamby in U.S. District Court in Atlanta for using racial slurs against Black workers at a construction site. Mary Ingram, 66, filed the lawsuit when she was fired in 2017 after working for the school district for nearly 20 years. AJC.com reports, “Ingram and Hamby clashed after she questioned why the color gold — representing the city’s Black school district before the system was integrated in 1969 — wasn’t included in the district’s green and white emblem. Ingram said an agreement had been reached decades ago to have gold incorporated into Buford schools’ colors.” In addition, “Ingram continued to receive write-ups over the next two years until June 14, 2017, when she was told she was fired. Her termination letter said she was ‘perceived as being disrespectful, argumentative and unfriendly and not a good fit in a school environment.’” Now it looks like Hamby will be jobless. In the audio, he says, “(Expletive) that (n-word). I’ll kill these (expletive) — shoot that (expletive) if they let me,” and “Don’t send us a deadbeat n—- from a temp service.” Listen below: LISTEN. A recording has recently been released from what is said to be from an Atlanta area school superintendent – Geye Hamby. In it, he repeatedly and casually refers to African Americans as niggers and even casually speaks about wanting to shoot some niggers. However, even with this clear audio, an attorney representing the school board said the board has “been unable to determine its veracity and authenticity and whether the recording was altered and was at the consent of at least one party or the product of illegal surveillance. Our investigation continues into this matter, but we are hamstrung in that the plaintiff has failed or refused to produce the original recording for testing or provide any information concerning the background or foundation of the recording,” according to AJC.com. Again, Hamby is on administrative leave. Hopefully, he never returns to the school district. The rapper, whose real name is Clifford Harris, donated a year’s worth of lunch money to a sophomore that was reportedly denied food at school because she was 15 cents short last week. News about the incident involving Danielle Aiken , a student at University High School in Volusia County, has sparked outrage, with the lyricist and actor taking to social media to address it. “This s**t is despicable!!! This is the kinda s**t that deters kids from coming to school. I’d like to take care of her school lunch for the year. I hate to hear this type of thing happening to our children. The meal was thrown in the trash, her mother said. “She puts her food on the tray, gets to the front, gives her [account] number to the cashier, and she says, ‘Well, you owe 15 cents,’” the mother said. “My daughter said she didn’t have any money, so the cashier took her food. That’s the big thing — it’s eat breakfast, lunch, so that they can make sure that they’re doing good on their work.
