The late NFL star and convicted killer Aaron Hernandez was granted an abatement on his conviction for the 2013 murder of Odin Lloyd. What does that mean? It means the former New England Patriots star, who took his own life last month in prison, is now considered not guilty in the eyes of the law. Bristol County (Mass.) Judge Susan Garsh, who presided over the original trial, ruled in favor of the star’s estate, citing a bizarre law. Massachusetts law states that if a defendant dies while a conviction is still in the process of appeal, then the previous verdict is vacated. Hernandez committed suicide late last month while serving a sentence of life without parole for the murder of Lloyd. He was just 27. “Abatement is the law in this Commonwealth and this court is required to follow that precedent,” Garsh said. “The Court has no other choice.” The state is expected to appeal the controversial decision, which will most likely wind up in the Massachusetts Supreme Judicial Court. In other words, the legal battle is just beginning. Hernandez’s attorney, John Thompson, argued that neither his client’s cause of death nor any assumed motives should apply to the law. He also noted there was no precedent in any other ruling on the issue that called for abatement not to be granted in a similar situation. “[The original Lloyd ruling] is not a final conviction,” Thompson said, even though a jury convicted Hernandez of murder. “And that’s what matters.” Prosecutor Patrick Bomberg argued otherwise. Bomberg argued that Hernandez chose to die, thus making a conscious decision to forfeit his appeal as a means of being cleared. This is supported by the suicide note to Shayanna Jenkins that basically says as much, and was never, he says, the intent of the law. According to a state police report, Hernandez even mentioned to an unnamed fellow inmate that he was aware of the abatement law. In one of his suicide notes, he allegedly wrote “YOURE RICH” to Jenkins (above), his fiancee and the father of his four-year-old daughter. “The defendant should not be able to accomplish in death what he could not accomplish in life,” Bomberg said of Hernandez’s efforts. At stake is not just Hernandez’s criminal record, which is a moot point now, but his potential monetary payouts from the NFL franchise. The Patriots may no longer be able to withhold money owed on his contract due to a conviction for murder, as they have been doing. “We are arguing there is a motive to [commit suicide],” Bomberg said, noting the financial benefits; Garsh summarily dismissed that point. “This court cannot know why Hernandez took his life,” Garsh said, citing other possible motives, including the athlete’s increased spirituality. She also noted that other inmates heard via a Boston radio show that Hernandez might be gay or bisexual and trying to hide that. Also complicating matters is that if the Hernandez estate does get paid, the family of Odin Lloyd still has a wrongful death civil suit pending. They, in turn, may be able to access any or all money the Hernandez estate gets, if it comes to that (the Patriots are expected to fight this). The families of Daniel de Abreu and Safiro Furtado, whom Hernandez was acquitted of murdering in 2012, may also be suing his estate. A civil suit requires a lower standard of proof than a conviction in criminal court (see O.J. Simpson’s $33 million judgment, for example). Hernandez estate is currently valued at $0.00. Lloyd’s mother and sister led a large group at the hearing of supporters for Lloyd, a former semi-pro football player and Boston landscaper. That group included Shaneah Jenkins, Lloyd’s former girlfriend and the sister of Shayanna Jenkins-Hernandez, who was not present. The Lloyd supporters wept at the ruling. After a lengthy trial, a Bristol County jury ruled in 2015 that Hernandez shot Lloyd six times in an industrial park less than a mile from his home. The Bristol, Conn., native won a national title at the University of Florida and played three seasons with the Patriots, appearing in one Super Bowl. The Voice top 10 performers laid it all on the line once again Monday night, and the stakes are high, especially after the last two weeks. Obviously, every week matters when you’re facing elimination, but after The Voice results last Tuesday, it’s clear that no one is safe. It’s time to run down all of the performances from the episode. Jesse Larson Jesse Larson’s latest performance was a cut above last week’s and boy; it was needed. Singing “Jungle Love” by The time, he made me realize just how much he deserved to be in the competition. He made the song his own and turned in a rock-solid performance. What more could I ask for? Aliyah Moulden Aliyah went with “Jealous” by Labyrinth, and it proved that she had the vocal range to make even a quieter song sound awesome. All season long, she’s been singing anything that she can shout at, but this showed a completely different side to her. Vanessa Ferguson Vanessa opted to sing “Doo Wop” by Lauryn Hill, and it was a return to form for the star. There is absolutely nothing negative I could say about this number. Mark Isaiah There was something very off about Mark’s performance tonight. He went with “Sign of the Times” by Harry Styles, and it was just not all that. The song is not a good one, and the performance suffered. I’m all for people trying to break out of their vocal range, but this was a resounding dud. Chris Blue “24K Magic” by Bruno Mars is a great song, and Chris is an excellent sing, so what could go wrong? A lot. Here’s the thing: Chris has a knack for hitting all the notes, but adding in a high-octane dance number meant his voice struggled. Whether this will signal the end of his time in the competition is another story, but something tells me he may have screwed up. Lilli Passero Lilli went with “Unforgettable” by Nat King Cole, and it was a doozy. I’ve been critical of Lilli in the past, but she’s managed to find her groove and is not straying away from that. More performances like this and I could Lilli on the season finale. Lauren Duski The country singer went with “Tell Me Why” by Wynonna Judd, and it was pretty amazing. She effortlessly hit all the notes and kept the audience intrigued. Hunter Plake Hunter went with “Higher Love” by Steve Winwood, and it was meh. It was such a shame because he’s been one of the ones to watch, but he’s tailed off over the past few weeks. He needs to get it back together right about now because two people are leaving the process. Maybe he never got the memo. TSoul This competitor went with “At this Moment” by Billy Vera. It was great, with several portions that sounded amazing. He knows his style, and he sticks to it. Brennley Brown Brennley has been a frontrunner since the start of the season. His two daughters were ecstatic to meet her, but they were probably a little apprehensive because how many siblings they have out there. The daughters quizzed Stevie about whether a romance was on the horizon for him and Joseline, but he had no idea what the future held for him. As you probably know if you watched Leave It To Stevie online, Savannah was not impressed with Joseline for all of the crap she spouting on social media about her family. “I don’t mind her being my sister, but I don’t want the mother around until she apologizes to all of the girls for all of the stuff she said on social media.” While that was going down, Joc turned his attention to Treasure for opening up about his business with Tommie and Karlie. “I know that someone has been spreading my business all over the streets and I wonder who it was.” Treasure tells him “I felt like I had to tell Sina about you and Tommie because she is my friend and you claim to love her.” Joc tells Treasure “You have no right to get in my business and I can’t mix business with pleasure, so you have to go.” If that was not bad enough, Joc fired Treasure on the spot. We then switched gears to Joc, Scrappy and Stevie who were listening to some new music being recorded by someone named Gunplay. Stevie was congratulated by all of the men for becoming a father, again. When Joc opened up about all the female drama in his life, Stevie wanted to know whether Tommie was going to get hurt in the crossfire. Stevie asks “Are you smashing Tommie?” Joc says “Nope. She was using me to get back at Karlie.” Scrappy then started thinking about the future, while confirming his wedding was off. He also wanted to celebrate the momentous occasion. Scrappy says “I want to throw a bachelor bash.” Stevie says “I have a Panamanian Goddess that I’ll bring through.” Um, alright then. Scrappy then met up with Momma Dee to let her know about the wedding. She asks him “What’s going on with you and the Bam?” Scrappy says “Nothing. It’s over I am having a bachelor bash to get all my feelings out of me because I am moving on to Miami.” Momma Dee was less than impressed but knew she would be fighting a losing battle if she commented on it. Momma Dee then asked about the situation with Kirk and Rasheeda. “Rasheeda is heartbroken, and Kirk is laughing and talking about how he won’t take a DNA test.” Momma Dee says “Oh yes he will. I need to go talk to Shirleen and see what we can do about this.” Scrappy says “I would love to ask you not to do that.” Oh, the drama. What happened with the wedding?” Scrappy tells her “She got up and said There ain’t no wedding and that was all.” Treasure hunted down Joc at the party and managed to turn it around and got her job back. It’s been a good few years for TV revivals, huh? Netflix has brought back shows like Arrested Development and Full House, as well as the limited run of Gilmore Girls, and various television networks are reviving The X-Files , Twin Peaks, and Will & Grace. Considering all that, it’s easy to look back at some of the best TV shows of yesteryear and think about which ones deserve another shot, you know? And few shows could use another go-round as much as Roseanne. Roseanne, the blue collar sitcom created by legendary comedian Roseanne Barr, ran for nine seasons, from 1988 to 1997. It was full of great moments, great actors … all in all, it really was a wonderful show. And that’s why, joy of all joys, a revival is in the works ! The new series will last for eight episodes, with Roseanne and Sara Gilbert, who played Roseanne’s daughter Darlene, signed on as executive producers. Roseanne, Sara, and John Goodman are the only actors signed onto the project so far, with other stars like Laurie Metcalf and Johnny Galecki still in negotiations. Right now there’s no official deal, but networks like ABC and Netflix are bidding on the rights to the revival. It’s all so exciting, right? And honestly, it’s a little confusing, too. For one, John Goodman is returning, but — spoiler alert — his character died in the series finale. Or, well, actually he died in the season 8 finale, but in the series finale Roseanne revealed that the entire final season had been a figment of her imagination, which went into overdrive as she mourned the loss of her husband. She also explained that several elements of the series weren’t actually true: her sister, Jackie, was a lesbian, and her daughters had really ended up with each other’s spouses. See what we mean about it being confusing? To add another element of confusion, in a 2009 blog post, Roseanne gave an update on where she felt the characters would be today. In the post, she said that the Roseanne character, along with Jackie, opened up Landford, Illinois’ first medical marijuana dispensary, saving the house from foreclosure (remember, they never won the lottery). She wrote that “David leaves Darlene for a woman half his age,” then “Darlene meets a woman and they have a test tube baby,” which doesn’t take into account that in the finale she said that David actually ended up with Becky. (And also David would never .) Becky “works at Walmart,” and Mark “dies in Iraq,” which is especially tragic since the actor that played Mark, Glenn Quinn, died from a heroin overdose in 2002. DJ “gets published,” and Dan, who supposedly died of a heart attack at Darlene’s wedding? He “shows up alive after faking his death.” It would be bizarre if the revival followed this storyline, but Roseanne is the show’s creator, and it would explain how John Goodman is signed on to return. But really, whatever happens, we’re definitely looking forward to a return of Roseanne. Especially if it somehow eases the pain and confusion of that last season. Boy Accidentally Kills His Sister On His Birthday Martaveous Santiago took his little sister’s life just moments after she gave him a hug on his 17th birthday. According to the Miami Herald , 13-year-old Tedra King had just run up to her big brother and given him a hug inside their Florida City home. Just as she turned her back to him, Martaveous pointed a loaded semi-automatic handgun he had been playing with at the back of her head — as a joke, he says — and pulled the trigger. Martaveous insists that it was an accident and called the police immediately afterward to tell them what had happened. He said he got the gun from his 14-year-old unnamed friend, who was also at the home at the time of the incident. Police arrested him and charged him with aggravated manslaughter of a child and possession of a weapon during the commission of a felony — neither of which are charges that imply intent. SMH! This has to be an immensely tragic blow for the family, both losing their daughter and possibly a long sentence for their son. We know Lesley Murphy best as a contestant on season 17 of The Bachelor — she fought for Sean Lowe’s heart , and she came in fifth place. Or at least, that was how we knew her. These days, she’s doing work that’s a little more important than reality show love. Last month, Lesley revealed that she carried a gene that put her at high risk for breast cancer and ovarian cancer and, as a preventative measure, she’d be getting a double mastectomy . She explained that her mother battled breast cancer, and so she felt it was best to “take care of it right now” with the surgery. And so last week, she had both of her breasts removed. She’s been documenting her recovery on her Instagram page, and it’s really just amazing to see. The first day after her surgery, she wrote that the whole thing was “hard to wrap my head around,” and after seeing her chest, she described it as “It looks like I was in a bear fight and lost. Badly.” But, she added, “The human body is truly amazing, though, and I will heal soon enough.” The second day after her surgery, she was able to go home, but with a little apron that held four tubes attached to her chest to drain fluids. Poor Lesley wrote that “Walking and breathing still doesn’t come easy,” but she looks pretty tough to us. And then on Sunday, she shared another update — along with a topless photo of herself, taken just five days after her mastectomy. “My Sunday best,” she captioned the picture, “or what I could manage to put on today with limited arm movements.” “My mom washed and dried my hair today. She dresses me in the mornings. She also measures my drains twice daily which are the tubes you see coming out of my lovely red apron I never take off,” she continued. “She’s the freaking best. She slept in my hospital room and bed at home for the first few nights, helping me in and out of bed and giving me meds at horrid hours to control the pain.” “I have to sleep on my back in the exact same position every night,” she described. “Sometimes when I make the wrong movements it feels like my chest is detaching from my body, but all in all, I think my upper half is healing nicely!” “Sure, it’s sunken in and lumpy because what you see are deflated expanders that were put in which will gradually get filled every 2-3 weeks as I get ready for reconstructive surgery.” “Hopefully by then the permanent marker will be off my body.” Lesley wrote that she feels “lucky” because “my surgeons only made one vertical incision on the lower half of both breasts will saving skin and nipple.” “So while all breast tissue is (hopefully) gone,” she concluded, “I retained some of the old me! Happy Sunday. God is good.” In her latest update, which she wrote yesterday, she wrote that she had two of her four tubes removed, and the other two would be removed next week. “As always,” she added, “I love you guys. I read every heartfelt comment and truly feel the love of this incredible support system.” “Together we are creating so much awareness for early detection, screenings, gene mutations and how to work with the options we have.
