The Side-Eye: Papa John’s CEO Releases An ‘Explanation’ On All That Obamacare Job-Cutting Bull

Wonder if Papa’s ‘dip’ in sales had anything to do with this shady letter? Pay attention folks! According to The Huffington Post , this is what a half-azzed apology from a wealthy CEO looks like! Reading what has been written about statements I made on the effect of the Affordable Care Act on our franchisees reminds me of a quote from Lewis H. Lapham, former editor of Harper’s magazine: “People may expect too much of journalism. Not only do they expect it to be entertaining, they expect it to be true.” Many in the media reported that I said Papa John’s is going to close stores and cut jobs because of Obamacare. I never said that. The fact is we are going to open over hundreds of stores this year and next and increase employment by over 5,000 jobs worldwide. And, we have no plans to cut team hours as a result of the Affordable Care Act. Clearly there was some misunderstanding somewhere. The remarks that generated the headlines were made during an entrepreneur class I was asked to speak to at a Florida college. I was asked to share my experience as an entrepreneur and to provide the students with real-life small business situations. Unbeknownst to me, until she identified herself, a reporter was there. Reporter: “My understanding is that if you’re a full time employee, which is 35 hours or over, you’d be covered. Or if you’re part time then you wouldn’t be. So wouldn’t some business owners just cut people down like 34 hours a week so they wouldn’t have to pay for health insurance?” Me: “It’s common sense. It’s what I call lose-lose.” Companies like Papa John’s are largely a collection of small independent businesses. The average Papa John’s franchisee owns three to four stores. Since our franchisees own the restaurants they operate, who they hire, how many hours they give each employee and what they pay each employee is up to them, not me or Papa John’s. Like any small business in these economic times, our franchisees are under a tremendous amount of pressure on costs. During that same interview, talking about Obamacare I said, though it wasn’t widely reported: “The good news is 100% of the population (full-time workers) is going to get health insurance. I’m cool with that.” “We’re all going to pay for it. There’s nothing for free.” “And this way I get to provide health insurance and I’m not at a competitive disadvantage … our competitors are going to have to do the same thing.” Papa John’s, like most businesses, is still researching what the Affordable Care Act means to our operations. Regardless of the conclusion of our analysis, we will honor this law, as we do all laws, and continue to offer 100% of Papa John’s corporate employees and workers in company-owned stores health insurance as we have since the company was founded in 1984. How the hell is this a ‘lose-lose situation’ when the dayum CEO isn’t losing a thing? Maybe because the worker’s losing out twice?? Another Teabagger bites the dust! Via CBS News : Allen West Concedes In Florida The third time’s a charm. Patrick Murphy has declared victory twice already in his race against Rep. Allen West for Florida’s 18th district. But this time, a declaration of victory means a bit more. After two weeks of challenging the election results in one of South Florida’s congressional district, Republican Rep. Allen West is throwing in the towel. Early Tuesday morning, the Tea Party favorite conceded that he does not have enough votes to beat Murphy. “[W]e will not contest the certification or challenge the seating of Congressman-Elect Murphy,” West said in a statement according to The Palm Beach Post. Murphy remained ahead of West by 0.58 percent, which is more than the 0.5 percent margin required by Florida law to require a full recount. West has called for partial recounts and challenged the accuracy of the St. Lucie County Supervisor of Elections, but after a judge denied his latest request for a recount of all early votes and legal challenges failed to prove an alternate outcome, West conceded. He continued, however, to raise questions about the process. “While there are certainly still inaccuracies in the results and the actions of the St. Lucie County and Palm Beach County Supervisors of Elections rightly raise questions in my mind and for many voters, after much analysis and (Sunday’s) recount in St. Lucie County, our legal team does not believe there are enough over-counted, under-counted or fraudulent votes to change the outcome of the election,” West said in a statement. Despite West’s challenges, the 29-year-old Murphy was in Washington last week with the rest of the newly-elected members of the U.S. House for orientation. Womp! Womp! We have a feeling we ain’t done hearing about Mr.West though. SMH!

Hate It Or Love It?1?! 58-Year-Old Woman Becomes A Surrogate For Her Own Daughter

Is this sweet or a lil’ too much? Some are saying it’s a beautiful, selfless act and other’s are questioning the safety risks Cathy Donnelly took for her daughter’s own happiness. According to The Daily Mail : Cathy Donnelly, 58, is six months pregnant and will welcome her seventh grandchild into the world when she gives birth to her – before daughter Shannon Fischer raises the baby. Mrs Fischer and her husband Jamie had been trying for two years when they discovered they couldn’t conceive due to scarring in her uterus. So Mrs Donnelly mother of three and a grandmother of six, volunteered to be a surrogate mother for her daughter. Mrs Fischer said: ‘The day I came home from my surgery mum said “I’ll do it”. She didn’t hesitate.’ Mrs Donnelly, from London in Ontario, Canada, said: ‘I felt bad for them – I just thought what’s nine months of my life? They are going to have a child for the rest of theirs? It’s not like I’m busy doing anything.’ Michael Murray, specialist at the Northern California Fertility Medical Center, says though there have been cases of mothers acting as surrogate for their daughters before it is typically something the medical community does not advise. He said: ‘Usually it’s a close friend or a sister that acts as the gestational carrier – women who are over 45-years-old are not normally in good enough health. ‘Pregnancy for older women is much riskier. The most common complications are high blood pressure, gestational diabetes and premature child birth.’ But they were risks Mrs Donnelly was willing to accept and while she admits her pregnancy hasn’t been easy, she has had no complications so far. ‘It was long process and involved a heavy dose of fertility drugs for both of us but in the end it all paid off. ‘But it has been challenging. Now I’m showing I make sure people aren’t staring or looking at me because they’re probably thinking ‘look at that old lady.’ Mrs Donnelly said she did question whether she was doing the right thing and if everything would work out okay until she started to feel the baby move. Now her only concerns are about how she will feel once she has given birth. ‘I don’t know if I’ll feel like I’ve lost her, I don’t know how I’m going to feel,’ Mrs Donnelly said. Shannon plans to name her daughter Zoey Hope Catherine after her mother. And for her the whole experience has made her cherish their mother-daughter relationship even more. Uhmmm…ok. Nicki Minaj is voicing her fears about her performance as a judge on the new season of “American Idol.” Via PEOPLE : Nicki Minaj is as fearless on stage as she is on the red carpet. But when it comes to the season premiere of American Idol on Jan. 16, the new judge isn’t quite so brave. “I’m scared,” she told Idol host Ryan Seacrest on his radio show Monday morning. What’s she worried about? “Maybe I shouldn’t have been so like … ” she says, before adding, “It’s hard for me to not say how I really feel.” When Seacrest asks the singer, who performed Sunday on the American Music Awards, if she’s nervous about how honest she was with the contestants, she answers, “Yes.” “Everyone else is so nice,” she says. “I was just thinking back about some things and I was like, ‘I wonder if that was not so nice.’ “ But Minaj, 29, says she takes a tough-love approach only to help out season 11′s singers. “As an artist I’ve always grown more from the tougher criticism,” she says, “and so I would like to be that person and to try to help people get that thick skin and to really give it their all, because it is a competition.” And though Minaj won’t likely be hosting a viewing party with popcorn and friends, she does think Idol fans will enjoy the new lineup. “I don’t think I’m going to be able to watch it. I’m going to be so nervous,” she says of the premiere. “But I know people are going to love it. I think it’s a great dynamic.” Despite the on-set feud with costar Mariah Carey, Minaj says, “The chemistry of the judges, I feel it while I’m there. Get this guy outta here… Cal State University Professor Under Fire For Neo-Nazi Teachings California State Univeristy, Long Beach psychology professor Kevin MacDonald, a man the Southern Poverty Law Center calls the “ neo-Nazi movement’s favorite academic,” continues to rile community members with language that some say teaches white supremacist and neo-Nazi beliefs. According to HuffPo : MacDonald prefers the description “white advocate.” As a director of the new political party American Third Position (AP3), he believes that immigration (both illegal and legal) must be stopped in order to preserve American society. According to the OC Register, part of AP3′s mission statement reads: “Government policy in the United States discriminates against white Americans … white Americans need their own political party to fight this discrimination.” MacDonald stands firm in his positions, noting in an interview with KCAL9 that white citizens will be a minority in the U.S in 2042. “I think the white middle class is scared economically,” MacDonald said. “They’re concerned about the future of the country. Underlying it, there is a fear of the future. When whites are a minority, there is a concern the country won’t be the same anymore.” Funny he’s a psychology professor. Opinions like his should be a paramount study in the field of psychology. There is something clearly mentally wrong if you deem yourself superior to other people. Bye-Bye Twinkies: Stores Sell Out Of Hostess Products As Prices Jump On Ebay!!

Did you know Hostess factories were closing their doors today?? While we were over here hoping the strike would come to an end, Hostess execs didn’t fold on their shady azz decision to shut things down today. According to ABC News : On Hostess Brands’ last day of shipping its iconic snacks, entrepreneurial eBay sellers have taken the opportunity to tap into buyers’ Hostess panic, selling boxes for 95 percent more than grocery stores. In one Food Emporium grocery store in New York City, Twinkies were sold out by 1:30 p.m. ET. In its place, was a box of 8 Hostess Strawberry Cupcakes, sitting next to several other Hostess products. Retailing there for $4.29 for a box of ten Twinkies, one eBay seller sold a box for $59.99. Other boxes were on sale for $100 or more. Hostess’ final shipments take place Friday, said Erik Halvorson, a spokesman for Hostess, the same day CEO Gregory F. Rayburn said it filed a motion with the U.S. Bankruptcy Court to close its business and sell its assets. Halvorson said retail prices for Hostess products vary. The company had filed for bankruptcy twice. The company filed in 2004 and then again in January of this year. “We deeply regret the necessity of today’s decision, but we do not have the financial resources to weather an extended nationwide strike,” said CEO Gregory F. Rayburn in a statement on Friday morning. “Hostess Brands will move promptly to lay off most of its 18,500-member workforce and focus on selling its assets to the highest bidders.” The fate of the Twinkie and other Hostess products hang in the balance as Hostess winds down the company. Private equity firm Ripplewood Holdings is one of the owners. Hedge funds Silver Point Capital and Monarch Alternative Capital own Hostess’ debt. Among the 33 bakeries and 565 distribution centers Hostess said it will close is a factory in Schiller Park, Ill., which neighbors Chicago O’Hare International Airport. The bakery was the birthplace of the Twinkie, created on April 6, 1939 by Continental Baking Co.’s James Dewar. Really tho? $60 fawking dollars? For one box of Twinkies? You may be waiting in that line longer than usual if you’re shopping at Walmart next Friday. According to The Huffington Post : Organizers are planning a nationwide strike against Walmart, the largest retailer in the world, and are banking on a new strategy: online organizing. Labor organizers are working with social action nonprofit Engage Network as well as corporate watchdog nonprofit Corporate Action Network to pull off what they are calling a “viral” — meaning national and spreading online — strike. Brian Young, cofounder of the Corporate Action Network, said on a conference call coordinated by the United Food and Commercial Workers (UFCW) union Thursday, that organizers cannot cover the roughly 4,000 Walmarts across the country, but enabling self-appointed leaders online has widened and decentralized the campaign. The campaign is also mobilizing strikers and supporters through a Facebook app, multiple Facebook pages, a Tumblr and Twitter with the hashtag #walmartstrikers. The outreach leading up to Black Friday follows a series of unprecedented actions taken by Walmart workers against their employer and working conditions. In October, for the first time in the company’s 50-year history, more than 70 workers at multiple Los Angeles-area Walmart stores walked off the job, even though their jobs are not protected by an official union. The strike had a ripple effect, causing strikes in 12 other cities, in large part through online organizing. The success of these strikes, as well as one over the summer touted as the largest ever protest against the company, and a six-day pilgrimmage of warehouse workers in September, would not have been possible without Facebook, Twitter and other web sites, Young said. “Making Change at Walmart,” which organized the demonstrations and is a campaign affiliated with the UFCW union, has over 25,000 supporters on Facebook. Corey Parker, a Walmart worker from Mississippi, said on the conference call that he became active with OUR Walmart after finding out about it through a HuffPost article on Facebook. Now, he has mobilized workers at his store to strike on Black Friday because, he said, he realized that “not being able to make a living was not just an issue at my store.” Adding fuel to movement, Walmart announced Thursday that it will kick off its Black Friday sale at 8 p.m. on Thanksgiving, its earliest start ever. “Lots and lots of Walmart workers are going to be forced to not have Thanksgiving because they’re going to be preparing all day for the busiest shopping day of the year,” Dan Schlademan, director of Making Change at Walmart, said on the conference call. “This essentially cancels Thanksgiving for hundreds of thousands of workers.” “It’s not like Walmart is financially hurting. It’s not like they’re not making unbelievable sums of money. The price of this is really decimating an important family day in our country.” But Walmart spokesman Steven Restivo said of the sale, “Last year, our highest customer traffic was during the 10 p.m. hour and, according to the National Retail Federation, Thanksgiving night shopping has surged over the past three years.” “Most of our stores are open 24 hours and, historically, much of our Black Friday preparations have been done on Thanksgiving, which is not unusual in the retail industry,” he said, adding that the strikes planned for Black Friday, will not “have any impact on our business.” Regarding the action over the last few months, Restivo said, “While the opinions expressed by this group don’t represent the views of the vast majority of more than 1.3 million Walmart associates in the U.S., when our associates bring forward concerns, we listen.” In September, dozens of Walmart-contracted warehouse workers in Southern California’s Inland Empire walked off the job and went on a six-day, 50-mile pilgrimage to protest working conditions and retaliation for speaking up. More than a month later, the warehouse company NFI responded to some of the strikers’ working condition requests. “Just in the last week, we’ve seen the warehouse operators scrambling to replace broken and unsafe equipment, they’ve rented fans to increase ventilation, and they’ve added more water coolers,” Elizabeth Brennan, communications director for Warehouse Workers United, said on the conference call. However, the strikers who returned to work have continued to face retaliation, many times getting their hours cut from 35 down to eight, she said.
