Judge Aaron Persky: Will He Be Recalled?

A recall petition is making its way around the Internet, one that seeks to penalize the judge at the center of the Brock Turner sexual assault case. Last week, Turner was found guilty on three felony accounts of sexual assault for actions that stemmed from an incident in January of 2015. A jury decreed that Turner digitally raped an unnamed victim near a dumpster after the two had attended a party. The woman was unconscious and woke up hours later in a hospital, dried blood and pine needles all over her. Turner was stopped in the middle of his heinous action by two men who rode by on bicycles, one of whom chased the rapist and tackled him in the street. Due to the verdict, Turner was eligible to face up to 14 years in state prison. On Thursday, however, Santa Clara County Judge Persky ordered a shockingly lenient ruling: only six months… in county jail. Why did Persky barely punish Turner for his sexual assault? In court, the judge cited Turner’s clean criminal record and said he believed that a harsher punishment would leave a “severe impact” on him. As you might expect, critics have gone off on Persky ever since, especially in light of the moving statement also made in court by the victim. You want a “severe impact,” Judge Persky? It already has amassed more than 230,000 signatures and it states that “Judge Persky failed to see that the fact that Brock Turner is a white male star athlete at a prestigious university does not entitle him to leniency. “He also failed to send the message that sexual assault is against the law regardless of social class, race, gender or other factors.” It’s worth noting that Persky, like Turner, is a Stanford graduate who played a sport for the prestigious university. This sad case has also gone viral because Turner’s dad, Dan Turner, wrote a letter defending the college athlete surfaced. In it, Dan described the rape as “20 minutes of action out of [Brock’s] 20-plus years of life” and argued that his child should not spend any time in jail at all. On June 2, Brock Turner – a swimmer from Stanford University – was convicted of sexually assaulting an unconscious woman near a dumpster. His sentence of just six months in jail, followed by three months of probation, was seen as a slap on the wrist to many. It has stirred up an Internet storm. The judge ruled that a longer sentence would have done the 20-year old more harm than necessary, despite actions most believe to have been unconscionable.  There has been outrage on social media about the whole thing and now Turner’s father, Dan, has only added fuel to the fire. A lot of fuel to the fire.  In a statement, he compared his son’s assault on the woman to “20 minutes of action” for which his child should not be punished with any jail time. Seriously.  This is a look at the statement in full: This case has gone viral because the brave victim at the center of it stood in front of the judge last week and read a moving letter, directing her anger, pain, bitterness and shock to Turner and everyone in court. In instances like this, you expect the parents to be releasing an apology for bringing the offender into this world… but it appears Brock’s father is just as deluded as him. “His life will never be the one that he dreamed about and worked so hard to achieve,” Turner wrote. “That is a steep price to pay for 20 minutes of action out of his 20-plus years of life.” The whole thing is pretty disgusting.  He then went on to speak about how his son has lost his appetite nowadays. He also blamed the incident on “binge drinking” and “promiscuity.” It’s truly disgusting all around. As a quick refresher: On January 18, 2015, two students found Brock on top of the unconscious woman. They even tackled him when he tried to flee. Evidence pointed to Turner shoving his fingers inside the woman, along with pine needles and other objects. His attorney tried to argue in court that the sex was consensual and that Turner asked for permission every step of the way. But a jury saw right through this defense. Via DailyMail A former Stanford University swimmer who was facing a 10-year jail sentence for raping a drunk woman he met at a campus party, has been given just six months in prison for his crime. Brock Allen Turner, 20, was found guilty of sexually assaulting a drunken and unconscious woman. Turner who is part of Stanford’s high-powered swimming program was convicted in Santa Clara County Superior Court of three counts of sexual assault. Superior Court Judge Aaron Persky was lenient, after hearing emotional pleas from Turner and the victim. Lenient? Emotional pleas?? Where they do that at?!? Turner’s crime happened in January of 2015 when he had met a woman at a party at the Kappa Alpha House. The pair were kissing outside. He said he took off the woman’s underwear, penetrated her with his hands and touched her breasts, but never took off his pants. According to Turner, the woman appeared to be enjoying herself as she rubbed his back. He added that his ‘intentions were not to try and rape the girl without her consent’ but to ‘hook up’ with a girl’, the report said. New York Attorney General Investigating Suspicious Death Of Jailed Woman Much like #SandraBland , Raynette Turner’s family is desperately seeking answers to how an arrest over a petty crime ended with the loss of her life. Via Huff Po reports : New York Attorney General Eric Schneiderman announced Monday that his office will launch a formal investigation into the death of Raynette Turner, the mother of eight who died in a Mount Vernon, New York, jail cell while in police custody last week. “My office’s Special Investigations and Prosecutions Unit will investigate the death of Raynette Turner, consistent with Executive Order No. 147 and a conforming order to be issued by the Governor at my request,” Schneiderman said in a statement. It’s the first such investigation since Gov. Andrew Cuomo (D) last month issued an executive order appointing Schneiderman as special prosecutor in all cases where an unarmed civilian dies at the hands of police. Turner, 42, was arrested on Saturday, July 25 after allegedly shoplifting some crab legs from a grocery store. With no judges working on Sundays to arraign her in court on the misdemeanor charge, police officers opted to keep Turner in custody through the weekend. On Sunday night, the Mount Vernon Police Department told The Journal News, Turner said she was feeling ill and was taken to a hospital. Turner, who had a history of high blood pressure, was treated at the hospital and released. At the courthouse Monday, Turner reportedly vomited while awaiting her arraignment in an upstairs holding area. She was then taken back to a cell downstairs. Although courthouse officials are supposed to check on the holding cells every 15 minutes, The Journal News reported, no one saw Turner for another hour, when she was found dead in the cell around 2 p.m. A spokesman for the Westchester County District Attorney’s Office told The Huffington Post that Turner’s initial autopsy was inconclusive. The medical examiner’s office is awaiting results from toxicology tests. Turner was one of five black women to have died in jail during a two-week span in July. Among them was Sandra Bland, whose death in a Waller County, Texas, jail cell drew national attention and touched off demonstrations by the Black Lives Matter movement in Texas and across the country. As special prosecutor, Schneiderman’s investigation will determine whether there should be any criminal charges in Turner’s death. We hope that this investigation is not just a ruse and that they are able to find some real answers into what happened to Raynette.
