Marissa Alexander , the black woman who was sentenced to 20 years for firing a gun to keep her abusive husband at bay despite the same Florida Stand Your Ground law that helped George Zimmerman walk, will have a second chance to beat the case. Via MSNBC reports : Marissa Alexander, the African-American woman who was sentenced to 20 years for discharging a firearm in Florida despite pleading Stand Your Ground against her husband, will get a new trial. Alexander, 32, said she fired a bullet at the ceiling because she was afraid of her husband. No one was injured. It took 12 minutes for the jury to convict her. “We reject her contention that the trial court erred in declining to grant her immunity from prosecution under Florida’s Stand Your Ground law,” wrote Judge James H. Daniel, “but we remand for a new trial because the jury instructions on self-defense were erroneous.” Alexander, who had given birth the week before, testified that after an altercation regarding texts from her ex-husband, she locked herself in the bathroom. Her husband Rico Gray broke through the door, grabbed her by the neck, and shoved her into the door. She ran to the garage, found she couldn’t get the door open, and returned with a gun. When Gray saw the gun, he said, “Bi**h, I’ll kill you.” Alexander testified that firing the gun into the air as a warning shot was “the lesser of two evils.” The jury rejected her self-defense argument, and instead Alexander was sentenced under the “10-20-Life” law, which carries a series of mandatory minimum sentences related to gun crimes. The prosecutor in her case was Angela Corey, who also prosecuted George Zimmerman who was acquitted in the death of Trayvon Martin. After an outcry at the apparent racial double standard in the application of Stand Your Ground, Corey told the Washington Post, “I think social media is going to be the destruction of this country.” The appeals court judge ruled that the lower court judge improperly put a burden on Alexander to prove that the firing was in self-defense. “The defendant’s burden is only to raise a reasonable doubt concerning self-defense,” Daniel wrote. “The defendant does not have the burden to prove the victim guilty of the aggression defended against beyond a reasonable doubt.” He ordered a retrial. A separate proceeding would determine whether Alexander could be released on bail pending that trial. We hope the jury gets it right the second time around.

Steven Torres, 22, told detectives he stabbed Ever Orozco, 69, because he was offended during a chance encounter on a Jackson Heights street Monday afternoon, police sources said. “He (Torres) said the victim was blowing kisses to him. That’s what set him off,” a source said. Torres also claimed Orozco touched himself, sources said. But widow Alba Orozco, 64, said Torres got her husband all wrong. “He loved women,’’ she said, showing off a photo of him celebrating his 65th birthday. “This man who did this to him is a liar.” The couple met in Colombia and married 15 years ago. The retired mechanic left behind two sons, Jeffrey, 38, and Harvin, 34, from a previous marriage. Torres underwent a psychiatric exam at Elmhurst Hospital and is awaiting arraignment in Queens Criminal Court. He has no previous arrest record. The confessed killer’s claim that Orozco had greeted his glance with a come-on was met with skepticism by detectives due to the fact Torres has also taken responsibility for stabbing a co-worker whom he says blew kisses at him at a construction site in Greenwich Village on Sept. 12. Father Of Sexually Assaulted 5-Year-Old Girl Calls For Justice These worthless pigs deserve everything that’s coming to them. via MSNBC The father of a five-year-old who was gang-r*ped and dumped on a road in Pakistan’s second largest city wept as he called on officials to find and punish those responsible for the attack. “l want justice and for the culprits to be punished severely,” the 46-year-old told NBC News from the hospital in the Lahore, the capital of the province of Punjab, where his daughter was being treated. “I have talked to my daughter a little bit,” the man added. “She talks and then closes her eyes.” NBC News is not naming the five-year-old or her father in order to protect the victim’s identity. A report commissioned by Pakistan’s Chief Justice found that the child had been r*ped by a number of people. The case became front-page news nationwide after CCTV footage emerged on Saturday showing a man dumping the girl wearing a white dress on a road outside a hospital. Local police confirmed to NBC News the CCTV footage from Friday night was genuine. A hospital security guard then found the girl, who had gone missing a day earlier, and took her into the hospital.

George Zimmerman has been released from custody following Monday’s allegedly heated dispute with his sobbing, estranged wife Shellie, who called 911. On the phone with dispatchers, Shellie Zimmerman claimed that her spouse was threatening her and her father with a gun and that feared for her life. George Zimmerman 911 Call Local police converged on the home in the Orlando, Fla., suburb of Lake Mary and held George Zimmerman in custody , though he was not arrested. After speaking to her attorney, Shellie changed her story. She said she never saw a gun and that she and her father, whom she said Zimmerman had punched in the face, had no interest in pressing charges. Police later said they did not find a gun on Zimmerman. The encounter Monday was the latest in a string of incidents in which Zimmerman has landed in the news since his acquittal in the Trayvon Martin case. Besides Shellie Zimmerman filing for divorce , he’s twice been pulled over on suspicion of speeding, and received a ticket on one of those occasions. He’s also appeared in photos at a gun maker that were published online and assisted members of a family from their vehicle following a car wreck. Monday’s dispute isn’t uncommon for a couple in the midst of a divorce, said his attorney, Mark O’Mara, who denied any guns or threats were involved. Meanwhile, the girl is believed to have been forced to have sex by the same man again on Wednesday, according to NDTV. The victim’s family has refused to accept the elders’ decision. The man was arrested and an investigation has been launched into the allegations against the council elder. A police spokesman said: ‘He locked her in a room and raped her.
