Lindsay Lohan To Be Released From Jail

Actress will reportedly have to wear SCRAM bracelet again upon release. Since Lohan’s jailing Friday (September 24), lawyer Shawn Chapman Holley was reportedly working to get her client the option of posting bail . The Los Angeles Times reports that on Friday afternoon, Los Angeles County Superior Court Judge Patricia M. Schnegg overturned Judge Elden Fox’s order and granted the actress $300,000 bail. TMZ adds that Lohan will have to be outfitted with a SCRAM bracelet within 24 hours and avoid venues where alcohol is the “chief item of sale.” Lohan sported a SCRAM bracelet this summer, which reportedly went off at a party, an incident that ultimately led to her July prison sentence. Lohan was sent to prison exactly one week after she admitted to failing a court-ordered drug test , the screening being one of many conditions the starlet had to adhere to after back-to-back stints in jail and rehab. Judge Fox ordered Lohan to be held without bail until a scheduled October 22 hearing in the case. The move was reportedly a tactic to keep the actress in prison instead of sentencing her outright, which might have cleared the way for early release due to overcrowding. “Ms. Lohan cannot be released early because this isn’t a jail sentence,” L.A. Sheriff’s spokesman Steve Whitmore told People on Friday. “She’s being held by court order until her hearing on October 22. She will be held in the same conditions as her last stay, in a keep-away unit.” Lohan has been frank about her struggles with addiction and recently tweeted about her willingness to face the repercussions of her actions after reports of her failed drug test surfaced. “Regrettably, I did in fact fail my most recent drug test and if I am asked, I am prepared to appear before judge Fox next week as a result,” Lohan tweeted last Friday. “Substance abuse is a disease, which unfortunately doesn’t go away over night. I am working hard to overcome it and am taking positive steps forward every day. I am testing every single day and doing what I must do to prevent any mishaps in the future. … This was certainly a setback for me but I am taking responsibility for my actions and I’m prepared to face the consequences.” In July, Lohan served 13 days of a 90-day jail sentence over a probation violation stemming from a 2007 DUI conviction. She followed up the jail time with 23 days court-ordered rehab, a fraction the court’s original mandate of 90 days. The 24-year-old actress was ousted from the production in a stunning turn of events in May, only to be replaced by Victoria’s Secret model Rosie Huntington-Whiteley . And while Fox told MTV News that she “might be a little jealous when I see somebody kissing my Shia,” LaBeouf acknowledged that there are both upsides and downsides to smooching with another actress while alien robots battle around them. “I think there’s positives and negatives to her not being [in the movie],” said LaBeouf, who was at the Toronto Film Festival to promote “Wall Street 2.” “It’s awesome that we get the discovery again. I think when everybody’s vetted and everybody’s been through these wars, then that discovery of the first film is nonexistent. It’s kind of beautiful in that we get a new set of eyes, a fresh set of eyes for the audience to vibe with. So you get the discovery again, which is something that wouldn’t happen if Megan came back.” Yet he still counts Fox as a good friend, and praised her turns in the first two “Transformers” flicks. As for Huntington-Whiteley , who will make her acting debut in the new film, LaBeouf said she’s “doing great,” though there’s little he could do to prepare her for the experience of working with the famously fiery director, Michael Bay. “You can only do so much,” he laughed. “Fight or flight. Lindsay Lohan And E-Trade Settle ‘Milkaholic’ Lawsuit

According to TMZ , the actress settled a $100 million lawsuit against E-Trade , which ran a Super Bowl TV spot that Lohan felt mocked her tabloid reputation. Lohan’s attorney Stephanie Ovadia revealed that the lawsuit had come to a close in a statement to TMZ: “The case between Lindsay and E-Trade has been settled … there is no further comment.” While no other details regarding the settlement have been revealed, Team Lohan is reportedly pleased with the suit’s outcome, even suggesting that the actress received an undisclosed amount of money from the suit. Dina Lohan shared her two cents on the lawsuit, telling TMZ, “The family is pleased that the case has been settled.” Representatives for E-Trade admitted to TMZ that they were interested in putting the case behind them, saying, “E*TRADE has always maintained that the claims were without merit, which is why we moved to dismiss the case. With the case now withdrawn, we are pleased to have the matter behind us.” Earlier this year, Lohan’s lawyer filed the $100 million suit in New York claiming that the actress’ name was used without her permission in an advertisement. In the spot, a female baby character named Lindsay is deemed a “milkaholic” while in the midst of a baby love triangle. “That milkaholic Lindsay wasn’t over?” the baby girl says, questioning why the baby boy didn’t call her. “Many celebrities are known by one name only, and E-Trade is using that knowledge to profit,” Ovadia told the New York Post back in March. “They used the name Lindsay. … They’re using her name as a parody of her life. Why didn’t they use the name Susan? This is a subliminal message. Before even the masses got it or anybody heard it, I felt like it was a defining album in an artist’s career,” he told MTV News. “Because even before that album, I had a couple hits, I had top 10 records, but those were songs. I had hit songs but I wasn’t a hit artist. But right now people know my name and right now I feel like with Ready being so successful, I felt that was me only scratching the surface of my potential. That was almost the beginning of my career, if you will. With his latest release, Passion, Pain & Pleasure, Trey takes another big leap forward. Songz’ first two offerings are already heating up at radio and on the charts. “Bottoms Up,” featuring Nicki Minaj, sits in the top 20 on Billboard ‘s Hot 100 and “Unusual,” featuring Drake , appears primed to follow suit. “With Passion, Pain & Pleasure, I feel like I’m taking it to new heights,” Songz said of his fourth studio album. By Gil Kaufman Lindsay Lohan Photo: David McNew/ Getty Images There may be some unfortunate consequences for Lindsay Lohan in light of her failed drug test, but even with a slip in her sobriety so soon after leaving rehab, the fact that the actress fessed up to her indiscretion is a positive sign, experts told MTV News. “From what I’ve heard, the tone with which Lindsay talked about the fact that she tested positive was very encouraging,” said Robert J. Lindsey, president and CEO of the National Council on Alcoholism and Drug Dependency . “She really recognized that what this is is a relapse into active addiction, and she is very committed to making sure that she gets back on track.” Over the weekend, Lohan admitted to failing her recent drug test . Hours after reports surfaced Friday that the “Mean Girls” actress didn’t pass her latest test, the troubled starlet conceded she was still struggling with addiction. “Regrettably, I did in fact fail my most recent drug test and if I am asked, I am prepared to appear before judge Fox next week as a result,” Lohan tweeted late Friday night. “Substance abuse is a disease, which unfortunately doesn’t go away over night. I am working hard to overcome it and am taking positive steps forward every day. I am testing every single day and doing what I must do to prevent any mishaps in the future. … This was certainly a setback for me but I am taking responsibility for my actions and I’m prepared to face the consequences.” Lindsey, who has no firsthand knowledge of Lohan’s case, said her admission points to the value of doing drug tests. “Someone who is living in active addiction may not necessarily be able to tell you accurately what they have or have not done,” he explained. After wrapping up 13 days in prison and roughly three weeks in rehab, the actress was required to submit to random drug and alcohol tests, among other requirements, in order to avoid more jail time. According to the conditions of her post-rehab release, the actress could return to prison for 30 days if she fails a drug and alcohol test. Another encouraging factor in Lohan’s response to her positive test is the tone she took, which is quite different from the one she had in a recent Vanity Fair cover story , in which she appeared to be downplaying her addiction and deflecting blame for her troubles. “The individual path to recovery varies for everyone,” Lindsey said. “There are plenty of people who go into treatment and then NA or AA, and from that moment on, they never drink or use again. But the reality is that, for some people, they relapse back into active use, and it can be in some ways the best thing that ever happened.
